His most recent books include Rethinking Military History (Routledge, 2004) and The British Seaborne Empire (Yale University Press, 2004), on which this article is based. or a century and a half, from the Napoleonic Wars to World War II, the British Empire was the greatest power in the world. At the core of that F power was the Royal Navy, the greatest and most advanced naval force in the world. For decades, the distinctive nature, the power and the glory, of the empire and the Royal Navy shaped the character and provided the identity of the British nation. Today, the British Empire seems to be only a memory, and even the Royal Navy sometimes can appear to be only an auxiliary of the U.S. Navy. The British nation itself may be dissolving into its preexisting and fundamental English, Scottish, and even Welsh parts. But British power and the Royal Navy, and particularly that navy’s power projection, still figure in world affairs. Properly understood, they could also continue to provide an important component of British national identity. The Distinctive Maritime Character of the British Empire The relationship between Britain and its empire always differed from that of other European states with theirs, for a number of reasons. First, the limited authority and power of government within Britain greatly affected the character of British imperialism, especially, but not only, in the case of colonies that received a large number of British settlers. -

THE EMERGENCE OF SPACE LAW Steve Doyle* I. INTRODUCTION Space law exists today as a widely regarded, separate field of jurisprudence; however, it has many overlapping features involving other fields, including international law, contract law, tort law, and administrative law, among others.1 Development of space law concepts began early in the twentieth century and blossomed during the second half of the century into its present state. It is not yet widely taught in law schools, but space law is gradually being accorded more space in law school curricula. Substantial notional law and concepts of space law emerged prior to the first orbiting of a man made satellite named Sputnik in 1957. During the next decade (1958-1967), an intense effort was made to bring law into compliance with the realities of expanding spaceflight activities. During the 1960s, numerous national and international regulatory laws emerged to deal with satellite launches and space radio uses and to ensure greater international awareness and governmental presence in the oversight of ongoing activities in space. Just as gradually developed bodies of maritime law emerged to regulate the operation of global shipping, aeronautical law emerged to regulate the expansion of global civil aviation, and telecommunication law emerged to regulate the global uses of radio and wire communication systems, a new body of law is emerging to regulate the activities of nations in astronautics. This course looks at the development of that system during the period known as the “Age of Sail.” Course topics include the maritime aspects of European exploration of the world, the development of ships and navigational technology, naval developments, general maritime economic theory, and maritime cultural history. The SKYLON Spaceplane
The SKYLON Spaceplane Borg K.⇤ and Matula E.⇤ University of Colorado, Boulder, CO, 80309, USA This report outlines the major technical aspects of the SKYLON spaceplane as a final project for the ASEN 5053 class. The SKYLON spaceplane is designed as a single stage to orbit vehicle capable of lifting 15 mT to LEO from a 5.5 km runway and returning to land at the same location. It is powered by a unique engine design that combines an air- breathing and rocket mode into a single engine. This is achieved through the use of a novel lightweight heat exchanger that has been demonstrated on a reduced scale. The program has received funding from the UK government and ESA to build a full scale prototype of the engine as it’s next step. The project is technically feasible but will need to overcome some manufacturing issues and high start-up costs. This report is not intended for publication or commercial use. The idea that Japan had an early modern period is gradually becoming common in every sector of our field, from institutional to intellectual history. Yet what that means has rarely been discussed until now, even in the minimal sense of determining its temporal boundaries: I want to thank David Howell and James Ketelaar for raising the issue in this forum, prompting what I hope will become an ongoing conversation about our periodization practices. To my knowledge, the sole attempt in English to trace the intellectual genealogy of this concept is John Hall's introduction to the fourth volume of the Cambridge History of Japan-a volume that he chose to title Early Modern Japan. Hall dates this expression to the 1960s, when "the main concern of Western scholars of the Edo period was directed toward explaining Japan's rapid modernization." Its ascendancy was heralded by the 1968 publication of Studies in the Institutional History of Early Modern Japan, which Hall co-edited with Marius Jansen. "By declaring that the Tokugawa period should be called Japan's 'early modern' age," he reflects, "this volume challenged the common practice of assuming that Japan during the Edo period was still fundamentally feudal.") Although Hall sees the modernization paradigm as having been superseded in later decades, he nonetheless reads the continuing popularity of the early modern designation as a sign that most Western historians today see the Edo era as "more modern than feudal.',4 This notion is reiterated in even more pointed terms by Wakita Osamu in the same volume. -

G It is a curious and regrettable fact that so little information is available about those trading communities, or factories, which developed independently of control or assistance from their home country and yet played such an important part not only in our commercial expansion but in our naval predominance at the time when the distant Mediterranean suddenly became the great strategic battle-ground - the “Keyboard of Europe”. Thanks to the ability and industry of Mr. A. R. Walford we now have a picture of the great British Factory at the vital port of Lisbon during the latter part of its history.2 Of the earlier part, which is “shrouded in obscurity” I would venture to place on record a few details which have attracted my attention while trying to find out something about the history of our early consuls who were originally chosen, if not actually appointed, by them to be their official spokesmen and chief executives. An interesting but perhaps characteristic feature of these establishments, or associations, for that is probably a more accurate description, is that they were not legal entities at all and their correct official designation seems to have been the “Consul and the Merchants” or the “Consul and the Factors”. The consul himself on the other hand had an unquestionable legal status, decided more than once in the Spanish courts in very early times, and was established by, or under authority from, royal patents. -

Driven by curiosity many have left home to explore new worlds: the sailors who sailed across unknown, treacherous seas to explore new lands; young country boys who enlisted during the world wars to escape their country homes and explore foreign places; scientists who are planning to travel to Mars knowing that there will be no return; and even many young people who long to leave their home after school and explore new worlds but after extensive travelling discover that their home was a wonderful place.
