A survey of the site was undertaken on 22nd July 2014 and the report published: Ecological Constraints Report – Llys Y Frân Reservoir, Pembrokeshire (AECOM, 2014) (Appendix A, Figure 1). The site (as defined by the Site Boundary in Appendix A, Figure 2) lies within Afonydd Cleddau/Cleaddau Rivers Special Area of Conservation (SAC) and Afon Cleddau Dwyreiniol/Eastern Cleddau River Site of Special Scientific Interest (SSSI) (Appendix A, Figure 3). Amco Energy intends to submit a planning application for the installation of a hydroelectric turbine and associated infrastructure at the Llys-y-Frân site (the “proposed development”). Under the European Directive 92/43/EEC (The Habitats Directive), the competent authority (in this instance Natural Resources Wales) is required, to ascertain whether the proposed development has the potential for Likely Significant Effects (LSEs) on sites with European Designations including Special Protection Areas (SPAs), Special Areas of Conservation (SACs) and Ramsar sites (all hereafter referred to as Natura 2000 sites). Where LSEs are identified, the competent authority is required to make an Appropriate Assessment of the implications of the proposed development on those sites in view of those site's conservation objectives. Guidance (David Tyldesley and Associates, 2011; EC, 2000 & 2001) states that if, as a result of HRA screening, the developer concludes that there is no LSE on a European site, sufficient information must be provided with the planning application to allow the competent authority to assess and review the information and make its own determination that there are no LSE’s, and be satisfied that there is no residual effect. A developer should provide reasons why it is considered that an Appropriate Assessment will not be required and provide confirmation from the nature conservation body that this conclusion is supported. This HRA conclusion should be explained in a ‘No Significant Effects Report’. If there are likely to be significant effects on a European site, a Statement to Inform Appropriate Assessment (STIAA) should be prepared and submitted with the planning application to enable the competent authority to undertake an Appropriate Assessment. Appropriate Assessment considers if the likely significant effects will adversely affect the integrity of the site in view of its conservation objectives. The guidance identifies that it is the responsibility of the developer to include ‘sufficient information’ with the planning application at acceptance to identify the European sites and to enable the Appropriate Assessment to be made, if required. 1.2 The Proposed Development Llys y Frân Reservoir dam and associated infrastructure controls the flow release to the Afon Syfynwy in order to support abstraction at Dwr Cymru Wlesh Water’s (DCWW’s) Canaston Bridge pumping station, located approximately 15km downstream. The reservoir currently feeds an existing 30kW Gilkes Turgo turbine, which discharges approximately 13megalitres (ML)/day (150litres/second). The proposed development seeks to take advantage of the energy available in the outlet discharge by connecting a new transfer pipe from one or both of the existing outlet pipes to a new hydroelectric turbine located in a new turbine house. The water from the turbine house would then discharge into the existing stilling basin via a discharge chamber and the power generated would be fed to a new standalone transformer building. The development would be located immediately downstream of the Llys-y-Frân Reservoir spillway within the existing DCWW site. The candidate turbine being proposed is the ‘Francis turbine’ by Gilkes and the power generated would be exported to the National Grid through the existing grid connection. The proposed layout of the scheme is shown in Appendix B. The proposed development will include the erection of a new turbine house within a hardstanding area with perennial vegetation growing in cracks in the mortared stone pitching and a new transformer house within an area of dense scrub (Appendix A, Figure 4). Associated buried cables will run through hardstanding with perennial species, hardstanding and scrub habitats. Areas of hardstanding with perennial species, scrub and hard standing on site will be removed as part of the development. AECOM Llys Y Frân Reservoir Proposed Hydroelectric Turbine Installation Habitat Regulations Assessment Stage 1 Screening Report 2 Capabilities on project: Environment The proposed construction works require a partial and/or full drain of the standing water present within the stilling basin within the site boundary and the flow from the reservoir above into the stilling basin to cease. The drained water will discharge into the Afon Syfynwy and the water from the reservoir will be redirected via an existing valve into the Afon Syfynwy. The assessment of the potential impacts of the scheme on Natura sites is based on this current understanding of the proposed development. 1.3 Rationale The construction of the proposed turbine and associated infrastructure, and the operation of the completed turbine have the potential to have a significant effect on the designation features and conservation objectives of the Afonydd Cleddau/Cleaddau Rivers SAC. EC Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora (the Habitats Directive) requires that a Habitats Regulations Assessment (HRA) is carried out for a proposed scheme to inform the decision making process when the proposed scheme may have a significant
