6. EARNEST MONEY DEPOSIT ( EMD ): (a) Earnest money will have to be deposited in the form of Bank Draft or Bank Guarantee in prescribed format of SECL FROM Scheduled Banks/Nationalized Banks No tender shall be considered unless accompanied by the requisite earnest money, However, the work valued up to Rs- 1.00 lakh the earnest money may be deposited in cash or in the aforesaid form. The Earnest Money/Bid Security shall bear no interest. PERFORMANCE SECURITY INCLUDING THE EARNEST MONEY ALREADY DEPOSITED SHALL BE 5% OF ACTUAL CONTRACT VALUE TO BE DEPOSITED BEFORE EXECUTION OF WORK ORDER BY THE L-1 BIDDER WITHIN 28 DAYS AFTER ISSUE OF LOA. b) The date of issue of demand draft/Banker’s cheque towards EMD should be on or after the date of issue of NIT and Demand draft/Banker’s cheque made before the date of NIT shall be summarily rejected. 7. The contractor will Submit an undertaking that they will abide by/liable for any registration etc. It required, With regard to P.F. even after award of work, along with the tender. 11, The bills of the Contractor shall be accompanied by an attested copy of wages sheet with a certificate Given on the wages sheet by the authorized officials witnessing the payment of wages to labors/workmen engaged by the contractor for the subject work to the effect that the payment indicated in the prescribed column of wages sheet has been disbursed to the labors/workmen in their presence. In addition to the above a certificate shall be issued by the concern personnel head that Contractor has deducted the amount of CMPF and Pension and deposited along with the matching share with concern Regional Commissioner, CMPF and a copy of the certificate shall be attached with the bill of Contractor where applicable. Payment to the contractor workers is to be made through Bank. Payment to Contractor shall be released against the bill by the Finance Department after verifying the above documents. 12. The tenderers have to submit the following declaration on their letter head & self attested. Whether any relative of the owner/applicant or any of partners of the applicant firm is related to any of the employees employed in Coal India Limited or any of its Subsidiaries, It so, furnish name of the applicant/owner/partner and the name, designation and place of posting of the employee in CIL and its subsidiaries companies. Whether any relatives of the owner/applicant or any of the partners of the applicant firm are active trade Union leaders of CIL & its subsidiary company’s It so mention the name of the applicant/owner/partner and the trade union leader & field of the operation/activities. I/we have not been banned or delisted by any Govt. / Quasi Govt. Agencies / PSUs All information/declaration furnished by me/us in respect of fulfillment of eligibility criteria and qualification information of this tender is complete, correct any true. e) All documents / credentials submitted along with this tender are genuine, authentic, true and valid. f) If any information and documents is found to be false / incorrect any time, department may cancel my tender and action as deemed fit may be taken against me/us including termination of contract, forfeiture of all dues including Earnest money and banning / delisting of our firm. g) The contractor should have regular employees. h) We will not engage CHILD LABOUR for this work. 13. No correspondence will be made with the tenderers after receipt of the tender regarding lagging of any credential / supporting documents as mentioned in the NIT and incomplete offers will be out rightly rejected without assigning any reasons to such tenderers. 14. The validity of bid will be 120 days from date of submission. 15. All other terms & condition as prevailing in SECL will also be applicable for this NIT. 16. The payment of PF for the workmen employed by the contractor for the work as per the law prevailing under provision of CMPF/EPF and allied scheme valid from time shall be the contractors responsibility for which he has to submit statutory return. 17. The contractors has to pay bonus to their workers as per the provision of Bonus Act-1965 and also they have to get themselves registered on CIL portal for this. They are also required to update all information on this portal such as name of work, work order value and duration and details of workers deployed for this work. 18. The contractors shall register themselves on the Contractor Labor Management Portal (CLIP) of CIL within 30 days of issue of work order/ LOI in case the contract period is more than 30 days and within a period of 07 days in case of contract period is less than 30 days and will have to enter and update periodically in portal. 19. In case of forfeiture of EMD/SD L-1 bidder will be charged applicable rate of GST extra i.e. additional amount over EMD/Security deposit.
