Ensuring viability and deliverability Ensuring viability and deliverability Pursuing sustainable development requires careful attention to viability Local planning authorities should set out their policy on local standards and costs in plan-making and decision-taking. THERE IS NO STATUTORY GUIDANCE

NPPF says: ‘Evidence supporting the assessment should be proportionate, using only appropriate available evidence’.

The CIL guidance says: A charging authority must use ‘appropriate available evidence’ (as defined in the Planning Act 2008 section 211(7A)) to inform their draft charging schedule. The Government recognises that the available data is unlikely to be fully comprehensive. Charging authorities need to demonstrate that their proposed levy rate or rates are informed by ‘appropriate available’ evidence and consistent with that evidence across their area as a whole.

Minutes of Workshop

1. Introduction Simon Drummond-Hay (SDH) explained that the draft viability report is based on a snap-shot of the development strategy in the emerging Local Plan; if a site features do not assume it will be an allocation and equally if a site does not feature do not assume it will not be an allocation. SDH stated that the draft report is strictly confidential and should not be shared widely. SDH advised that a range of targets and developer contributions, as well as CIL, will be tested. SDH invited comments on the draft report to be submitted to Tonbridge & Malling Borough Council (TMBC) by Tuesday 10 April 2018. SDH stated that any comments will not be attributed to specific individuals but would be presented more generally, i.e. a developer said X, another developer said Y.

2. Current and Emerging Policy Context SDH advised that the viability work has been informed by: the Harman Report ‘Viability Testing Local Plans – Advice for planning practitioners’; ‘Financial viability in planning’ prepared by the Royal institute of Chartered Surveyors (RICS); the Government’s National Planning Policy Framework (NPPF); and the Government’s Planning Practice Guidance (PPG). SDH highlighted that the draft revisions to the NPPF place a greater emphasis on viability testing at the plan-making stage. A site cannot be included in the Local Plan if it is not proven to be deliverable. SDH explained that the draft PPG on Viability does not attempt to supersede the Harman Report and RICS guidance.

3. Methodology Residual Valuation Method - SDH advised that the Residual Valuation Method has been adopted. This involves starting with the Gross Development Value (GDV) of the completed development from which costs (construction, fees, profit, local policy requirements) are subtracted. For a site to be viable and therefore deliverable the residual value needs to be the existing use value +. At this point there is likely to be a willing land owner to sell the land for development. SDH asked if there are any questions about this approach. No questions were raised. SDH highlighted that there are no existing Local Plan viability reports relating to the existing TMBC Development Plan but there are viability reports associated with TMBC planning applications to provide a local context.

4. Assumptions

House prices - SDH advised that it is assumed that there will be no massive increase in house prices in TMBC moving forward. It is important to make conservative assumptions about house prices to avoid prompting an early radical review of the work. Turnover rates – SDH advised that according to Land Registry data the turnover rates in TMBC are higher than London. Selling – New build properties are in greater demand than existing dwelling stock because there is a shortage of supply of the types of homes being built. No questions were asked about the broad assumptions.

5. Values 5.1 Residential Residential Price Assumptions (£/m2) – SDH advised that the data points to there being two broad price areas in TMBC: North-East (Lower Value Area (LVA)); and South-West (Higher Value Area (HVA)). Prices per metre squared (£/m2) do not vary greatly across the borough. SDH stated that a higher premium (£/m2) for small greenfield sites is assumed in the HVA . In terms of large greenfield sites £4000/m2 is assumed in the HVA and a price of £3,500/m2 is assumed in the LVA. SDH asked if these assumptions were too high/too low/reasonable. In response one developer stated that they are a bit high, being comparable to Cambridge. Another developer observed that they are generic and questioned how different local scenarios will be tested. SDH stated that a full range of typologies have been developed to reflect typical development site scenarios in TMBC. These have formed the basis for the viability testing. SDH requested comments to be made on price assumptions with reference to local examples. SDH needs to know if they are realistic. Affordable housing – Existing target is 40%. SDH advised that this could be challenging moving forward. SDH stated that affordable rent figures are too low and should be higher. SDH asked what % of market values affordable rent values should reflect. One suggestion was that social rent should be 55% to 70% of market values. Affordable rent – SDH assumed that the cap of 80% of market rents is no higher than Local Housing Allowance (LHA) cap. SDH stated that affordable rents in TMBC are too low and don’t reflect what is happening in the wider market. Intermediate – SDH assumes that these are pitched at 65% market values. Starter homes – SDH stated that these are subject to an 80% cap of market values and that the value should not exceed £250, 000. Older people’s housing – SDH highlighted that the Strategic Housing Market Assessment (SHMA) identifies that the housing need of the aging population is substantial. SDH advised that the market values for sheltered and extra-care housing are very similar (£5,500/m2). No comments were made on these value assumptions.

5.2 Non-Residential SDH stated that it is important to understand that jobs provide opportunities for people to access the housing market. New office supply – SDH observed that the offer at present is mixed. SDH advised that the value of office space is £19.97/sq.ft whilst the value of retail warehousing is £16.72/sq.ft. SDH stated that non-residential development is likely to give rise to infrastructure requirements. SDH welcomed comments on these values.

5.3 Land Values SDH advised that he is reviewing land values at present. SDH has concluded the following existing use values (£/hectare):

• Agricultural Land: £20,000/ha

• Paddock Land: £50,000/ha

• Industrial Land: £500,000/ha

• Residential Land: £? In response, no one challenged these figures at the workshop and the response was that they were reasonable. Residential land value – SDH advised that he is examining recent transactions. SDH advised that he will be focussing on minimum price in option agreements. SDH stated that this is possibly less than £250,000 to £300,000 per hectare across the whole site A developer asked about estates bought as part of a portfolio and how these would be treated. SDH advised that he would focus on the specific residential site in question. A developer questioned whether a high level approach is widely applicable. The developer pointed out that this approach does not take account of different capital funding; there is a need to drill down. Another developer asked if the minimum value that a land owner would be willing to sell at will be used in the assessment. SDH confirmed that this is the case. The developer responded by stating that this (minimum value) could be misleading and that a more cautious approach should be adopted.

5.4 Development Costs SDH advised that for small sites (6 units and fewer) development costs are assumed at 13% of the GDV. SDH advised that for a greenfield site involving a single developer the normal sites costs are 15% of GDV. For a brownfield site an additional 5% is applied. SDH assumes that fees represent 10% of the GDV, whilst contingencies represent between 2.5% (greenfield site) and 5% (brownfield site) of GDV. A developer asked about abnormal costs and how these are factored in. SDH responded by stating that abnormal costs should come off the value of the land and no allowance should be made. SDH advised that interest is assumed at 6% of GDV (plus fees).

In terms of the competitive return (profit), SDH assumes 20% of GDV for market housing and 6% for affordable housing. Profit – SDH advised that the Government’s draft guidance on viability suggests that profit should be related to value (market 20% and affordable 6%). SDH stated that he has assumed that the budget for sales represents 3.5% of the GDV. A developer asked if sales includes a marketing suite. SDH confirmed that this is the case. One developer observed that this is quite a generous allowance. Build costs – SDH advised that low and high build costs will be tested. A developer asked if a different level is assumed for employment space. SDH stated for employment development 15% of market value is assumed for profit. Another developer asked about assumptions on unit size. SDH advised that the Government’s nationally described internal space standards have been applied in the testing. It is understood that most current development in the District is above the NDSS. SDH also advised that the viability work will look at wheelchair access, higher water efficiency standards, Sustainable Drainage Systems and publicly accessible open space (starting point of 5.35 ha/1,000 population). In addition SDH explained that the viability assessment will assume 5% of residential units will be reserved for self-builders, with a focus on tailoring/refining existing house types to particular needs. In terms of densities, SDH advised that the viability work assumes 30/35 dwellings per hectare. SDH observed that the iteration of the development strategy in the emerging TMBC Local Plan that has formed the basis of the viability assessment will result in 83% of residential units being delivered on the strategic sites. SDH made it clear that the viability assessment will specifically look at each individual strategic site because of the significance of the contribution that it will make to the overall strategy. Affordable housing threshold – SDH advised that the national thresholds as set out in the PPG (11 units) will be applied. This means that a lower threshold (6 units) will be tested in the Areas of Outstanding Natural Beauty. Typologies – SDH requested that any site being promoted that is not covered by the proposed typologies should be drawn to his attention.

5.5 Existing Use Value (EUV) + SDH advised that the viability assessment assumes that the residual value of land needs to be the EUV plus 20% in order for there to be a willing land owner to sell the land for development. For greenfield sites this need to be the EUV + 20% + £300,000/ha. SDH invited comments. One developer asked if this is based on analysis of data. SDH confirmed that this assumption is based on analysis of data from across the whole country. Another developer asked if this is based on un-serviced land. SDH confirmed that this is the case. A developer asked if the 20% is informed by market transactions. SDH advised that the assumption is informed by the RICS financial viability guidance, by appeal decisions and market transactions. One developer questioned whether the 20% is a hope value. SDH explained that this is not the case; it is a reasonable assessment of what would provide a land owner with a competitive return.

6. Conclusions

SDH advised that the early results should be treated with absolute caution. They will inevitably change and little weight should be given to the sites that feature in the report because these might change as the development strategy evolves. SDH highlighted that the big sites and the brownfield sites will be challenging to deliver and it is important that careful consideration is given to the policies that are applied. SDH stressed the importance and value of meaningful engagement with the development sector on viability at the plan-making stage to help ensure sites are deliverable. SDH advised that the draft report would be circulated after the conclusion of the workshop and that comments need to be directed to TMBC by 10th April 2018, with a view of the final draft of the report being produced by the end of April. The meeting concluded at 15.30.
