She was not only as one of the earliest reporters of the authentic sayings of the Prophet Muḥammad, but also a great source for conveying his private family life. The article seeks to show that ‘Ā’isha’s life in the 7th century Arabia is especially remarkable when examined through the lenses of contemporary times. Her main characteristic was her critical, ever-inquisitive, and curious mind. Through the questions she was able to ask, ‘Ā’isha became a bridge between the time of the Prophet and the contemporary Muslim life. The important role she played in the scholarly efforts of Muslim men and women in learning and teaching knowledge needs to be examined and properly emphasized. Her sound scholarship in Islamic disciplines include but was not necessarily be limited to hadith, tafsīr, fiqh, literature, and poetry. Today Muslim women may take ‘Ā’isha not only as a pious example, but follow her intelligence, curiosity, and reasoning. 132 rudolph peters MURDER IN KHAYBAR: SOME THOUGHTS ON THE ORIGINS OF THE QAS¤MA PROCEDURE IN ISLAMIC LAW * RUDOLPH PETERS (University of Amsterdam) Abstract The institution of qas¨ma has intrigued both Muslim jurists and western scholars. The first were puzzled by its violation of essential legal principles, the latter by its apparent pre-Islamic origins. Because of its archaic and irrational character, western scholars assume that the institution was not applied in practice: Ò[I]t does not appear that this institution functioned much, even in the past, when the penal law of Islam had a certain practical application.Ó1 However, the evidence of fatwa collections shows that the qas¨ma was indeed enforced by courts as late as the nineteenth century, 2 and the rules connected with it have now found their way into some modern Islamic criminal codes. 3 The qas¨ma, it appears, was a living institution in Islamic law and not just theory. In this essay I will try to shed some light on the origins of this institution and its reception into Islamic law. I will attempt to chart the earliest developments of Islamic jurisprudence by analyzing the available hadith material and the statements of the first generation of jurists. In the conclusion I will suggest that my analysis of the material on qas¨ma corroborates MotzkiÕs 4 and I thank Harald Motzki and Gautier Juynboll for introducing me to the unfamiliar field of isn¨d analysis and for their critical remarks on earlier versions of this essay, from which I have greatly benefited. -

This is the biggest misconception in Islam, no doubt resulting from the constant stereotyping and bashing the media gives Islam. When a gunman attacks a mosque in the name of Judaism, a Catholic IRA guerrilla sets off a bomb in an urban area, or Serbian Orthodox militiamen rape and kill innocent Muslim civilians, these acts are not used to stereotype an entire faith. Never are these acts attributed to the religion of the perpetrators. Yet how many times have we heard the words 'Islamic, Muslim fundamentalist, etc.' linked with violence. Politics in so called "Muslim countries" may or may not have any Islamic basis. Often dictators and politicians will use the name of Islam for their own purposes. One should remember to go to the source of Islam and separate what the true religion of Islam says from what is portrayed in the media. Islam literally means 'submission to God' and is derived from a root word meaning 'peace'. Islam may seem exotic or even extreme in the modern world. Perhaps this is because religion doesn't dominate everyday life in the West, whereas Islam is considered a 'way of life' for Muslims and they make no division between secular and sacred in their lives. Like Christianity, Islam permits fighting in self- defense, in defense of religion, or on the part of those who have been expelled forcibly from their homes. It lays down strict rules of combat which include prohibitions against harming civilians and against destroying crops, trees and livestock. -

Muhammad And The Banu Qurayza What really happened with the Banu Qurayza? Part 1: The siege, the surrender & the intercession of al-Aus After the Battle of the Ditch Muhammad attacks the last of the large Jewish tribes of Medina, the Banu Qurayza. After a 25 days siege, they surrender unconditionally. In the end, all 600-700 males of the tribe are killed and the women and children sold into slavery. Muslims have many versions trying explain away the cruelty of these events and are trying shift them blame away from Muhammad to the Jews themselves. We will not argue the Banu Qurayza are 100% innocent angels, or the Muslims are 100% evil devils. This is not and never was the claim. In every war, both sides commit injustices and do evil things. And in each war, the losing side has to pay some penalty. We do not expect otherwise. But the kind of penalty and its relationship to the crime is a valid question. This paper is an examination of the early Muslim sources to give a detailed account of the events. Instead of responding to various Muslim constructions one by one, since there are as many versions as there is creativity, we will rather look at the account as it is reported by Ibn Ishaq in his word Sirat Rasul Allah available in the abridged edition of Ibn Hisham, and translated by A. Guillaume under the title The Life of Muhammad. This is is by far the oldest (written) account of Muhammad's life in regard to the date of its first composition. -

CHAPTER ONE RELIGIOUS AND SOCIAL LEADERSHIP As the tribesmen of Arabia, the Jews of Medina drew their leadership from the more dominant clans among them. Their community leaders were judges, military commanders, and those who ruled on halakhic matters. A study of “the occasions of revelation” (asbāb al-nuzūl) in Islamic literature reveals that the Jewish leaders in Medina often provoked Muḥammad with questions on religious issues. As a result, they were referred to as the “people of the question” (aṣḥāb al-masʾala).1 A reflection of the numer- ous questions that the Jewish sages in Medina asked Muḥammad exists in the following saying, which indirectly presents the Jews as a trigger for the revelation of many verses of the Qurʾān: “[Much of] the Qurʾān was revealed because of the questions they (i.e., the Jewish leaders in Medina) posed to him (i.e., Muḥammad)” (kāna al-Qurʾān yanzilu fīhim fīmā yasʾalūna ʿanhu).2 1. The Leaders of the Jewish Tribes of Medina ʿAbd al-Malik b. Hishām (d. 833 CE) records a list of the Medinan Jew- ish leaders of every Jewish tribe in Medina.3 Many of these leaders are reported to have been killed during the Muslim-Jewish conflicts in Med- ina and Khaybar. The leaders of the strongest Jewish tribe in Medina, the Banū al-Naḍīr, were the brothers from the Abū al-Ḥuqayq family: Sallām, the richest merchant in the Ḥijāz, and al-Rabīʿ together with the three brothers from the Banū Akhṭab family: Ḥuyayy, Judayy and Abū Yāsir. In 625 CE, after the Banū al-Naḍīr surrendered to the Muslims, these two families along with others, moved to Khaybar where their relatives lived. -

Report Marriages in Muhammad's tribe Introduction A database for given project was provided by Dr. Majied Robinson with the title "Marriages in Muhammad's tribe". The database was represented in multiple tables, such as "Marriage Database", which is the main dataset with all the data and multiple sub-databases for every tribe and clan represented there (e.g. "Qurayshi marriages by clan"). The information of marriages in pre-Islamic and early Islamic period were classified by tribes or clans (subtribes). Aside from basic information such as names of men and women, tribes(subtribes) of both of them, number of children they had, generations of men and women were also indicated (Figure 1). Figure 1. "Marriages in Muhammad's tribe" excel table th By the information provided from dataholder the 5 generation is the generation of Muhammad, th th which means generations before 5 belong to pre-Islamic period while those after 5 belong to early Islamic period. The main interest of dataholder was the question how marriage traditions could affect politics at that time or how otherwise political and social factors probably had an impact on marriage traditions and behaviour. Context Basically, we did not intend to explore every detail of every clan in Quraysh tribe that is presented in our database, but to mainly focus on the major and the most powerful and influential clans which were the rulers of first arabic kingdoms (caliphates): Umayyads and Hashemite. The reason why we chose them is the fact that a lot of historical sources argue that they were so called sworn enemies. -

Sociology is, by common consent, the most ambitious advocate of modern society. In other words, it undertakes to develop an understanding of modern existence in terms of breakthroughs from ancient cosmological cultures to ordered and plural civic life based on the gradual subsiding of communal life. Thus, within this undertaking, the sociological project of modernity figures as the cultural machine that dislodges the rationale of social being from local, communal, hierarchic contexts into the logic of individualism and social differentiation. The conventional wisdom of sociology has been challenged by post-modern debate, abolishing this dichotomous evolutionism while embracing a more heterogeneous view of coexistence and exchange between local cultures and modern institutions. Islam, however, is often described as a different cultural machine for the holistic reproduction of pre-modern religion, and Muslims are seen as community-bound social actors embodying a powerful potential for the rejec- tion of and opposition to Western modernity. Sociologists insist on looking for social differentiation and cultural differ- ences. However, their concepts remain evolutionist and inherently tied to the cultural machine of modernity. The Yearbook of the Sociology of Islam takes these antinomies and contradic- tions as a challenge. -
