contenido generado por usuarios (ugc), wikies y derecho de autor juan * i. introducción La web 2.0 y los modelos colaborativos de creación que con él van de la mano han sido objeto de consideración jurídica por parte de los estudiosos del Derecho. Desde la perspectiva de la propiedad intelectual, el tema no ha sido la excepción. Ello se debe, en gran medida, a la explosión del número de contenidos creados; la superposición del rol de usuario y creador de los contenidos, junto con la gran cantidad y diversidad de los intervinientes en el proceso de creación y el alcance –en muchas ocasiones– global de dicho proceso. El presente artículo pretende contribuir al estudio de la web 2.0 y los modelos creativos a él asociados. Específicamente, pretende inquirir (desde el punto de vista del Derecho de autor) sobre los hiper-documentos creados mediante el software colaborativo tipo Web 2.0 conocido como “wiki”. Para lograr tal objetivo, se estudiarán el concepto de wiki, sus principales características y su función como herramienta tecnológica de creación de valor; las figuras jurídicas que median en la atribución de facultades patrimoniales (y morales) sobre obras protegidas por el Derecho de autor; a qué figura jurídica que media en la atribución de facultades corresponde el contenido generado mediante wiki, y, por último, los problemas que tal adecuación típica representa y las posibles soluciones a dichos problemas. Dicho estudio propondrá dos tipos de problemas y una solución a los mis- mos. Respecto de los problemas, indagará el problema formal de establecer a qué figura de Derecho de autor se adecúan los contenidos creados mediante wiki. -

Sep. 2021 International Journal of Communication 10(2016), 5233–5251 1932–8036/20160005 In the Time of the Microcelebrity: Celebrification and the YouTuber Zoella ANNE JERSLEV University of Copenhagen, Denmark This article discusses the temporal changes in celebrity culture occasioned by the dissemination of digital media, social network sites, and video-sharing platforms, arguing that, in contemporary celebrity culture, different temporalities are connected to the performance of celebrity in different media: a temporality of plenty, of permanent updating related to digital media celebrity; and a temporality of scarcity distinctive of large-scale international film and television celebrities. The article takes issue with the term celebrification and suggests that celebrification on social media platforms works along a temporality of permanent updating, of immediacy and authenticity. Taking UK YouTube vlogger and microcelebrity Zoella as the analytical case, the article points out that microcelebrity strategies are especially connected with the display of accessibility, presence, and intimacy online; moreover, the broadening of processes of celebrification beyond YouTube may put pressure on microcelebrities’ claim to authenticity. Meanwhile, Ilana does not have lunch at all, but chooses to continue sleeping in the of ficebathroom, in which she smoked a joint earlier in the day. -

International Journal of Communication 3 (2009), 715-741 1932-8036/20090715 Barack Obama and Celebrity Spectacle1 DOUGLAS KELLNER University of California at Los Angeles In the contemporary era of media politics, image and media spectacle have played an increasingly important role in presidential politics and other domains of society. With the increasing tabloidization of corporate journalism, lines between news, information and entertainment have blurred, and politics has become a form of entertainment and spectacle. Candidates enlist celebrities in their election campaigns and are increasingly covered in the same way as celebrities, with tabloidized news obsessing about their private lives. In this context, presidential candidates themselves become celebrities and are packaged and sold like the products of the culture industry. In this study, I will suggest some of the ways that the logic of the spectacle promoted the candidacy of Barack Obama and how he has become a master of the spectacle and global celebrity of the top rank. I will discuss how he became a supercelebrity in the presidential primaries and general election of 2008 and utilized media spectacle to help his win the presidency. Finally, I will discuss how Obama has so far in the first 100 Days of his presidency deployed his status as global celebrity and utilized media spectacle to advance his agenda. In the contemporary era, celebrities are mass idols, venerated and celebrated by the media. The media produces celebrities and so naturally the most popular figures promoted by the media industries become celebrities. Entertainment industry figures and sports stars have long been at the center of celebrity culture, employing public relations and image specialists to put out positive buzz and stories concerning their clients, but business tycoons and politicians have also become celebrities in recent years. -

In re: Section 512 Study: May 9, 2019 Notice and Request for Public Comment Docket No. USCO-2015-7 UPDATE TO COMMENTS OF INTERNET ASSOCIATION Internet Association appreciates the opportunity to update its April 2016 comments1 on the Copyright Office’s study of Section 512 of the Copyright Act. The U.S. copyright system has a strong and innovation-oriented copyright framework that benefits consumers, protects creators’ rights, and enables innovation – including through the safe harbors and limitations and exceptions in the Digital Millennium Copyright Act (DMCA). Internet Association (IA) represents over 40 of the world’s leading internet companies.2 IA is the only trade association that exclusively represents leading global internet companies on matters of public policy. IA’s mission is to foster innovation, promote economic growth, and empower people through the free and open internet. IA member companies are leading licensees, distributors and creators of copyrighted works, as well as platforms that allow people to distribute and share the copyrighted works they have created. IA filed comments with the U.S. Copyright Office (the Office) in 2016 in response to its request for comments and participated in the public round tables held by the Office in the same year. IA has consistently held the position that Section 512 creates a balanced system that supports diverse stakeholders, providing rights holders, creators, internet companies, technology industries, and users the tools necessary to grow a robust online ecosystem. The DMCA safe harbors have achieved the goal3 established by stakeholders and policy makers: the internet has survived and thrived, benefiting creators, the public, and internet companies. -

49 The Internet Usage in the Political Campaigns: The Obama Campaign Zeynep Hamurdan Abstract One of the most important events of 2008 was the election of Barack Obama as the first African American president of the United States. His victory was stunning. Voting levels were unprecedented as 80% of the American population voted. The U.S. citizens chose the person who promised to change the status quo. We cannot explain Obama’s victory only with his intellectual background and today’s economic situation, though. Obama’s presidential campaign managers created a media campaign that was unique and successful in many ways. They used new media efficiently. They raised more than $500 million through online donations. At the end of the campaign, there were two million users, who had organized more than 200,000 campaign events. YouTube, Facebook and another 14 social network sites were also used as tools in the campaign. Many studies and analyses of this topic have said political campaigns are not going to be the same again; this campaign entirely changed media usage in political campaigns. Not only campaign managers, but also marketing researchers, advertisers and businessmen have been inspired by its success. This study consists of analytical and descriptive research. Its aim is to describe and explore Obama’s media usage, especially the new media, during the 2008 presidential campaign. This work tries to explain the reasons of the Obama team’s success. Under this view, copyright holders are at the center of the copyright universe and exercise considerable control over their exclusive rights, with the expectation that others seek prior permission for all uses of copyrighted works outside of a fair use. Though pervasive, this conventional view of copyright is wrong. The Copyright Act is riddled with gray areas and gaps, many of which persist over time, because so few copyright cases are ever filed and the majority of those filed are not resolved through judgment.
