Marriage in the , also called matrimony, is the "covenant by which a man and a woman establish between themselves a partnership of the whole of life and which is ordered by its nature to the good of the spouses and the procreation and education of offspring", and which "has been raised by Christ the Lord to the dignity of a sacrament between them.

The Catholic Church has requirements before Catholics can be considered validly married in the eyes of the Church. A valid Catholic marriage results from four elements: (1) the spouses are free to marry; (2) they freely exchange their consent;

9/8/20 32 Validity of Marriage in the Catholic Church (3) in consenting to marry, they have the intention to marry for life, to be faithful to one another and be open to children; and (4) their consent is given in the canonical form, i.e., in the presence of two witnesses and before a properly authorized church minister. Exceptions to the last requirement must be approved by Church authority.

9/8/20 34 The Abbreviated Form of Marriage Nullity Cases Pope Francis reflected after the 2014 Synod on the Family that: "A great number of synod fathers emphasized the need to make the procedure in cases of nullity more accessible and less time- consuming, and, if possible, at no expense."

9/8/20 35 The Abbreviated Form of Marriage Nullity Cases "Putting the poor at the centre is what distinguishes the reform of Pope Francis." In the words of the : "Care is to be taken that everyone, parties or witnesses, can participate in the process at a minimum of cost."

9/8/20 36 The Abbreviated Form of Marriage Nullity Cases September 8, 2055: The matrimonial nullity trial reforms of Pope Francis are the reforms of Canon Law governing such trials. The reforms were effected: by two separate Apostolic Letters: Mitis Iudex Dominus Iesus (1983 CIC) Mitis et Misericors Iesus (CCEC)

Ø An automatic “Second Review" at the Appelate Court before nullity can be declared was eliminated. Ø Bishops now have the authority to declare nullity themselves, and in a more efficient manner. Ø The process should be gratis, as long as the Tribunal workers can still be paid a just wage. The Reforms took effect on December 8, 2015

Ø Very short duration of life in marriage Ø Both Petitioner and Respondent participate in the proceedings Ø A very clear Case of Marriage Nullity
