THIS SIDE UP: TIZ THE MALATHAAT & MARACUJA REMATCH IN ALABAMA STORY OF A TRUE Maracuja (Honor Code) put an end to 'TDN Rising Star' Malathaat (Curlin)'s unbeaten record when they last met in MAGICIAN Saratoga's GI CCA Oaks July 24. Now that GI Kentucky Oaks winner will try to turn the tables on that foe and return to winning ways as the even-money, morning-line favorite in Saturday's prestigious GI Alabama S. going an additional furlong at the Spa. A perfect three-for-three as a juvenile, capped by a victory in the GII Demoiselle S., Malathaat kicked off her sophomore campaign with a head success in Keeneland's GI Central Bank Ashland S. Apr. 3. The $1.05-million KEESEP acquisition rallied to a gritty victory in the Kentucky Oaks Apr. 30 and led every step of the way in the CCA Oaks before being worn down late by Maracuja to be second by a head. A few summers ago, I sitting alone in the baronial boardroom at Spendthrift, waiting to interview the farm's owner. It was a hot day, but here all was panelled cool, the venerable furnishings slumbering through the prosperous drone of a lawnmower. I was thinking about this apt conflation of heritage and modernity when startled by the entry of a tanned octogenarian whose casual apparel, in the round, must have cost rather less than a typical pair of socks on Wall Street. B. Wayne Hughes apologized for running a little late, slouched into a chair, and gave the kind of smile you hope to see from the fellow who takes up his place next to you in the bleachers. By the time we had finished, of course, I understood that even the immense riches that had funded the Spendthrift revival were nothing compared with the inner wealth of this extraordinary human being. Of course, he couldn't have accumulated one without the other--but nobody fortunate to have borrowed his insights for an hour or two would be so crass as to measure the man we lost on Wednesday merely by his worldly assets. When I have that kind of money, I must likewise see through the trappings; and remember that someday we will all be reduced, by our shared mortality, to the basic human equation: a finite existence that spans infinite possibilities of conduct, but only one ultimate outcome.

There's a consoling paradox to the fact that the B. These latter will be discovering little comfort in the reflection that Hughes was one of the greatest of all "winners" in the game of life. By all accounts, Hughes remained to the end as restlessly full of ideas as he had been the morning of our meeting, when he had just made an offer for a stallion--an investment, as he noted, he couldn't begin to judge for at least four years. LETTERS TO THE EDITOR LETTER TO EDITOR: POTENTIAL ARLINGTON PARK SALE AN ANTITRUST VIOLATION FANDUEL NAMED TITLE PARTNER AT KENTUCKY In your article, "Arlington Horsemen Beg for Help," published Aug. 17, it is was stated by President Michael Campbell of the DOWNS Illinois Thoroughbred Horsemen's Association (ITHA) at the public comment period before the Illinois Racing Board, that Churchill Downs may not sell Arlington Park to the highest bidder in order to avoid competition. Mr. Cambell said, it is "the worst-kept secret in Illinois--and we all know it--is that Churchill Downs and [that corporation's business entity at] Rivers is attempting to eliminate at Arlington Park because they're afraid that it will turn into a [competing] gaming location." I offer no opinion whether the facts asserted by Mr. Cambell are true or not. That said, as an attorney, I would be of the opinion that were it true that Churchill Downs would not sell a racetrack to the highest bidder if it were part of a horse racing operation, this would constitute a serious antitrust violation. This smells of a market boycott so as to prevent or extremely hamper a potential competitor from competing. Ordinarily this Kentucky Downs | Coady would be bad, but in a highly regulated industry such as horse With Kentucky Downs and FanDuel entering into a three-year racing that inherently limits market entry by government partnership, the upcoming six-day meet at Kentucky Downs has regulation, this is particularly egregious. Bid rigging, refusals to been renamed the FanDuel Meet at Kentucky Downs. Cont. p11 injuries. I would remind the public that apart from being a civil violation, antitrust violations can be criminal. By way of example, members of the then mighty General Electric Company were sent to jail in the early 60's for antitrust violations committed in the late 50's. Suffice it to say, what I read was sufficiently disturbing (if the facts turn out to be true) that I hope the Antitrust Division of the Department of Justice looks into it. The behavior might violate the Illinois Antitrust Act which, among other things, makes it illegal to "Establish, maintain, use, or attempt to acquire monopoly power over any substantial part of trade or commerce of this State for the purpose of excluding competition." One of the more complex issues is standing to sue for these antitrust violations. Certainly the would-be gambling industry competitor that offered the highest bid would certainly seem to have standing to sue.
