Under contract with the Federal Emergency Management Agency (FEMA), the Homeland Security Operational Analysis Center (HSOAC) provided substantial support in developing the plan by soliciting and integrating inputs from a wide variety of stakeholders, contributing analysis where needed, and supported drafting the plan. The plan included an overview of damage and needs, courses of action to meet those needs, estimated costs of the courses of action, and potential funding mechanisms for those costs. To support federal agencies evaluating and funding recovery actions, HSOAC is releasing this detailed volume for the transportation sector. The purpose of this document is to provide decisionmakers greater detail on the conditions in Puerto Rico prior to the 2017 hurricane season, damage from Hurricanes Irma and Maria, courses of action that were identified to help the sector (and, more broadly, Puerto Rico) recover in a resilient manner, potential funding mechanisms, and considerations for implementers as they move forward. This document will likely also be of interest to other stakeholders funding or implementing recovery activities, including government of Puerto Rico and local agencies, nongovernmental organizations, and the private sector. Furthermore, this body of material contributes to the larger literature about disaster recovery and resilience, and may be of interest to other communities planning for or recovering from similar disasters. This research was sponsored by the Federal Emergency Management Agency and conducted within the Strategy, Policy, and Operations Program of the Homeland Security Operational Analysis Center, a federally funded research and development center (FFRDC). About the Homeland Security Operational Analysis Center The Homeland Security Act of 2002 (Section 305 of Public Law 107-296, as codified at 6 U.S.C. § 185), authorizes the Secretary of Homeland Security, acting through the Under Secretary for Science and Technology, to establish one or more FFRDCs to provide independent analysis of homeland security issues. The RAND Corporation operates HSOAC as an FFRDC for the U.S. Department of Homeland Security (DHS) under contract HSHQDC-16-D-00007. The HSOAC FFRDC provides the government with independent and objective analyses and advice in core areas important to the department in support of policy development, iii decisionmaking, alternative approaches, and new ideas on issues of significance. The HSOAC FFRDC also works with and supports other federal, state, local, tribal, and public- and private- sector organizations that make up the homeland security enterprise.     Storm Water Management Program Regulated MS4 1.0 Introduction The Storm Water Phase II regulations became effective on December 1999 under the jurisdiction of the Environmental Protection Agency (EPA). They required operators of Small Municipal Separate Storm Sewer Systems (MS4) to secure a National Pollutant Discharge Elimination System (NPDES) Permit to regulate the discharge of storm water runoff from their systems into surface bodies of waters of the United States. Although the Department of Transportation and Public Works (DTPW) and the Puerto Rico Highway and Transportation Authority (HTA) are not municipal entities, the definition of regulated systems, also incorporated the discharges of storm sewer systems operated by public entities like the mentioned agencies as part of the regulated community. The regulations also required the development of a Storm Water Management Program (SWMP) as a tool to satisfy some water quality requirements and minimum technology standards detailed in Clean Water Act (CWA) amendments. 1.1 Regulatory Background The CWA establishes the basic structure for regulating discharges of pollutants into the waters of the United States and quality standards for surface waters. The origins of may be traced back to 1948, where the Federal Water Pollution Control Act was enacted. This Act was significantly reorganized and expanded in 1972. When it was amended in 1977, it became commonly referred to as the CWA. It was under this new name that EPA began the implementation of pollution control programs that start setting wastewater standards for the industry. It also established water quality standards for a wide range of contaminants in surface waters. The act made unlawful the discharge of pollutant from defined (or point sources) into navigable waters, unless a permit was obtained.

In 1950, Congress enacted legislation (P.L. 81-600) authorizing Puerto Rico to hold a constitutional convention and in 1952, the people of Puerto Rico ratified a constitution establishing a republican form of government for the island. After being approved by Congress and the President in July 1952 and thus given force under federal law (P.L. 82-447), the new constitution went into effect on July 25, 1952. Puerto Rico is subject to congressional jurisdiction under the Territorial Clause of the U.S. Constitution. Over the past century, Congress passed legislation governing Puerto Rico’s relationship with the United States. For example, residents of Puerto Rico hold U.S. citizenship, serve in the military, are subject to federal laws, and are represented in the House of Representatives by a Resident Commissioner elected to a four-year term. Although residents participate in the presidential nominating process, they do not vote in the general election. Email: [email protected] Abstract: : In the 1940s, when the Governor of Puerto Rico was appointed by the US President and the Puerto Rican government was answerable only to the US Federal government, a large state-owned enterprise (SOE) sector was established on the island. Public services such as water, transportation and energy were nationalized, and several new manufacturing SOEs were created to produce cement, glass, shoes, paper and chalkboard, and clay products. These enterprises were created and managed by government-owned corporations. Later on, between 1948 and 1950, under the island’s first elected Governor, the government sold these SOEs to private groups. This paper documents both the creation and the privatization of the SOE sector in Puerto Rico, and analyzes the role played by ideology, political interests, and economic concerns in the decision to privatize them. Whereas ideological factors might have played a significant role in the building of the SOE sector, we find that privatization was driven basically by economic factors, such as the superior efficiency of private firms in the sectors where the SOEs operated, and by the desire to attract private industrial investment to the Puerto Rican economy.
