FOR INSTALLATION, OPERATIONALIZATION AND MAINTENANCE OF DIGITAL X-RAY MACHINES IN IMAGING CENTRES AT 159 LOCATIONS IN ON PPP MODE

Sealed bids are invited from reputed agencies for the installation, operationalization and maintenance of Digital X-ray machines at 159 Government facilities in Bihar under PPP mode. The installation of Digital X-ray is proposed at 7 Government Medical College, Gardiner Road Hospital, LNJP Ortho hospital, Guru Gobind Singh hospital and 149 First Referral Units in 38 districts of the state. Competent and only seriously interested agencies are requested to submit the details of their proposal to the SHSB on or before 25/06/2014 by 5.00 P.M. through speed-post or courier only. I. INTRODUCTION

Health sector in Bihar has witnessed notable developments in the last few years particularly in fields of health infrastructure, institutional delivery & improvement in various other health parameters. The results of health initiatives in Bihar are positive and the state needs to sustain and strengthen the momentum during the coming years. Radiology Diagnostics being one of the most important components of health, second generation of reforms and positive initiatives has warranted establishment of high technology and good result Radio imaging centers in the state.

State Health Society Bihar (SHSB), thus, intends to establish Digital X-ray at 7 Government Medical College, Gardiner Road Hospital, LNJP Ortho hospital, Guru Gobind Singh hospital and 149 First Referral Units in 38 districts of the state under Public Private Partnership (PPP). The detailed location with district name can be seen at Annexure I. The agency may apply for one or more clusters as mentioned in Annexure I

II. SCOPE OF WORK

The agency will have to provide facility of digital X-ray for 24 hours free of cost to all patients coming to the health institution and being referred by the Medical Officers posted at the facility. The services will be connected with the "Sanjeevani" software/ HMIS application as and when implemented by Department of Health, installed in the health facility for registration of patients, for issuing requisition slips. The selected agency will be allotted space with ready to use electricity & water connection (both payable by the agency) in all the proposed health institutions. The selected agency will have to carry out complete civil & electrical work, employ technical manpower as well as carry out all the necessary work for the establishment of the Digital X-ray in the proposed installations. The Shortlisted agency will charge the cost of digital x-ray at CGHS, rates throughout the state.

The agency will be responsible for installing all necessary equipment with accessories and required furniture as per requirement and also for operation and maintenance of the digital x-ray equipment. The agency will also recruit and train the necessary technicians/staff for operating and managing the machines and generating reports as per requirement of the concerned hospital/State Health Society/Department of Health, Government of Bihar.

EOI Imaging Centre (2014) - SHSB The Technical Details of Digital X-ray is to be proposed by the bidders. The selected Agency will have to install latest product introduced in /globally within last 3 years. Before installation of the machines the agency will provide necessary documentary evidence (including an affidavit) of the total machines being new with the State Health Society Bihar.

III. GENERAL TERMS & CONDITIONS 1. The selected agency/agencies will have to install, operate and maintain the Digital X-ray for initial five years. The period of engagement may be extended beyond the stipulated 5 years based on performance and mutual consent of both parties.

2. Rogi Kalyan Samiti at each proposed facility will provide vacant covered space including water and electricity connection to the selected agency. Water and electricity charges will be borne by the agency. In case the electricity connection has to be upgraded, the agency would be required to do the same.

3. The selected agency will have to carry out civil work for the centre. If required, civil work of related area will also be carried out by the selected agency to ensure proper functioning and maintenance of imaging centre. 4. The agency will carry out repair works at the centre when the centre is operationalized.

5. Selected agency will set up the equipments at the Hospitals in the space identified by the institution under the project and bear all cost (cost of equipment, personnel, training facilities, repair & maintenance, transportation, security, etc.) for setting up and running of the unit.

6. The selected agency will have to provide the services of digital x-ray free of cost for educational and training purposes to the Medical Colleges & Hospitals. To the extent mentioned above, the services of the Imaging Centers at the Medical Colleges & Hospital will be placed at the disposal of the Principals/ Superintendent/ Head of the Radiology Department of the person/s authorized by them of the respective Medical Colleges & Hospitals.

6. User charges for different services will be at CGHS, Patna for all kinds of patients.

7. Sub-contracting for any part or any setup would not be allowed. The selected agency would have to report to the SHSB, the name, qualification, photograph and other relevant details of every personnel working in the proposed centre.

Selected agency will operate and maintain these centers as required by any law or board, such as the AERB norms and shall display the requisite licenses for operationalizing the same. The Agency shall also display the ‘do’s and don’ts’ for the imaging centre to prevent any hazard. The agency will also prominently display the rate chart for conducting digital x-ray at the health institution.

9. The Agency shall take all responsibility for maintaining monitoring of the Thermo luminescent Dosimeter (TLD) badges for the employees as per rule to ensure employee safety.

10. All services are to be provided as per standard guidelines prescribed by the Government and AERB. The SHSB reserves the right for third party inspection for assessment of physical and financial quality of the services being provided. 11. Before submitting the proposal, the bidder will be deemed to have satisfied themselves by actual inspection of the site and locality of the works, that all conditions liable to be encountered during the execution of the works are taken into account and that the rates quoted in the proposal are adequate and all inclusive to accord with the provisions of contract for the completion of works to the entire satisfaction of the SHSB. The SHSB, under no circumstances, would share any financial burden for any related services.

12. Force Majeure The clause of Force Majeure will be added at the time of signing the agreement with the selected agency.

13. In the event that the Highest Bidder withdraws or is not selected for any reason in the first instance (the “first round of bidding”), the Authority may invite all the remaining Bidders to revalidate or extend their respective Bid Security, as necessary, and match the Bid of the aforesaid Highest Bidder (the “second round of bidding”). In this case, two situations may arise – (i) only one Bidder matches the Highest Bidder, then it shall be the Selected Bidder. (ii) If two or more Bidders match the said Highest Bidder in the second round of bidding, then the Bidder whose Bid was higher as compared to other Bidder(s) in the first round of bidding shall be the Selected Bidder. For example, if the third and fifth highest Bidders in the first round of bidding offer to match the said Highest Bidder in the second round of bidding, the said third highest Bidder shall be the Selected Bidder

14. Number of Applications and costs thereof No Applicant shall submit more than one Application for the Project. An applicant applying individually or as a member of a Consortium shall not be entitled to submit another application either individually or as a member of any Consortium, as the case may be.

15. Nature of Partnership:

i. The State Health Society will empanel the shortlisted vendors for the next

EOI Imaging Centre (2014) - SHSB five/seven years. ii. The Agreement will then be done per cluster between concerned Rogi Kalyan Samiti (RKS) and the selected agency. The SHSB will facilitate to get all the MOU signed with each RKS in the cluster at the SHS office with all the stakeholders in one sitting after selection of the vendor. iii. The selected agency shall function under the overall supervision of Rogi Kalyan Samiti of the respective hospital. iv. The SHSB would be overall in-charge of the timely operationalization, quality control, arbitration among others.

16. Monitoring System:

a. The RKS under whose jurisdiction the hospital falls will monitor the facility. Each facility will follow the advice of superintendent/MOIC in whose jurisdiction the hospital falls for day-to-day activity. The agency will be free to have its own administrative system for management of its facility but it will have to take into consideration the advice and monitoring of operational activity from the competent authority of the RKS. b. At the end of each month, within 5th day of the next month, the agency will be required to submit monthly report in a prescribed format on the activities and result areas for the month to the concerned Rogi Kalyan Samiti (RKS), District Health Society (DHS) and State Health Society Bihar (SHSB). c. DHS/RKS will make one visit in three months to the facilities as part of monitoring activity. The monitoring can be comprehensive in terms of quality control, usage of manpower, cleanliness of the premises among others. The frequency of monitoring visits may be increased as necessary. d. The agency in consultation with SHSB will develop the quality assurance systems for ensuring quality of services. The agency will have to abide by these guidelines. e. The SHSB, as mentioned earlier, would monitor overall functioning, quality control, timely operationalization among others of the Imaging centres. SHSB would act as an arbitrator in case of any dispute or lack of co ordination between the agency and the different RKS. f. In the event (supported by necessary evidence) of any agency following any malpractices including charging the patients at rates other than CGHS rates/ flouting government guidelines, the matter would be reported immediately to the State Health Society Bihar, which after following due process may impose financial fine on the agency and may also order the termination of the contract. The decision of the SHSB in this regard would be final.

17. The Agency shall provide the following and shall he responsible for the same: a. The centres should function 24 X7. b. The reports must be of highest quality standard.

The agency shall be responsible for hiring qualified technical personal as per guidelines and Standard Operating Procedures (SOPs) and training them for running the centers. d. The agency shall be responsible for generating reports for the x-rays conducted by Radiologists, either by a locally engaged one or through a Central Reporting System which would have to be established by the agency itself. e. The agency shall maintain the premises and it shall be the responsibility of the agency to carry out disposal of waste of the center as per the Biomedical Waste (Management and Handling) Rules, 1998. f. The agency shall obtain all necessary provision and business such as laboratory licenses, Trade license from state. Centre agency as relevant and comply with all statutory requirements for running the Centre and produce relevant documents during inspection by statutory authorities. g. The Agency shall be responsible for running the Centre as per Atomic Energy Regulation Board norms. h. Agency shall be responsible for setting up of their own operations in respect of inventory management, customers servicing, financing accounting, record keeping and MIS. i. Agency shall coordinate with superintendent/MOIC concerning operational activities, patient servicing on day to day basis. j. Agency shall make provision for a suggestion box to give feedback based on which remedial action would be taken for patient/ customers satisfaction through a services mechanism. k. Equipment/ system should be certified/accredited by relevant authorities wherever applicable. It must be highlighted here that all the equipments installed in the facilities have to be brand new with annual maintenance contract, where ever applicable. The agency will have to submit documentary proof with the SHSB about procurement of every instruments and equipment installed in every facility. l. All internet usage charges have to be met by the agency, if applicable. The hardware and software for internet usage has also to be provided by the agency. The agency will have to provide 24 hrs power back up. m. The agency will have to set up a silent generator sufficient to run the machinery & accessories installed to provide electricity supply during power cuts/breakdowns. n. The Bidder shall be responsible for all of the cost associated with the preparation of the EOI. The SHSB will not be responsible for any cost, regardless of the conduct for outcome of the bidding process.

18. Delivery and installation: The Imaging Centre shall be installed and commissioned within 3 (three) months from the date of handing over the premises with proper power and water supply by the hospital to the agency.

EOI Imaging Centre (2014) - SHSB 19. Payment Terms & Security deposit: Bank Guarantee of appropriate amount per centre has to be deposited with the SHSB by the selected agency at the time of signing of the agreement.

20. Uptime guarantee: During the contract period, the agency shall ensure that machines are not out of order for a maximum period of 60 hours in a month.

21. Penalty Clause: The agency will be bound to establish the unit within the stipulated period as mentioned above, failing which the following penalty will be levied on the agency. a. For delayed setting / non-setting up of Unit in any cluster: A penalty of INR 10,000/- per day will be imposed for each day delayed in setting up a unit. Delay beyond 90 days in setting up of unit shall result in termination of contract and seizure of Bank guarantee submitted by the agency for the whole cluster. After the termination of the contract, the bank guarantee will be revoked and no money shall be returned to the agency. Such matters are to be reported by the RKS to SHSB which would arbitrate on such matters after following due process. b. In case of downtime of more than 24 hours: A penalty of INR 10,000/- would be imposed for each day of the downtime after the first 24 hours. Such matters are to be reported by the RKS to SHSB which would arbitrate on such matters after following due process. c. If after the award of the work to the concerned agency for installing and running the Digital X-ray unit the agency withdraws, then the PBG submitted by the agency may be encashed by SHSB.

22. Correctness and Completeness of Imaging Centre: The Centre should be correct and complete in every aspect with all the mounting fitting, fixtures, standard accessories which are normally supplied even though not specifically listed out in the technical specification. 23. The Agency will have to procure and install the equipment/ fixtures/ articles manufactured only by the reputed companies/ manufacturers. They will have to indicate the name of manufacturers in the bid document which will be duly approved by the Technical Committee of the SHSB before executing the work. 24. The agency will have to keep the soft copies of the Digital X-rays at least for a period of one year. This may be more than a year in medico-legal cases. 25. The agency will have to meet the NABL standards for each imaging centre within three years of commissioning at their own costs. NABL will be a pre-requisite/ eligibility criteria for the extension of the contract. Failure to attain NABL accreditation would be considered as a violation of the contract. 26. Medico-legal cases: In the event of any medico-legal arising out of unethical practice or medical negligence/ quality of reporting by the agency, the legal and financial responsibility will have to be borne by the concerned agency. 27. Agency interested in this work should be following ethical practice of provision of undisturbed patient care services irrespective of the clarification or issues that may

EOI Imaging Centre (2014) - SHSB be needed to be sorted with the local authority or state authority during the project period. In the event of evidence against this, the firm will be blacklisted for the future man days of the contract.

IV. ELIGIBILITY CRITERIA: The exact eligibility criteria of agencies will be discussed and finalised at RFP stage.

V. SUBMISSION REQUIREMENTS Interested Agencies wishing to undertake the above task on behalf of State Health Society Bihar, may submit their application in a sealed envelope marked “EOI FOR DESIGN, INSTALLATION, REFURBISHMENT, OPERATIONALIZATION AND MAINTENANCE OF IMAGING CENTRES IN GOVERNMENT MEDICAL COLLEGE & HOSPITALS, 33 DISTRICT HOSPITALS AND LNJP ORTHO HOSPITAL RAJVANSHI NAGAR, PATNA IN BIHAR ON PPP MODE”. Agency is required to clearly indicate the relevant page number against each of the submission requirements mentioned below in the cover letter/application accompanying the proposal. There should be two sealed envelopes, one each for (i) technical proposal, and (ii) financial bid. The contents of each envelope are discussed below.

i. TECHNICAL PROPOSAL The technical proposal should include following documents: a. Cover letter to participate as per Annexure - III b. No-conviction certificate for the last three years submitting affidavit from Magistrate that they are not blacklisted by any Govt. Dept. /Govt. organization and/or the Competition Commission of India/ Central Vigilance Commission/ Comptroller and Auditor General of India for bid rigging & cartelization/ pending cases to this effect in the court of law as per Annexure - IV. c. A Power of Attorney for signing of Proposals needs to be furnished in favour of Authorised Signatory as per Annexure - V. d. Contact details of the experts responsible for implementation of the project e. Detailed information about equipment including make, manufacturer, warranty, etc. of the proposed machines. This may include data sheet of the proposed machines.

ii. FINANCIAL PROPOSAL The agency would be required to submit their financial quotations at the RFP stage in the proposed format at Annexure VI. The format may be revised at the time of floating the RFP.

VI. OTHER CONDITIONS 1. Applicants will be deemed to have understood and agreed that no explanation or justification on any aspect of the Bidding Process or selection will be given. 2. The Authority reserves the right to reject any Application which is non-responsive and no request for alteration, modification, substitution or withdrawal shall be entertained by the Authority in respect of such Application. 3. Safe custody of equipment: The GoB will try to provide a space wherever possible for the vendors for safe keeping of the materials under lock and key. However, the

EOI Imaging Centre (2014) - SHSB GoB is not responsible for the safety of the material stocked within the hospital premises and the vendors will have to make their own arrangements for the same.

VII. SUBMISSION DEADLINE AND ADDRESS: Completed Expression of Interest in English in a sealed envelope marked as “Expression of Interest for Setting Up & Operating Imaging Centre in Government Hospitals in Bihar under PPP mode” should reach the office of Executive Director, State Health Society Bihar, Sheikhpura, Patna - 800014 by 5:00 p.m. on 25/06/2014 through registered post/ courier/ speed post.

The decision of SHSB to accept or reject any or all of the application(s) shall be final and binding. The State Health Society Bihar reserves the right to modify the terms & conditions partially or wholly or cancel the tender without assigning any reason.
