The seventy-five titles, including two unique pamphlet compilations, reveal Morris’s intellectual commitment to full citizenship, equality, and participation for people of color. The library also demonstrates the importance of book and pamphlet publication as means of community building among antebellum civil rights activists. -

DOWN BUT NOT OUT: HOW AMERICAN SLAVERY SURVIVED THE CONSTITUTIONAL ERA by JASON E. BUTLER Under the Direction of H. Robert Baker, Ph.D. ABSTRACT Whether through legal assault, private manumissions or slave revolt, the institution of slavery weathered sustained and substantial blows throughout the era spanning the American Revolution and Constitutional Era. The tumult of the rebellion against the British, the inspiration of Enlightenment ideals and the evolution of the American economy combined to weaken slavery as the delegates converged on Philadelphia for the Constitutional Convention of 1787. Even in the South, it was not hard to find prominent individuals working, speaking or writing against slavery. During the Convention, however, Northern delegates capitulated to staunch Southern advocates of slavery not because of philosophical misgivings but because of economic considerations. Delegates from North and South looked with anticipation toward the nation’s expansion into the Southwest, confident it would occasion a slavery-based economic boom. -

What we do know are the events that led to their arrival. African people were first brought to Massachusetts in 1638 as part of an exchange. The treaty that ended the Pequot War stated that the surviving Native American people were barred from living freely in their former territory. Some Native people were enslaved locally, others shipped to Bermuda. Enslaved African people were sent to the Massachusetts Bay colony in their place. Slavery and indentured servitude were common practices in all of the European colonies in the Western Hemisphere at this time. Massachusetts Bay Colony made slavery legal in 1638. In 1641 the Massachusetts General Court established the first legal code by colonists in New England. This code specified laws pertaining to the treatment of “servants,” a category that included enslaved people. In contrast with southern colonies, enslaved Africans in Massachusetts had rights that were delineated in the Body of Liberties. -

BARRY* Three themes have characterized death penalty abolition throughout the Western world: a sustained period of de facto abolition; an understanding of those in government that the death penalty implicates human rights; and a willingness of those in government to defy popular support for the death penalty. The first two themes are present in the U.S.; what remains is for the U.S. Supreme Court to manifest a willingness to act against the weight of public opinion and to live up to history’s demands. When the Supreme Court abolishes the death penalty, it will be traveling a well-worn road. This Essay gathers, for the first time and all in one place, the opinions of judges who have advocated abolition of the death penalty over the past half-century, and suggests, through this “law of abolition,” what a Supreme Court decision invalidating the death penalty might look like. -

Nature of the Request Historic Hudson Valley (HHV) is requesting $100,000 to develop a working prototype that demonstrates the integration of humanities ideas, digital technology, and public outreach for an online interactive documentary tentatively titled Slavery in the North. The website will shed light on the often-overlooked history of slavery in the colonial North, with a special focus on individual stories as a means to personalize the past.
