The Shi'ah and Islamic Disciplines IN THE NAME OF ALLAH, THE ALL–BENEFICENT, THE ALL–MERCIFUL ﻗﺎﻝ ﺍﷲ ﺗﻌﺎﱃ: ﴿ﺇﹺﻧﻤﺎ ﻳﺮﹺﻳﺪ ﺍﻟﻠﱠﻪ ﻟﻴﺬﹾﻫﺐ ﻋﻨﻜﹸﻢ ﺍﻟﺮﺟﺲ ﺃﹶﻫﻞﹶ ﺍﻟﹾﺒﻴﺖ ﻭﻳﻄﹶﻬﺮﻛﹸﻢ ﺗﻄﹾﻬﹺﲑﺍ. ﴾ Indeed, Allah desires to repel all impurity from you, O People of the Household, and purify you with a thorough purification. (Surat al–Ahzab 33:33). Prophetic traditions, mentioned in most reliable Sunni and Shiite reference books of Hadith and Tafsir (Quranic Exegesis), confirm that this holy verse was revealed to exclusively involve the five People of the Cloak; namely, Muhammad, Ali, Fatimah, al–Hasan, and al– Husayn, peace be upon them, to whom the term ‘Ahl al–Bayt (People of the House)’ is solely dedicated. The Messenger of Allah (s) said: “Verily, I am leaving among you two precious things [Thaqalayn]: The Book of Allah and my progeny [‘Itrah], the members of my Household [Ahl al-Bayt]. If you hold fast to them, you shall never go astray. These two will never separate from each other until they meet me at the Pond [hawd] (of Kawthar).” This holy tradition has been narrated, with different paraphrases, by numerous Sunna and Shī ‘ah Specialist and non-specialist media have projected unani tibb as a seamless continuation of Galenic and later West Asian ‘Islamic’ elaborations. In this thesis unani Jibb in early twentieth-century India is understood as a loosely conjoined set of healing practices which all drew, to various extents, on the understanding of the body as a site for the interplay of elemental forces, processes and fluids (humours). More specifically is the case in the implementation of the above method wherein the mujtahids were unable to get two hadiths incongruent over a particular issue, whereas there could never be contradictions amongst the hadiths. This paper examines the concept and application of al-Tawaqquf in Mukhtalif al-Hadith according to hadith scholars. The research is conducted via data collection methods sourced from literature review. Data from various major hadith compilations and the Ulum al-Hadith are analyzed based on deductive and inductive methods. The findings show that the al-Tawaqquf concept is based on several principles. Applying it becomes compulsory in the event of failure to resolve inconsistencies among hadiths. In those situations the mujtahid and his inability is blamed, and this does not absolve other mujtahids from continuing their efforts. This research also proves that the al-Tawaqquf methodology is not only one solution to solve the discrepancies amongst hadiths but is one of the methods engaged by hadith jurists when they cannot reconcile contradictions.

This study examines how Arabic poems and proverbs can be used as effective methods in the teaching and learning of Arabic to non-native speakers in Malaysia. It proposes that new and more innovative and effective methods should be introduced to replace the current conventional methods of teaching Arabic. The teaching of literature; i.e., Arabic poems and proverbs requires a passion for literature itself. When the passion for literature has been instilled, language learners will enjoy their literature courses, and find them to be easier than before they had this awareness. As a result of the learners‟ advancement and acquired appreciation, they are able to access the vast linguistic treasures Arabic literature has to offer and therefore, simultaneously improve their competence in Arabic.     THE IQTA' SYSTEM OF IRAQ UNDER THE BUWAYHIDS TSUGITAKA SATO* In 334 A. H. (946 A.D.), having established his authority in Baghdad, Mu'izz al-Dawla granted iqta's in the Sawad to his commanders, his asso- ciates, and his Turks. This is the formation of the so-called "military" iqta' system in the Islamic history. The appearance of the military iqta's brought about not only the evolution of the Islamic state, but also the transformation of the Iraqi society during the 10-11th centuries and of the other countries in the following periods. Nizam al-Mulk understood this as the change from bistagan (cash pay) to iqta',(1) while al-Maqrizi described as the change from 'ata' to iqta' in the same meaning.(2) As for the iqta' system under the Buwayhids, H. F. Amedroz first translated the Miskawayh's text into English with annotations,(3) and then C. H. Becker tried to realize the iqta' system in the history of 'Lehen' from the early Islamic period to the Ottoman Turks.(4) A. A, al-Duri, who studied the economic history of the Buwayhid Iraq, made clear the character of iqta' comparing it with milk (private land) and waqf, though the reality of iqta' holding remained to be investigated in future.(5) On the other hand, Cl. Cahen published the general survey of iqta' in the history of the Islamic land holding, which gave us usefull informations concerning the right and obligation of soldiers, and the fall of peasants by way of himaya (protection) and the loan at high interest.(6) We also find the general description of iqta' in the study of H.

In the first chapter I deal with the fixed punishments or Mal hududrl; four punishments are discussed: the punishments for theft, armed robbery, adultery and slanderous allegations of unchastity. The other two punishments which are usually classified as "hudud11, i.e. the punishments for wine-drinking and apostasy are dealt with in the second chapter. The idea that they are not punishments of "hudud11 is fully ex- plained. Neither of these two punishments was fixed in definite terms in the Qurfan or the Sunna? therefore the traditional classification of both of then cannot be accepted.

Umer Chapra1 Abstrak Perdebatan masalah riba seperti tidak pernah selesai di diskusikan oleh banyak kalangan, baik akademis, organisasi keagamaan, bahkan sampai pada forum-forum intenasional. Beberapa terminologi dibahas dengan baik dalam tulisan ini yang dimulai dengan pelarangan riba itu sendiri kemudian pembagian-pembagian riba, diantaranya riba al-Nasi’ah dan riba al-Fadl, serta implikasi dari dua bentuk riba tersebut. Pembahasan didukung dengan pendapat-pendapat para ulama dan ekonom yang merujuk langsung dari ayat-ayat al-Qur’an, sampai pada perdebatan hukum. Demikian juga al-Qur’an sangat jelas membedakan antara riba dan perdagangan, namun pelarangan riba sangat jelas bahkan diperkuat dengan hadits-hadits yang dengan eksplisit melarang riba. Dijelaskan pula tentang perbedaan antara riba dan bunga bank.
