Ron Perez led the effort to care for and rehome the 177 horses who were seized on Paragallo=s Center Brook Farm in Climax, New York, after they were found to be seriously malnourished during an April, 2009 raid. Wilhelm said that Paragallo was also ordered to pay additional restitution in a yet-to-be deter- mined amount to the Columbia- Greene S.P.C.A. and another non-profit organization which bore some of the burden for car- ing for the horses. Wilhelm said that Paragallo was ordered to serve one year in jail for each of the 33 counts, to be served con- secutively, but that the maxi- mum allowed for multiple misde- Ernie Paragallo meanor convictions was two NYRA photo years. "The fact that Mr. Paragallo neglected his responsibilities to his horses under the criminal law has been decided during the recent trial culminating with his conviction in Greene County Court. Our action today will initiate a hearing into whether he violated his responsibility as a Board licensee to racing and the welfare of horses and, if so, what may be the appropriate administrative penal- ties." WHO GOT LUCKY? Almost nobody begrudged Lookin at Lucky (Smart Strike) finally getting a clean trip and winning last Satur- day=s GI Preakness; he deserved it. He=s been the most consistent member of this crop from the word go, and he=s another great advertisement for his sire. Who knows, had he had a clean trip in the GI Kentucky Derby, he might even be a contender right now to win the Triple Crown. He=s an admirable colt with an excel- lent record. But.... The >but= is that his winning Beyer figure of 102, coupled with the proximity of the first four, clustered within two lengths, confirms two things: that those North American three-year-olds left standing are going to have to improve markedly to hold their own against older horses later on; and that the now-retired Eskendereya stood head and shoulders above the survi- vors. The case for the latter assertion is based on Preakness third Jackson Bend, by Carson City=s for- merly obscure son Hear No Evil being beaten under a length by Lookin at Lucky; he was blown out by an average of nine lengths when twice running second to Eskendereya earlier this year; in the GII Fountain of Youth S. and the GI Wood Memorial. Preakness fourth Yawanna Twist, by Yonaguska (now standing in Tur- key, but also sire of last year=s Preakness third, Musket Man) had run Beyers of 96 and 94, respectively, when second to Awesome Act in the GIII Gotham S., and to American Lion in the GIII Illinois Derby. Though Jackson Bend and Yawanna Twist improved to the 99-101 range, along with pacesetter and second-place finisher First Dude (Stephen Got Even), the overall profile of this crop of North American three-year-olds is not so im- pressive.
