Improving electoral system: a critical step in maintaining Hong Kong’s long-term prosperity and stability

On 11 March, the fourth session of the 13th National People’s Congress (NPC) overwhelmingly approved the ‘Decision of the National People’s Congress On Im- proving the Electoral System of the Hong Kong Special Administrative Region’. The Central Government, through revising and improving the electoral system of the Hong Kong SAR, plugging the institutional loopholes, fully implementing the princi- ple of “patriots administering Hong Kong”, takes a critical step in maintaining Hong Kong’s long-term prosperity and stability. Improving Hong Kong’s electoral system is within the power and responsibility of the Central Government. In a unitary state, the central government makes de- cisions for sub-national units regarding their electoral systems, a political practice commonly enshrined in their constitutions. China is no exception. It is within the Central Government’s power to create a special administrative region and establish its systems. It is the Central Government’s constitutional power and responsibility prescribed in both the Constitution of the People’s Republic of China and the Basic Law of the HKSAR to decide on the electoral system of Hong Kong according to its realities. The moves of the NPC and its Standing Committee in improving the elec- toral system of the HKSAR are completely in line with the provisions of the Cons- titution and the Basic Law, and thus have unquestionable legitimacy, rationality, constitutionality and lawfulness. Improving the electoral system under the guiding principle of “patriots administe- ring Hong Kong” is in line with the principle of “one country, two systems” and the general international practice. “Patriots administering Hong Kong” is a necessary requirement and the core meaning of the “one country, two systems” policy. Mo- reover, it is also a necessary requirement of China’s resuming exercise of sovereign- ty over Hong Kong, a prerequisite of comprehensively implementing the policy of “one country, two systems”, and a reliable pillar supporting Hong Kong’s long-term prosperity and stability. Strict requirements on patriotism and related political qua- lifications of the administrators is a general international practice. Adhering to the principle of “patriots administering Hong Kong” is not a high requirement, but the minimum standard for “Hong Kong people govern Hong Kong”.
