December 30th, 1961. To the Honorable Senate and House of Representatives: Pursuant to the provisions of section forty-eight of chapter six of the General Laws, the State Racing Commission respectfully submits its Twenty-seventh Annual Report for the year ending December 31st, 1961.

COMMISSION The Commission during the past year consisted of: Leo J. Madden of Wellesley, Chairman. Appointed a member of the Com­ mission by Governor John A. Volpe on January 25th, 1961 to fill the vacancy caused by the expiration of the term of Edmund J. Burke of West Roxbury. Confirmed by the Executive Council and sworn in on Thursday, February 9th, 1961. Designated as Chairman by Governor John A. Volpe on Thurs­ day, February 9th, 1961. Term expires on January 31st, 1964. Morris H. Leff of Longmeadow. Chairman from January 1st, 1961 to Febru­ ary 8th, 1961. Term expires on January 31st, 1963. Thomas J. Fleming of Fall River. Term expires on January 31st, 1962. Edmund J. Burke of West Roxbury. Term expired on January 31st, 1961.

M eetings and H earings During the year of 1961 the Commission held thirty-seven (37) executive meetings at its office in Boston. The Commission held twelve (12) public hearings on applications for licenses to conduct horse and dog racing meetings. These hearings were held in Boston, Revere, Raynham, Dighton, Foxboro and Hancock. The Commission considered and approved the following rulings: Thirty-three (33) rulings of the Stewards of the Suffolk Downs meeting (Running Horse Racing). Fifteen (15) rulings of the Judges of the Bay State Raceway, Foxboro. Nine (9) rulings of the Judges of the Suffolk Downs Meeting (Harness Horse Racing) . Eight (8) rulings of the Stewards at Berkshire Downs, Hancock (Running Horse Placing) . Five (5) ltilings of the Judges of the Revere Racing Association, Inc., Wonderland Park, Revere. Four (4) rulings of the Judges of the Massasoit Greyhound Association, Inc. Raynham Park, Rayriham. Eight (8) rulings of the Judges of the Taunton Greyhound Association, Inc. Taunton Dog Track, Dighton. Three (3) rulings of the Stewards at the Brockton Fair. One (1) ruling of the Stewards of the Marshfield Fair. Three (3) rulings of the Stewards of the Weymouth Fair. After consideration, the Commission1 ^ ft extended 1 the suspensions imposed by the various racing officials in ten (10) cases. From the decisions of the officials of the various racing meetings four (4) appeals were filed with the Commission. Hearings were granted and held on each appeal. Decisions were rendered by the Commission on all appeals after the hearings had been held.

Legislative Committees The members of the Commission appeared before various committees of the Legislature on matters pertaining to racing. The Commission has endeavored at all times to cooperate in every way with the members of the various committees of the Legislature, special commissions established by the Legislature and other State Departments. The Commission has furnished the various committees and all other interested parties with all information requested.

R ules of R acing The Commission amended the Rules of Horse Racing after a public hearing held on March 10th, 1961, as provided by the Administrative Procedure Act (Chapter 681 of the Acts of 1954). The Commission amended the Rules of Dog Racing after a public hearing held on March 10th, 1961, as provided by the Administrative Procedure Act (Chapter 681 of the Acts of 1954). The Commission amended the Rules of Harness Horse Racing after a public hearing held on March 10th, 1961, as provided by the Administrative Procedure Act (Chapter 681 of the Acts of 1954).

Saliva and U rine T ests The Commission continued the program established in 1946 of analyzing the saliva and urine from every winning horse and any other horse designated by racing or Commission officials. Each such horse is under the surveillance of a State Police Officer and a Commission inspector from the moment the race is over untd the specimens of the saliva and urine are obtained for analysis bv the state police chemist. The samples obtained are forwarded immediately by the State Police to the racing laboratory maintained by the Department of Public Safety at 1010 Com­ monwealth Avenue, Boston, for analysis. This system has met with the approval of horsemen by reason of the pro­ tection of the samples against tampering before analysis. At dog racing meetings held during the year of the 1961 urine samples were obtained from winning greyhounds and such other greyhounds as may have been designated by racing or Commission officials. These samples were also analyzed at the racing laboratory of the Department of Public Safety 1010 Commonwealth Avenue, Boston. During the year of 1961 there were 5,413 saliva and urine samples taken and analyzed. 1 hese samples were divided as follows: Saliva Urine Horse ...... 1,124 979 Standard Bred Horse (Harness) .... 912 471 Greyhounds ...... — 1,927 2,036 3,377 Of the samples analyzed one was reported positive at a runni ng horse meeting. I his case was investigated by the Commission and after a hearing the purse in the race was ordered forfeited and redistributed on the order of 4 P.D. 155 the Commission. The owner-trainer was exonerated of all blame in connec­ tion with the case and was ordered reinstated to good standing.

U npaid Pari-Mutuel T ickets During die year of 1961 the sum of $68,524.30 was received from the several racing associations, being the entire remaining sum of pari-mutuel tickets issued during the year of 1959 and which were valid for payment but not claimed for redemption before January 1st, 1961. An audit is being conducted of the books of the various associations con­ cerning the dollar value of pari-mutuel tickets issued during the year of 1960 which were valid for payment but not claimed for redemption before January 1st, 1962. L icenses and R egistrations In accordance with Section nine-A of Chapter 128-A of the General Laws, and to aid the Commission in the enforcement of its rulings; owners, trainers, jockeys, agents and stable employees at the horse tracks; owners, trainers and agents at the dog tracks and owners, trainers, drivers, agents and stable em­ ployees at the harness tracks were all licensed. Colors, assumed names, partner­ ships, etc. were registered with the Commission. Through this system a definite record of all persons directly involved in racing is available to the Commission at all times. During the year 1961 the sum of $29,318.00 was realized from all licenses and registrations. The Com­ mission has found this system a most effective aid to its supervision.

R evenue During the calendar year of 1961 the gross revenue to the Commonwealth from licensed pari-mutuel racing amounted to $14,470,966.48 compared with $13,720,914.51 for the year of 1960. The number of day's of racing in 1961 by all licensees combined was four hundred and twenty-seven (427) compared with four hundred and twenty- four (424) in 1960. Wagering in the Commonwealth at horse and dog racing meetings amounted to $184,716,320.00 compared with $173,534,581.00 in I960. P.D. 155 5

Agricultural P urpose Fund During the calendar year of 1961 the total receipts paid into the Agricul­ tural Purpose Fund by iicensees conducting meetings in connection with State or County fairs amounted to $394,981.19. This amount compares with: 1960 $358,667.22 1959 313,291.01 1958 ...... 271,034.18 1957 255,719.18 1956 184,671.18 1955 141,764.35 1954 103,263.21 1953 125,181.63 1952 .'...... 110.214.81 1951 91,799.83 The receipts paid into this Fund by the licensees conducting racing meet­ ings in connection with State or County fairs consists only of such payments as are made under the provisions of Section 5, Chapter 128-A of the General Laws. (3t/2% of total handle over $65,000.00 daily and one-half of the breakage.)

N ational Association of State R acing Commissioners The Commission continued its membership in the National Association of State Racing Commissioners. This organization comprises the members of the Racing Commissions of twenty-six (26) States where racing is legalized as well as the supervising authorities of Canada, Mexico and Puerto Rico. The Association acts as a clearing house for changes in rules; statistical information; rulings of other Commissions and rulings of racing officials throughout the countries of North America. A regular and timely bulletin service is maintained from the office of the Secretary at Lexington, Kentucky. These bulletins contain the current rulings of all tracks and Commissions and are of vital importance in maintaining cor­ rect records of all persons connected with racing and the reciprocal enforce­ ment of rulings of other States. The Annual Convention of the National Association of State Racing Com­ missioners was held at Toronto, Ontario, Canada from June 7th to June 10th, 1961. The Massachusetts State Racing Commission was represented at this con­ vention by Chairman Leo J. Madden; Commissioner Morris H. Leff and Sec­ retary Lawrence J. Lane. The members of the Commission have taken an active part in the National Association of State Racing Commissioners with Chairman Leo ). Madden serving as Chairman of the International Relations Committee; Commissioner Morris H. Leff serving as Chairman of the Finance Committee; and Secretary Lawrence J. Lane serving as Chairman of the Committee on Licensing and Administration. N ew Legislation During the Legislative session of 1961 the following changes were made in the racing law (Chapter 128-A of the General Laws): Chapter 1—Acts of 1961—“An Act prohibiting the issuance of licenses to hold racing meetings at which the pari-mutuel system of wagering is permitted at certain locations within two miles of churches, schools or housing develop­ ments.” Chapter 137—Acts of 1961—“An Act continuing during the years nineteen hundred and sixty-one and nineteen hundred and sixty-two the temporary tax on amounts wagered on horse and dog racing meetings conducted under the pari-mutuel system of wagering.” The temporary tax of 2% provided for by Chapter 137, Acts of 1961 amounted to $3,694,326.40 during the calendar year of 1961. 6 IM ) . 155

John J. McHugh, State Police Chemist, assigned to the Racing Division of the State Police Laboratory. The Thoroughbred Racing and Protective Bureau, Inc. through its President, Spencer J. Drayton and its agent in charge in New England Vincent L. Murphy. The United States Trotting Association, through its Executive Vice President, Don R. Millar. The American Greyhound Track Operators Association through its President Joseph M. Linsey and its Secretary Frank Winchell. The Horsemen’s Benevolent and Protective Association through its National President, Irving I. Gushen and the New England Division President, Max White. Effect of H urricane Esther On Thursday, September 21st, 1961, the Taunton Greyhound Association, Inc. were forced to cancel the racing program due to the effects of Hurricane Esther. Inasmuch as this Association had been licensed to conduct dog racing to and including October Slst, 1961—this being the last day of dog racing permitted by Chapter 128-A of the General Laws, Section 3, paragraph (e) the cancelled day of September 21st, 1961 was not made up—and the Taunton Greyhound Association, Inc. in their combined meetings for 1961 conducted forty-nine (49) nights of racing, although the Commission had granted licenses for a total of fifty (50) nights to this Association.

Effect of Snow Storm—Suffolk D owns On Monday, November 20th, 1961, the Eastern Racing Association, Inc. were forced to cancel the harness racing program after the second race had been completed because of a driving snow storm which obscured the visibility, made the track very slippery and created dangerous condition for both the horses and drivers. After investigation the Commission found that it was impossible and impracticable to conduct the remainder of the racing program on Monday, November 20th, 1961 at Suffolk Downs. Upon request of the Eastern Racing Association, Inc. the Commission granted a make-up day of November 30th, 1961 to this Association in accordance with the provisions of Chapter 128-A of the General Laws, Section 4, second paragraph, as most recently amended by Chapter 521 of the Acts of 1949.

Application for license to conduct running horse racing meeting at Suffolk Downs, and Revere, Suffolk County, received on January 5th, 1961. Public Hearings held on January 17th, 1961 at the State House, Boston and on January 17th, 1961 at Revere P.D. 155 7

City Hall, Revere. License granted on January 30th, 1961 for running horse racing meeting from April 17th to July 1st, 1961, both dates inclusive, a total of sixty-six (66) racing days. License issued on March 16th, 1961. Eastern Racing Association, Inc. Application for license to conduct running horse racing meeting at Suffolk Downs, East Boston and Revere, Suffolk County, received on January 5th, 1961. Public hearings held on January 17th, 1961 at the State House, Boston and on January 17th, 1961 at Revere City Hall, Revere. Application dismissed without prejudice on January 30th, 1961 inasmuch as licenses for ninety (90) days of running horse racing permitted by Chapter 128-A of the General Laws, Section 3 (par. f) had been granted for the year of 1961. Hancock Raceway, Inc. Application for license to conduct running horse racing meeting at Berkshire Downs, Hancock, Berkshire County, received on January 4th, 1961. Public hearing held on January 23rd, 1961 at the Central School, Hancock. License granted on January 30th, 1961 for running horse racing meeting from September 18th to October 14th, 1961, both dates in­ clusive, a total of twenty-four (24) racing days. License issued on August 31st, 1961. H arness H orse R acing M eetings Bay State Harness Horse Racing and Breeding Association, Inc. Application for license to conduct a harness horse racing meeting at Bay State Raceway, Foxboro, Norfolk County, received on January 5th, 1961. Public hearing held at the Central Fire Station, Foxboro, on January 18th, 1961. License granted on January 30th, 1961 for harness horse racing meeting from June 22nd, 1961 to August 26th, 1961, both dates inclusive, a total of fifty-seven (57) racing days. License issued on May 19th, 1961. Eastern Racing Association, Inc. Application for license to conduct a harness horse racing meeting at Suffolk Downs, East Boston and Revere, Suffolk County, received on January 5th, 1961. Public hearings held at the State House, Boston, on January 17th, 1961 and at Revere City Hall, Revere, on January 17th, 1961. License granted on January 30th, 1961 for harness horse racing meeting from October 23rd, 1961 to November 29th, 1961, both dates inclusive, a total of thirty-three (33) racing days. License issued on May 19th, 1961. Eastern Racing Association, Inc. Supplementary application for license to conduct a harness horse racing meeting at Suffolk Downs, East Boston and Revere, Suffolk County for one (1) day to make up for the day of No­ vember 20th, 1961 on which day racing was cancelled after the second race, received on November 21st, 1961. The Commission found that it was impos­ sible and impracticable for Eastern Racing Association, Inc. to complete the racing program of November 20th, 1961 after the second race because of inclement weather and through no fault of the licensee. License granted on November 24th, 1961 for a make-up day of November 30th, 1961. License issued on November 24th, 1961.

D og R acing Meetings Revere Racing Association, Inc. Application for license to conduct a dog racing meeting at Wonderland Park, Revere, Suffolk County, received on December 20th, 1960. Public hearing held at Revere City Hall, Revere on January 17th, 1961. License granted on January 30th, 1961 for dog racing meeting from May 10th, 1961 to September 2nd, 1961, both dates inclusive, a total of one hundred (100) racing days. License issued on March 16th, 1961. Massasoit Greyhound Association, Inc. Application for license to conduct a dog racing meeting at Raynham Park, Raynham, Bristol County, received on December 27th, 1960. Public hearing held at Police Association Hall, Broadway, Raynham, on January 18th, 1961. License granted on January 8 P .D . 155

Application for license to conduct a dog racing meeting at the Taunton Dog Track, Dighton, Bristol County, received on January 4th, 1961. Public hearing held at the Dighton Town Office, Dighton, on January 18th, 1961. License granted on January 30th, 1961 for dog racing meeting from September 18th, to October 31st, 1961, both dates inclusive, a total of thirty-eight (38) racing days. License issued on April 5th, 1961. Bristol County Veterans Charitable Foundation. Application for license to conduct a dog racing meeting at a site “being negotiated” received on January 5th, 1961. Application dismissed on January 27th, 1961 as not being in accordance with the provisions of Chapter 128-A of the General Laws. License granted on January 30th, 1961 for dog racing meeting from September 4th to September 9th, 1961, both dates inclusive, a total of six (6) racing days. License issued on June 20th, 1961. Rehoboth Fair, Inc. Application for dog racing meeting at the Taunton Dog Track, Dighton, Bristol County, received on March 23rd, 1961. License granted on April 5th, 1961 for dog racing meeting from September 11th, 1961 to September 16th, 1961, both dates inclusive, a total of six (6) racing days. License issued on June 20th, 1961. Nantucket Agricultural Society. Application for license to conduct a harness horse racing meeting at the property of the Bay State Flarness Horse Racing and Breeding Association, Inc. Bay State Raceway, Foxboro, Norfolk County, received on March 31st, 1961. Application dismissed on April 25th, 1961 as not being in proper form in that it did not comply with the provisions of Section 3 of Chapter 128-A of the General Laws. A total of ninety (90) days were allotted to running horse racing meetings as provided by Section 3, paragraph (f) of Chapter 128-A of the General Laws. A total of two hundred (200) days were allotted to dog racing meetings as provided by Section 3, paragraph (g) of Chapter 128-A of the General Laws. A total of ninety (90) days were allotted to harness horse racing meetings as provided by Section 3, paragraph (j) of Chapter 128-A of the General Laws. A total of thirty (30) days were allotted to running horse racing meetings at State or County Fairs. A total of eighteen (18) days were allotted to dog racing meetings at State or County Fairs.
