PROJECT DESCRIPTION AND LOCATION

San Dieguito Lagoon is located within the San Dieguito River Valley in the City of San Diego, San Diego County, California (Attachment A and B contain report and bibliographic information). The San Dieguito Lagoon W-19 Restoration Project (proposed project) would be located within San Dieguito Lagoon, east of lnterstate 5 (I-5), south of County Highway S6, and west of El Camino Real (Figure 1 and 2; figures are attached to this report as Attachment C). The proposed project site (W-19) is located within lands owned by the San Dieguito River Park Joint Power Authority (JPA), California Department of Fish and Wildlife, the 22nd Agricultural District, and the City of San Diego, and is within the Focused Planning Area of the San Dieguito River Park.

The proposed project would restore approximately 141 acres to a functional mix of tidal salt marsh, brackish marsh, and transitional/upland habitats (Figures 3 and 4; Attachment C). Tidal salt marsh habitat would be created west of the existing utility corridor and brackish marsh habitat east of the utility corridor. Upland/transitional habitats would be placed adjacent to wetland habitat to support the ecological function of the restoration project. An existing utility corridor would be enhanced (e.g., through planting with transitional habitat consisting of low- growing, native species that would be maintained by San Diego Gas & Electric) as part of the proposed project.

Approximately 60 acres of tidal salt marsh would be created west of the existing utility corridor and south of the San Dieguito River. Tidal connection with the river would be constructed at the west end of the project site in the vicinity of the existing least tern nesting island. An upland terrace berm planted with a mix of transitional and upland habitat would be constructed between the salt marsh and the San Dieguito River channel to protect the wetlands from damage due to flood and sedimentation, and to maintain sand movement through the river channel. Protection from erosion within the site would be provided along the utility corridor as well as at the outlet of the existing stormwater culvert extending under El Camino Real.

East of the existing utility corridor, approximately 15 acres of brackish marsh would be created as part of the proposed project. An open water channel from the San Dieguito River would be constructed through the brackish marsh area. Similar to the salt marsh area, an upland terrace berm planted with coastal sage scrub would be constructed between created brackish marsh habitats and the San Dieguito River channel. The upland terrace berm would be designed to protect the wetlands from damage due to flood and sedimentation, and to maintain sand movement to the ocean.

Implementation of the proposed project would require relocation of the existing 69-kilovolt electrical line and poles that extend through the W-19 site. The City of San Diego is planning to underground that segment within existing and planned roadways in the future, but if timing requires relocation prior to that planned implementation, the proposed project would coordinate

San Dieguito Lagoon W-19 Restoration Project Page 1 Archaeological Resources Report the relocation to incorporate the line along the existing utility corridor, either within the corridor easement or by increasing the easement up to 20 feet, if necessary. The electrical line would then be redirected along El Camino Real west to reconnect with the system extending south of the W-19 site. In this scenario, the City may underground the electrical line as part of the future project.

Habitat restoration activities would include excavation of material to lower elevations and opening of the area to tidal and/or river influence. Excavated material and excess sediment removed during restoration would be transported for disposal either on-site or off-site. There are two potential disposal sites; one site is on City of San Diego land south of the project (on-site, shown in Figure 3) and the other site is Miramar Landfill (off-site).

The proposed project would also include construction of a new trail adjacent to El Camino Real. This new trail would extend north from the existing Dust Devil Nature Trail (previously identified as the Mesa Loop Trail in the Park Master Plan) to provide increased recreational opportunities in the lagoon. In addition, a maintenance road extending west from the utility corridor would be constructed within the upland terrace berm to provide access to the salt marsh and existing least tern nesting island.

Because of federal and local discretionary actions, the proposed project requires evaluation pursuant to both the California Environmental Quality Act of 1970 (CEQA) and the National Environmental Policy Act of 1969 (NEPA). As primary landholder, the JPA is the state lead agency responsible for compliance with the CEQA statutes (Cal. Pub. Res. Code § 21 et seq., as amended) and implementing guidelines (Cal. Code Regs., Title 14, § 15000 et seq. (1998). The JPA, as lead agency, and San Diego Association of Governments, as a responsible agency, have jointly prepared the Environmental Impact Report (EIR). The U.S. Army Corps of Engineers is the federal lead agency responsible for compliance with NEPA (42 United States Code § 4332 [1994]) in accordance with the Council on Environmental Quality regulations implementing NEPA (40 Code of Federal Regulations [C.F.R.] §§ 1500–1508).

This Archaeological Resource Report was prepared in support of the proposed undertaking’s environmental compliance with CEQA, NEPA, and Section 106 of the National Historic Preservation Act. Because the proposed project is located within City of San Diego lands, this document was prepared according to City of San Diego format and content guidelines (City of San Diego 2001). This report details the methods and results of the records search and literature review, the archaeological survey, and the efforts to coordinate with Native American representatives (survey photos are found in Attachment D). Recommendations to mitigate impacts to unanticipated archaeological resources are also provided. Resumes of key project personnel are included as Attachment E.

NATURAL ENVIRONMENT

Paleoenvironmental Setting

The early Holocene was a time of environmental transition, with a number of global climatic trends resulting in biotic and habitat adjustments in coastal Southern California. While temperatures in the Northern Hemisphere were characterized by pronounced warming in the early Holocene (West et al. 2007), local climates in the San Diego area may have been relatively cool and wet due to the influence of coastal fog produced by upwelling and the resultant cold sea surface temperatures (Pope et al. 2004). In general, however, the early Holocene was a time of climatic warming in coastal California, resulting in a number of changes to biotic communities, most prominently, the retreat of coniferous forests and the expansion of oak woodland throughout most of the region.

The most significant environmental change at this time, however, was likely the stabilization of sea levels. By the time people first arrived at what is now the project area, sea levels had been rising rapidly for several thousand years, pausing only briefly at about 11,500 years before present (B.P.) for the Younger Dryas re-glaciation and again for another global cooling event at about 8200 B.P. (Masters and Aiello 2007). This rapid transgression flooded coastal drainages during the early Holocene, resulting in a series of deep embayments along the coast of what is now San Diego County. Current data suggest, however, that the sea level rise, which had reached maximum rates of 2 to 4 meters (m) per century, began to stabilize by about 8,000 years ago, and approached the current level by about 6000 B.P. This slowing of the transgression allowed the accumulation of sediment at the lagoon margins, resulting in a complex mosaic of biotic habitats that provided prehistoric populations with a wide array of marine, riparian, and terrestrial resources.

The middle Holocene climate in coastal Southern California was marked by pronounced warming and increased aridity between approximately 7800 and 5000 B.P. (Carbone 1991), which was consistent with a broader warming trend seen elsewhere during this interval. This was followed by a cool, moist interval that persisted until approximately 2,000 years ago in coastal Southern California (Davis 1992).

Due largely to their more recent occurrence, climatic changes in coastal Southern California during the past 2,000 years are much better understood. Among the clearest of these records is a 1,600-year tree-ring record reported by Larson and Michaelson (1989) for the Transverse Ranges, and the pollen record from San Joaquin Marsh. During the early portion of their sequence (A.D. 500 to 1000), Larson and Michaelson record relatively high variability in yearly precipitation totals. During the first 150 years of the reconstruction, approximately A.D. 500 to 650, climatic conditions were characterized by moderately low precipitation levels. This period was followed by very low rainfall levels, which lasted from approximately A.D. 650 to 800. Extreme drought was experienced between approximately A.D. 750 and 770. The succeeding

San Dieguito Lagoon W-19 Restoration Project Page 3 Archaeological Resources Report 200 years, approximately A.D. 800 to 1000, were a sustained high-interval period of rainfall unmatched in the entire 1,600-year reconstruction.

Paleoclimatic records from a wide variety of contexts consistently indicate that the period between approximately 1,000 and 700 years ago (A.D. 1000 to 1300) was characterized by generally higher temperatures and periods of extreme drought. This event, known as the Medieval Warm Period or the Medieval Climatic Anomaly, has received considerable attention, due both to the apparent severity of the droughts and to its apparent coincidence with important cultural changes described throughout the prehistoric archaeological record of California (Jones et al. 1999; Raab and Larson 1998). Evidence of severe drought and increasing temperatures at this time is documented for the Sierra Nevada area by Stine (1990, 1994) and Graumlich (1993), and is documented along the Southern California coast by Larson and Michaelson (1989). Larson and Michaelson’s (1989) data indicate that the interval between approximately A.D. 1100 and 1250 was one of continued drought, particularly between about A.D. 1120 and 1150.

According to the geotechnical report prepared for the proposed project, much of the area is covered in young alluvium (Geocon Inc. 2014). This young alluvium most likely overlays buried stable surfaces, particularly near the margins of the lagoon, that could contain archaeological sites.

Existing Natural Setting

The proposed project is located in southwestern San Diego County, approximately 2.3 kilometers (1.4 miles) east of the Pacific Ocean, west of El Camino Real and south of the San Dieguito River within the San Dieguito River Valley (see Figures 1 and 2). Elevation ranges from 7 feet to approximately 237 feet above mean sea level. Prehistorically, for at least some period of time, the river area undoubtedly contained a more substantial estuary or lagoon including fresh and/or saltwater marshes and is now called San Dieguito Lagoon. The local climate is semiarid and cool with less than 10 inches of annual rainfall, daily average maximum temperatures in July of less than 75 degrees Fahrenheit (° F), and January minimum daily temperatures averaging around 44° F. The property is geologically characterized by recent river alluvium containing silt, sand, gravel, and minor proportions of cobbles and boulders. Small portions of Pleistocene terrace deposits of marine and nonmarine origin (poorly consolidated to unconsolidated and poorly sorted to unsorted aggregates of silt, sand, pebbles, cobbles, and a minor proportion of boulders) and Eocene-age sandstone (fine to medium-grained Torrey sand composed mostly of feldspar and quartz, with a small portion of silt, clay, and dark minerals) (Weber 1963).

Prehistorically, the natural vegetation immediately surrounding the site (i.e., within a 2-kilometer [1.2-mile] radius) probably consisted of as many as six native communities: coastal sage scrub, riparian, oak-woodland, grassland, fresh water marsh, and salt water marsh. Prehistorically, the coastal sage scrub community covered most of the hillsides, ridges, and canyons in the coastal areas with interspersed areas of native grasslands (Stipa, Elymus, Poa, Muhlenbergia). This diverse plant community provided many economically important plants that were exploited by Native Americans. Furthermore, this highly productive floral community supported an extensive faunal assemblage that provided many species of economic or social importance to the Native

Over the last 200 years, however, these natural communities have been disturbed by historic development, and today introduced grasses (Bromus spp., Avena spp.), foxtail (Hordeum murinum), mustard (Brassica spp.), and various shrubs are present or predominate in many areas. Currently, the project property is landscaped and the vegetation consists entirely of introduced plants including lawn, nonnative trees, and numerous varieties of flowering plants.

Commonly occurring native plants of the sage scrub community are the California sagebrush (Artemisa california), white sage (Salvia apiana), flat-top buckwheat (Eriogonum fasiculatum), broom baccharis (Baccharis sarothroides), wild onion (Allium haematochiton), laurel sumac (Malosma laurina), San Diego sunflower (Viguiera laciniata), golden-yarrow (Eriophyllum confertiflorum), sawtooth goldenbush (Hazardia squarrosa), yucca (Yucca schidigera, Y. whipplei), prickly pear cactus (Opuntia occidentalis), and scrub oak (Quercus dumosa), while grasses of the native grassland community consists of Stipa, Elymus, Poa, Muhlenbergia (Munz 1974). Prior to historic and modern activities, major drainages, such as San Dieguito River, contained extensive stands of the riparian community with plants, such as sycamore (Platanus racemose), Fremont cottonwood (Populus fremontii), coast live oak (Quercus agrifolia), and willow (Salix sp.) (Munz 1974). Riparian plants were also undoubtedly present in many of the nearby smaller well-watered tributary drainages. Present at the mouth of a larger drainage were marshes and/or sloughs. Plants present in the freshwater marsh include cattail (Typha), spike- rush (Eleocharis sp.), and bulrush (Scirpus sp.). Saltwater species include salt grass (Distichliis spicata), sea lavender (Limonium californicum), and pickleweed (Salicornia virginica) (Cooley et al. 2000).

Animal life, prehistorically, in the project area environs, undoubtedly included large- to medium- sized mammal species, such as grizzly bear (Ursus horribilis) and black bear (Ursus americanus), along with current occupants such as mountain lion (Felis concolor), bobcat (Lynx rufus), mule deer (Odocoileus hemionus), coyote (Canis latrans), gray fox (Urocyon cinereoargenteus), badger (Taxidea taxus), ringtail (Bassariscus asutus), raccoon (Procyon lotor), and striped skunk (Mephitis mephitis). Numerous species of smaller-sized mammals are also present including jack rabbit (Lepus californicus), brush rabbit (Sylivilagus bachmani) cottontail rabbit (Sylvilagus audubonii), ground squirrel (Spermophilus beecheyi), and pocket gopher (Thomomys bottae), and several species of mice and rats (Burt and Grossenheider 1976). Other animals include numerous predatory bird species such as red-tailed hawks (Buteo jamaicencis) and golden eagles (Aquila chrysaetos) (Peterson 1961); and various amphibian and reptile species including a large variety of lizards and snakes as well as pond turtles (Clemmys marmorata) (Stebbins 1966).

ETHNOGRAPHY/HISTORY

Prehistoric Period

In coastal San Diego County, the earliest known cultural materials date to about 10,000 years ago, or approximately the conventionally recognized end of the Pleistocene and beginning of the Holocene. Although the specific adaptations of these first arrivals are unclear, it is apparent that

San Dieguito Lagoon W-19 Restoration Project Page 5 Archaeological Resources Report by the very early Holocene two archaeological complexes were in place, known as San Dieguito and . The former is dominated by well-made flake tools, bifaces, and projectile points, and is thought to represent a hunting adaptation possibly related to the stemmed point tradition of the California deserts (Moratto 1984). The latter, marked by a variety of simple flake and core tools, a general scarcity of projectile points, and high frequencies of groundstone, is thought to be a local manifestation of the widespread Milling Stone Complex that is recognized throughout much of pericoastal California. The relationship of San Dieguito and La Jolla has long been debated and is far from resolved (Gallegos 1987). However, recent data from elsewhere in Central and Southern California increasingly show that coastal gathering complexes similar to Milling Stone were well established along the coast very early in the Holocene (Jones 2008).

The adaptation represented by the La Jolla Complex persisted in a fairly consistent form for several thousand years. Along the coast, there were local adjustments in settlement and subsistence, as coastal habitats shifted in response to fluctuating rates of sea level rise (Masters and Gallegos 1997; Masters and Aiello 2007). Overall, the coastal zone between about 8000 and 1500 B.P. appears to have supported a substantial population, as many coastal archaeological components have been found that date to this interval. At the same time, it has been suggested that the contemporaneous Pauma Complex of inland San Diego County may represent seasonal movements of these populations, which would imply a relatively broad mobility range for this period (True and Pankey 1985).

By approximately 1,500 years ago, patterns began to emerge that seem to suggest the presence of the ethnohistoric Kumeyaay and Luiseño indigenous populations. This Late Prehistoric period (1500 B.P. to A.D. 1769) is characterized by higher population densities and elaborations in social, political, and technological systems. Economic systems diversified and intensified during this period, with the continued elaboration of trade networks and the appearance of more labor- intensive but effective technological innovations. Subsistence is thought to be focused on the utilization of acorns and grass seeds, with small game serving as a primary protein resource and big game as a secondary resource. Rabbits, jackrabbits, and rodents were very important to the prehistoric diet; deer were somewhat less significant for food, but were an important source of leather, bone, and antler. Fish and shellfish were also secondary resources, except immediately adjacent to the coast where they assumed primary importance (Bean and Shipek 1978; Sparkman 1908). The settlement system is characterized by seasonal villages where people used a central- based collecting subsistence strategy. Artifact assemblages included arrow shaft straighteners, pendants, comales (heating stones), Tizon Brownware pottery, ceramic figurines reminiscent of Hohokam styles, ceramic Yuman bow pipes, ceramic rattles, miniature pottery, various cobble- based tools (e.g., scrapers, choppers, hammerstones), bone awls, manos and metates, and mortars and pestles. The arrow point assemblage is dominated by the Desert Side-notched and Cottonwood series.

Ethnohistoric Period

The project area is in the traditional territory of the Kumeyaay. Also known as Kamia, Ipai, Tipai, and Diegueño, the Kumeyaay occupied the southern two-thirds of what is now San Diego County. The Kumeyaay spoke a language belonging to the Hokan language family, which

Page 6 San Dieguito Lagoon W-19 Restoration Project Archaeological Resources Report includes the lower Colorado River tribes and Arizona groups to whom they are closely related. The Kumeyaay lived in semi-sedentary, politically autonomous villages or rancherias. Most rancherias were the seat of a clan, although it is thought that, aboriginally, some clans had more than one rancheria and some rancherias contained more than one clan (Bean and Shipek 1978). Several sources indicate that large Kumeyaay villages or rancherias were located in river valleys and along the shoreline of coastal estuaries (Bean and Shipek 1978; Brackett 1951; Hoover et al. 1966; Kroeber 1925).

The project property, located along the south side of the San Dieguito River, is well within the Kumeyaay/’Iipai (southern Diegueño) territory as understood by the Spaniards and later chroniclers. The Kumeyaay are traditionally considered a hunting-gathering society characterized by central-based nomadism. While a large variety of terrestrial and marine food sources were exploited, emphasis was placed on acorn procurement and processing, as well as the capture of rabbit and deer. The Kumeyaay lived in semi-sedentary, politically autonomous villages or Rancherias. Most Rancherias were the seat of a clan, although it is thought that, aboriginally, some clans had more than one Rancheria and some Rancherias contained more than one clan (Bean and Shipek 1978).

With a history stretching back at least 2,000 years, the Kumeyaay at the point of contact were settled in permanent villages or Rancherias with strong alliances. During the Late Period, the mouths of major drainages were often the location for a larger settlement. Locally, examples of known Kumeyaay villages were Kulaumai, immediately to the north; San Elijo Lagoon at the mouth of Escondido Creek (Kroeber 1925); and to the south, Ystagua, in Sorrento/Soledad Valley near the mouth of a coastal confluence of several larger creeks (Carrico 1977; Carrico and Taylor 1984). It is, therefore, interesting that the early explorers and ethnographers did not record such a village at the mouth of the San Dieguito River. While the Portola expedition apparently did encounter a settlement when they crossed the river in 1769, no native name has survived to assign to this drainage (Carrico 1977:34–35).

Historic Period

Spanish Period (1769–1821) The Spanish period represents a time of European exploration and settlement. While California was, in theory, a colony of Spain since its discovery by Juan Cabrillo in 1542, it was more than 200 years later that Spain established colonies in the area. Early historic contact in the project area is documented in the records of Don Gaspár de Portolá’s 1769 expedition up the California coast to Monterey to identify locations for future missions and presidios. The Portolá expedition consisted of 63 men, including Franciscan Father Juan Crespí, cartographer Miguel Costansó, and Spanish officers and soldiers. Following established trails north from the Native American village of Cosoy at Presidio Hill on July 14, the expedition reached the San Dieguito Valley the following day, camping “near a large pool of fresh water west of present day El Camino Real” (Carrico 1977:34). South of the camp among a concentration of fresh water pools was a large Kumeyaay village. After exchanges and interaction with the Kumeyaay, the expedition left the next day, following the route of today’s Camino Viejo. Portolá’s route was used in subsequent years by Franciscan Padre Junipero Serra as he spearheaded the establishment of presidios,

San Dieguito Lagoon W-19 Restoration Project Page 7 Archaeological Resources Report missions, and pueblos from San Diego to Sonoma. General Stephen Kearney’s men followed its path during the Mexican-American War, and following California’s admission to the United States in 1850, the well-worn El Camino Real served as the main north-south stage route (Forbes 1915; Corle 1949; Riesenberg 1962).

Mexican Period (1822–1848) Following Mexico’s independence from Spain in 1821, the Mexican period began, which lasted until 1848, ending as a result of the Mexican-American War. During this period, most Spanish laws and practices continued until shortly before secularization of the Mission San Luis Rey, Mission San Juan Capistrano, and the Mission San Diego de Alcalá in the 1830s. Some large grants of land were made prior to 1834, but secularization of mission lands in 1835 and division of the mission's large grazing holdings made numerous tracts available for redistribution as land grants and ushered in the Rancho Era. The project area lies southwest of former Rancho San Dieguito. After the missions were secularized, many of the natives were forced to work on Mexican ranchos, although those living farther from the ranchos maintained their traditional life styles longer. During this period, Native American populations in California came under increasing pressure as new ranches were established under the land grant system. New grants were made from inland territories still occupied by the Kumeyaay, forcing them to acculturate or move away. Oftentimes, the Kumeyaay would relocate away from the intruders and farther into the back country. In several instances, however, former mission neophytes organized pueblos and attempted to live within Mexican law and society. The most successful of these was the Pueblo of San Pasqual, founded by Kumeyaay who were no longer able to live at the Mission San Diego de Alcalá. With former Presidio soldiers becoming civilian residents, the Pueblo of San Diego was established, transportation routes were expanded, and cattle ranching continued to predominate over other agricultural activities, with trade in hides and tallow trade increasing during the early part of this period (Rolle 1998).

American Period (1848–Present) Mexico’s defeat in the Mexican-American War in 1848 initiated the American period, when Mexico ceded California to the United States under the Treaty of Guadalupe Hidalgo. Subsequently, land ownership by the Mexicans living in California became a matter of considerable legal wrangling. A Lands Commission was created by the State of California in response to the Act of 1851 (in apparent violation of the treaty), to validate land ownership throughout the state through settlement of land claims. Because of legal costs and a lack of what Americans considered sufficient evidence to provide title claims, however, few Mexican ranchos remained intact, and much of the land that once constituted rancho holdings became public land, available for settlement by emigrants to California. The discovery of gold in the state, the conclusion of the Civil War, and the subsequent availability of free land through passage of the Homestead Act, all resulted in an influx of people to California and the San Diego region after 1848. California’s importance to the country as an agricultural area began in the latter half of the nineteenth century and was subsequently supported by the construction of connecting railways for the transportation of people and goods.

When California became a part of the United States, homesteading of the land increased, and many of the areas traditionally used for hunting and gathering by local Native American groups

Reservations were established to offset this encroachment but instead forced many natives to adopt a more sedentary life style based on Anglo economics as an alternative to moving to reservations. As in other parts of the state, local Native Americans were forced to contend with new laws and policies created by a U.S. government located far away from the local area. They attempted to maintain their associations with the Hispanic community, while attempting to cope with an ever-increasing new Anglo population. During the period from 1850 to 1880, deprivations and tribulations were many and adaptation to the new ways of the Anglo settlers was very difficult for the local native population (Carrico 1987).

The start of the American Period did not bring much change to the project area. On April 18, 1871, 8,824.71 acres of the former Rancho San Dieguito were officially deeded by the United States Government to Juliana L. Osuna and family (California State Archives 2000: MC 4:4- 183). By 1872, the area of the San Dieguito River Valley between the ocean and the former Rancho was occupied by six property owners. Until the end of the nineteenth century, the river valley sustained ranches and agriculture. At the same time, the coastal area was being used for recreation, including the tent city of “Del Mar” owned by Ella and Theodore Loop, which lent its name to the later residential development. The land within the proposed project area continued to be used primarily for agriculture in the east up until the late 2000s as multiple restoration and mitigation projects altered the landscape (County of San Diego 1956, 2009).

Pursuant to 36 C.F.R. 800.4(a)(1), an area of potential effects (APE) is the geographic area within which an undertaking may directly or indirectly alter the character or use of historic properties. As shown on the U.S. Geological Survey (USGS) 7.5-minute Del Mar (1984) Topographical Quadrangle, the W-19 project area lies within Sections 6 and 7 of Township 14 South, Range 3 West and 1, 12, and 13 of Township 14 South, Range 4 West of the San Bernardino Baseline and Meridian (see Figures 1 and 2). The proposed archaeological APE consists of 172.5 total acres, consisting of approximately 141 acres for W-19 and 31.5 acres for the soil disposal site.

This investigation was undertaken to identify archaeological properties within the project area (Figure 3). The proposed archaeological APE consists of approximately 172.5 acres. An intensive pedestrian archaeological field survey was conducted by AECOM archaeologists Patrick McGinnis (M.A., RPA), Rachel Droessler, Lauren Downs, and Tim Wolf on September 10 and 11, 2015. The field survey, performed in 10-m transects, revealed that most of the project area has been disturbed by previous agricultural activities, roadways, and the renovation and revegetation of the San Dieguito Lagoon area. Visibility in these areas ranged from nonexistent (0%) to poor (5%–10%) (Plates 1, 2; found in Attachment D). Developed areas of the archaeological survey along the access roads were highly disturbed with good visibility (90%- 100%) (Plates 3, 9). Of the 172.5 acres, 68 acres were inaccessible due to tall, choking vegetation (Plates 5, 6). Most of the inaccessible area was within the eastern portion of the project area, which, until 2009, was strawberry fields. The northern half of the disposal area has 100% visibility due to clearing and padding, while the southern half has nonexistent (0%) to poor (5%-10%) visibility due to vegetation (Plate 11). Vegetation consisted of mustard grass, Russian thistle, ornamental landscaping such as ice plant, nonnative trees and bushes, and native and nonnative grasses. Cut banks, rodent disturbances, and areas with higher surface visibility were examined thoroughly for resources. A total of 105 acres were surveyed with the remaining 68 acres inaccessible. Three previously identified archaeological resources and one new archaeological site were observed during the current survey (Plates 4, 7, 8, 10). Site records and site location maps are included in Confidential Appendices A and B (bound separately).

Site recordation included photographic documentation, artifact and feature descriptions, and description of environmental contexts. Resource boundaries, features, and artifacts were recorded with a GEO-XH submeter Trimble global positioning system unit, and sketch maps were produced as appropriate. The three previously recorded sites were checked against the existing documentation for any changes in site constituents, condition, or boundaries, and updated Department of Parks and Recreation (DPR) 523 forms were prepared. All updated DPR 523 site forms will be sent to the South Coastal Information Center (SCIC) for filing, and are included in this report in Confidential Appendix C.

As described in further detail below, a subsurface investigation of the two shellfish processing sites (CA-SDI-21796 and CA-SDI-20032) was also conducted on October 8 and 9, 2015, by AECOM archaeologists Julie Roy, Tim Wolf, and Lauren Downs to determine the presence or absence of subsurface cultural materials.

BACKGROUND RESEARCH

Initial investigations for this proposed undertaking began with a records search conducted by the SCIC at San Diego State University on February 2, 2011, under the initial consultant company, Dokken. An updated records search was requested on July 7, 2015, by AECOM. The SCIC manages the San Diego County portion of the State of California’s records of cultural resources for the California Office of Historic Preservation (OHP). Nick Doose, geographic information system (GIS) Supervisor at SCIC, conducted the records search, and the results were compiled by AECOM. The records search conducted in 2015 used a 1-mile radius surrounding the project area to identify archaeological properties that may be impacted by the project and that may be indicative of similar property types within the proposed project area.

The records search focused on the identification of previously recorded archaeological properties and previously conducted investigations. The records search involved a review of historical files, including an examination of historic maps and historic site inventories pertaining to the project area. This included a review of properties listed in the National Register of Historic Places (NRHP), California Register of Historical Resources (CRHR), California Historical Landmarks, and California Points of Historic Interest. A copy of the records search can be found in Confidential Appendix A (confidential – bound separately).

Historic aerials were also consulted during initial investigations. The W-19 project area has been used extensively as agricultural land since at least 1956 with agricultural use continuing until early 2009 (County of San Diego Aerial 1956, 2009).

During review of the Draft EIR for the project, the City of San Diego Archaeological staff discovered additional information regarding an archaeological site in proximity to the W-19 site (P-37-8225H/CA-SDI-8225H) that was originally recorded in 1980 and updated in 1983. The site was further expanded during monitoring and data recovery for another project in 2004. However, a site form was never prepared to reflect new information, which included the discovery of human remains and associated cultural materials.

Previous Investigations

The records search revealed that 179 investigations have been conducted within a 1-mile radius of the project area (Table 1). Of these 179 reports, 36 intersected the proposed project APE. These investigations consisted of seven EIRs, four Finding-of-Effects, six inventory reports, five monitoring reports, seven survey reports, two survey and evaluation/testing reports, one general overview, two records searches, one project supplemental, and one technical report. The entirety of the project has been previously surveyed twice (USFWS and SDRPJPA 2000; Hector and Brewster 2002) and 90% of the project had been surveyed three times (Gallegos et al. 1988; Berryman and Woodman 2000; Byrd and O’Neill 2002). Previously Recorded Archaeological Properties

The records search revealed that 116 archaeological resources have been recorded within a 1- mile radius of the project area (Table 2). These resources consist of 39 prehistoric isolates, one cairn isolate of undetermined age, 63 prehistoric sites, five historic sites, and five multicomponent sites. Two sites (CA-SDI-192 and -193) have no description and CA-SDI-5370 is fossilized shell that is not an archaeological resource. Of the 116 archaeological resources identified in the records search, nine resources (CA-SDI-7291, -7293, -10118, -10535, -20032, P-37-14760, -14764, -14765, -31577) were previously identified within the proposed archaeological APE for the project. P-37-14761 was previously recorded 12 m from the project area and was later observed within the project area. Five of the archaeological properties (P-37-

San Dieguito Lagoon W-19 Restoration Project Page 25 Archaeological Resources Report 14760, -14761, -14764, -14765, -031577) are prehistoric isolates, three (CA-SDI-7291, -7293, -10118) are prehistoric shell scatters with lithic components, CA-SDI-20032 is a shell scatter with pit feature, and CA-SDI-10535 is a historic refuse scatter. In proximity to the project area is CA-SDI-8225, a prehistoric site with four loci, human remains, and historic materials. These 10 resources are further described below.

CA-SDI-7291

CA-SDI-7291 (P-37-007291) was originally recorded by Carrillo (1979a) and was later updated by Robbins-Wade and Sparrevohn (1984a) as a prehistoric site containing a shell scatter with some lithics. At the time of the 1984 recordation, the resource was documented within an area with an existing dirt road with disturbances from previous farming. Artifacts documented in both recordings included a shell scatter, a core, a flake, and two mano fragments. The 1984 update also included historic ceramics and glass along with modern mammal bone. One shovel test pit (STP) yielded a single shell on the surface and a single shell and metal hook below the surface. This site was not evaluated for eligibility for either the NRHP or CRHR.

CA-SDI-7293

CA-SDI-7293 (P-37-007293) was originally recorded by Carrillo (1979b) as a shell scatter with a mano and two flakes. The site appeared to have been bulldozed over the edge of the mesas. The site was relocated by Robbins-Wade and Sparrevohn in 1984(b) in the same condition. This site was not evaluated for eligibility for either the NRHP or CRHR.

CA-SDI-8225/H

CA-SDI-8225/H (P-37-8225H) was originally recorded by E. Dittmar in 1981 and described as a 80 x 80 m sparse lithic scatter. In the mid-1980’s, the Fairbanks Ranch Country Club (FRCC) proposed construction of a 27-hole Championship USGA private golf course along the southern terraces of the San Dieguito River. Due to the presence of the known archaeological site, a testing program was implemented to determine whether the site was a significant cultural resource. In 1983, Mooney-Lettieri and Associates (MLAI) recorded artifacts on the site’s surface, expanding the site’s boundary to 214 x 244 m, and conducted a limited archaeological testing program. MLAI (1983) excavated four 1 x 1 m test units and determined that the site exhibited no vertical integrity. Although they had identified burned and calcined bone fragments “consistent with cremations” MLAI (1983) recommended the site ineligible for listing in the National Register of Historic Places (NRHP), and the lead agency, the ACOE, concurred. In 2003, the second phase of golf course construction was undertaken by the FRCC, implementing the MMRP which stipulated that grading would occur at no greater than 6-inch intervals within the known boundaries of SDI-8225/H and 1-ft intervals beyond the site boundary, and that all ground disturbing activities be monitored by a qualified archaeologist and a Native American monitor. The monitoring identified additional artifacts and four loci (A, B, C, and D), expanding the site dimensions to 248 x 400 m. Observed at three of these loci (A, B, and D) was an ashy lens containing cultural material (Douglas et al. 2004). During the course of the monitoring program, Native American human remains were encountered resulting in the development and implementation of a testing/recovery plan to determine presence or absence of additional resources, which revealed disturbed and undisturbed strata supporting the prior determination that the site was not eligible for listing in the NRHP. However, testing did reveal one area with intact subsurface deposits and lithic materials, but further data recovery was not conducted; rather, in consultation with the Most Likely Descendant (MLD), the San Pasqual Band of

San Dieguito Lagoon W-19 Restoration Project Page 31 Archaeological Resources Report Mission Indians, it was decided that the course would be redesigned, the area capped for preservation, and remains reinterred in accordance with a Memorandum of Agreement (MOA) developed between the City of San Diego and the San Pasqual Band of Mission Indians. A preservation easement was also recorded to protect the location in-perpetuity pursuant to the revised MOA. Although a report (Douglas et al, 2004) was prepared, the site form was not updated and submitted to the SCIC to reflect the activities which occurred during the 2003/2004 work effort, the information is relevant to the current project and as such, included herein for context.

CA-SDI-10118

CA-SDI-10118 (P-37-010118) was originally recorded by Robbins-Wade (1984) as a temporary prehistoric camp with two loci. Artifacts included shell, lithics, and groundstone. Limited testing was conducted in Locus B by RBR & Associates (Robbins-Wade and Cardenas 1985) for the El Camino Real Road Alignment Project. The entire site was tested and evaluated by RECON (Eighmey and Cheever 1990, 1993) and determined not significant under CEQA. Monitoring was undertaken by RECON in 2009 during grading activities associated with the development of the San Dieguito Wetlands Restoration Project (Zepeda-Herman and Price 2009). Several manos, hammerstones, scrapers, and lithic debitage pockets of marine shell were observed. The site was destroyed during grading efforts. The site area was resurveyed in 2010 by AECOM (Droessler 2010a) for utility line pole replacements and alterations. Some shell and a mano were observed in the site area, but the area had been highly disturbed by grading, vehicular activity, agricultural activity, and nearby road widening.

CA-SDI-10535

CA-SDI-10535 (P-37-010535) was originally recorded by Robbins-Wade and Seymour (1986) as a historic structure, two foundations, trees, and a cactus garden. The site condition was listed as fair with the area being used as grazing land. The site was revisited in 2010 by R. Droessler (2010b). The historic structure, foundations, and the cactus garden had been removed. A historic debris scatter was observed along with pepper and eucalyptus trees that may have been ornamental. CA-SDI-10535 was determined not eligible for listing in the NRHP.

CA-SDI-20032

CA-SDI-20023 (P-37-031581) consists of a deflated shell midden and pit feature originally recorded in 2010 by C. Bowden-Renna (2010a). Shell species observed included Haliotis, Chione, Argopecten, Tagelus, Olivella, Mytilus, and Protothaca. A pit feature measuring 1.5 m by 2.5 m was also recorded. This site was not evaluated for eligibility in either the NRHP or CRHR.

P-37-014760 is an isolate consisting of two flakes recorded in 1984 by Cardenas and Robbins- Wade (1984a). The flakes were both core reduction flakes one of quartzite material and the other was metavolcanic.

NATIVE AMERICAN CONTACT PROGRAM

AECOM contacted the Native American Heritage Commission (NAHC) regarding traditional cultural properties, sacred lands, or other resources that might be affected by the project. A Sacred Lands File Search was requested from the NAHC on June 10, 2015, for the proposed project site and a 1-mile radius. Two responses, from the Inaja Cosmit Band of Mission Indians and the Kwaaymii Laguna Band of Mission Indians, were received and neither had comments.

FIELD RECONNAISSANCE

Archival research indicated that 10 archaeological properties (CA-SDI-7291, -7293, -10118, -10535, -20032, and P-37-14760, -14761, -14764, -14765, -31577) were previously identified within the proposed archaeological APE for the project (Table 3). P-37-14761 was previously recorded 12 m from the project area but was observed within the project area during the current survey. Five of the archaeological properties (P-37-14760, -14761, -14764, -14765, and -31577) are prehistoric isolates, three (CA-SDI-7291, -7293, -10118) are prehistoric shell scatters with lithic components, CA-SDI-20032 is a shell scatter with pit feature, and CA-SDI-10535 is a historic refuse scatter. One new site, P-37-035484 (CA-SDI-21796), was also identified during the intensive pedestrian survey. Photographs are attached as Attachment D and site location maps can be found in Confidential Appendix B.

CA-SDI-21796

CA-SDI-21796 is a light-density prehistoric shell scatter located in previously tilled agricultural land that was located during the survey for the current undertaking. Six concentrations of shell were observed in an 86-by-35-m area. The area is highly disturbed due to agricultural use and till marks are still visible in the ground. There was approximately 5–10% visibility due to tall mustard grass and other various seasonal grasses. Shell species observed included Argopectin, Chione, Mytilus, Protothaca, and Astrea with approximately 25% burned. No artifacts or middens were observed in the site.

A subsurface survey of the site was conducted on October 8, 2015, and consisted of the excavation of 13 auger holes to determine subsurface presence or absence as site boundaries appeared mildly intact despite intensive agricultural disturbances. The auger holes were dug near shell concentrations and along determined site boundaries to better define site limits. All auger holes were dug until the water table was hit, which varied between 130 centimeters (cm) and 200 cm. No cultural material was observed in any auger hole and it was concluded that there is no subsurface depth to the site and no further site components.

The pedestrian survey for the proposed undertaking partially located components of site CA-SDI-7291 within the proposed archaeological APE. The original site boundaries were poorly defined and the only objects that could potentially be identified as past site components included Pismo clam shells. The portion of the site located in the proposed archaeological APE is within two existing padded access road/haul routes and previously plowed agricultural fields. The area surrounding the APE was covered by dense ground vegetation that limited visibility. CA-SDI- 7201 (P-37-007291) was originally recorded by Carrillo (1979a) and was later updated by Robbins-Wade and Sparrevohn (1984a) as a prehistoric site containing a shell scatter with some lithics. At the time of the 1984 recordation, the resource was documented within an area with an existing dirt road with disturbances from previous farming. Artifacts documented in both recordings included a shell scatter, a core, a flake, and two mano fragments. The 1984 update also included historic ceramics and glass along with modern mammal bone. STP was dug during this update, which yielded a single shell on the surface and a single shell and metal hook below the surface. As this site was poorly defined with little to no aspects of the site remaining and because it was previously tested and research potential exhausted, no subsurface survey was conducted at this site during the current effort.

CA-SDI-7293

The pedestrian survey for the proposed undertaking failed to identify any surface artifacts at CA-SDI-7293 within the proposed archaeological APE. The portion of the site located in the proposed archaeological APE is within an existing padded access road/haul route, previously plowed agricultural fields, and a least tern fenced-off sanctuary. The area surrounding the APE was covered by dense ground vegetation that limited visibility. CA-SDI-7293 (P-37-007293) was originally recorded by Carrillo (1979b) as a shell scatter with a mano and two flakes. The site appeared to have been bulldozed over the edge of the mesas. The site was relocated by Robbins- Wade and Sparrevohn in 1984 in the same condition (Robbins-Wade and Sparrevohn 1984b).

CA-SDI-10118

CA-SDI-10118 (P-37-010118) was originally recorded by Robbins-Wade (1984) as a temporary prehistoric camp with two loci (Robbins-Wade and Cardenas 1985). The entire site was tested and evaluated by RECON (Eighmey and Cheever 1990, 1993) and determined not significant under CEQA. The site was previously destroyed during grading activities associated with the development of the San Dieguito Wetlands Restoration Project (Zepeda-Herman and Price 2009). Some shell and a mano were observed in a survey in 2009 (Droessler 2010a), but the area had been highly disturbed by grading, vehicular activity, agricultural activity, and nearby road widening. During the current survey, the site boundaries were found to be under a padded gravel parking lot created for the walking trails. The area around the parking lot is fenced and cleared for walking trails. No evidence of the site was observed.

The portion of the site located in the proposed archaeological APE is along an existing, padded haul route. The remaining portion of the site was located on either side of the haul route in tall, inaccessible vegetation.

CA-SDI-10535 (P-37-010535) was originally recorded by Robbins-Wade and Seymour (1986) as a historic structure, two foundations, trees, and a cactus garden. The site was revisited in 2010 and it was found that the historic structure, foundations, and the cactus garden had been removed. A historic debris scatter was observed along with pepper and eucalyptus trees that may have been ornamental.

CA-SDI-20032

CA-SDI-20023 (P-37-031581) was originally recorded as a deflated shell midden and pit feature originally recorded in 2010 by Bowden-Renna (Bowden-Renna 2010a). This site was relocated in the same condition during the current pedestrian survey for the proposed undertaking. Shell species observed included Haliotis, Chione, Argopecten, Tagelus, Olivella, Mytilus, and Protothaca. The pit feature was observed with an abundance of tall vegetation in it and is believed to be a shovel-dug hole most likely from recent agricultural activities. The existing nearby transmission pole line had a gravel access road that runs directly to the south of the site and may have disturbed the southern portion of the site. This access road was in existence in the first recordation of the site and has become overgrown since 2009. Ground visibility in areas with open ground was good, with approximately 75% to 90% visibility, as vegetation was limited to short seasonal grasses; however, these areas appear to have been graded or tilled.

P-37-014760

P-37-014760 was originally recorded as a quartzite flake and a metavolcanic flake in 1984. It was not relocated during the current pedestrian survey for the proposed undertaking. It was originally recorded in an area that was primarily agriculture land and that has recently been extensively disturbed due to the widening of El Camino Real. There was no visibility in the area due to seasonal grasses and flattened, dead mustard grass.

P-37-014761, recorded as a unifacial mano fragment, was possibly relocated and updated during the current pedestrian survey for the proposed undertaking. A bifacial mano fragment was observed in a heavily eroded bank 13 m to the south of the original isolate location. It is believed that this mano may be the one observed in 1984, but is impossible to tell due to the large time gap between the original recording and the current undertaking. No original photo was taken, but the mano is in close enough approximation to the site that it was determined to be P-37-014761.

P-37-014764

P-37-014764 was originally recorded as a patinated metavolcanic flake in 1984 and was not relocated during the current pedestrian survey for the proposed undertaking. It was originally recorded in an area that was primarily agriculture land and that has recently been extensively plowed and terraced for reconstruction of the lagoon area. A graded access road with gravel currently bisects the isolate location boundary. The flake appears to have been displaced or destroyed by the extensive agricultural activities, recent reconstruction efforts, or the access road that is in continuous use.

P-37-014765

P-37-014765, originally recorded as a metavolcanic core in 1984, was not relocated during the current pedestrian survey for the proposed undertaking. It was originally recorded in an area was primarily agriculture land and that has recently been extensively plowed and terraced for reconstruction of the lagoon area. The core appears to have been displaced or destroyed by the extensive agricultural activities or recent reconstruction efforts.

P-37-031577

P-37-031577, originally recorded as two shell fragments, was not relocated during the pedestrian survey for the proposed undertaking. It was originally located along an access road that is still in use. The shell fragments appear to have been displaced or destroyed due to current use of the road or the extensive water and aeolian erosion observed throughout the surrounding area.

EVALUATION

Under federal law, historic properties are defined as any buildings, sites, structures, or objects, each of which may have historical, architectural, archaeological, cultural, and/or scientific importance, that are eligible for listing in the NRHP. To qualify as a historic property, a resource must be significant at the local, state, or national level under one or more of the following four criteria:

A. Are associated with events that have made a significant contribution to the broad patterns of our history;

Embody the distinctive characteristics of a type, period, or method of construction, or that represent the work of a master, or that possess high artistic values, or that represent a significant and distinguishable entity whose components may lack individual distinction; and/or D. Have yielded or may be likely to yield, information important in prehistory or history.

In addition, resources must retain integrity to qualify for the NRHP. As defined by the Advisory Council on Historic Preservation, integrity is the ability of a property to convey its significance through physical features and context, including location, design, setting, materials, workmanship, feeling, and association.

Under California state law, cultural resources are defined as buildings, sites, structures, or objects, each of which may have historical, architectural, archaeological, cultural, and/or scientific importance (Office of Historic Preservation 1995). Significant resources are those resources which have been found eligible to the CRHR. California state law designates significant cultural resources as “historical resources.”

CEQA, Public Resources Code 21084.1 and CEQA Guidelines, California Code of Regulations Title 14 Section 15064.5 defines a “historical resource” as follows:

• resource(s) listed or determined eligible by the State Historical Resources Commission for listing in the CRHR (14 CCR Section 15064.5[a][1]) • resource(s) either listed in the NRHP or in a “local register of historical resources” or identified as significant in a historical resource survey meeting the requirements of Section 5024.1(g) of the Public Resources Code, unless “the preponderance of evidence demonstrates that it is not historically or culturally significant” (14 CCR Section 15064.5[a][2]) • resources determined by the Lead Agency to meet the criteria for listing on the CRHR (14 CCR Section 15064.5[a][3])

For listing in the CRHR a historical resource must be significant at the local, state, or national level under one or more of the following four numbered criteria. A site will be eligible if:

1. It is associated with events that have made a significant contribution to the broad patterns of local or regional history, or the cultural heritage of California or the United States; 2. It is associated with the lives of persons important to local, California, or national history; 3. It embodies the distinctive characteristics of a type, period, region, or method of construction, or represents the work of a master or possesses high artistic values; and/or

Under 14 CCR Section 15064.5(a)(4), a resource may also be considered a “historical resource” at the discretion of the lead agency.

All historical resources eligible for listing in the CRHR must retain integrity, which is the authenticity of a historical resource’s physical identity evidenced by the survival of characteristics that existed during the resource’s period of significance. Resources, therefore, must retain enough of their historic character or appearance to be recognizable as historical resources and to convey the reasons for their significance. Integrity is evaluated with regard to the retention of location, design, setting, materials, workmanship, feeling and association. It must also be judged with reference to the particular criteria under which a resource is proposed for nomination (Office of Historic Preservation 1995).

As described below, all archaeological resources within the W-19 site were assessed as not eligible to the CRHR or NRHP.

CA-SDI-21796 is a low-density, prehistoric shell processing site with no subsurface component. Shell processing sites are nonsignificant resources according to the City of San Diego Historical Resources Guidelines (City of San Diego 2001). CA-SDI-21796 does not have direct association with persons or events important to the past (Criteria A and B of the NRHP and Criteria 1 and 2 of the CRHR) and, as a shell processing site, there are no site components that represent a distinct style, type, or design (Criterion C of the NRHP and Criterion 3 of the CRHR). It is therefore recommended not eligible for inclusion to the NRHP under Criteria A through C based on site components. As the site does not contain a subsurface component and further work would not reveal artifacts or features that could increase our knowledge of prehistory beyond the already recorded constituents of the site, the research potential of the site has been exhausted through recordation of the resource (Criterion D of the NRHP and Criterion 4 of CRHR). It is, therefore, not recommended as eligible for inclusion in the NRHP or CRHR.

CA-SDI-7291 was not previously evaluated for eligibility to either the NRHP or CRHR. CA-SDI-7291 has been highly disturbed by extensive human activities in the area starting as early as 1956 including agriculture, restorative efforts for the lagoon area that involved plowing, construction of trails, and the built-up padded access road/haul route that runs through the site. This site is a prehistoric shell processing site with a small historic component. Shell processing sites are nonsignificant resources according to the City of San Diego Historical Resources Guidelines (City of San Diego 2001). As a shell processing site, CA-SBR-7291 does not have direct association with persons or events important to the past (Criteria A and B of the NRHP and Criteria 1 and 2 of the CRHR). Only shells were found in association with the site, so there are no site components that represent a distinct style, type, or design (Criterion C of the NRHP and Criterion 3 of the CRHR). It is therefore recommended not eligible for inclusion to the NRHP under Criteria A through C based on site components. This site is recommended not eligible to the CRHR or NRHP due to the destruction, and therefore lack of integrity, of the site. Further work would not reveal artifacts or features that could increase our knowledge of

The research potential of the site has been exhausted through recordation of the resource(Criterion D of the NRHP and Criterion 4 of CRHR) and it is, therefore, not recommended as eligible for inclusion in the NRHP or CRHR.

CA-SDI-7293 was not previously evaluated for eligibility in either the NRHP or CRHR. CA-SDI-7293 has been highly disturbed by myriad human activities including agriculture, restorative efforts for the lagoon area that involved plowing, construction of trails, and the built- up padded access road/haul route that runs through the site. CA-SBR-7293 does not have direct association with persons or events important to the past (Criteria A and B of the NRHP and Criteria 1 and 2 of the CRHR). No artifacts were found in association with the previously recorded site, so there are no site components that represent a distinct style, type, or design (Criterion C of the NRHP and Criterion 3 of the CRHR). The former shell processing site has lost its integrity and would not yield information important to San Diego prehistory (Criterion D of the NRHP and Criterion 4 of CRHR). It is therefore recommended not eligible for inclusion to the NRHP or CRHR based on lack of integrity and site components.

CA-SDI-10118 was previously recommended ineligible for listing in the CRHR or NRHP (California OHP 2012). It was previously determined that CA-SDI-10118 does not have an association with persons or events important to the past (Criteria A and B of the NRHP and Criteria 1 and 2 of the CRHR) and that no site components represented a distinct style, type, or design (Criterion C of the NRHP and Criterion 3 of the CRHR). The entire site was tested and evaluated by RECON (Eighmey and Cheever 1990, 1993), which exhausted research potential through recordation (Criterion D of the NRHP and Criterion 4 of CRHR). The current study supports the recommendation of ineligibility for listing in the CRHR or NRHP due to extensive site destruction and lack of integrity and site components.

CA-SDI-10535 was determined ineligible for listing on the CRHR or NRHP (California OHP 2012) and the current study supports that determination. Most of the site components are gone and none of them were associated with important persons or events (Criteria A and B of the NRHP and Criteria 1 and 2 of the CRHR). The historic structure has been removed; therefore, no site components represent a distinct style, type or design and the ornamental trees are unlikely to yield information important to history (Criteria C and D of the NRHP and Criteria 3 and 4 of the CRHR). The site lacks integrity and does not meet any of the four elements of the CRHR or NRHP.

CA-SDI-20032 was not previously evaluated for eligibility in either the NRHP or CRHR. A subsurface survey of the site concluded that there is no subsurface depth to the site and no further site components. Shell processing sites are nonsignificant resources according to the City of San Diego Historical Resources Guidelines (City of San Diego 2001). As a shell processing site, CA-SBR-20032 does not have direct association with persons or events important to the past (Criteria A and B of the NRHP and Criteria 1 and 2 of the CRHR). Only shells were found in association with the site, so there are no site components that represent a distinct style, type, or design (Criterion C of the NRHP and Criterion 3 of the CRHR). It is therefore recommended not eligible for inclusion to the NRHP under Criteria A through C based on site components. As the site does not contain a subsurface component and further work would not reveal artifacts or

Isolates P-37-014760, -014761, -014764, -014765, and -031577 are not unique resources and do not have the potential to yield important information. Recordation of the isolates exhausts their research potential and, as such, they are not eligible for listing in the NRHP or CRHR.

While no CRHR- or NRHP-eligible archaeological properties within the proposed project APE will be adversely affected, much of the proposed project area is covered in young alluvium, which likely caps buried stable surfaces that may contain archaeological resources. Dredging and grading activities for the proposed project have the potential to encounter previously unidentified potentially significant archaeological resources on these stable sediments, particularly in the margins of the lagoon where human activities may have been obscured by the deposition of these younger alluvial soils by seasonal flooding.

Excavations in these areas of sensitivity should be monitored by a qualified archaeologist. A Mitigation Monitoring and Reporting Program (MMRP) meeting the City of San Diego (2001) standards should be developed and implemented, identifying areas of moderate to high sensitivity requiring archaeological and Native American monitoring during ground-disturbing activities. The MMRP shall provide flexibility for the qualified archaeologist to reduce or cease archaeological monitoring based on soil observations indicating a lower sensitivity for cultural materials. Specific monitoring and communication protocols shall be outlined in the MMRP. The MMRP will also lay out the protocols for unanticipated discoveries made during monitoring, including CRHR and NRHP eligibility evaluation and recommended treatment measures for eligible archaeological resources.

Although there is no evidence to suggest the presence of human remains within the proposed project site, based on an unrecorded discovery of human remains in proximity to the project area as described under Background Research above, there may be a potential for encountering human remains during ground-disturbing activities. iIn the event they are encountered during ground-disturbing activities, all work will cease and the County Coroner will be contacted, per the California Public Resources Code (PRC) Sections 5097.9 through 5097.996. Should the remains be identified as Native American, the NAHC will be contacted within 48 hours to provide a Most Likely Descendent to determine appropriate actions. This process, responsibilities, and timelines per PRC Sections 5097.9 through 5097.996 will also be detailed in the MMRP.

Education Mr. Patrick McGinnis has been professionally involved in M.A. Archaeology and Heritage, University of Leicester, 2005 B.A. Anthropology with a concentration in Archaeology, prehistoric and historic archaeology for over 16 years. His University of California, San Diego, 2002 specialty in ethnohistoric period archaeology combines material culture and archival research in anthropologically Professional Registrations Register of Professional Archaeologists (RPA) driven analyses of cultural resources and cultural affiliation.
