1 ARTICLE 1- DEFINITIONS

1.01 "Employer" shall mean SC360 (Markham) Inc.

1.02 "Union" as used hereinafter shall mean Unifor and its Local5011.

1.03 Earnings shall mean the total of all task codes rates and hourly pay.

1.04 Wherever the term he, she, his, her, etc. is used throughout this agreement, such term is intended to apply to individuals of either gender.

1.05 Unless specifically referred that hours are paid at minimum wage of the Province of Ontario all references to an hourly rate will be set out in Appendix "A" based on seniority.

1.06 "Region" shall mean the area as defined as Simcoe Region, Durham Region, and York Region.

1.07 "Weekly Top Up Program": Program to review earnings on a weekly basis to ensure that the minimum hourly rate, as outlined in Appendix "A", is met, based on the working hours.

1.08 "Working hours" shall mean all hours logged in the "Click System" from the daily start time until finishing the last work order, minus the unpaid breaks. It is understood that "Click Hours" will be compared to the weekly timesheet to minimize any inaccuracies in the click system. (i.e. calls not cleared, system down, hours in click are Jess than three hours, banking calls)

1.09 "White Space" the time, within the scheduled shift, where the employee is not performing work at a customer site or moving from one call to another. ·The Company will add up to 20 minutes time between calls to account for travel time. "White Space" is used for calculations of overtime only.

ARTICLE 2- RECOGNITION

2.01 The Employer recognizes the Union as the sole and exclusive bargaining agent for all connectivity technicians and custom wiring technicians employed by SC360 (Markham) Inc. excluding Field Supervisors and those above the rank of Field Supervisor.

2.02 The purpose of this agreement is to advance the mutual interests of the· Employer and the employees; to provide for the operation of the service of the Employer under methods which will further, to the fullest extent possible, the safety, efficiency and economy of operations; and to maintain a continuation of employment under conditions of reasonable hours, compensations and working conditions. It is recognized by this Collective Agreement to be the duty of the Employer, the Union, and the employees to cooperate fully, both individually and collectively, for the advancement of their mutual interests.

2.03 There shall be no discrimination, intimidation or coercion by either party against any employee.

2.04 There shall be no discrimination or harassment by the Employer, its employees or the Union against anyone because of race, ancestry, colour, ethnic origin, citizenship, creed, sex, age, marital status, sexual orientation, or family status.

2.05 It is agreed that the employees of the Employer not covered by the scope of this Collective Agreement shall not perform the work normally performed by employees within the Bargaining Unit.

2 The Union agrees that there could be exceptional reasons for the Employer to use employees not covered by the scope of the agreement. Prior notice would be provided in order to reach an agreement with the Union. This will not result in a reduction of work or lay off for Union members.

Supervisors can perform work covered by the scope of this agreement for emergency or force majeure reason, training, testing and for requested assistance to a technician.

2.06 An accredited representative of Unifor shall be allowed to enter the Employer's premises to perform Union business with reasonable notice to the Director or Human Resources Manager.

2.07 Orientation Program: The Employer will allow a designated representative of the Union up to one (1) hour during training for new employees for the purpose of conducting the Unifor New Members' Orientation Program. These sessions will be held on Company premises. New employees participating in Orientation Program meetings during their normally scheduled training hours will be paid minimum wage of the Province of Ontario or ifthe Orientation is completed outside of training then they will be paid at the hourly rate as per Appendix A. The Union Representative conducting the Orientation program will be paid at their hourly rate as per Appendix A.

ARTICLE 3- DEDUCTION OF UNION DUES

3.01 The Employer agrees to deduct from the wages of all employees covered by this agreement, and during the period of the agreement, the amount of Union dues for general Union purposes as designated by the Union, and such moneys shall be paid to the Union not later than the 20th day of the following month.

3.02 The Employer agrees to furnish the Union monthly with a list of employees for and on behalf of whom such deductions are being made.

3.03 This provision for Union security shall be enforced by the Employer against each employee to whom the agreement applies as a condition of his continuance in or entrance into the Employer's service

ARTICLE 4- NO STRIKES, NO LOCK OUTS

4.01 The Employer agrees that there shall be no lock outs and the Union agrees that there shall be no strikes, picketing, slowdown or work stoppage either complete or partial during the life of this agreement.

4.02 The Union agrees that it will not involve any employee of the Company or the Company itself, in any dispute which may arise between any other employer and the employees of such other employer.

4.03 If employees engage in any of the above mentioned conduct, the Union agrees that the Union, its officers or representatives shall immediately cease and/or repudiate such conduct when it is made aware.

ARTICLE 5- RESERVATION TO MANAGEMENT

5.01 The Union recognizes and acknowledges the right of the Employer to operate and manage its business in all respects in accordance with its contractual obligations and in accordance with legislation and regulations from time to time in force under governmental authority without limiting the generality of the foregoing the Union acknowledges that it is the exclusive function of the Employer to,

3 a) Hire, promote, demote, transfer, classify, reclassify, lay-off, recall and retire employees, and also the right of the Employer to maintain order, discipline and efficiency and in connection herewith to make and alter from time to time Company rules and regulations to be observed by employees; discharge any employee for just cause, subject to the rights of the employee concerned, who has acquired seniority, to lodge a grievance in the manner and to the extent herein provided.

b) Make, establish, maintain, enforce and alter from time to time reasonable rules and regulations, policies and practices relating to the protection of its property, the maintenance of confidential information regarding customers and clients, the promotion of safety and the general conduct and procedures for employees.

c) Generally manage the enterprise and without restricting the generality of the foregoing, to plan, direct, locate, extend, curtail or cease operations, fa control and inspect operation systems, methods and services, to abolish or change any job, department, operation and service, to assign duties, to determine reporting relationships, to direct employees, to determine the complement, classification and location of employees from time to time, to alter and evaluate standards and performance, the methods, procedures and the kinds and location. of equipment and facilities to be used and services provided, to fntroduce new methods or facilities, to determine schedules of work and overtime.

5.02 The Employer agrees that it will not exercise its function in a manner inconsistent with the provisions of this agreement.

ARTICLE 6- UNION REPRESENTATION

6.01 The Employer will recognize a negotiating committee composed of no more than three (3) Employees from the Local plus the Union's National Representative.

6.02 When an employee serves as a Unit Chair/Steward during his/her normally scheduled working hours he/she will be entitled to their hourly rate for all such hours while dealing with the grievance up to and including Step 3 ofthe grievance procedure.

The Unit Chair/Steward must obtain prior management approval for hours required for l)nion business. The Unit Chair/Steward and aggrieved employee shall not unduly impair the efficient operation and such time off shall be of reasonable length.

The Steward activities shall be limited to grievance and disciplinary issues.

6.03 An accredited representative of Unifor shall be entitled to participate in meetings between the Employer and the Union, when so requested by the Local.

6.04 The Union shall notify the Employer in writing of the names of those employees who are designated as members of the negotiating committee or as Stewards, its officers and the employee designated to receive official correspondence relating to the Local, whenever a change takes place.

6.05 When management requires a formal interview with an employee in order to establish the facts of any given case which may result in discipline to that employee, the employee concerned will be offered representation of an elected Union official during such interview(s) unless the employee requests otherwise.

4 Union representation will also be offered in regards to all forms of discipline meetings and arrangements will be made to have the Union Representative present.

Except when dealing with terminations, and whereas there is no Union Steward in a designated region, the available Union Steward from another region may participate via telephone conference. A telephone conference will be arranged with all parties and minutes of the conference will be distributed.

This does not include standard one-one evaluation session with their manager unless a formal written performance process is being initiated.

Union Chair/Steward will be paid at their hourly rate while attending any meeting outlined above which includes telephone conferencing.

6.06 Company vehicles are not to be used by employees, including Shop Steward, for attending any Union activities except for the shop day to day direct representation duties.

6.07 The Union shall receive a copy of all discipline reprimands. These notices will be sent to the Unit Chair and placed in a locked cabinet' supplied in the Unit Chair's regional office where each employee file with discipline will be maintained.

The Steward dealing with a grievance is entitled to a copy of the relevant discipline documentation.

ARTICLE 7- GRIEVANCE PROCEDURE

7.01 The purpose of this article is to establish a procedure for the orderly settlement of grievances. A grievance shall be considered to exist when it is alleged that there is a violation of this agreement arising from the interpretation, application or failure to comply with the terms thereof. When a grievance arises, an earnest effort shall be made to settle it by the Employer, the employee concerned, and the Union, and it shall be han<;lled in the Steps as hereinafter provided. It shall be optional with the Company or the Union to consider any grievance, the alleged circumstances of which occurred more than thirty (30) days.

The employee who submitted the grievance will be entitled to pay at their hourly rate as per Appendix "A" for grievance meetings for Step 2 and Step 3 as set out in Article 7. This does not apply to group grievances. Grievance meetings shall be scheduled during technician's scheduled shift.

7.02 Step 1 Any Employee who has a grievance shall present the grievance to the Regional Manager and will be accompanied by a Steward. The Steward shall provide the Regional Manager with the grievance in writing. Management shall state their decision in writing within seven (7) business days of such meeting. If this written decision does not satisfactorily adjust the grievance, it may be appealed to Step 2 following.

Step 2 Notice of appeal must be made within seven (7) business days of the Step 1 decision, in writing, and shall be presented to the Operations Manager designated to handle Step 2. Within seven (7) business days of receipt of the appeal or within any agreed upon extension, Management designated to handle Step 2 will meet with the griever and the Steward in an attempt to resolve the grievance. A written decision shall be given by Management designated to handle Step 2 within seven (7) business days of

5 the date of such meeting. If this written decision does not satisfactorily adjust the grievance, it may be appealed to Step 3.

Step 3 Notice of appeal must be given in writing by dating and signing the grievance forms within ten (10) business days from the written decision of Management or their designate, to the Director or Human Resources Vice-President setting forth the areas or points of disagreement with the Step 2 written decision. The Manager will arrange to meet with the Union's designated representatives, within ten (10) business days or a time mutually agreed upon. The Director or Vice-President will render his decision in writing within ten (10) business days from the date of such meeting to the Union. If this decision does not bring about a satisfactory settlement, the grievance may be referred by either party to arbitration as provided for in Article 8.

7.03 Should an employee claim that he has been unjustly discharged and wishes to seek redress under the grievance procedure, he must present such grievance, in writing, within three (3) business days of his discharge and may present this at Step 3 of the grievance procedure.

7.04 An employee and/or Steward shall obtain the permission of Management before interrupting or leaving his work to deal with a grievance .. Permission will not be arbitrarily or unreasonably withheld.

7.05 In this article, when computing business days, Saturdays, Sundays and rec.ognized holidays shall not be included.

7.06 Should the Union seek to submit a Policy Grievance, they may do so by submitting the grievance in writing and may present this at Step 3 of the grievance procedure.

7.07 Time limits established in this article may be changed by mutual consent of the parties.

ARTICLE 8- ARBITRATION

8.01 Where a difference arises between the parties relating to the interpretation, application or administration of this agreement, including any questions as to whether a matter is arbitrable, or where an allegation is made that this agreement has been violated, either party may, after exhausting anv. grievance procedure established by this agreement, notify the other in writing of its desire to submit the difference or allegation to arbitration. The notice shall contain at least three (3) names proposed as the Sole Arbitrator and shall be delivered to the other within thirty (30) days of the reply under Step 3 of the Grievance Procedure.

If the parties can't agree for the selection of an arbitrator, rules stated at Article 57 of the Canadian Labour Code shall apply.

Prior to submitting proposed Arbitrators, the Company and the Union may agree to have the matter(s) heard by a mutually agreed upon Grievance Mediation Officer with the intent to settle the grievance(s) in the most timely and effective manner.

8.02 No person may be appointed as the Sole Arbitrator who has been involved in an attempt to negotiate or settle the grievance.

6 8.03 The Sole Arbitrator shall not have power to alter or change any of the provisions of this agreement, nor to substitute any new provisions for any existing provisions, nor to give any decision inconsistent with the terms and provisions of this agreement.

8.04 Where a grievance resulting from a discharge or suspension which is filed under Article 7 is not settled and duly comes before an Arbitrator, the Arbitrator may make a ruling:

a) Confirming the Employer's action;

b) Reinstating the employee with compensation for regular time lost (except for the amount of any remuneration or compensation the employee has received from any other source pending the disposition of his case); or

c) Disposing of the grievance in any other·manner which may be deemed by the Arbitrator to be just and equitable.

8.05 The fees and expenses of the Arbitrator shall be shared by both parties.

ARTICLE 9- SENIORITY

9.01 New employees will be considered as probationary employees until they have been employed for a 90 cumulative days. For employees hired after July 8, 2012, the probationary period will be 120 cumulative days. Probationary employees shall have no seniority rights but after completing the probationary period their seniority shall be dated back to the date of commencement of the probationary period. Seniority will be one of the factors to determine the submission of vacation or time off request, lay-off and recall.

9.02 Periods of absence from work shall not affect an employee's seniority. Seniority lists showing employees' names, job titles, and where applicable classifications or grades and seniority date shall be posted on bulletin boards and revised quarterly or upon .request from the Union. A copy of the seniority list will also be supplied to the Union. Protests in regard to seniority standing must be submitted in writing within sixty (60) days from the date when the seniority lists are posted. When proof of error is presented by an employee or the Union, such error will be corrected.

In addition to the seniority list above the Company will provide a contact list in an excel spreadsheet format which will include the employee's name, home address, phone numbers, division/region, seniority date, email address and employment status. This will be sent to the Unit Chair and National Representative quarterly or upon request by the Union.

The Company will advise the Unit Chair/Steward(s) when new employee(s) are hired and will be provided with the name(s) and their region.

9.03 Seniority and employment shall be lost if an employee:

a) Voluntarily leaves the employ of the Employer;

b) Is discharged for just cause and is not reinstated pursuant to the provisions of this agreement.

7 c) Is absent for five (5) consecutive working days without notifying the Employer of the reason for such absence, and if upon such notice the employee does not have a justifiable reason for his absence;

d) Fails to return to work after Jay-off within five (5) working days after notification from the Employer by registered mail to his last known address unless it is shown that such failure has been caused by circumstances beyond the employee's control;

e) Is on Jay-off in excess of 6 months.

9.04 LAY-OFF AND RECALL

a) A reduction in the number of employees in a classification, region and for a period longer than five (5) days due to the reduced volume of work or for economic reasons shall be deemed to be a Jay-off. Lay-offs and recalls shall occur in the manner hereinafter set forth, provided there are available senior employees who are qualified, willing and able to do the work required. Both parties agree to meet quarterly to discuss and monitor the status of technicians being laid-off for five (5) days or Jess. The Employer also agrees that they will provide the necessary tracking documentation when req·uested by the Union.

b) In the event of a Jay-off the most junior employee in the classification within the reg!on, affected shall be laid off provided there are available senior employees who are qualified, willing and able to perform the work required. The regional lay-offs will only occur for temporary lay-offs and do not apply to a permanent downsizing in a region. Employees laid off permanently, will have the opportunity to bump a more junior employee in another region provided they have the seniority and qualifications to perform the required work. Relocating may be required in order to bump into another region and will be discussed on a case to case basis.

c) Employees who are laid off from their job shall be recalled, in order of seniority, to their original job from which they were laid off for a period of six (6) months from the respective dates of the employee's original lay-off or displacement.

d) Any period of lay-off. shall not affect seniority or service.

e) A Jist of employees affected shall be given to the Union, and at that time, the Company will discuss the reason for the Jay-off with the Union.

9.05 When there is an increase in the work force after Jay-off and before any new employees are hired, the employees who have retained seniority will be recalled in the reverse order in which they were laid off, provided that such employees are qualified, willing and able to perform the work required.

9.06 In no circumstances shall an employee who has acquired seniority Jose his seniority because of absence due to illness provided the employee satisfies the Company of such illness.

9.07 Seniority shall continue to accumulate during any employee's leave.

9.08 When two or more employees have the same seniority date, their ranking will be based on the date and time stamping of when the employee accepts the offer of employment.

8 9.09 The Employer will inform the Union when Employees are assigned temporarily outside of areas covered under Article 1.06 for special projects or assignments in supervisory role.

a) Employees accepting supervisory roles are not eligible to exercise any rights under the Collective Agreement.

b) Employees accepting such assignment (special projects or assignment in supervisory role) may do so for a period of up to nine {9) months per calendar year, however, this period may be extended for subsequent times with written agreement between the Company and the Union.

c) During this period the employee shall continue to pay Union dues in order to maintain and accumulate seniority within the Bargaining Unit. Seniority will be lost for those Employees accepting a temporary assignment in excess of nine (9) months. Employees accepting a supervisory role may choose not to pay Union dues and seniority shall be lost.

d) An employee accepting a supervisory role as per this article will not perform work covered by the scope of this agreement as per Article 2.05.

e) The employee's voluntary assignment shall be considered a temporary transfer and shall be for the duration of the project. It is the Company's intention that on the completion of the temporary transfer the employee shall be returned to his/her former position and region. However, in order to enable a more senior employee who is on a temporary transfer to return to his former position and reporting centre, the Company agrees to displace an employee, if needed, with Jess seniority in the same position at that region.

f) The Company will provide the Union with a Jist of the employees accepting special projects and will contain the working conditions and wages applicable to the er:nployee(s). During such assignments, employees shall retain their rights covered under the grievance procedure with respect to those working conditions or applicable wages.

ARTICLE 10-JOB POSTING$ AND FILLING OF VACANCIES

10.01 Vacancies and newly created jobs within the Bargaining Unit shall be posted for six (6) days on Employer bulletin boards accessible to all employees affected. Such bulletins will show the job title and qualifications required.

10.02 a) Any employee desiring to fill such a vacancy shall, within the six (6) days posting period, forward his application to the Human Resources Manager.

b) In the filling of vacancies and making of promotions within the Bargaining Unit, an employee with the greatest seniority shall be given preference provided he/she have equivalent skills and meets the qualification requirements. Should the senior applicant not be selected to fill the vacancy, the Employer will discuss the reasons with the Union.

9 ARTICLE 11-WAGES AND CLASSIFICATION

11.01 a) Job titles, classifications and rates of pay shall be as set forth in Appendix "A", attached hereto, which forms part of this agreement.

b) Should the Employer establish any new jobs or job classifications within the Bargaining Unit, during the term of this agreement, it will immediately advise the Union thereof and of the rate or rates it proposes therefore; the Union shall forthwith advise the Company of its acceptance or rejection of the proposed rate or rates, and in the event of rejection, both parties agree to negotiate bona fide a rate or rates acceptable to each, and failing agreement the determination of such rate or rates shall be referred to and settled by arbitration.

ARTICLE 12- HOURS OF WORK AIIID SHIFT PREMIUM

12.01 The work week is from 8:00am Sunday to 7:59am the following Sunday.

12.02 Residential Hours Employees will be assigned on a ten and one half (10 Yz) hour shift: Work travel between work locations will be included in the ten and orie half (10 1/2) hour shift.

Commercial Hours Commercial- Employees will be assigned on a nine (9) hour shift. Work travel between locations will be included in the nine (9) hour shift.

Maintenance Hours Maintenance/Other Hourly Classifications- Employees will be assigned on an eight and one-half (8 Yz) hour shift. Work travel between locations will be included in the eight and one-half (8 Yz) hour shift.

Hours of work and shift hours are riot to be construed as a guarantee of hours of work per day per shift, or per shift cycle.

12.03 The daily start and stop times for each Residential shift will be as follows:

1" shift, 8:00am to 6:30pm inclusive and

2"' shift, 9:30am to 8:30 pm inclusive

These shifts include a one half (Yz) hour unpaid lunch period and two (2) unpaid coffee breaks of fifteen (15) minutes. The onus is on the employee to schedule their own breaks.

The actual shift cycle is built on a twelve (12) week rotating shift cycle, average of forty-two and one half (42 Yz) hours a week and ten and one half (10 Yz) hours a day shift.

The daily start and stop times for each Commercial shift will be 9:00 am to 6:00 pm which includes a half­ hour (1/2) unpaid lunch period and two (2) unpaid coffee breaks of 15 minutes. The onus is on the employee to schedule their own breaks.

10 The daily start and stop times for each Maintenance/Hourly Employee(s) shift will be 8:00 am to 4:30 pm which includes a one-half (1/2) hour unpaid lunch period. The onus is on the employee to schedule their own breaks.

Notice of Shift Cycle Change The Employer may change the shift cycle upon notice. Such notice shall be given as early as possible.

ARTICLE 13- OVERTIME

13.01 Piecework overtime is all hours worked, less "White Space", in excess of 480 hours per 12 week schedule as per Article 1.09. All codes billed while working overtime are paid at 150% of the rates outlined in Appendix A.

Hourly Employees -All hourly employees shall be paid overtime at a rate of one and one-half (1 'h) times their hourly rate for hours worked in excess of 40 hours per week. In the event that an hourly rated employee works overtime performing piecework they shall be paid at the regular piece rates in the same manner as pieceworkers for all such work.

If piecework is available for hourly employees, it will be offered based on seniority.

ARTICLE 14 -HOLIDAYS

14.01 Recognized Holidays

The Employer will recognize the holidays listed below: New Year's Day Good Friday Christmas Day Boxing Day Labour Day Thanksgiving Day Canada Day Family Day Victoria Day

14.02 The Parties agree that since SC360 executes residential work in a continuous operation model, statutory holidays will be handled as "banked days", equivalent to the normal number of hours worked, paid at their hourly rate per Appendix "A" to be used at a later date to ensure continuous operation of the business.

Those employees are entitled to holiday allowance equivalent to their scheduled shift excluding unpaid breaks. Residential technicians may request to be paid for the Holiday when working instead of banking.

Technicians who work on a holiday will be paid the task code rates and are eligible to take a paid day off in lieu for the holiday on a later date mutually agreed upon.

Commercial - Holiday pay of an observed holiday will be paid out on the pay period where it is processed for employees assigned to Commercial and will be paid based on their hourly rate for their scheduled shift, excluding unpaid breaks, as per Appendix A.

11 Maintenance/Hourly Classifications - Holiday pay of an observed holiday will be paid out on the pay period where it is processed for employees assigned to Maintenance or other hourly classifications and will be paid based on their hourly rate.

ARTICLE 15 -VACATION

15.01 Employees will accrue an amount equal to a percentage of their earnings as Vacation Pay and be entitled to annual vacation as per the following rules:

a) 4% vacation pay and two (2) weeks' vacation from the start date; b) 6% vacation pay and three (3) weeks' vacation after completion of five (5) or more year's continuous service; c) 8% vacation pay and four (4) weeks' vacation after completion of ten (10) or more years' continuous service; d) 10% vacation pay and five (5) weeks' vacation after completion of eighteen (18) or more years' continuous service.

In year one vacation entitlement will be pro-rated.

The employee can carry over unused vacation days and pay into the following year(s). Unused vacation pay will be paid out upon request in writing by the employee for previous or current vacation accrual.

Employees requesting to use current year accrual value will be paid out the current value. The Employees will not be able to be paid out more money than what is accrued.

15.02 Vacation Scheduling

Employees wishing to take vacation should request them as early as possible with a minimum of 17 days' notice. This will be on a first come, first serve basis.

Every effort will be made to accommodate the request, depending on client's requirements and manpower availability.

Management will confirm vacation requests not later than 14 days after the· request was made or when the client approval is given.

Seniority shall not allow changes in already requested or approved vacation.

15.03 If an employee, within his/her vacation period is admitted to a hospital as an "in" patient, and provides their management with appropriate medical documentation, then he/she may reschedule his/her vacation for that day and for the remaining days of hospitalization that coincide with the originally scheduled vacation days.

ARTICLE 16- BENEFITS

16.01 The Employer will provide to employees, a group benefit plan equivalent to the current plan through Great West Life. The Employer may change the benefit carrier at any time as long the level of coverage as outlined below is unchanged. Any change to the existing level of coverage must be agreed upon by both parties.

12 Benefit program will be paid by the Employer and the employee as per the following:

Bronze, 80% by the Employer- Policy Number 168313, Division 001, class 10 Silver, 70% by the Employer- Policy Number 168313, Division 002, class 20 Gold, 60% by the Employer- Policy Number -168313, Division 003, class 30

16.02 Employees temporarily laid-off or on illness leave (less than six (6) months), or are on maternity/parental leave can be eligible for benefits (excluding LTD) if they continue to pay their regular contribution to such benefit plan. It is the Employees responsibility to make arrangements to pay the premiums up front or submit post-dated cheques to cover for the bi-weekly premium, if they wish to continue their group benefits coverage while on their leave.

16.03 Reti'rement Plan After one (1) year of seniority, the employee may contribute to the Employer's Registered Retirement Savings Plan (RRSP). The Employer will contribute the equivalent amount contributed by the employee up to a total of 3% ofthe employees gross earning.

16.04 The parties agrees to ·maintain the existing· benefits for employees provided that the cost to the Company of providing the same does not increase by more than two'percent (2%) of the cost in the previous year.

The Company will meet with the Union to negotiate how best to ensure that the cost of benefits to the Company does not increase more than two percent (2%) per year and the manner in which any additional increase will be dealt with by the parties .

ARTICLE 17- CLOTHING. TOOLS & EQUIPMENT

17.01 Safety Footwear.

After a six (6). months period, employees required by the Employer to wear safety footwear will be reimbursed up to a maximum of $125.00 upon receipt presentation and then every year toward the purchase of summer and/or win~er safety footwear.

17.02 The Employer will provide Company and Client identification required clothing, at no cost, in sufficient quantities including all safety gear, one (1) fire retardant coverall, except safety boots. The Employee will be required to wear the uniform as per Employer policy. The current uniform will remain in use with only the Company logo and will not be outfitted to include Clients identification logo.

Four (4) will be defined as sufficient number of Company and Client identifiable shirts given to each Employee on a yearly basis. In the event that the Company cannot provide the sufficient number of shirts, the Employee will be able to wear suitable professional shirts to represent the Company and the Client.

The Employee will supply and wear clean black cargo style pants while at work.

Clothing will be replaced if required, as per Employer's standards. Clothing will remain the property of the Employer and must be returned to the Employer if requested or upon termination of employment.

13 A fee of $120 per item will be charged for loss or refusal to return coveralls and/or winter coats if requested.

Cleaning will be the responsibility of the Employee.

17.03 The Employer agrees to provide and replace other necessary tools and equipment as required for connectivity technicians, including all masonry and wood drill bits.

The Employer may charge the employees for loss or damaged tools and/or lost equipment.

The Employer and employee can agree to a payment arrangement. The employee will receive a document outlining the payment agreement and will be signed by both parties. The employee retains the right to dispute any charges through the grievance process and such charges will not be deducted until a resolution has been determined.

It is a requirement for employees to have all tools in Appendix B in their possession and in working order to be assigned work.

ARTICLE 18-SAFETY AND HEALTH

18.01 a) The Employer will institute and maintain reasonable precautions for the health and safety of all employees. All employees covered by this agreement shall co-operate in the implementation of such health and safety precautions. The Company and the Union shall cooperate fully in the elimination and prevention of unhealthy and unsafe working conditions and practices and assist in the prevention of accidents.

b) There shall be a Joint Health and Safety Committee established and operated, consisting of members representing the Company and of members representing the employees. Bargaining Unit employees sitting on this Committee will earn their hourly. rate as per Appendix "A". Number of Bargaining Unit employees on the committee, wages, training etc. will be in accordance with the Canada Labour Code.

c) All matters considered and handled by the Health and Safety Committee shall be recorded and minutes maintained.

d) Return to Work The Company and the Union agree to support and cooperate with a modified work program when an employee is unable to return to their regular duties as a result of a workplace injury.

ARTICLE 19 -LEAVES OF ABSENCE

19.01 Union Business Employees elected as officers of the local or designated by the President of the Local to attend to authorized Union business will be granted leave of absence without pay.

All such leaves of absence shall be requested by written notice to the Employer at least fourteen (14) calendar days prior to the commencement of the period of leave.

14 19.02 Other Than Union Business

The Employer may grant leave of absence without pay for a period not exceeding two months to an employee for legitimate personal reasons. Legitimate and reasonable requests for leave of absence beyond two months will be given due consideration by the Employer and, as a matter of policy, permission will not be withheld, provided such absence will not seriously interfere with the efficient continuation of satisfactory customer service. All leaves of absence shall be requested by written notice to the Employer at least seventeen (17) calendar days prior to the commencement of the period of leave.

19.03 Bereavement Leave

a) In the case of deatn in the immediate family of an employee (i.e. Mother, Father, Wife, Husband or common law partner, Child, Brother, Sister, Mother-in-Law, Father-in-Law, Step­ parent or Step-Child, Brother-in-law, Sister-in-law, Grandparent or Grandchild) the employee, upon request will be granted time off up to five (5) calendar days with three (3) paid days based on the hourly rates as per Appendix "A" and based on your scheduled shift.

In the event of extenuating circumstances, requests for additional time off work without pay will be considered.

b) In the case where bereavement occurs during an employee's scheduled vacation period, and provided the employee would have been granted time off with pay in accordance with Section 19.03 (a), an equal number of vacation days that would have been granted in accordance with 19.03 (a) may be. rescheduled to.be taken at a later date. Such rescheduled days must be taken within the same calendar year:

19.04 Jury Duty An employee who is called to jury duty or subpoenaed as a witness, will be permitted such absence as is necessary as a result of such call or subpoena and he will be compensated by the Company for the difference between payment received for such duty and their hourly rate as per Appendix "A". The employee will present proof of service as a juror or witness as well as the amount of pay received for such service to his .supervisor.

19.05 Maternity and Parental Leave The Employer will abide by the provisions of The Federal regulations for maternity and parental leaves.

19.06 Unifor Paid Education Leave The Employer agrees to pay into a special fund an amount of three hundred (300.00) dollars per month for the duration of the agreement for a Unifor Paid Education Leave (PEL) program. Such payment will put into a trust fund established by the Unifor National Union effective from the date of ratification. Payments will be sent by the Employer to the following address:

15 The Employer shall approve Education Leave for the members of a Bargaining Unit at the request of the Union. Candidates for PEL shall be selected by the Union to attend. The Union will provide written confirmation to the Employer of such selection. Employees on PEL leave of absence will continue to accrue seniority and service.

19.07 Sick Leave Sick leave in excess of three days may require a Medical note indicating fitness to return to regular duties and regular schedule. When the Employer requests a Medical Note the Employee will be reimbursed the costs of the Medical Note up to the amount of $30 when the receipt is submitted to Human Resources including additional notes when requested.

If a medical note is indicating modified work, the Employee may be subject to provide a functional abilities form indicating limitations and restrictions and the length of time required. If the medical note indicates a post-dated return to work date, the Employer has the right to request further medical documentation to ensure fitness to return to regular duties. If the cost of a functional abilities form is in excess of $100.00, the employee will need to have prior approval from Human Resources before incurring the cost.

Absences should be reported to the Regional Manager by cell phone. If the Regional Manager is not available, the Employee is required to leave a message indicating the absence is due to sickness, and the expected return to work date.

ARTICLE 20- GENERAL

20.01 Discipline and Discharge In case of an employee's dismissal for just cause, the Employer shall inform the employee of. such cause in writing within a period of twenty-four (24) hours, and a copy will be sent to the Union. Where a meeting is taking place a Union Representative will be present unless the employee requests otherwise. The Union Representative will be given notice of the reason prior to the meeting. The Empl.oyer will use a progressive discipline model.

20.02 Bulletin Boards The Employer agrees to provide a bulletin board for the posting of official Union notices. All notices posted on this bulletin board will have the prior approval and signature of an elected representative of the Union.

20.03 Collective Agreements The Employer will make available a Collective Agreement to each employee and each new employee. This agreement shall be provided in printed booklet form by the Union. New employee(s) will receive a Collective Agreement upon being hired. A Unifor Local 5011 welcome letter will also be included with the Collective Agreement with contact information of the Union Representatives.

20.04 Contracting Out It is understood that during the lifetime of this agreement, the Employer shall not subcontract work that can be performed by available employees (including temporary laid off employees) covered by this agreement that would result in reduction of work or lay-off for Union members.

20.05 This Collective Agreement will nullify and void any previous employment contracts.

16 20.06 The Employer will provide and replace Company owned equipment and vehicles at no cost to the employee. The employee agrees it shall not be used for other personal reasons.

Monthly Laptop air time is not for personal use and could be subject to discipline and be subject to a charge back to the employee if found to be in excess.

The employee will be entitled to a $47.00 monthly allowance for supplying a cell phone.

Employee(s) that are on modified duties monthly allowance entitlement will be on a case by case basis.

20.07 Discipline will be removed from an employee's record provided there has been no other discipline within a one year period.

Motor vehicle infractions, criminal offences and health and safety violations are exempt from this clause.

20.08 Pay days will be bi-weekly by direct deposit.

The Employer will furnish the employee with a statement in writing setting out:

• The period for which the payment is made; • The actual number of hours for which the payment is made; • The rate of wages; • Details of the deductions made from the wages a.nd the actual sum being received by the employee

20.09 All employee initiated sales/product codes will be paid as per Appendix "A" rate sheet.

20.10 Training While training new employees, regular employees will receive a daily premium of $50. The Employer will select employees who will be trainers.

20.11 Labour Management Relations Committee A Labour Management Relations Committee shall be formed consisting of up to five (5) representatives from the Company and four (4) representatives from the Bargaining Unit as well as the Unifor National Representative. The Committee shall meet once every two (2) months.

The purpose of this Committee will be to discuss matters of mutual concern such as productivity, performance, and quality matrix, to deal with problems arising from the administration of the Collective Agreement and to improve the communications between the parties.

Union Representatives will be paid their hourly rate as per Appendix "A" to attend.

20.12 All agreed to Letters of Understanding will form part of this agreement.

20.13 If technician(s) are required to pay for parking while completing assigned work the Company will reimburse the technician for the parking fees. Pre-approval is required by the technician's immediate supervisor prior to paying parking. Should approval be given a receipt for reimbursement will be required and employees are expected to use free parking when available.

17 Employee(s) are required to notify their manager of any parking violation within 48 hours of receipt.

20.14 Employees will be paid their hourly rate as per Appendix "A" for attending Company meetings, Training (Including On-line) and Inventories that are not compensated with piece code rates. Exclusions: One-on-one evaluations, material and equipment pick up and vehicle maintenance.

ARTICLE 21- HARASSMENT

SC360 and Unifor agree that everyone has the right to work in an environment free from harassment, violence and discrimination. As outlined in the Violence and Harassment Policy, Harassment, violence and discrimination will not be tolerated in the workplace.

Definitions: Harassment is defined as "any unwelcome action by any person(s), whether verbal or physical, on a single or repetitive basis, which humiliates insults or degrades".

Discrimination is an action or decision that treats a person or group negatively based on the following grounds: race, national or ethnic origin, colour, religion, age, sex (gender), .Sexual orientation, marital status, family status, disability or a conviction for which a pardon has been granted.

Violence in the workplace is the exercise of or attempt to exercise physical force by a person against a worker, in a workplace, that causes or could cause physical injury to the worker. This can also include statements or behaviours that could be perceived as a threat of violence. Workplace violence includes domestic violence that could cause physical injury to a worker in a workplace.

The workplace is defined as any Company facility or any other place where employees gather.

Procedure: If you believe you are being.harassed and/or discriminated against by someone you work with (co-worker, manager, customer, client) there are specific actions you may take to put a stop to it:

• Inform the individual that their behaviour is unwanted and unwelcome and ask them to stop; • Document the events, complete with times, dates, location, witnesses and details; • If you are uncomfortable to ask them to stop or they refuse to stop when asked, seek assistance from your Manager, Human Resources or Union representative.

In addition to the process outlined in the Violence and Harassment policy, the Company and Union agree to the following process for investigating any complaints.

• Once a complaint is made to the Manager, Human Resources or Union Representative, the Company and the Union will partner together to review the allegations and determine if a formal investigation is required. • If a formal investigation is required, Human Resources and the Union Representative will interview all employees involved and determine the best course of action/resolution. An investigation summary with recommendations for a resolution will be kept in a secure location by both Company and the Union.

If the matter remains unresolved the complaint will be inserted into the last step of the grievance procedure for resolution. In the event that the complaint is not resolved by the parties at the last step of the grievance

18 procedure, the Union may refer the matter to arbitration in accordance with the provisions of the Collective Agreement.

ARTICLE 22-TERM OF AGREEMENT

This agreement shall become effective on July 8, 2014 and continue in full force and effect until July 7, 2017 and thereafter from year to year unless, within 90 days prior to the expiration date of the agreement, notice is given by either party to the other party of their intention to revise, amend or terminate this agreement.

19 APPENDIX "A"

The Employer agrees to not alter or modify the rate sheet unless agreed to by both parties. The Employer will provide the documentation and meet with the Union to discuss proposed changes.

All active piecework employees at time of ratification will be entitled to a retroactive lump sum payment equivalent to 1.5% of earnings from July 8, 2014 to date of ratification. The lump sum payment will be paid out no later than thirty (30) days following the date of ratification. The 1.5% increase on the existing codes will carry through until July 7, 2015. Employees on special project, approved Leave of Absence, WSIB, Modified Duties will be entitled to the lump sum.

Effective July 8, 2015 -All codes will be increased by 1% except for the New Bundle codes that became in effect by Rogers on April 1, 2015.

Effective July 8, 2016- All codes will be increased by 1.5% except New Bundle codes which will be increased by1%

(Note: Existing codes includes all codes in current CA as well as codes that were established after printing of CA- Commercial would also apply.)

New rates or new wde value will be established comparing with other existing codes, evaluating the task, and the material value. If parties can't agree, one party can initiate arbitration process. Until parties reach an agreement, work will be executed by the Employees at the proposed Employers rate and any increase to these settled rates will be retroactive to the date of the code and rate implementation.

When Travel time exceeds 25 minutes and upon Client approval, the employee would be entitled to code a maximum of 2 rural drive codes (code 232) per day to compensate for this travel time.

The Employer guarantees the employee will be paid a weekly top-up in accordance with the hourly applicable rate as set out below based on working hours as per Article 1.07 and Article 1.08 in the event that the total task code rates paid during the week are lower than the guaranteed minimum weekly top-up.

For piece work employees, the hourly rate outlined below will be used for the earnings calculation for a weekly top-up and all articles in the Collective Agreement that refers to an hourly rate.

New employees in training will be paid at minimum wage of the province of Ontario.

20 An employee who reports for work at the express demand of his Employer or in the regular course of his employment and who works fewer than three consecutive hours, except in the case of a fortuitous event, is entitled, to an indemnity equal to three hours' wages at the prevailing hourly rate.

Hourly Classification

All Active Hourly Classification employees will be entitled to the following:

Lump sum settlement of one and one half percent (1.5%) of earnings from July 8, 2014 to date of ratification (June 17, 2015) and will be paid out no later than thirty (30) days following ratification.

A one and one half percent (1 Y,%) increase will apply to earnings between June 18, 2015 and July 7, 2015.

1.5% Wage increase effective July 8, 2015 1.5% Wage increase effective July 8, 2016

Note: Employees that have moved from one classification to another will be entitled to the Lump sum settlement for both classifications based on earnings.

Performance Program

A performance program is currently used by the client to give a penalty to the Employer for repeats due to craft and random failed inspections on work performed by the employees.

When a penalty applies, the following rules will establish the non-compliant work fee:

Penalties to the Employer divided by the number of non-compliant work for the covered period (month) will establish the non-compliant fee. The non- compliant work fee cannot be more than the totai amount of the failed work order to a maximum of $25 per occurrence.

Non - compliant penalties, and the circumstances surrounding the determination of non­ compliance, may be challenged through a review process by sending a request to the Regional Manager. Non - compliant penalties will not apply if it is proven that the technician is not at fault. If non-fault assessments are not reversed, the issue may be challenged at Step 2 of the grievance procedure. (See Appendix "C")

A formal challenge and review process of the non-compliant penalties will be created. The charge­ back will be deducted after the challenge has been processed and completed.

The Union may designate one representative per region to participate in craft repeat determination process. The designate will receive the weekly report for him to review. The designate will receive thirty (30) minutes pay for such review provided the review has been completed. Proposed change to·craft determination must be provided within five (5) business days. (See Appendix "C")

The Company agrees that only one (1) non-compliant work fee will apply for each work or service order per address.

SUBJECT: Performance·

The Parties agreed on at least these principles:

I. The Parties recognize the intent of the daily minimum pay is to offset the items that are not under the control of the employee.

2. The daily minimum pay could have negative impact on performance and productivity.

3. An employee who intentionally slows down or adversely affects productivity may be subject to disciplinary measures.

4. There is recognition that there is a need to reduce repeats and to maintain work quality to the highest .standards possible. To this end, the parties commit to work co-operatively to achieve the following: a) Inspections above 85% b) Repeats for Installs below 6% c) repeats for Service Calls below 9%

5. The parties will meet to review all data as it relates to repeats and inspections, and will attempt to develop plans to meet our common objective. Additionally, the parties further agree to discuss volumes of work performance. These discussions would include a review of the current daily minimum payouts as they relate to work volumes.

SUBJECT: GROUP BENEFITS

1. Purpose

The purpose of this Letter of Understanding is to outline the terms of the management of cost of the Group Benefit Programs for the unionized employees covered under this agreement .

. 2. Reference

The references thatdirectly related to this Letter of Understanding is the Group Insurance Benefits of SC360.

3. Concern

The Group insurance benefit offerings and usage, as well as the premiums related to the costs of the same.

4. Scope

Both parties involved will ensure the co-operative spirit in dealing with the group benefits renewal.

5. Understandings, agreements, support and resource needs:

Both parties agree to meet and discuss the Group Insurance program, three (3) months prior to the annual group insurance renewal.

Both parties will review and discuss the group benefit in order to ensure that the cost of the insurance program do not increase more than two percent (2%) per year and the manner in which any additional increases will be dealt with by the parties.

6. This letter of understanding will be in effect from the date of ratification of the Letter of Understanding.

71 7. Agreement

The parties agree to modify the actual benefit program on August 1'', 2012 to limit the paramedical cost per claim to $35 for bronze, $40 for Silver and $50 for Gold.

The limits will be $750 for all specialties.

UniFOR thEUnion I it:syndicat SUBJECT: FLEET During the negotiations in 2014-2015 the Employer raised concerns over their existing Fleet Policy specifically in regards to the following:

• Vehicles are subject to inspections. • Unreported damage(s) to Vehicle will be subject to disciplinary measures. • Infractions. Any tickets received as a result of driving infractions, parking tickets, 407 ETR changes, are the sole responsibility of the Employee. As such, all Employees are required to reimburse the Company for the full cost of any tickets incurred. See Article 20.13 covering paid parking by the Company. • Each Employee is obligated to submit their vehicle and equipment for Inventory Counts. • Personal usage of vehicle will be subject to discipline. • The Company at its discretion may require the return of the Company vehicle for any term of vacation leaves or absences. • The Employee is required tp provide their odometer reading to the warehouse.

The Company and the Union are committed to partnering together to resolving the concerns noted ab.ove. The parties agree that through the Labour Management Relations Committee they will discuss the matters of concern and work together to address problems raised. by the Company.

During negotiations the Company agreed to secure any and all necessary work permits to comply with applicable legislation in regards to the averaging of the hours of work and overtime pay as per Article 12 and 13 of the Collective Agreement.
