The request of the petitioner is that he may be permitted to peruse the case file and certified copy of the enquiry report related to the complaint under CSR 228/W5/dated 28-6-2004.

The public authority, the Assistant Commissioner of Police, Villivakkam holding additional charge Anna Nagar, has informed that on 27-10-2007, the petitioner was permitted to peruse the related case file CSR 228/W5. This is in pursuance of the letter issued by the Assistant Commissioner of Police, Villivakkam. The petitioner visited the Assistant Commissioner Office on 27-10-2007 and recorded that on perusal, the papers shown to him was not related to the case but only a small part of that. Against this, the petitioner preferred appeal before the Deputy Secretary to Government, Home Department. Thereafter, he approached the State Information Commission, the second appellate authority, under Right to Information Act. This petition was received on 6-12-2007. The case was partly heard on 17-6-2008 and posted for final hearing today (30-6-2008).

After hearing the petitioner and the public authority and after perusal of the records produced by the public authority, the Commission directs that a copy of CSR 228 W5, Anna Nagar Police Station, CSR 2004, dated 28-6-2004 and the disposal given by Anna Nagar Women Police Station in respect of CSR No.228 of 2004 and the disposal given to the petitioner in response to Rc No.625/JCOP(C), Camp, G1 of 2004, No.1463/DC Anna Nagar/Camp/04, 15/W8/ANPS Current/04, 409 AC Anna Nagar, 04, cited above a reply was given to the petitioner by the Inspector, Thirumangalam Police Station on 29-9-2004 stating that the case was registered in C. No.1320/04 under Section 417,420 IPC and Sec.4 of DP Act, on 28.9.2004 in Villivakkam Women Police Station.

In respect of Case No.228 CSR W5 Anna Nagar Police Station/06, dated 28-6-2004, statements have been obtained from Sumathy, Muralidharan and Rajeswari. The public authority is directed to give a copy of CSR W5 ANPS 04 dated 28-6-2004 and also Xerox copy of the disposal of CSR records relating to 228 CSR 4, dated 28-6-2004 and also copies of statements recorded by the Anna Nagar Police Station from Sumathy, Muralidharan and Rajeswari and also copy of the statement recorded by Thiru R. Pannerselvi, Sub Inspector, W9 Women Police Station, Villivakkam dated 22-2-2006 of a CD file in which it has been recorded that along with CSR 228, 49 pages have been received from the Anna Nagar Women Police Station and they have been handed over to Chief Metropolitan Magistrate Court, Egmore. Copy of these pages of CD file may also be handed over to the petitioner. The public Authority is directed to comply with this direction forthwith and get acknowledgement from the petitioner and file it before the Commission.

The petitioner is also directed to inspect the file relating to CSR No.228 of 2004 of Anna Nagar Police Station dated 28-6-2004 in the Office of the Assistant Commissioner of Police, Anna Nagar, Chennai, today (30-6-2008) and, if any, enquiry was conducted in the said case, copies of the statements, if available, may be given to the petitioner today itself under acknowledgement. The public authority is directed to supply the information free of cost and amount if any remitted by the petitioner should be refunded as the information was not supplied within the stipulated period.
