Minutes of 109th SEAC-3 meeting held on 8-9-10 June, 2020 through Video Conference

The tenure of SEIAA/SEAC‟s in the State of ended on 16th March 2020. The MoEF&CC informed to the Maharashtra SEIAA by an e-mail stating that, the tenure of SEIAA, Maharashtra has been extended up to 16.06.2020

In view of above communication and present pandemic situation of COVID-19, Maharashtra SEIAA directed SEAC-3 to appraise the proposals by using information technology facilities. Hence, SEAC-3 initiated to appraise the proposal received by the SEIAA through Videoconferencing technology from 8th June, 2020 to 10th June, 2020. All the members confirmed that they have received information pertaining to the proposals considered in this meeting through e-mail.

The proposal was discussed on the basis of the documents submitted and presentation made by the proponent.

The Committee observed that the proposal was considered in 70th, 74th & 77th SEAC-3 meeting. In 77th SEAC-3 meeting the proposal was previously appraised by SEAC-3 for FSI area of 1,52,714.10 m2, Non FSI area of 1,26,760.64 m2 and total BUA of 2,79,474.74 m2 and the proposal was recommended for grant of EC for aforesaid figures of FSI, non-FSI and TBUA.

Then case was discussed in 151st & 162nd SEIAA meeting. As per decision taken in 162nd meeting of SEIAA, EC was granted vide no. SEIAA-EC-0000001454 dated 05.04.2019 restricting to total built up area of 1,45,517.65 m2. (FSI: 93,394.07 m2 & non FSI: 52,123.58 m2) as per sanction dated 21.02.2019 vide no.CC/3665/18.

Further on 28.01.2020 PP had obtained revised sanction vide no. CC/2627/19 for total FSI area of 2,83,343.92 m2.

On 09.03.2020, PP had applied through PARIVESH portal for issuing the EC for total built up area for which appraisal was done in 77th SEAC-3 meeting i.e. 2,79,474.74 m2. (FSI: 1,52,714.10 m2 and Non FSI: 1,26,760.64 m2).

PP has informed that there is no change in project configuration and environmental parameters as per appraisal made by SEAC-3 in its 77th Meeting.

During discussion following points emerged: (1) PP to revalidate NOCs viz. for Water Supply, Drainage, CFO, Garden, Solid waste management etc. if expired. (2) PP to envisage bio medical waste management plan, especially for disposal of masksetc.

In view of above, the Committee decided to refer the proposal to SEIAA for further needful action. ******

(b) PP to propose provision of dialysis units to Government Hospital. (c) PP to submit number of solar lights and RWH units to be provided. (d) Activity of improvement of sewerage system is job of local body hence not allowed. PP to propose provision of electric crematorium / ambulance etc. (2) PP to obtain NOC for water supply with quantity from competent authority. (3) PP to ensure that excess treated waste water will be disposed in sewer line provided by local authority. If the same is to be disposed in nearby nalla, PP shall ensure that treated effluent meets standards for disposal into inland surface waters prescribed by CPCB / MoEF&CC. The Committee noted that Show cause Notice/Proposed Directions u/s 5 of the Environment (P) Act, 1986 r.w. EIA Notification dated 14.09.2006 vide letter dated 31.01.2020 was withdrawn by Environment Department, GoM, vide letter no.No. Comp-2020/CR-01 /SEIAA February 18.02.2020. The case was discussed on the basis of the documents submitted and presentation made by the proponent. All issues relating to environment, including air, water, land, soil, ecology, biodiversity and social aspects were examined. The proposal is appraised as category 8(a)B2.

During discussion following points emerged: (1) PP to revise parking layout plan showing the number of parking required for multiplex as per DCR and provide in such a way that cars are able to manoeuvre independently as it is a multiplex public parking. Parking for commercial building shall be independent of multiplex building. PP to submit details of fire tender movement plan and basement ventilation plan. (2) PP to submit co-ordinated master layout superimposing all environmental parameters and UGT sections. (3) PP to obtain and submit following NOC‟s: (a) Water supply with quantity, (b) solid waste / e- waste management.

E.9 1033 Atria Grande at S. No. 2/2/1, 2/1/1, 6/3/4, Autade Handewadi, Haveli, Pune by Atria Constructions. PP / Consultant were unable to present the proposal due to technical / connectivity problems. The proposal was deferred. ******

E.10 3490 „The Nook‟ at S.No. 60/1-2, Behind D.Y. Patil College, Tathawade, Mulshi, Pune by by M/s Pyramid Developers. PP had submitted application for prior Environmental clearance for total plot area of 29144.64 m2, FSI area of 52178.30 m2, Non FSI area of 41335.47 m2 and total BUA of 93513.77 m2.

The Committee noted that the PP was issued Stop Work Notice vide directions u/s 5 of Environment (Protection) Act, 1986 vide no. SEAC-III-2014/CR-262/TC-3 dt.25.03.2015, which mentions that PP has constructed total BUA of 16846.99 m2 at site.

Further As per MoEF & CC notification dated 14.03.2017, PP has applied for grant of ToR to MoEF & CC on 14.06.2017 as Category „A‟ Project . The same was transferred to SEIAA, Maharashtra, on 12.03.2020 as Category „B‟ Project.

Now, PP has applied as per the MoEF&CC Notification dated 8/03/2018 and informed that the total constructed area on site till date is 30372.90 m2 ( FSI :-17765.41 m2 and non-FSI:- 12607.49 m2).

Thus it is prima facie observed that PP has continued construction activity even after receiving stop work directions u/s 5 of Environment (Protection) Act, 1986 on dt. 23.03.2015.

PP to clarify the difference between above mentioned two figures regarding actual construction work carried out till date with supporting documents. The proposal will be considered and appraised after receiving the same.

PP requested for time to submit the information sought; after deliberations committee asked PP to comply with the observations and submit information to the committee for further discussion and consideration of SEAC. ******
