Kenya’s Supreme Court: Old Wine in New Bottles? By Special Correspondent As the six Supreme Court judges were adjudicating Kenya’s first presidential election petition in March 2013, Justice Kalpana Hasmukhrai Rawal was waiting for a new president to take office and the newly elected National Assembly to convene so that her nomination as Deputy Chief Justice could move forward. The Judicial Service Commission (JSC) had settled on her appointment after interviewing a shortlist of applicants in February 2013. The Judges and Magistrates Vetting Board had earlier found her to be suitable to continue serving as a Court of Appeal judge. Justice Rawal eventually joined the Supreme Court on 3 June 2013. Two years later, Justice Rawal became the second Deputy Chief Justice (after Nancy Baraza, who resigned after she was heavily criticised for abusing her authority by threatening a security guard after the guard demanded to search her at a mall) to be embroiled in controversy. In 2015, Rawal challenged a notice that she retire at the age of 70. Around the same time, the then Chief Justice, Dr Willy Mutunga, would announce that he wanted to retire early so that the next Chief Justice would be appointed well ahead of the next election. In May 2014, Justice Philip Kiptoo Tunoi and High Court judge David Onyancha challenged the JSC’s decision to retire them at the age of 70. They argued that they were entitled to serve until they reached the age of 74 because they had been first appointed judges as under the old constitution. What seemed like a simple question about the retirement age of judges led to an unprecedented breakdown in the collegiate working atmosphere among the Supreme Court judges that had been maintained during the proceedings of the presidential election petition. -

Edwin Odhiambo Abuya* Asiyekubali kushindwa si msihindani.1 I. INTRODUCTION ¶1 Can African States hold free and fair elections? To put it another way, is it possible to conduct presidential elections in Africa that meet internationally recognized standards? These questions can be answered in the affirmative. However, in order to safeguard voting rights, specific reforms must be adopted and implemented on the ground. In keeping with international legal standards on democracy,2 the constitutions of many African states recognize the right to vote.3 This right is reflected in the fact that these states hold regular elections. The right to vote is fundamental in any democratic state, but an entitlement does not guarantee that right simply by providing for elections. -

Many are hopeful that the solution to hun- ger, poverty and gross inequalities that have be- devilled the country lie in a devolved system of governance. “Due to the centralized system, where all de- cisions regarding this country are made in Nai- robi, people travel from the other seven regions to Nairobi since they believe it represents pros- pects for a better life,” says Dr Danson Mwan- gangi, an economist and market researcher in East Africa. He says that centralization of power and re- sources has compromised the establishment of strong linkages between policy, planning and execution of the national budget. “When the national budget is being read in parliament, millions of poor Kenyans hurdle around radio sets for news on price reductions of major items, our concern being our day to day survival,” says Benjamin Owuor, a mason in Nairobi. COMMENTS ON PETER KAGWANJA’S AND TOM WOLF’S CHAPTERS Macharia Munene Professor of History and International Relations United States International University, Africa [email protected] I Peter Kagwanja and Tom Wolf, uniquely positioned as “insiders”, use their “insight” to make telling statements on the politics of the International Criminal Court, the ICC. They, in their different ways, show how the master states, or the Western Powers, misuse and turn the ICC into a perceived organ of postmodern colonialism. Kagwanja is a prolific columnist and media personality with unusual access to various corridors of power. He is a self-confessed policy advisor to governments, especially that of Mwai Kibaki and Uhuru Kenyatta. Wolf is a self-confessed pollster and has shaped what people think of the ICC and Kenyan politics. Seemingly representing Euro interests, meaning the interests of Western Powers, he probably has access to the corridors of power at Euro embassies and institutions in and out of Nairobi. II The two men are in agreement that the ICC was externally calibrated to stop Uhuru and Ruto from participating in the electoral process and they portray the master states as seemingly believing in their own geopolitical wishes. Western Powers and their local backers, Kagwanja observes, choreographed the ICC politically and “were in a great hurry to intervene.” They wanted to achieve geopolitical objectives which had little to do with objectivity. -
