Box 203003 Helena, Montana 59620-3003 Re: Limited Scope Representation Rules, AF 09-0688, AF 07-0157 Montana Supreme Court Justices: I am a member of the State Bar Access to Justice Committee and a board member of Montana Legal Services Association. I also served on this Court's Equal Justice Task Force for approximately seven years during which time a substantial legal needs study was conducted. The results of that study confirmed what most legal practitioners and certainly all social service providers already knew: many Montanans have significant unmet legal needs. In an effort to provide yet another tool to provide meaningful access to our courts, I write to ask this Court to support the rule changes proposed. The Montana Rules of Professional Conduct currently permit limited scope representation (LSR). However, the current rules provide no guidance and result in too much risk for lawyers to actively seek or even accept LSR to enhance their practice. The intent of this rule is not to lower the quality of legal representation, but to increase access to legal representation. The proposed rules provide the necessary guidance to assist attorneys in ethically providing LSR. For these reasons, I respectfully request the Montana Supreme Court to adopt the proposed rules changes to the Rules of Civil Procedure and the Rules of Professional Conduct. The Court opened a 60-day comment period on the revisions, and after review and consideration of the revisions in a public meeting held on September 24, 2019, the Court determined the revisions were well taken, and approved them with some revisions. IT IS ORDERED that the proposed revisions as approved by the Court are ADOPTED. The Montana Uniform District Court Rules are amended to read as shown in the attachment to this Order, effective January 1, 2020. This Order and the attached rules shall be posted on the Court’s website. In addition, the Clerk is directed to provide copies of this Order and the attachment to the State Law Library, to Todd Everts and Connie Dixon at Montana Legislative Services, to Chad Thomas at Thomson Reuters, to Patti Glueckert and the Statute Legislation department at LexisNexis, and to the State Bar of Montana, with the request that the State Bar provide notice of the revised rules on its website and in the next available issue of the Montana Lawyer.

Dep’t of Revenue, 2018 MT 306, 393 Mont. 466, ___ P.3d ___, concluding that § 15-30- 3111, MCA (the Tax Credit Program), was unconstitu- tional because it violated Article X, Section 6, of the Montana Constitution. Appellees (collectively, Plain- tiffs) filed a Motion to Stay Judgment Pending United States Supreme Court Review. Appellant, the Depart- ment of Revenue (the Department), filed a response in- dicating it does not oppose a reasonable stay to allow for efficient administration of the Tax Credit Program. The Department represents that it has already com- pleted state tax returns, forms, and instructions for tax App. 2 year 2018, which provide taxpayers with the ability to claim tax credits based on their donations to Student Scholarship Organizations. The Department repre- sents that the most efficient course of action would be for it to administer the Tax Credit Program in tax year 2018. The District Court denied the motion. On April 19, 2004, Bonck, although still represented by counsel, made a pro se motion to withdraw his guilty plea, citing identical reasons he listed on March 3.
