LEVY COLLECTION Order No. 06/13. The SASKATCHEWAN BARLEY DEVELOPMENT COMMISSION, pursuant to the provisions of The Barley Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 From each payment made to a producer for barley marketed, each buyer shall deduct a levy of 50 cents per net metric tonne, a fraction thereof on a pro-rated basis. 2 All deliveries are subject to the levy. 3 All buyers shall deduct the levy amount from any proceeds payable to or on behalf of the producer when barley is: (a) purchased from a producer; or (b) acquired from a producer for sale on the producer’s behalf. 4 Each buyer of barley shall forward to the office of the Commission the required levy along with a statement, using the form provided by the Commission, setting out the following: (a) the amount of barley obtained from the producer; (b) the amount of levy being paid on behalf of the producer; and (c) the name and address of the producer. 5 Subject to any directions given by the Commission, any buyer who collects a levy shall pay to the Commission the amount of the levy collected within 30 days from the end of the month within which the levy was collected. 6 Where the levy is not deducted by a buyer in respect of barley marketed by or on behalf of a producer, the producer may be held liable for payment of the appropriate levy to the Commission. 7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. 1788 THE SASKATCHEWAN GAZETTE, august 23, 2013

SCIENTIFIC RESEARCH Order No. 07/13. The SASKATCHEWAN BARLEY DEVELOPMENT COMMISSION, pursuant to the provisions of The Barley Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 The Commission may act as an agent for registered producers in matters related to the Scientific Research and Experimental Development (SR&ED) Program and the Saskatchewan Research and Development Tax Credit. 2 All SR&ED transactions by the Commission will constitute a transaction made by registered producers. 3 The appropriate percentage of levy contributions will be considered as a payment directly from registered producers to researchers and developers under the SR&ED. 4 The Commission shall: (a) Ensure registered producers have a preferential right to exploit the results of the SR&ED; (b) Have in place a committee comprised of organization executives and producer representatives for the purpose of determining the SR&ED projects that will be funded each year. Minutes must be maintained for each committee meeting. (The board of Directors may fulfill this capacity providing registered producers have representation on the board); (c) File an SR&ED claim each year on behalf of their members within six months of their fiscal year end to assist registered producers in receiving their tax credit entitlements on a timely basis; (d) For purposes of review, maintain books and records that identify the funds received and distributed for SR&ED, as well as minutes from meetings where SR&ED projects received funding authorization; (e) In cases where registered producers cannot determine the SR&ED contribution, provide that information when possible; (f) Provide each registered producer with information identifying the percentage of the total levy that was used to fund SR&ED in the year; and (g) Advise registered producers in which province the SR&ED was performed. 5 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. PRODUCER REGISTRATION Order No. 03/13. – The SASKATCHEWAN WHEAT DEVELOPMENT COMMISSION, pursuant to the provisions of The Wheat Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 Each producer shall be deemed to be registered with the Commission upon: (a) the deduction of a levy by a buyer; or (b) the provision of evidence to the Commission, in a form acceptable to the Commission, that the producer has sold wheat within the last two years. 2 A producer’s registration shall remain in effect until the producer ceases to pay levies for two consecutive fiscal years under the Plan. 3 Each producer shall inform the buyer of the business name under which the sale is made and the mailing address of that business. 4 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. REPORTING Order No. 05/13. – The SASKATCHEWAN WHEAT DEVELOPMENT COMMISSION, pursuant to the provisions of The Wheat Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 A buyer shall record for each month the total volume of wheat acquired by the buyer from each producer and report to the Commission, by the 30th of the month, the amounts determined for the previous month. 2 The Commission may request from a producer or buyer the following information: (a) the amount of wheat grown by a producer or to which the producer is entitled to under a crop-share arrangement; (b) the amount of wheat marketed by a producer and the details of the marketing; (c) the amount of wheat marketed by a producer and the manner in which the wheat was marketed; and (d) any such other general information relating to the production and marketing of wheat that the Commission requires to carry out the purposes of the plan. 3 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. LEVY COLLECTION Order No. 06/13. – The SASKATCHEWAN WHEAT DEVELOPMENT COMMISSION, pursuant to the provisions of The Wheat Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 From each payment made to a producer for wheat marketed, each buyer shall deduct a levy of 52 cents per net metric tonne, a fraction thereof on a pro-rated basis. 2 All deliveries are subject to the levy. 3 All buyers shall deduct the levy amount from any proceeds payable to or on behalf of the producer when wheat is: (a) purchased from a producer; or (b) acquired from a producer for sale on the producer’s behalf. 4 Each buyer of wheat shall forward to the office of the Commission the required levy along with a statement, using the form provided by the Commission, setting out the following: (a) the amount of wheat obtained from the producer; (b) the amount of levy being paid on behalf of the producer; and (c) the name and address of the producer. 5 Subject to any directions given by the Commission, any buyer who collects a levy shall pay to the Commission the amount of the levy collected within 30 days from the end of the month within which the levy was collected. 6 Where the levy is not deducted by a buyer in respect of wheat marketed by or on behalf of a producer, the producer may be held liable for payment of the appropriate levy to the Commission. 7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. Order No. 06/13 is made pursuant to clauses 7(1)(d) and (h) and section 23 of The Wheat Development Plan Regulations and shall be effective upon the date of this Order. SCIENTIFIC RESEARCH Order No. 07/13. – The SASKATCHEWAN WHEAT DEVELOPMENT COMMISSION, pursuant to the provisions of The Wheat Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 The Commission may act as an agent for registered producers in matters related to the Scientific Research and Experimental Development (SR&ED) Program and the Saskatchewan Research and Development Tax Credit. 2 All SR&ED transactions by the Commission will constitute a transaction made by registered producers. 3 The appropriate percentage of levy contributions will be considered as a payment directly from registered producers to researchers and developers under the SR&ED. 4 The Commission shall: (a) Ensure registered producers have a preferential right to exploit the results of the SR&ED; (b) Have in place a committee comprised of organization executives and producer representatives for the purpose of determining the SR&ED projects that will be funded each year. Minutes must be maintained for each committee meeting. (The board of Directors may fulfill this capacity providing registered producers have representation on the board); (c) File an SR&ED claim each year on behalf of their members within six months of their fiscal year end to assist registered producers in receiving their tax credit entitlements on a timely basis; 1794 THE SASKATCHEWAN GAZETTE, august 23, 2013

(d) For purposes of review, maintain books and records that identify the funds received and distributed for SR&ED, as well as minutes from meetings where SR&ED projects received funding authorization; (e) In cases where registered producers cannot determine the SR&ED contribution, provide that information when possible; (f) Provide each registered producer with information identifying the percentage of the total levy that was used to fund SR&ED in the year; and (g) Advise registered producers in which province the SR&ED was performed. 5 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. Order No. 07/13 is made pursuant to clause 7(1)(a) of The Wheat Development Plan Regulations and section 12 of The Agri-Food Act, 2004 and shall be effective upon the date of this Order.
