Abigail Wilder Boatwright ABIGAIL WILDER BOATWRIGHT FC1 Our mission Our mission at the American Paint Horse Association (APHA) is to collect, record and preserve the pedigrees of American Paint Horses, and to stimulate and regulate all matters pertaining to the promotion, history, breeding and exhibition of this breed. Our success depends on our ability to provide fiscally responsible and efficient services to our members. We aspire to excellence in recordkeeping, reporting, recruiting, educating and supporting our membership, so that we may inspire confidence and create in them a desire to use our services. APHA serves both the breed and our members by being aware of the industry and market, and of the needs, opportunities and challenges of our members. The theme of my presentation was the importance of the Associa- tion reaching out and connecting with people who love Paint Horses. Your APHA employees are committed to staying connected with our members, potential members and Regional Clubs as we move forward in another year of a troubled economy. We want you to know that your Association is a healthy organization within the horse industry and we will see that it stays that way by stimulating Association programs, activities and services with innovative ideas. We will accomplish this by generating new revenue opportunities and continuing to cut expenses. As we go through this next year, we urge you to not underestimate the value of your membership. In 2009, one of our main goals was to bring new benefits to our members and we are proud of the progress we have made. APHA began offering members a new series of benefits including a free pharmacy card and a choice of four health and lifestyle discount plans, plus a suite of insurance products. These are all in addition to many other great existing benefits, such as discounts and incentives through our corporate sponsors and preferred rates on APHA transactions. But perhaps the most rewarding aspect of your membership is the knowledge that your dollars and participation are helping to advance the American Paint Horse breed. In 2009, we reached out to our Regional Clubs with two new sponsor-supported programs. Purina Mills provided cash and prizes to clubs for hosting social/educational activities at Zone shows. The New Holland tractor raffle program allowed clubs to sell raffle tickets and receive 50 percent of the proceeds for their Youth activities. In 2010 Regional Clubs will again have an opportunity to generate additional funds through the New Holland sponsorship. New Holland is donating a Rustler all-terrain utility vehicle for clubs to use as a raffle item. Regional Clubs will once again receive 50 percent of the proceeds from the sale of each ticket. As we look ahead, we see another year of financial challenges. But these challenges make us work smarter and provide new definitions of what it means to grow. These are the times that teach us the most and prepare us best for the future. We continue to grow in wisdom, resourcefulness, creativity, perseverance, unity. We remain a viable organization and are taking steps to secure a healthy future for our Association and the horses we love. I extend a hand to you, our members, to thank you for your continued loyalty and dedication, and to you, our potential members, to ask you to join our Paint Horse family. You will be connecting with a network of people who share your passion and together, we can do great things. Sincerely, Lex Smurthwaite APHA Executive Director 2 A Message from the President It is hard to believe another year has come and gone, but here we are at the beginning of another calendar year, which finds me in the middle of my one-year term as president of the American Paint Horse Association. It never ceases to amaze me how time flies. As we embark on another new year, it is much like starting out each new day—we have decisions to make as to how we will spend our time, money and energies. Undoubtedly, the attitude we take each day affects absolutely everything we do. And so it is with our Association. A new year has dawned and we face new challenges, opportunities and possibilities as we go about each day, week and month conducting our business. As with other businesses and associations, APHA has had to make adjustments in these tough economic times. While we have limited control over what is going on in today’s world economically, we have much control over how we approach and plan for our future, and rest assured we are making smart decisions to keep our Association healthy. This past year we listened to member feedback and expanded our Fall Show to include world championship classes, making our World Championship Show a two-part series. The result—two solid shows designed to best meet the needs and requests of our members. The series kicked off with the Summer World Show, which featured all Youth classes as well as Open and Amateur reining and cattle classes, and culminated with the Fall World Show that included the remainder, and majority, of the Open and Amateur classes plus the exciting slot, challenge and sweepstakes classes. This show also debuted the much-anticipated Breeders’ Futurity classes. We must be doing something right—I am happy to report that the numbers for the Fall World Show exceeded expectations. As you can see, we are working hard to bring you the best possible combination of past successes and new ventures. We had a memorable and enjoyable Convention in Colorado Springs in October, complete with a trail ride, dinner, auction and therapeutic riding demonstration—all compliments of the Foundation. Of course, business was conducted and important decisions were made, such as electing our new Executive Committee, voting on rule changes and recognizing our exemplary Regional Clubs. Speaking of Regional Clubs, one of the areas we will be focusing on in 2010 is enhancing communication with our clubs and helping them to become better and stronger by providing them with their own Web site which can be accessed through the APHA Web site. We have also reinstalled the Regional Club standing committee; not to deal with governance issues so much as to assist clubs in communicating and building better relationships within, as well as building their membership numbers. We are making great efforts to provide more benefits for your membership, enhance programs and provide the wonderful customer service that our members deserve. Of course, our lifetime members enjoy the maximum benefits in return for their dedication and loyalty to our great breed. And the word is out—I am thrilled to report that our lifetime memberships increased 6.1 percent this year. Stay tuned in to the Web site and all of our print and on-line publications to learn more about new programs available to members. Remember that you have the opportunity to choose the type of day, week, month and year you will have simply by the attitude you take. Choose a positive, upbeat attitude toward your horse activities and let it carry over into your shows, gatherings and club meetings. Thank you for being a part of our great organization. I encourage you to recruit others to join us, as well, so they can experience the fun, excitement and fulfillment of being a member of the APHA family. Bogdanos and Todd Anten of Quinn Emanuel Urquhart & Sullivan, LLP for Pro-Football, Inc. _____ Before Kuhlke, Cataldo and Bergsman, Administrative Trademark Judges. Opinion by Kuhlke, Administrative Trademark Judge: OVERVIEW Petitioners, five Native Americans, have brought this cancellation proceeding pursuant to Section 14 of the Trademark Act of 1946, 15 U.S.C. § 1064(c). They seek to cancel respondent’s registrations issued between 1967 and 1990 for Cancellation No. 92046185 trademarks consisting in whole or in part of the term REDSKINS for professional football-related services on the ground that the registrations were obtained contrary to Section 2(a), 15 U.S.C. § 1052(a), which prohibits registration of marks that may disparage persons or bring them into contempt or disrepute. In its answer, defendant, Pro-Football, Inc., asserted various affirmative defenses including laches.1 As explained below, we decide, based on the evidence properly before us, that these registrations must be cancelled because they were disparaging to Native Americans at the respective times they were registered, in violation of Section 2(a) of the Trademark Act of 1946, 15 U.S.C.

“We All Have a Part to Play”: Salvage Tourism in American Indian Historical Pageantry A DISSERTATION SUBMITTED TO THE FACULTY OF THE UNIVERSITY OF MINNESOTA BY KATRINA MARGARET-MARIE WILBER PHILLIPS IN PARTIAL FULFILLMENT OF THE REQUIREMENTS FOR THE DEGREE OF DOCTOR OF PHILOSOPHY Adviser: JEAN O’BRIEN MAY 2015 Acknowledgements I am, like my father, often stubborn and independent. However, as I have been reminded time and time again throughout this humbling and gratifying journey, I just can’t do it alone. First and foremost, there is my adviser, Jeani O’Brien, who has read every single word I have ever written – many of them multiple times over. I am eternally grateful for the ways in which she has motivated me, encouraged me, and guided me throughout my graduate school career. I can never repay her for the time she has dedicated to me, and I thank you from the bottom of my heart. David Chang has pushed me to challenge myself and expand my horizons, which has made me a better scholar. I thank David as well as Kat Hayes for serving as my reviewers, and their feedback was instrumental in shaping this final product. Kevin Murphy and Brenda Child have also kindly served on my committees, and I truly appreciate their time and insight. Barbara Welke’s comments during my preliminary exams urged me to look beyond the scope of my initial research. Any errors in the final product, though, are mine and mine alone. The American Indian and Indigenous Studies Workshop has been my academic home since my first year of graduate school – and special thanks to Boyd Cothran, who helped me with my senior undergraduate thesis and my graduate school applications.

  • Native American Mascots: Pride Or Prejudice?
http://inamerica.blogs.cnn.com/2013/04/04/native-american-mascots-pride-or-prejudice/ April 4th, 2013 Native American mascots: Pride or prejudice? By Moni Basu, CNN (CNN) – Suzan Shown Harjo remembers when she walked into a store with her grandfather in El Reno, Oklahoma. She wanted to get something cool to drink on a summer day. It was the early 1950s and the storekeepers told the 6-year-old she had to leave. “No black redskins in here,” they said. At that moment, Harjo felt small, unsafe, afraid. Because she was a dark-skinned Native American – Cheyenne and Hodulgee Muscogee – she was being identified by just her coloring. She wasn’t even a whole human being. Not even her grandpa, whom she saw as all-powerful, could do anything to protect her. Later in her life, that incident made her angry. Angry enough for Harjo to launch a lifelong mission to protect her people. Part of her work took aim at sporting teams that use Native Americans as mascots. With the start of the baseball season this week, some of those teams have been front and center. The Cleveland Indians, for instance, feature a smiling Indian dubbed Chief Wahoo, criticized by Native Americans as a racist caricature. The most offensive example of a mascot, says Harjo, is the one used by Washington’s football team. She has been fighting for years to get the Redskins to change their name. The R-word – she can’t even bring herself to say it – is the same as the N-word, says Harjo, president of Morning Star Institute, a national Native American rights organization.
