THEN COMPENSATE: WHY THE UNITED STATES OWES REPARATION PAYMENTS TO FORMER GUANTÁNAMO DETAINEES Cameron Bell* In late 2001, U.S. government officials chose Guantánamo Bay, Cuba, as the site to house the “war on terror” detainees. Since then, 779 individuals have been detained at Guantánamo. Many of the detainees have endured years of detention, cruel and degrading treatment, and for some, torture—conduct that violates well-established prohibitions against torture and inhumane treatment under both general international law and the law of war. -

GHAILANI, 36, a Tanzanian national and the first detainee held at the Guantanamo Bay Naval Base in Cuba to be tried in a civilian court, was found guilty of conspiring to destroy property and buildings of the United States, following a five week trial before U.S. District Judge LEWIS A. KAPLAN. GHAILANI faces a mandatory minimum sentence of 20 years in prison and a maximum sentence of life on this count. GHAILANI was acquitted of the remaining counts against him. "Ahmed Ghailani was today convicted of conspiring in the 1998 destruction of the United States Embassies in Kenya and Tanzania, causing death as a result," said United States Attorney PREET BHARARA. "He will face, and we will seek, the maximum sentence of life without parole when he is sentenced in January. I want to express my deep appreciation for the unflagging commitment, dedication, and talent of the agents who so thoroughly investigated this case and the prosecutors who so ably tried it." According to the evidence presented at trial, previous court proceedings in this case, and documents filed in Manhattan federal court: GHAILANI was first indicted on December 16, 1998, by a federal grand jury in the Southern District of New York. -

Introduction On January 25, 2017, President Trump repeated his belief that torture works1 and reaffirmed his commitment to restore the use of harsh interrogation of detainees in American custody.2 That same day, CBS News released a draft Trump administration executive order that would order the Intelligence Community (IC) and Department of Defense (DoD) to review the legality of torture and potentially revise the Army Field Manual to allow harsh interrogations.3 On March 13, 2018, the President nominated Mike Pompeo to replace Rex Tillerson as Secretary of State, and Gina Haspel to replace Mr. Pompeo as Director of the CIA. Mr. Pompeo has made public statements in support of torture, most notably in response to the Senate Intelligence Committee’s 2014 report on the CIA’s use of torture on post-9/11 detainees,4 though his position appears to have altered somewhat by the time of his confirmation hearing for Director of the CIA, and Ms. Haspel’s history at black site Cat’s Eye in Thailand is controversial, particularly regarding her oversight of the torture of Abd al-Rahim al-Nashiri5 as well as her role in the destruction of video tapes documenting the CIA’s use of enhanced interrogation techniques.6 In light of these actions, President Trump appears to be signaling his support for legalizing the Bush-era techniques applied to detainees arrested and interrogated during the war on terror. -

Allegiance can be used to define a singular national identity and common connection to a nation-state. In a global context, however, we need more dynamic conceptions to understand the importance of maintaining diversity and building allegiance with Thomas Paine and the Idea of Human Rights Holes in the Safety Net others outside borders. Scott Wadsworth Heaney Member, Board of Directors World Affairs Council of Connecticut Scott Wadsworth Heaney was born in Hartford Connecticut on June 3, 1973 and was raised in Glastonbury, Connecticut where he graduated from Glastonbury High School in 1992. From 1992-1996, Scott attended Springfield College in Springfield, Massachusetts earning a Bachelors of Science Degree in Psychology. While at Springfield College, Scott was the Student assistant to the Director of Alumni Relations, was a member of both the track and cross country teams, and was involved in numerous extra curricular activities on and off campus. Scott was also a founding member of the Springfield College Student Alumni Council and the Springfield College Veteran’s Day Committee. In 1993, Scott was accepted into the Marine Corps Platoon Leader’s Class Officer Candidate Program. Upon graduation, he was commissioned a Second Lieutenant in the United States Marine Corps. In September 1996, he reported to the Marine Corps Combat Development Command in Quantico, Virginia for The Basic School (TBS), a grueling six month officer development program which all Marine Corps officers must complete after after becoming a commissioned officer. Having graduated from the Basic Logistics Officer’s Course, The Landing Force Logistics Officers Course and the Joint Maritime Pre-positioned Force Staff Planner’s Course, Scott became a logistics officer and was assigned to his first duty station in California. In 1998, Scott reported to First Marine Corps Division in Camp Pendleton California to serve in the infantry battalion as the Assistant Logistics Officer for First Battalion First Marines (1/1). During his tour from 1999-2000, Scott’s battalion completed a six month deployment on the USS Peleliu operating in Korea, Thailand, United Arab Emirates, Saudi Arabia and conducting peace keeping operations in East Timor. -

This article discusses the laws governing Guantánamo's military commissions system and mental health evaluations. Notably, the US government initially treated detaineesas“unlawful enemy combatants” who were not protected under the US Constitution and the United Nations Convention Against Torture and Other Forms of Cruel, Inhuman or Degrading Treatment, allowing for the use of “enhanced interrogation techniques.” In subsequent legal documents, however, the US government has excluded evidence obtained through torture, as defined by the US Constitution and the United Nations Convention Against Torture. Using open-source document analysis, this article describes the reasons and outcomes of all forensic mental health evaluations from Guantánamo's opening to 2018. Only thirty of 779 detainees (~3.85%) have ever had charges referred against them to the military commissions, and only nine detainees (~1.16%) have ever received forensic mental health evaluations pertaining to their case. -

Persons still serving in the active armed forces may be accepted for membership provided that they meet eligibility requirements. Staff Column: Trump’s Sisyphean Task You all remember Sisyphus, history’s first rock star. Or maybe you don’t. He’s the king in Greek mythology who was condemned by some angry gods to roll a massive boulder all the way to the top of a steep mountain. The rock would immediately roll right back down and he’d have to start all over. For eternity. It is a slight overstatement to say that Donald Trump may be looking at Sisyphus with a touch of envy right about now, but the president-elect does face some daunting and hellish tasks. Chief among them is how to live up to his vow to ‘bring this country together.’ Sure, he now has a favorability rating of about 50%, way up from a few weeks ago. But that means about half the country still disapproves of Mr. Trump, and many of those folks will never, ever be swayed into thinking otherwise. Compared to Donald Trump, Barack Obama had a romantic and lusty honeymoon with the American people. Part of the Trump resistance comes from people who depend on government help, which is traditionally the domain of Democrats. About 100-million Americans receive some form of government assistance other than Medicare or Social Security. In other words, they’re ‘on the dole,’ to use a quaint expression that may now be considered hate speech. Welfare reform, enacted by Bill Clinton and Newt Gingrich, forced millions of Americans to find meaningful work, but the rules imposed by that law have been unraveled. ‘One of the most pernicious things that has happened in this country,’ Karl Rove lamented on The Factor this week, ‘is that President Obama has systematically and quietly undone a lot of what that welfare reform law did. -
