Perhaps the incident became newsworthy because it brought together two seemingly opposed news-values: fame and misfortune. But judging by the way it was reported in one black community newspaper, The Black Voice, Michael's unhappy accident took on a deeper significance for a cultural politics of beauty, style and fashion. In its feature article, 'Are we proud to be black?', beauty pageants, skin-bleaching cosmetics and the curly-perm hair-style epitomized by Jackson's image were interpreted as equivalent signs of a 'negative' black aesthetic. All three were roundly condemned for negating the 'natural' beauty of blackness and were seen as identical expressions of subjective enslavement to Eurocentric definitions of beauty, thus indicative of an 'inferiority complex'.1 The question of how ideologies of 'the beautiful' have been defined by, for and - for most of the time - against black people remains crucially important. But at the same time I want to take issue with the widespread argument that, because it involves straightening, the curly-perm hair-style represents either a wretched imitation of white people's hair or, what amounts to the same thing, a diseased state of black consciousness. I have a feeling that the equation between the curly-perm and skin-bleaching cremes is made to emphasize the potential health risk sometimes associated with the chemical contents of hair-straightening products. By exaggerating this marginal risk, a moral grounding is constructed for judgements which are then extrapolated to assumptions about mental health or illness.

    Guidance on Race Discrimination Based on Hairstyle September 2019 This enforcement guidance clarifies and explains how the New Jersey Division on Civil Rights (DCR) applies the New Jersey Law Against Discrimination (LAD) to discrimination based on hairstyles,1 with a particular focus on hairstyles closely associated with Black people.2 As we explain below, the LAD’s prohibition on discrimination based on race encompasses discrimination that is ostensibly based on hairstyles that are inextricably intertwined with or closely associated with race. That means, for example, that the LAD generally prohibits employers, housing providers and places of public accommodation (including schools) in New Jersey from enforcing grooming or appearance policies that ban, limit, or restrict hairstyles closely associated with Black people, including, but not limited to, twists, braids, cornrows, Afros, locs, Bantu knots, and fades.3 A similar analysis applies to discrimination based on hairstyles that are inextricably intertwined with or closely associated with other protected characteristics, such as hairstyles associated with a particular religion. Background on Anti-Black Racism and Discrimination Based on Hairstyles That Are Inextricably Intertwined with or Closely Associated with Being Black Anti-Black racism, along with implicit and explicit bias against Black people, is an entrenched and pervasive problem both in New Jersey and across the country. In 2017 and 2018, respectively, 52 and 54 percent of reported bias incidents in New Jersey were motivated by the victim’s race, ethnicity, or national origin. The system recommends hairstyles that suit the individual’s characteristics. This is based on a neural network learning algorithm, which is trained with features, extracted from 1060 images of people, relating to 53 different hairstyles. The trained network reaches an accuracy of 28.10% when validated with images that were not used for training. This can be improved by trying different combinations of input variables, or using a different conversion for the values that were gained from the APIs. It is also possible that the APIs are not completely accurate. A third possibility for improvement would be to use a different learning algorithm, such as k-Nearest Neighbors or naive Bayes.
