TEDISCO: “GOVERNOR SPITZER, YOU ARE SERVED!” Outlines lawsuit that will be filed tomorrow morning to try and stop Governor Spitzer’s unlawful plan to give illegal aliens driver’s licenses from going forward

In anticipation of Governor not rescinding his unlawful plan to give illegal aliens driver’s licenses, Assembly Republican Leader (R,C,I-Schenectady-Saratoga) today said he will file a lawsuit to stop the plan from going forward.

The lawsuit – which will be filed in State Supreme Court in Albany County tomorrow morning – is being brought on behalf of Assemblyman Jim Tedisco and members of the Assembly Republican Conference. The suit will list five causes of action.

First, that Governor Spitzer’s plan is in violation of Section 502 of the State Vehicle and Traffic Law, which indicates that the Commissioner of the Department of Motor Vehicles shall require a Social Security number before issuing a driver’s license.

Second, that Governor Spitzer’s plan defies the principle of separation of powers between the Executive and Legislative branches as outlined in Articles I and II of the State Constitution.

Third, that Governor Spitzer’s plan does not follow proper administrative procedure in the manner in which it failed to provide New Yorkers with notice and an opportunity to be heard, as required under the State Administrative Procedure Act.

Fourth, that Governor Spitzer’s plan impairs the legislative intent behind an amendment to the State Vehicle and Traffic Law’s Section 502, which was to enhance the state’s ability to enforce child support obligations.

Finally, that Governor Spitzer’s plan would impair ’s ability to share driver information with other states.

“Regrettably, all signs point to Governor Spitzer not rescinding his unlawful proposal to give illegal aliens driver’s licenses. Governor Spitzer has left our Conference with no choice than to file a lawsuit against him and David Swarts, Commissioner of the State Department of Motor Vehicles, to try and stop this unlawful plan from proceeding,” Tedisco stated.

“This lawsuit is not something I or my colleagues entered into lightly – we gave it serious thought and consideration. We are going forward because we truly believe – as do 72 percent of New Yorkers – that Governor Spitzer’s plan, which was crafted unilaterally, in near secrecy with no input from the public or legislature, is unlawful and, if implemented, would make our state and nation a less secure, less safe place,” Tedisco said.

“Our lawsuit has one goal and one goal only – preventing Governor Spitzer’s illegal plan from becoming a reality. We will use every means at our disposal – legislative, legal and otherwise – to stop the Governor’s plan,” Tedisco concluded.

STATEMENTOF FACTS

1. Plaintiff,James N. Tedisco is a memberof the NewYork State Assembly, representingthe 110'nAssembly District, and has beena Memberof the New YorkState Assembly continuously since 1984.

The defendant,Eliot Spitzer (hereafter referred to as the "Governor"),is currentlythe Governorof the Stateof NewYork havinqtaken office on January1,2007.

A a- The defendant,David Swarts (hereafter referred to as the "Commissioner"),is the Commissionerof the NewYork State Department of MotorVehicles (DMV),having been appointed by the Governor-electSpitzer on December 21,2006and having taken office on January1,2007.

6 The DMV issues,from DMVoffices and from offices run by electedCounty Clerks,who act as agentsfor the Commissioner,driver's licenses and non- driver identification cards.

6. The statutoryrequirement for the submissionof proofof identityis contained in thethird sentence of Vehicle& TrafficLaw $502 (1)which states, "The applicantshall furnish such proof of identity,age, and fitness as maybe requiredby the commissioner".

7. Duringthe 1994-95Legislative Session, plaintiff, James N. Tedisco, and other plaintiffsvoted in the affirmativeon Assemblybill A7984-A, which was enactedas ChapterB1 of the Lawsof 1995.This law amended Vehicle & TrafficLaw$502 (1)to add the sentence, "ln addition, the commissionershall alsorequire that the applicantprovide his or hersocial security number".

B. The sectionof the NewYork Code of Rulesand Regulationspertaining to the socialsecurity number requirement (15 NYCRR 53 9) was lastamended on December11 ,2002. That section states that an applicantfor a licenseor non- driveridentification card or an applicantseeking to reneweither must submit hisor hersocial security number or provideproof that he/she is ineligiblefor a socialsecurity number.

9. Paragraph(b) of section3.9 states that a personwho fails to submita social securitynumber or proofof ineligibilityfor samewill be disqualifiedfrom renewingor obtaininga driver'slicense or identificationcard.

10.The current DMV Application for DriverLicense or Non-DriverlD Card,MV-44 (9107)provides a spacefor the applicant to fillin hisor hersocial security numberand contains the notice,"You must provide your SSN. Authority to collectyour SSN is grantedby Sections490.3 and 502 of theVehicle and TrafficLaw. The informationwill be usedonly for exchangewith other iurisdictions.to assist in verificationof identitv,and to invokedriver license

") sanctionspursuant to V&T LawSection 510(4-e). Your number will not be givento the public,or appearon anyform or informationrequest".

11. Paragraph (c) of 15 NYCRRS3.9 states, "The acquisition of socialsecurity numbersof suchlicensees and identification card holders will permit the deparlmentto moreaccurately exchange driver's license data with police agencies,other states and the federal government. The social security numbersubmitted will not be printedon the driver'slicense or identification carddocument. The social security number will not be a publicrecord and will notbe madeavailable to the public.

12.Onor aboutSeptember 21,2007, the defendantsannounced that they have changedstate policy, effective immediately, to now permitthe NewYork State Departmentof MotorVehicles (DMV) to issuedriver's licenses to applicants whodo nothave valid Social Security Numbers, without requiring those applicantsto provideproof of ineligibilityfor a SocialSecurity Number. The DMVannounced that it willstart issuing those licenses at the endof 2007- A copyof the defendants'press release on this policychange is attachedhereto as Exhibit"A". ln the pressrelease, the first sentence of the lastparagraph, at the bottomof page2, states,"State law requireslicense applicants to prove theiridentity, date of birthand fitness to driveand to providea socialsecurity number(SSN)"

.13.Priortothe policychange no newstate lawwas enacted, no newrule or regulationwas filedwith the NewYork State Secretary of State,nor was any noticeof rule-makingpublished in the StateRegister or otherwisenoticed'

14.TheDMV website (http://www.nvdmv.state.nV.usllicensure.htm) contained informationfor licenserenewal applicants who havean expiredNew York Statedriver license and who were unable to renewsuch license because the driverdid nothave either a validsocial security number (SSN) or a letterof SSNineligibility. In response to the question,"What proof of identitydo I need to renewmy Oiiverlicense?" listed as a FrequentlyAsked Question (FAO)' ihe DMVresponse is as follows:"lf you cannotprovide an SSNor a letierof SSNineligibility, you mustprovide a currentand valid passport and other acceptableproofs of identity.lf you do not havea passport,or your passport is expired,contact your consulate or embassyto geta validpasspotl". A copy of the DMV FAQson thissubject is attachedhereto as Exhibit"8"'

15.TheDMV prepared a letter,dated September 24,2007, and an accompanyingtwo-page explanation. Upon information and belief,this letter wassent to individualswho were unable to renewtheir drivers' licenses becausethey did not provide DMV with a validSSN or letterof SSN "C". ineligibility.iopies of thesedocuments are attached hereto as Exhibit The lastline of the secondpage of the explanationstates, "From now on, licenseapplicants will check a boxon the licenseapplication that states that the applicantis noteligible to receivea SocialSecurity number and insteadof presentinga SSNor a letterof ineligibilitywill instead provide a current foreignpassport and othervalid and vei'ifiable documents to proveidentity. '16. By administrativeaction, the DMVhad previously devised a pointsystem for applicantsto documenttheir age and identity ("Point system"). under the pointsystem, certain specified documents are assigned cedain point values, andthe applicantis requiredto producea minimumof six(6) points of acceptabledocuments in theaggregate.

17.|npresenting its plan to theCounty Clerks, DMV indicated that the newpolicy wouldexpand the listof documentsthat would be assignedpoint values underthe PointSystem to include:foreign passports, foreign birth certificates, Canadianor MexicanBorder Crossing cards, parole papers, deeds, and other documents.Previously, foreign source documents were assigned no points as the DMVcould not verify their authenticity.

lB.section508 (2) of theVehicle & TrafficLaw states, in applicablepart, "The applicantshall furnish all information required by statuteand such other informationas the commissionershall deem appropriate".

19. Fromabout December 2003 until the implementationof the newpolicy, the DMV,under an agreementwith the SSA,exchanged data regarding license holdersand applicants, cross-referencing license, cardholder and applicant datawith the SSA'sdatabase to ensurethat SSNs matched.

20.Accordingto DMVstatements in 2005,as a resultof the SSNverification process,it hasdiscovered numerous uses of falseidentities which were in turnused to commitfraud, drive illegally because of otherlicense revocatrons, andhide criminal convictions and to avoidchild support obligations.

2l.Accordingto the Commissioner,of theten millionor moreNew York State licenseand cardholder records, about 600,000 were reporting as not matchingSSA records. After notice to the licenseand cardholders that their licensesor cardswould be suspendedand an opportunityto correct information,that numberwas reduced to about120,000. lt isthese 120,000 formerlicense or cardholdersthat are the subject of the Commissioner's invitationto nowseek to renewtheir licenses or cardswithout submittinq valid SSNsor proofof ineligibility.

22.1na pressrelease issued October 27,2007, ihe Governorannounced that NewYork State will continue to moveforward with its planto license undocumentedimmigrants, but will now implement that policy in tandemwith the implementationof modified REAL lD regulations.

4.- 23.The major differences between the October27 ,2A07 policy announcement andthe September21,2007 policy are: ('1) that New York State will begin to offeran "EnhancedDriver's License that would allow holders to crossthe U.S.- Canadianborder without a passportunder the Western Hemisphere Travellnitiative; (2) New York will offer a REALlD compliantdriver's license to thoselawfully present in the U.S.and residingin the state;and (3) New Yorkwill issue a driver'slicense that will not comply with the federal Real lD Actwhich will bear a legend,"Not for U.S.government purposes".

24.Theother significant difference in the policyannouncements is thetimetable for implementation"The "Q & A" documentaccompanying the pressrelease indicatedthat the policychange to issueNew York driver's licenses to undocumentedimmigrants will be implementedtogether with the REALlD program,most likely in late2008. A copyof the pressrelease and the accompanyingQ & A areattached hereto as Exhibit"D""

25.No otherchanges in the policy'scriteria for issuanceof driver'slicenses to undocumentedimmigrants were announced.

26.TheGovernor did notannounce any plan to seeklegislative changes, nor was thereany announcement that the stateruling-making process would be followed.

27. As to the newtypes of federallycompliant driver's licenses, the Q & A states, "Thechanges to complywith these laws do notrequire Legislative approval, butcan be accomplishedusing DMV's authority to definehow licenses are issued.pursuant to existinqstatute".

AS AND'O* O FIRSTCAUSE OF ACTION

28.Defendants, by the announcementand implementationof their new policies, havecompletely disregarded the explicitlanguage of section502 (1) of the Vehicle& TrafficLaw, enacted as ChapterB1 of the Lawsof 1995,which compelsthe Commissionerto requirethat applicants for a driver'slicense submithis or herSocial Security Number.

29. By so doing,the defendants have nullified the plaintiffs'votesin favorofthe legislationthat became Chapter Bl of the Lawsof 1995.

30.By theiractions, the defendants have violated the NewYork State Constitution,Article 3, S1,which vests the legislativepower in thestate to the Assemblyand the Senate.

-5- AS ANDFOR A SECONDCAUSE OF ACTION

31. The DMVby promulgating15 NYCRR93.9 ignored the expresslanguage of Vehicle& TrafficLaw $502 (1) ihat compels the Commissionerto require applicantsfor driver's licenses to submittheir social security numbers.

32.Thestatute does not providean alternativeto the requirementand it was not withinthe powerof the DMVto do so.The appropriatecourse of actionwould be forthe DMVto havesubmitted an agencybill for consideration by the legislature.

33.8ypromulgating and adopting such regulation, the DMVacted arbitrarily and capriciouslyand violated the NewYork State Constitution, Article 3, S1,which veststhe legislativepower in the stateto theAssembly and the Senate.

AS ANDFOR A THIRDCAUSE OF ACTION

34.Assumingarguendo that 15 NYCRR$3.9 was lawfullypromulgated, the defendantsacted arbitrarily and capriciously and engaged in unlawfulrule- makingin violationof the NewYork State Constitution, Article lV, 58 andthe StateAdministrative Procedure Act by not filingthe proposednew rulewith the Secretaryof Stateand by not followingthe proceduresoutlined in SAPA 5203and the by ignoringand effectively repealing that rule's requirement thatapplicants for driver'slicenses submit their social security numbers or provideproof that he or sheis noteligible for a SSN.

35.Thedefendants further acted arbitrarily and capriciously and engaged in unlawfulrulemaking by failingto enforceand effectivelyrepealing the provisionsof 15 NYCRR53.9 (b) which states that a personwho fails to submithis or herSSN or proofthat he or sheis ineligiblefor a SSNis disqualifiedfrom renewing or obtaininga driver'slicense.

36.Thedefendants further acted arbitrarily and capriciouslyand engaged in unlawfulrule making by failingto enforceand effectively repealing the provisionof 15 NYCRRS3.9 (c) which states that social security numbers will permitthe DMVto moreaccurately exchange driver's license data with nnlino agencies,other states and the federal government.

37.Thedefendants acted arbitrarily and capriciously in thatthe new"policies" havebeen promulgated by the Governorwho hasbeen granted no rulemakingauthority over DMV matters by the Legislatureand has not been grantedany authority to interpretDMV rules and regulationsby the courts. AS AND FORA FOURTHCAUSE OF ACTION

38.Defendants, by theirpolicy changes, have acted arbitrarily and capriciously in thatthey have or willthwad the legislativepurpose and intent behind the 1995amendment to Vehicleand Traffic Law $502 (1) by makingit easierfor individualsto obtaindriver's licenses without first securing SSNs thereby makingenforcement of childsupport obligation of thoseindividuals more difficult.

AS ANDFOR A FIFTHCAUSE OF ACTION

38. Defendants,by theirpolicy changes, have acted arbitrarily and capriciously in thatthey have or willthwart the legislativepurpose behind Vehicle and Traffic Law$5'16, our Driver License Compact, in thatthey will impair our ability to exchangeinformation to ascertainwhether individuals have held driver's licenses in otherjurisdictions or whetherthey were convicted of disqualifyingoffenses.

WHEREFORE,plaintiff respectfully prays for judgment against the defendants as follows: 1) An orderdeclaring that the defendants, by eliminatingthe requirementthat applicantsfor driver'slicenses submit a validSSN or proofof ineligibilityfor same,acted in violationof the NewYork State Constitution, Art lll, S1,without statutoryauthority and enjoining them from implementing their new "policy"; 2) An orderdeclaring that the defendants, by adoptingtheir new "policy" have doneso in violationof the rule-makingrequirements of SAPA5203 and the NewYork State Constitution, Article lV, 58; 3) An awardof plaintiff'sreasonable costs, litigation expenses and attorneys fees;and 4) A grantof suchother and further relief as the courtdeems just, proper and equitable.
