Foreword - Cllr Bound, Cabinet Member for Communities and Community Safety I am pleased to support the recommendations made in this report. The allocation of S106 contributions to open space and play projects have been identified through appropriate discussions and agreement with ward members and Councils. The identified schemes will improve our residents’ quality of life in those areas affected, as part of a rolling programme of play and open space enhancements across the borough.

Recommendation to Cabinet / Council:

. £14,035 is released in accordance with the S106 Agreements for 13/00579/OUT, 13/02321/FUL & 13/02322/FUL and allocated to the Rooksdown Skate Park project to facilitate structural soft landscaping works at Rooksdown Park, Rooksdown Ward.

. £17,878 is released in accordance with the S106 Agreement for BDB/74060 and allocated to a project to upgrade the play area and wider open space at Kingsmill Road, Grove Ward.

. £85,000 is released in accordance with the S106 Agreement for BDB/44271 and allocated to a project to upgrade the Hanmore Road Play Area, Chineham Ward.

. £20,000 is released in accordance with the S106 Agreement for BDB/57987 and allocated to a project to install a replacement footbridge over Petty’s Brook, Chineham Ward.

Background, corporate objectives and priorities

The Council’s policies regarding obtaining and allocating S106 contributions are set out in the Local Plan. S106 contributions are secured where it is considered that the provision of required facilities is not feasible within the development site. Contributions are then made to provide new or enhance existing facilities in order to mitigate the impacts of additional residents in areas likely to be used by the additional population. The allocation of S106 funds is sought through discussion with ward members, parish councils and local organisations.

This report accords with the council’s Budget and Policy framework and directly supports the Council Plan priority of improving residents’ quality of life, as a result of enhancing local play and open space facilities, as well as the natural environment.

Main considerations

1 Executive Summary

1.1 The purpose of this report is to gain approval to release Section 106 developers’ contributions secured for improvements to open space and play facilities.

1.2 The council has a legal and accounting obligation to allocate funds collected in accordance with the requirements of Section 106 Agreements, and as part of this process ward members and parish councils are consulted on how best to allocate the available funding.

2 The Proposal

2.1 It is proposed that the Portfolio Holder considers the information in this report and approves the proposed allocation of S106 contributions as set out below.

2.2 The recommendations are based on the basis that the schemes will achieve the greatest benefit or meet the priority needs for the area to which the funds are to be allocated. The S106 contribution is sometimes only part of a collaborative funding approach for a particular scheme.

2.3 Details of each contribution and the schemes they are proposed to be allocated to are outlined below:

1. Proposed Project: Rooksdown Skate Park Project Costs: £14,035.00

Description: Rooksdown Park is the main open space serving the local population. Rooksdown Parish Council, with the support of the local ward member, identified a need for a skate park within this area, and have been successful in

2 of 8 gaining LIF funding to provide it. As part of the design process for the skate park, additional open space improvements have been identified, including structural planting and site entrance improvements which will complete the works to provide this facility. Revenue Implications: Rooksdown Park in which the skate park is situated is owned and managed by the council. The provision of additional structural planting and boundary improvements to support the skate park will have a small revenue implication for the council, however it is felt that they can be accommodated within existing budgets. Recommendation: To release the contributions set out below to provide structural planting and boundary enhancements within Rooksdown Park to support the provision of the recently completed skate park. Subject to the approval of this funding, it is expected that this work will be undertaken during 2018/19.

13/02321/FUL Site/Developer: Main Hall, Park Prewett / Homes & Communities Agency and Taylor Wimpey Developments Ltd Contribution Sum: £1,052.00 Contribution type: Public Open Space Spend by date: March 2025 Purpose of developer contribution as set out in the S106 Agreement: A contribution towards the cost of providing, running and maintaining open space in the locality of the site.

13/02322/FUL Site/Developer: Commercial Area, Park Prewett / and Homes and Communities Agency and Taylor Wimpey Developments Contribution Sum: £346.00 Contribution type: Public Open Space Spend by date: January 2025 Purpose of developer contribution as set out in the S106 Agreement: A contribution towards the cost of providing, running and maintaining open space in the locality of the site.

3 of 8 2. Proposed Projects: Kingsmill Road Play Area and Open Space Project Costs: £17,878.09

Description: The open space and play area at the ends of Kingsmill Road and Cranbourne Lane are well used local facilities. Ward members have identified a need for improvements to the play area to include the provision of additional equipment suitable for the pre-school age group. In addition, open space enhancements will be carried out to plant trees along the approach footpath to the play area, and around the site, to provide softening and shade whilst children are playing. Revenue Implications: This site is owned and managed by the council. The provision of additional new facilities will have a small revenue implication for the council, however it is felt that this can be accommodated within existing budgets. Recommendation: To release the contributions set out below to provide additional play equipment and structural tree planting at Kingsmill Road Open Space. Subject to the approval of this funding, it is expected that this work will be undertaken during 2018/19.

BDB/74060 Site/Developer: Queen Marys College Contribution Sum: £17,878.09 Contribution type: Equipped Play Provision (£13,134.34) Public Open Space (£4,743.75) Spend by date: February 2027 Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the cost of providing, running and maintaining open space and equipped play provision in the locality of the site.

3. Proposed Projects: Hanmore Road Play Area and Toll House Meadow Pedestrian Bridge, Chineham Project Costs: £85,000.00 and £20,000 respectively

Project Description: As part of the ongoing Community Audit work for Chineham, Chineham Parish Council with the support of ward councillors have identified two projects that they would like to see delivered within the parish. The first is at Hanmore Road, and involves the upgrading of an existing council play area. The site currently contains one piece of skate equipment which is underused, and as such the Parish Council would like the site to be refurbished to include equipped play provision for the toddler and junior age groups. The second project relates to the installation of a new pedestrian bridge over Petty’s Brook within Toll House Meadow open space. The existing bridge is reaching the end of its life, doesn’t have guard rails and is flat in profile, so it floods in periods of high rainfall. The design of the replacement bridge would provide an improved solution on the site, with an arched profile allowing better water flow beneath, as well as vertical posts and handrails, for safety and a more

4 of 8 aesthetically pleasing finish. Both projects have the support of ward members.

Revenue Implications: Hanmore Road Play Area as well as Toll House Meadow are owned and managed by the council. The provision of additional new facilities will have a small revenue implication for the council, however it is felt that they can be accommodated within existing budgets.

Recommendation: To release the contributions set out below to facilitate the refurbishment of Hanmore Road Play Area, and to supply and install a new pedestrian footbridge over Petty’s Brook. Subject to the approval of this funding, it is expected that this work will be undertaken during the autumn of 2018.

BDB/57987 Developer/Site: Land at 73-74 Reading Road, Chineham Contribution Sum: £29,120.00 Contribution type/s: Play Areas (£14,421.00) Open Space (£1,874.00) Community Facilities (£12,825.00) Date of S106 Agreement: 10 September 2004 (Antler Homes) Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the Council’s costs in providing, running and maintaining off site open space/equipped play/community facilities in the locality of the site.

BDB/44271 Developer/Site: North Binfields Development Area Contribution Sum: £129,042.40 Contribution type: Community Facilities Date of S106 Agreement: 8 August 2001 (Hampshire County Council) Purpose of developer contribution as set out in the S106 Agreement: A once and for all contribution towards the Council’s costs in providing, running and maintaining community facilities (including but without prejudice to the generality of the foregoing sports barns, outdoor kickabout areas and all weather ballcourts) upon the site or within the northern sector of the Town Area and its environs.

3 Key issues for consideration

3.1 This report seeks to allocate a number of developer contributions to projects that would improve council owned public open spaces and play areas.

3.2 Failing to allocate secured S106 contributions to appropriate and relevant projects could in many instances result in the contribution having to be handed back to the developer and a community missing out on identified infrastructure improvements. Hence, the purpose of this report is to ensure that funding is allocated to schemes that have been identified by parish councils, ward members and their communities.

4.1 There are two options that could be taken, as follows:

a. Not to allocate funding to the open space and equipped play enhancement schemes. This has been rejected, as it would mean that the council would not be meeting its obligations with regard to obtaining and allocating developer contributions. b. To allocate the contributions referred to in this report to the schemes proposed. This is the preferred option as it will allow the council to meet its obligations and provide improved facilities for borough residents.

5.1 The S106 contributions should be allocated and spent for the purpose they were collected as set out in the S106 agreements.

6 Financial implications (must be completed by Financial Services)

This report proposes expenditure in 2018/19 totalling £31,913 which can be met from releasing developer contributions included in the Capital programme for Open Space Improvements as detailed below;

It is expected that there will be a small revenue implication as a result of this schemes but this will be met from within existing parks and open spaces budgets.

7 Risk management 7.1 A risk assessment has been completed in accordance with the council’s risk management process and has identified no significant (Red or Amber) residual risks that cannot be fully minimised by existing or planned controls or additional procedures.

8 Equalities implications

8.1 Developer’s contributions are sought for local community infrastructure provision needed as a result of new development. When taking into account the Public Sector Equality Duty and the requirements of the Equality Act 2010,

6 of 8 the projects funded through these contributions are positive for all protected characteristic groups particularly in relation to building good relations between different groups.

9 Consultation and communication

9.1 All relevant parish councils and ward members have been part of the process to identify proposals for open space and equipped play facilities within their areas.

10.1 There are no direct HR issues arising from this report.

11 Summary and reason for the decision

11.1 The projects set out in this report meet the purpose for which S106 contributions have been collected in the relevant wards and . They have been assessed as being deliverable and have local support. It is recommended that the funds therefore be released to enable the projects to progress.

12 The options considered and rejected

12.1 The option considered and rejected was not to allocate any of the S106 developer contributions to projects. This was rejected as it would mean that the council would not be meeting its obligations with regard to obtaining and allocating developer contributions.
