Annual Report of Political Contributions Disclosure Statements January 1, 2006 to December 31, 2006 Published June 2007 by the designated person (Chief Electoral Officer) pursuant to the Members and Public Employees Disclosure Act Annual Report of Political Contributions Disclosure Statements January 1, 2006 to December 31, 2006 Published June 2007 by the designated person (Chief Electoral Officer) pursuant to the Members and Public Employees Disclosure Act Foreword Annually the official agent of every electoral district association and recognized party and any “candidate” as that term is defined under the Elections Act, is required to file an Annual Statement of Political Contributions disclosing the name and residential or business address of each contributor whose contributions received by such official agent during the previous calendar year exceeded fifty dollars in total and the total amount of contributions by that contributor. Filing is with the “designated person” pursuant to section 14 of the Members and Public Employees Disclosure Act and in accordance with the Political Contributions Disclosure Regulations made under the Act. For purposes of the 2006 reporting period, January 1, 2006 to December 31, 2006, there were four recognized parties in the Province of Nova Scotia, namely, the Green Party of Nova Scotia (GPNS), the Nova Scotia Liberal Party (NSLP), the Nova Scotia New Democratic Party (NSNDP) and the Progressive Conservative Association of Nova Scotia (PC). The acronyms noted are used throughout this report to identify the individual recognized parties. Each of the four recognized parties submitted a Form 3, Recognized Party’s Annual Statement of Political Contributions for the 2006 reporting period. There are 158 electoral district associations in the Province of Nova Scotia of which 156 filed a Form 4, Electoral District Association’s Annual Statement of Political Contributions for the 2006 reporting period. There were 210 candidates officially nominated for the June 13, 2006 Provincial General Election of which 209 filed a Form 2, Candidate’s Annual Statement of Political Contributions for the 2006 reporting period. Besides including disclosure of political contributions, this report also contains reports filed by official agents of the four recognized parties entitled Recognized Party’s Annual Statement of Contributions for Which Official [Tax] Receipts have been Issued required to be filed for each calendar year pursuant to the Elections Act. It is to be noted that the total contributions to any recognized party do not exactly correspond with the total contributions for which income tax receipts were issued because an income tax receipt is not issued unless requested but disclosure of contributions by any contributor of fifty dollars or more in total is mandatory. Recognized Party’s Annual Statement of Contributions for which Official [Tax] Receipts have been Issued ................................... 455 OVERVIEW The Members and Public Employees Disclosure Act S.N.S. 1991, c. 4 describes the regime governing political contributions in Nova Scotia. It sets out the rules surrounding contributions and specifies how and to whom they can be made. For this reporting period January 1, 2006 to December 31, 2006, there were no restrictions or limits on contributions. Under section 14 of the Members and Public Employees Disclosure Act, on or before March 31 in each year the official agent of each electoral district association, recognized party and candidate in an election year is required to file with the designated person, in this case the Chief Electoral Officer, a disclosure statement “showing the full name and residential or business address, other than a post office box unless that is the only address available, of each contributor whose contributions received by that official agent during the previous calendar year exceed fifty dollars in total and the amount of the total contributions by that contributor”. The forms on which these annual disclosure statements are required to be filed are set out in the Political Contributions Disclosure Regulations (N.S. Reg 5/2003) made under the Members and Public Employees Disclosure Act. Although the statements can be filed electronically, very few are, except by some of the recognized parties. Once received by the designated person and in order to make this information available electronically on the Elections Nova Scotia website, the disclosure statements are data-entered into a recently revised format. This is a very time consuming process. Time and authority do not permit correction of errors or filling in of incomplete data in the statements. Some disclosure statements filed included contributions of less than fifty dollars from individual contributors as well as transfers from recognized parties to electoral district associations, from recognized parties to candidates and from electoral district associations to candidates. The only changes to the data filed in the annual disclosure statements are to correct addition errors. Blanks in the reports indicate incomplete or illegible data has been filed. Under section 20A, a recent amendment to the Members and Public Employees Disclosure Act, the designated person, currently the Chief Electoral Officer, is required to publish the disclosure statements for the previous calendar year by June 30.
