Colby* This Article approaches the originalism debate from a new angle— through the lens of the recently defeated Federal Marriage Amendment. There was profound and very public disagreement about the meaning of the FMA—in particular about the effect that it would have had on civil unions. The inescapable conclusion is that there was no original public meaning of the FMA with respect to the civil unions question. This suggests that often the problem with originalism is not just that the original public meaning of centuries-old provisions of the Constitution is hard to find (especially by judges untrained in history). The problem is frequently much more funda- mental, and much more fatal; it is that there was no original public mean- ing to begin with. -

Since 1997, WCF Thas held conferences and events around the world that foster homophobia and transphobia under the guise of protecting the “natural family.” It is connected to some mainstream conservative organizations and to the very highest levels of government in the countries where it operates. Thanks to WCF’s connections, its rhetoric and its willingness to associate with and encourage radically homophobic and transphobic activists, the group has had an outsized influence on anti-LGBT (lesbian, gay, bisexual, transgender) sentiment and legislation in many places. This report explores WCF’s influence in more depth, focusing on Russia — where the organization had its genesis — as well as Eastern Europe, Australia and Africa. WCF is an organization with strong ties to American religious and conservative groups — including Focus on the Family, Alliance Defending Freedom, American Family Association and Family Research Council — and religious groups — such as The Church of Jesus Christ of Latter-day Saints and the Knights of Columbus. -

Sessions Belatedly Supplements His Senate Judiciary Questionnaire— But Dozens of Items Still Missing and Records for Two Decades Still Largely Absent On Friday night, December 23—two weeks after Senator Sessions submitted his Senate Judiciary Questionnaire (SJQ) for his nomination to be Attorney General—he submitted a supplement with hundreds of new entries. This supplement confirms our initial report, on December 14, which demonstrated that his SJQ was “shockingly incomplete.” Indeed, many of his additional entries are based on the findings in our report. However, Senator Sessions’ SJQ remains astonishingly deficient, with two decades of his career still largely missing and dozens of more recent items still omitted—including an interview just last month. Especially as Senator Sessions continues to refuse to take the confirmation process seriously, Judiciary Committee Chair Chuck Grassley’s double standard in scheduling this hearing is all the more appalling. As Judiciary Committee Chair, Senator Chuck Grassley has scheduled consideration of two Attorney General nominations: Loretta Lynch Jeff Sessions Questionnaire submitted: Dec. 1, 2014 Dec. 9, 2016 Grassley schedules hearing: Jan. 16, 2015 (46 days later) Dec. 9, 2016 (same day) Grassley holds hearings: Jan. 28-29, 2015 (58 days later) Jan. 10-11, 2017 (32 days later) The Senate had confirmed Lynch twice, including just five years before her nomination to become Attorney General. The Senate’s last consideration of Senator Sessions as a nominee was to reject him, 30 years ago. If anything, the timeline to consider Senator Sessions’ nomination should be twice as long—not half as long—as it was for Lynch’s nomination. -

United States Senate Washington, DC Re: Debating the Supreme Court Nomination Dear Senators: Senator Sessions recently published a fine column offering his advice to the President on the qualities that should define a Supreme Court nominee. Senator Sessions respectfully explained what he expected of the President. Now that the President has made his nomination, it is up to the Senate to give the President “advice and consent.” With like respect, and as the petitioners for millions of Americans, we write to express what we expect of you as leaders of the Senate Minority on a matter of the greatest concern to us – the confirmation process of the President’s nominee to the Supreme Court. In fact, we expect the same of the Majority in mirrored fashion. We assume that Senators and staffs of the Committee on the Judiciary will do all that they can to illuminate the issues that under-gird a Supreme Court nomination.
