1 the Honorable Arne Duncan August 2, 2010 Secretary of Education The Honorable Arne Duncan August 2, 2010 Secretary of Education U.S. Department of Education 400 Maryland Avenue, SW Washington, D.C. 20202 Dear Secretary Duncan: The undersigned organizations, representing a broad national coalition of public health, disability, education, hospital, organized labor, health care providers, and others write to request you to remove the 2006 IDEIA regulation at § 300.154(d) (iv) (A), which requires that school districts obtain parental consent, consistent with § 300.9, each time that access to a student’s Medicaid benefits is sought. Obtaining parental consent to bill Medicaid as mandated by the new regulation has proven to be exceptionally problematic for school districts. Many parents are mistakenly concerned that giving consent will result in out-of-pocket costs to them or a reduction in Medicaid benefits. The administrative time required of district staff to follow-up with students and parents to get signatures is costly, time-consuming, and ineffective. As a result, some LEAs are withdrawing from the reimbursement program and others have decided not to participate. Even more significant is the direct loss of reimbursement dollars to schools. This regulatory action could not have come at a worse time, as school districts across the country struggle with severe budget cuts. This regulation restricts federal reimbursement for services the schools deliver under federal mandate, imposing additional costs for compliance, and lost revenue from reduced parental participation. Losses to school districts across the country as result of this regulation are measured in the millions of dollars. By CMS’s own numbers, reimbursement to schools for the provision of direct services under IDEIA declined nationally between FFY2005 and 2008 by $422 million, a 21% decrease. Whether this is due to parental consent or myriad other factors is a valid debate, but at least a sizable portion of that amount relates directly to the parental consent regulation. Specific district losses are available. As but one example, a large Western school district estimates a $1.6 million loss between its 2008/2009 reimbursements. Specific numbers are available from a number of school districts across the country. 1 To frame the argument in its simplest terms: Schools have operated for more than twenty years without the regulation and with no abuses The regulation was created and promulgated under the previous administration The requirement for individual consent before billing Medicaid has had a chilling effect on the ability of school districts to obtain funds that are reimbursement for services they are mandated to provide As a result of the regulation, school districts have lost millions of reimbursement dollars In the period between FFY2005 and 2008 Medicaid payments to schools have experienced a decrease of $422 million, or 21% In a recent meeting, the Centers for Medicare and Medicaid Services indicated the regulation is of no interest to them and is solely a matter for the Department of Education On behalf of children’s health programs across the country, we respectfully request that you immediately remove the parental consent requirement found at § 300.154(d) (iv) (A) of the current version of the Individuals With Disabilities Education Improvement Act.     Annual Public Notice of Special Education & Early Intervention Services and Programs It is the responsibility of the Pennsylvania Department of Education to ensure that all children with disabilities residing in the Commonwealth, regardless of the severity of their disability, and who are in need of special education and related services, are identified, located, and evaluated. This responsibility is required by a federal law called the Individual with Disabilities Education Act (IDEA). The IDEA requires each state educational agency to publish a notice to parents in newspapers or other media before any major identification, location or evaluation activity. The IDEA requires this notice to contain certain information. Pennsylvania law requires each school district to fulfill this notice requirement by providing an annual public notice. The school district is required by the IDEA to provide a free appropriate public education to children with disabilities who need special education and related services. Pennsylvania has adopted state laws which conform with the IDEA and which school districts must follow. In Pennsylvania a school age child with disabilities who needs special education and related services is identified as a child with a disability. Students are exceptional if they need specially designed instruction and have one or more of the following physical or mental disabilities: Autism/Pervasive Development Disorder Orthopedic Impairment Deaf-Blindness Other Health Impairment Deafness Specific Learning Disability Emotional Disturbance Speech or Language Impairment Hearing Impairment Traumatic Brain Injury Intellectual Disabilities Visual Impairment Including Blindness Multiple Disabilities In Pennsylvania, students also qualify as exceptional if they require specially designed instruction and are determined to be mentally gifted.

We evaluated the District’s performance in the following areas as further described in the appendix of this report: • Transportation Operations • Administrator Separations • Bus Driver Requirements We also evaluated the application of best practices in the area of school safety. Due to the sensitive nature of this issue and the need for the results of this review to be confidential, we did not include the results in this report. However, we communicated the results of our review of school safety to District officials, the Pennsylvania Department of Education, and other appropriate officials as deemed necessary. The audit was conducted pursuant to Sections 402 and 403 of The Fiscal Code (72 P.S. §§ 402 and 403), and in accordance with the Government Auditing Standards issued by the Comptroller General of the United States. Those standards require that we plan and perform the audit to obtain sufficient, appropriate evidence to provide a reasonable basis for our findings and conclusions based on our audit objectives.     THE PITTSBURGH I REMEMBER IS A CITY THAT WILL USE THIS ACT OF HATE TO BUILD A PLACE OF LOVE AND HOPE By Ron Sirak • @ronsirak October 28, 2018 I remember the old Pittsburgh, the grimy city of steel mills and pollution, a lunch pail-carrying kind of place where the sweat of the blast furnaces was washed away with a shot and a beer. I remember a fiercely proud area that viewed Eastern Pennsylvania as another state, perhaps even another country. Pittsburgh, Western Pennsylvania, even has its own language. Phrases such as: “What yinz doin’ after you red up the house?” clang on the outsider’s ear like the wail of a car alarm at 3 in the morning. My mother, who worked as a welder from 7 a.m. until 3:30 p.m. and then as a cleaning woman in an office from 6 p.m. to 9 p.m., said of Eastern Pa.: “They’re from the anthracite region; we’re from the bituminous region,” as if that was a stamp you’d get on your passport. My father drove a ladle crane in about every mill in Western Pa. and Eastern Ohio as the steel industry was dying. United Engineering. Mesta Machine. Youngstown Sheet & Tube, Sharon Steel, Jones & Laughlin and finally Pennsylvania Engineering in our hometown of New Castle, 50 miles from Pittsburgh. That’s where he was working when he died at the age of 45, the life sucked from him by relentlessly hard work. When I was a kid the Interstate hadn’t been built yet and the drive to Pittsburgh to see a Pirates game at Forbes Field was an arduous affair, following a windy road that that traced the river.
