Gerber This dissertation is a biographical study of Moses Hayim Luzzatto (1707–1746 or 1747). It presents the social and religious context in which Luzzatto was variously celebrated as the leader of a kabbalistic-messianic confraternity in Padua, condemned as a deviant threat by rabbis in Venice and central and eastern Europe, and accepted by the Portuguese Jewish community after relocating to Amsterdam. -

Cheskin & Yitzchak Pechenick Section 1: The Obligation to Heal Introduction The fundamental principles regarding the practice of medicine are based on sources in the Bible. A t first glance, a fatalistic view may seem warranted: the course of the illness and its effects are predetermined by the A lmighty without any possibility of human intervention. Since both life and death, and health and illness, are in G-d’s hands, the physician has neither the right nor any poss- ibility of healing the sick. R ather, since everything is predeter- mined by G-d, to try to outwit the divine decree is to rebel. But one who looks more deeply at the sources in the Bible, Mishna, Talmud, early and later authorities, and in halachic literature will see that this fatalistic view is completely rejected in Jewish thought and practice. O n the contrary, the physician serves as a loyal agent of the A lmighty in healing the sick by means of the various medicines the A lmighty puts at his disposal, his wisdom, and his medical knowledge and experience. Looking to divine assistance, the physician should proceed with a sense that he is carrying out a mitzvah. W hen he operates in accordance with the best principles of medicine, he should not fear lest he bring about an accident or injury. The physician is not only granted the right to heal; he is obliged. -

289 Pointing to the Torah and other Hagbaha Customs By: ZVI RON The idea of displaying the text of the Torah to the listening congre- gation is already found in Tanakh. Before Ezra read to the assem- bled Jews from the Torah scroll, we are told that “Ezra opened the scroll before the eyes of the people … and when he opened it, all the people stood silent. Ezra blessed the Lord God, and all the people answered, ‘Amen! Amen!’ with their hands upraised, then they bowed and prostrated themselves before the Lord, faces to the ground” (Neh. 8:5-6). It is not clear if the showing of the Torah and the reaction of bowing was meant to be a onetime practice or some- thing that would accompany every public Torah reading. Still, this source forms the basis of the idea of displaying the Torah scroll as codified in Masekhet Soferim 14:13.1 Just as reported in Nehemiah, Masekhet Soferim instructs that the Torah is to be shown before the reading, at which time the congregation should bow: “It is a mitz- vah for all the men and women to see the writing, bow and say, ‘This is the Torah that Moses placed before the Children of Israel’ (Deut. 4:44). ‘The Torah of the Lord is perfect, restoring the soul’ (Ps. 19:8).” This source is quoted by Ramban in his discussion of 1 See Morekhai Zer-Kavod, Da‘at Mikra: Ezra v–Nehemia (Jerusalem: Mossad Harav Kook, 1994), p. 105, note 6. Introduction of Rabbi Yosef Kapach to his edition of Moses Maimonides’ Mishneh Torah (translated by Michael J. Bohnen) Rabbi Kapach was the foremost editor of the works of Maimonides. Born in Yemen in 1917, he used ancient manuscripts to restore the text of the Mishneh Torah. Several fascinating articles about Rabbi Kapach can be found at www.chayas.com/rabbi.htm The following is a summary and translation of his 20 page Introduction to his edition of the Mishneh Torah. Translator’s Summary My Work. When in my youth I studied the Mishneh Torah with my grandfather of blessed memory, most people used printed books, each with his own edition, but my grandfather and several of the others had manuscripts which were several hundred years old, each scroll of a different age. The errors and deficiencies of the printed texts were well known. The changes that Maimonides made over time in the Commentary on the Mishnah, after completing the Mishneh Torah, he then inserted in the Mishnah Torah. These are all found in our manuscripts, but some are not found in the printed texts. The Jews of Yemen are a conservative group. They would never have presumed to "correct" or "amend" a text that came into their hands, and certainly not the works of Maimonides. However, the Mishneh Torah was subjected to severe editing by the printers and various editors who made emendations of style, language, the structure of sentences and the division of halachot, to the extent that there is hardly any halacha that has not been emended. In this edition of ours, we are publishing, with God’s help, the words of Maimonides in full as we received them from his blessed hand. -

Nomos and Narrative Before Nomos and Narrative Steven D. Fraade* I imagine that when Robert Cover's Nomos and Narrative essay' first reached the editors of the Harvard Law Review, their befuddlement derived not so much from Cover's framing of his review of the 1982 Supreme Court term with a philosophically opaque discussion of the interdependence of law and narrative, but from the illustrations that he drew from biblical and rabbinic texts of ancient and medieval times. For Cover, both intellectually and as a matter of personal commitment, these ancient texts evoke a "nomian world," rooted more in communally shared stories of legal origins and utopian ends than in the brutalities of institutional enforcement, one from which modem legal theory and practice have much to learn and to emulate. Since my own head is buried most often in such ancient texts, rather than in modem courts, I thought it appropriate to reflect, by way of offering more such texts for our consideration, on the long-standing preoccupation with the intersection and interdependency of the discursive modes of law and narrative in Hebrew biblical and rabbinic literature, without, I hope, romanticizing them. Indeed, I wish to demonstrate that what we might think of as a particularly modem tendency to separate law from narrative, has itself an ancient history, and to show how that tendency, while recurrent, was as recurrently resisted from within Jewish tradition. In particular, at those cultural turning points in which laws are extracted or codified from previous narrative settings, I hope to show that they are also renarrativized (or remythologized) so as to address, both ideologically and rhetorically, changed socio-historical settings.2 I will do so through admittedly * Steven D. -

Hayyim Nahman Bialik’s Meditation on the Silence of the Divine in ‘On the Slaughter’ Dvir Abramovich Introduction Regarded as the greatest Hebrew poet of modern times, Hayyim Nahman Bialik (1873-1934) was instrumental in the revival of the Hebrew language and in expressing the Jewish people’s pain and yearnings in a time of great change.1 Translated into more than thirty languages, formally, Bialik’s corpus can be divided into verse articulating the national revival, interior poetry guyed in the personal, and songs of nature. But still today, the bard towers above all others as the artist who, more than anyone else, embodied in his work the spirit and mood of Jewish nationalism in the twentieth century. Never before had a poet developed such a cult of followers and evoked such popularity and admiration as Bialik did, setting his unique imprimatur on an entire generation. It is worth quoting at length Sara Feinstein, author of a literary biography on Bialik, who elucidates the esteem in which Bialik is held in Israel and in the Jewish world: Anyone somewhat familiar with Modern Hebrew literature recognises the name Hayyim-Nahman Bialik … a special phenomenon … reflecting the shock waves of his own generation and serving as a bridge of transition between old-world attitudes and modernity, between powerless victimization and vigorous self-determination … one of the most powerful influences in the transformation of Jewish culture during the first three decades of the twentieth century … Despite his long periods of silence, Bialik’s supremacy Dvir Abramovich is Director of the Program in Jewish Culture & Society at The University of Melbourne. -

The Golem Psalms Avodath Hakodesh (Sacred Service) Performed May 7, 2006 It is something of a surprise to realize that the world had to wait until 1933 for the first large-scale setting of the Jewish worship service by a mainstream composer, Ernest Bloch’s magnificent Avodath Hakodesh (Sacred Service), which forms the centerpiece of today’s concert. Mendelssohn Club also continues its tradition of commissioning new music to be paired with masterworks. The concert opens with the premiere of Andrea Clearfield’s The Golem Psalms, set to a newly written text created by Ellen Frankel and based on the famous legend of the Golem of Prague. A golem is a creature from Jewish folklore, created from mud or clay and brought to life through ritual and mystical incantations. The incantations are derived from the Kabbalistic tradition and feature both words made up from combinations and permutations of the Hebrew alphabet and the sacred, mystical names of God. The golem is often animated through a word of power which is either inscribed on the golem itself or written on a bit of paper and slipped into the golem’s mouth. Golems are completely lifelike, having hair, fingernails, and skin with the warmth and color of human skin, but they lack a soul and the power of speech. They are immensely strong and bound to obey their creator, which they occasionally do with a disastrous single-mindedness. There are many accounts of golems, but the most famous is that of the Golem of Prague and his creator, Rabbi Judah Loew. The creation of golems is bound up with the Jewish mysticism known as the Kabbalah. -

Elementary A delightful collection of stories adapted from the Talmud and Midrash. Each one is followed by the author's comments, giving sources, mentioning alternative versions, saying how she changed or embellished the tale, and asking questions that explore both the meaning of the story and how it reflects rabbinical thinking. Attractive illustrations in shades of black and grey are a pleasant addition to stories that beg to be read aloud or told. Goldin, Barbara Diamond.
