STATEMENT OF WORK To Original Contract Number ** *** ********

These provisions are to be read and interpreted in conjunction with the provisions of the contract specified above.

I. Project Description: This project serves to provide technical support of activities at the California Gulch Site. The activities will include support services for monitoring and assessing groundwater conditions across CalGulch.

Placer gold was discovered in the California Gulch area in 1860. Subsequent discovery of silver bearing carbonate ore initiated over 100 years of heavy industrial , mineral processing and smelting. Acidic, metal laden water from the historically mined area flows through the shallow groundwater and down California Gulch approximately six miles to its confluence with the Arkansas River.

The California Gulch was placed on the National Priorities List (Superfund) in 1983. The California Gulch Superfund Site (“CalGulch”) encompasses about 18 square miles in and around Leadville, in Lake County, Colorado, at an elevation of about 10,000 feet. The United States Environmental Protection Agency (EPA) is the lead agency for CalGulch and the Colorado Department of Public Health and Environment (CDPHE) is the cooperating agency. Colorado Mountain College’s Natural Resource Management Program provides field and logistical services to both the EPA and CDPHE.

CalGulch was divided into 12 Operable Units. Additional work of this project is to provide recommendations for the improvement of the monitoring program and for Operable Units to maintain effectiveness. The majority of the Record of Decision mandated activities have been completed at CalGulch. The Record of Decision is a publicly accessible document.

II. Definitions:

III. Work Plan: Goal #1: To improve the quality of the environment and public health for the citizens of Colorado by continuously improving efforts to for proper management of hazardous materials and waste. Objective #1: No later than the expiration of this contract, the Contractor shall provide technical support for activities at CalGulch. The Contractor shall attend a kick off meeting no later than 60 days following the execution of Primary Activity #1 this contract.

Primary Activity #2 The Contractor shall conduct groundwater monitoring

1. The Contractor shall maintain and operate continuous groundwater monitoring equipment. 2. The Contractor shall download continuous groundwater level monitoring data quarterly. 3. The Contractor shall provide a quarterly report of continuous groundwater level Sub-Activities #2 monitoring data.

4. The Contractor shall update the California Gulch Website at calforniagulch.us. 5. The Contractor shall maintain the Geostationary Operational Environmental Satellites agreement with Upper Arkansas Water Conservancy District, National Oceanic and Atmospheric Administration, and Data Collection System 6. The Contractor shall maintain the Early Alert System.

1. The content of electronic documents located on CDPHE and non-CDPHE websites and information contained on CDPHE and non-CDPHE websites may be updated periodically during the contract term. The contractor shall monitor documents and website content for updates and comply with all updates. 2. The Contractor shall submit all deliverables and correspondence to the CDPHE Project Manager via email. a. The CDPHE Project Manager will approve the deliverable or request changes within 21 calendar days. b. The Contractor shall update the deliverable to include any requested changes within 14 calendar days. c. The Contractor shall submit the updated deliverable to the CDPHE Project Manager by the close of business on the 14th day following the receipt of requested changes from the CDPHE Project Manager. d. The CDPHE Project Manager may approve extensions to the Contractor’s Standards and deliverables schedule via email for extenuating circumstances. Requirements 3. The continuous groundwater monitoring equipment shall include: a. Transducers b. Water level meters 4. The Contractor shall include at a minimum the following in the Quarterly Groundwater Level Monitoring Report: a. A summary of groundwater level data. b. Groundwater elevation plots. 5. The Contractor shall maintain the California Gulch Stream Data website located at calforniagulch.us and provide updated site data of the following: a. California Gulch near Malta b. Gaw Shaft Well, SPR-23 c. Leadville Mine Drainage Tunnel 36+77 d. Leadville Mine Drainage Tunnel 46+66 e. Marian Ditch Near Leadville 6. The Early Alert System shall be at the following groundwater monitoring locations: a. LDT36+77 b. LDT46+66

IV. Monitoring: CDPHE’s monitoring of this contract for compliance with performance requirements will be conducted throughout the contract period by the CDPHE Project Manager. Methods used will include a review of documentation determined by CDPHE to be reflective of performance to include progress reports, quarterly reports and other fiscal and programmatic documentation as applicable. The Contractor’s performance will be evaluated at set intervals and communicated to the contractor. A Final Contractor Performance Evaluation will be conducted at the end of the life of the contract.

V. Resolution of Non-Compliance: The Contractor will be notified in writing within ten (10) calendar days of discovery of a compliance issue. Within fifteen (15) calendar days of discovery, the Contractor and the State will collaborate, when appropriate, to determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be completed. The action(s) and time line for completion will be documented in writing and agreed to by both parties. If extenuating circumstances arise that requires an extension to the time line, the Contractor must email a request to the CDPHE Project Manager and receive approval for a new due date. The State will oversee the completion/implementation of the action(s) to ensure time lines are met and the issue(s) is resolved. If the Contractor demonstrates inaction or disregard for the agreed upon compliance resolution plan, the State may exercise its rights under the provisions of this contract.
