• Home with appropriate supports is the best place to recover from illness and injury, manage chronic conditions and live out final days

• Evidence shows that leaving hospital as soon as possible and recuperating at home with home supports and community services is better than waiting in hospital to fully regain your strength before returning home.

• Seniors who have been admitted to hospital will likely recover more

Esteemed Madam Mayor, Town Councillors and Water Commissioners, This is my request to speak to you about concerns and details of a perceived lack of "equality before the law" (as shown in the above Latin phrase) about recently installed changes to water connections to some (smaller) properties northwest of Town. By these I mean those properties served by the new "domestic and fire protection" watermains, that were installed in the 2017 contracts (one by Grizzly, one by Superior) and also in the currentyear's contract (by Superior). I have already spoken to a number of residents in this area, who (in their opinion) may not have been connected "adequately", and I hope to present some details to you as Council when doing more review and when the opportunity arises. I do not think that this is a widespread problem situation, and that perhaps only less than a dozen properties have already been cut off from the water services that they had before, and are currently beingbilled for. This is serious enough by itself to warrant your listening ear and possible actions. In my professional opinion, some water users (and I realize that the Town of Osoyoos is only the "purveyor of water" to us "out of towners" in what is called SOLID Area 8) have already "lost" their "irrigation water" although they are still being billed for the "irrigation water" by the Town. (We are charged a "ResidentialUnit" rate and a "Parcel Irrigation Charge".) But others, like ourselves, actually stand to "lose" our "domestic water" once the system that is currently being built in various phases, is finally put into service, and irrigation water will stop for the winter months, starting in the fall of2019 or 2020 or even 2021. I would therefore like to solicityour cooperation (and that of your staff) to get to the bottom of this situation, and if these allegations are true, that some remedial action take place to ensure that individuals are not being discriminated, andwill continue to receive both "irrigation water" and "domestic water" unless by mutual agreement between theirpnd the Town ofOsoyoos. <*^-*^~ I do allthis in the realization that things mayhavegradually "gonewrong" overthe manyyears, "' and without an intent to "point fingers" in any particular direction. (Exhibit numbers below are according to the bullet sequence in the Town's cover letter.) 1. Map showing location of service to propertyline at 8921 - 122nd Avenue: a. Thismap hasno date at all. It is obviously a copyof partof S.OXXD.'s record Map, updated and added to overthe years, and wasprovided to theTown of Osoyoos in late 1989/early 1990, andthenperhaps once . again "added to" as needed. Iteven shows the domestic water connection to 8949 - 122nd Avenue, made in 2004. (See below.) b. The parcel location of8921 - 122nd Avenue has been crudely shown, and ignores that with subdivision of the parcel ex "Lot 484" in 1970, by Plan 22410, N.I.D., the 122nd Avenue right-of-way was widened by 13'. c. The handwritten "Ties Into 2" PVC from Hwy 97" is most likely in error; why would a "2" connection" for a single residence, providing adequate water with adequate pressure from the 16" watermain on 87th Street, possibly be connected to another part ofthe S.O.L.I.D. system - ifthis was done prior to late 1989? Alternatively, why would the Town ofOsoyoos have done this - ifthis was done after late 1989? Was this pipe ever connected? I doubt this specific detail on Hit drawing; it must have been added later (and in error.) d. Why? My neighbours tell me that in 2004, the Town ofOsoyoos installed another (yes, a second and similar) 2"PVC pipe on 122nd Avenue, most likely inthevery same location as the 2"PVC pipe thathad been installed inNovember 1985. uid were building the house on Lot 479, (8949 - 122nd Avenue) and the Town ofOsoyoos first decided that a domestic water connection be made from a pipe on the opposite side of122nd Avenue, connected to one on Highway 97, that served^ property. But there was no pressure, and the Town ofOsoyoos then decided to install a 2" watermain that would connect 87th Street and Highway 97, NOT REALIZING THAT HALFTHAT PIPE ALREADY EXISTED. e. This 2" PVC pipe and "domestic" water connection to the property (Lot 466) is not shown on this Map. f. I have reason to believe that 8921 - 122nd Avenue and 8949 - 122nd Avenue are each served from one of these two pipes, and that the Town ofOsoyoos was until very recently, completely unaware ofthe "Stanley connection". (This would explain some ofthe water disruption problems we had last year with the Grizzly contract. Town ofOsoyoos staffonce mentioned "It is a looped system", which I queried, then and now.) g. The connection to 8921 - 122nd Avenue is shown in a completely wrong location - near the "lakeside" lot limit, instead ofnear the "hillside" lot line, adjacent to the driveway that was already these since 1962. Its length is about 530 feet (as measured by tape).

2. Bill dated June 6,1985 re Estimate to bring Domestic Water (3 pages): a. Page (1) ofthese 3 pages is a crude hand written adaptation to an "Estimate to bring domestic to" not 8921-122nd Avenue, but another property, namely Lot479, LotA,Plan 14028. Unfortunately, the distance of210 feet for that work was not changed. So I have no idea ifthe S.OXIJD.'s estimate to serve Lot 454, Lot 1, Plan 20410, was accurate, except that I know that the distance from my driveway to the lakeside edge ofasphalt on 87th Street is ±530 feet, and this is obviously much more than the 210' shown on page (1) and the 260' shown on page (2) as Item Nr. 10. b. I do know from this page (1) that Mrs. had to "sign form to come into the district". This likely meant the S.O.L.I.District, so that she would become entitled to irrigation water. Mrs _ also had to provide "payment up front" for the amount of$ 2,460.86 as per the estimate. (This estimate did not include an amount nfS 246.09 which is shown separately and she also had to pay that - see Exhibit 5.) Thisentitled herto domestic water and irrigation water - from the same pipe on 122nd Avenue, with a single connection into thelotand totheexisting house. c. There is nothingon pages (2) and (3) ofExhibit 2 to showthat two connectionsinto the property were provided, -namely: One for the house and one for the (irrigated) yard. I believe that providing two connections (fromthe samewatermain) had been S.OX.I.D.'s general practicein those days,as leastas I have perceived it inArea 8. At leastoneexception exists to whatI believe wasthis "general rule".

4. Connection (and) Inspection Permit dated November 6,1985: a. This document shows under Inspector's Remarks: "%" Installed Nov. 6/85" and "Service Turned on by SSZ on Nov. 13/85." The question arises what was turned on - either the connection to the property, or the connection to the house. The following observations ofNovember, (iii.) Water was turned on. b. From this, it is fairly obvious that whateverpiping systemhad been installed"on-site" and up to the pre existingplumbingof the house, had also been "inspected" and "approved" by S.O.L.I.D. staffj so that after the Connection Fee (of $ 375.00)had been paid, evidenced seeing by Receipt No. 27215, the work was done.

5. Application for Service Connection dated October 30,1985: a. This is an uncompleted form- the details on the bottomlines were not inserted by S.O.L.I.D.staff. The real facts need to be drawn from other documents like Exhibit 4. b. At that time, Mrs. ' (assisted in those days already, it seems, by her daughtei *who lives in ) did not need to apply for an "irrigation" connection, because the existing fruit trees (and the house) had been serviced by water in "Stanley Pond", entirely contained within Lot 484. (That is why Lot 484 is not shown as part ofthe "district" on the Map ofExhibit 1 - see hatched lines.) Although Mr. i Mrs. „ had sold the remainder ofLot 484 soon after the subdivision ofLot 1 in 1970, there was a pump station on Stanley Pond that served the house and irrigated the fruit trees on Lot 1 by way ofsome verbal agreement between Mr. r(before he died in late 1982) and the Owner ofthe orchard, who was a Mr. / ( ) at the time. In the summer of2014 or 2015,1 met Mr. ] the electrician,at the Osoyoos Dump, and he told me that "40 years ago", he installed the pump on Stanley Pond, "for Mr. /". The current Owners ofthe orchard,. r and m B, told me that during the late 1990's, after they has purchased the property from Mr.' ( ), they still had to switch on the pump on Stanley Pond occasionally,, to irrigate Mrs. /s fruit trees. It is also understood that only when this pump failed, the remainder ofLot 484 obtained irrigation water from the Town ofOsoyoos. But since 1985, the house onLot 1(at8921 - 122nd Avenue) received water from this single %" connection. This included (by default) irrigation water as well as domestic water. First the S.O.L.I.D., and then the Town ofOsoyoos, billed the Owners ofLot 1 (first Mrs ' , later the Estate of and then Jacob and Lydia de Raadt), accordingly, with two items on the annual

In addition to the "switch" to the municipal water system, some contributing factors to low service pressures include: o Flow control valves on the irrigation services. Flow control valves were required by the SOLID watersystem on ail domestic irrigation systems o In house pressure reducing valves (PRV's) o 12 mm(1/2 inch) service piping o Galvanized iron service piping Possible resolution options for lower service pressures in the 87th Street area are: o Removal of the PRV and/or flow control valve o Upgrading of on private property service piping o Irrigation system modifications o install a separate connection to the irrigation system for the watering oflawns and gardens around the house It is the Property owner's responsibility to implement any or all of the above noted suggestions to improve any concerns the lower water pressure may have created in the 87th Street area. BACKGROUND

Mr. and Mrs. Lees have sent numerous letters and emails informing the Town of Osoyoos about storm drainage issues near their property at 11619 – 115 Street since 2017. (See attached correspondence) The Operational Services Department installed four dry wells in front of the above noted property approximately 5 to 7 years ago in an attempt to deal with this issue. Unfortunately during heavy rainfall events or periods of extended wet weather the existing dry wells cannot absorb enough water and pools of rain water do indeed form on 115 Street.

OVERVIEW

True Consulting has looked into this storm drainage problem on 115 Street and have determine that a contributing factor to rain water pooling at this location is that drainage ditches once created to accommodate this storm flow have been filled in over the years. True Consulting recommends two possible solutions to this storm drainage problem, which are listed below: 1) Re-establish the ditch system on the boulevards of 115 Street which would then direct excess storm water to larger drainage ditches on Highway No. 3. Estimated cost = $35,000. 2) Create a new storm sewer system on 115 Street (new catch basins on both sides of the street tied together with appropriately sized piping which would eventually discharge to the drainage ditches on Highway No. 3). Estimated cost = $60,000.

Good afternoon Ms. Lees,

I am writing you this email in response to your numerous inquiries about storm water management along 115 Street in the industrial subdivision in Osoyoos. I will begin by informing you that there is no existing storm sewer system in the industrial subdivision (in other words there are no existing storm sewer pipes in the ground). Approximately 2 years ago the Operational Services department installed four (4) additional dry wells in front of the property at 11619 - 115 Street. These dry wells appear to be able to accommodate most rainfall events and it is only in the case of extreme, constant rainfall that the flooding conditions illustrated in your photos happen. Although these weather conditions have occurred in the past couple of years they are still considered to be rare and not the typical situation that infrastructure is designed to handle. A contributing factor to the formation of the large puddles in front of your property is probably storm water runoff from the business across the street (11640 - 115 Street/ Fort Storage), This business will be contacted and encouraged to arrange for more effective management of their storm water runoff. At this time, the Operational Services department has no capital budget plans to install a complete storm water management sewer system in the Industrial subdivision along 115 street. If you still feel that this is an issue which requires immediate attention you are welcome to write a letter to Town Council expressing your opinions. If directed by Town Council, the Operational Services department will then contact our engineering consultants to design a storm sewer system for this area and provide the Town with a cost estimate to construct this system,
