It was the penultimate event for the UFC in 2011. The event featured eight fights on television internationally, seven preliminary bouts aired on cable in the United States and Canada, and three preliminary bouts were broadcast live on Facebook. In the co-main event, Frank Mir, who was the first man to knock out Antonio Rodrigo Nogueira at UFC 92, became the first person to represent Nogueira. The world accomplished the feat with a kimura that eventually broke Nogueira's arm. In the main event, Lioto Machida also suffered his first performance defeat at the hands of John Jones. At the same time, Jones retained the UFC light heavyweight title. The background fight between Lioto Machida and Phil Davis was originally announced by the UFC president, Dana White, to happen at UFC 140. However, White, upon learning that Davis is still recovering from a knee injury, admitted to jumping the gun on the ad. Early reports also included a light-heavyweight bout between John Jones and Rashad Evans. First, Evans needs to be medically cleared after surgery, which requires pins to be inserted into his right arm due to injury during his technical knockout victory over Tito Ortiz. When it became clear that Evans would not be ready for the fight, he was replaced by Machida for the championship fight. Jon Jones won the UFC light heavyweight championship earlier this year after defeating Mauricio Rua at UFC 128 by TKO. Six months later, Jones defended the title after presenting the former UFC light heavyweight champion at UFC 135. Lioto Machida himself is a former ufc light heavyweight champion, winning the title through a knockout victory over Rashad Evans at UFC 98 in 2009. Mahida lost the title a year later to Mauricio Rua at UFC 113, the same man from whom Jones won the title in Rua's next outing. Machida's only career losses were to Rua and Jackson, both of whom Jones had beaten earlier in 2011. The co-main event was a rematch between Frank Mir and Antonio Rodrigo Nogueira. They fought about three years ago when Nogueira was the interim UFC heavyweight champion, at UFC 92. In this match, Mir became the first person to beat Nogeria on a stoppage, thanks to a technical knockout in the second round. Another Nogueira's twin brother, Antonio Rogerio Nogueira, was involved in the fight when he collided with Tito Ortiz. The pair were originally due to fight at UFC Fight Night in March 2011. However, when Ortiz withdrew due to injury, he was replaced by Phil Davis. Plans for UFC 140 were originally paired with Ortiz vs. Rich Franklin. Shoulder surgery required Franklin to withdraw from the fight; Franklin had been replaced by Ortiz's original rival eight months earlier, Nogueira. Rory McDonald was due to face Brian Ebersol at the event. However, on November 8, McDonald withdrew due to injury and was replaced by Claude Patrick. Patrick was originally scheduled to face Rich Attonito at a pre-map event. Rich Atonito stayed on the pre-map and collided with UFC rookie Jake Hecht. Dennis Hallman missed the weight allowance for his easy return, weighing in at 158.5 pounds. He was fined 20% of his earnings for the fight and his fight with John Makdessi was subsequently changed to a catch weight fight. The UFC 140 event consisted of twelve mixed martial arts bouts sanctioned by the Ontario Athletics Commissioner under MMA rules established by the New Jersey Sports Control Board and often referred to as the Uniform Mixed Martial Arts Rules. The championship match between John Jones and Lioto Machida was scheduled for five five-minute rounds. The event was scheduled to feature four pre-match live matches on Ion Television and on Sportsnet in Canada, as well as three pre-match matches streamed on Facebook. Due to the early end of the televised preliminary fights, three fights on Facebook were also broadcast on cable. Attendance at the Air Canada Centre is reported to be just over 18,000, bringing in nearly $4 million from ticket sales. It was reported that the pay-per-view fee was 485,000. Preliminary map of the first fight of the evening was between Mitch Clark and John Cholis. In the second round, Clarke tried an octail. During the fight, Cholish managed to find Clark's back. Cholish flattened Clarke and started hitting Clarke until referee John McCarthy stopped the fight. Cholish won the fight at 4:36 of the second round, thanks to a technical knockout that gives Clark his first professional defeat in MMA. Rich Atonito collided with Jake Hecht in the second fight of the evening. Attonito controlled the fight in the first round following a takedown and injured Hecht while on top of it. In the second round, Atonito again tried to carry the score, but Hecht hit Atonito in the temple with elbow punches, defending the rout. Attonito went down and Hecht continued to beat him until the referee finished the fight. Jake Hecht defeated Rich Atonito by TKO 1:10 in his UFC debut second round. Canadian-born Mark Bocek's fight with Nick Lentz lasted all three rounds. Bocek was able to take Lenz down on his own score and consistently on top of Lenz throughout the fight. Lentz was not very active from the bottom, although he was able to prevent Boczek from passing his guard. Lentz tried several times to use the guillotine, but unsuccessfully filed a sidek. The judges' decision went to Mark Bokek, 30-27, as a result of which Lenz got his first defeat in the UFC. In the first fight of the evening, which was broadcast on cable television, Yves Jabwin collided with Walel Watson in the second fight of the night to go the entire distance. Most of the battle took place with both fighters on their feet. Watson used his longer coverage and height to hit from distance, with Jabouin trying to get close to the ground for harder punches. The second and third rounds also saw Watson attempt to present his opponent with a choke. As a result, the judges scored the fight by a split decision in favor of Yves Jaboin. John Makdessi then faced Dennis Hallman in a catchweight bout due to Hallman's inability to make weight for the fight. Seconds after the fight began, Hallman was able to take Makdessi down, mount him and start the ground and pound Makdessi. Makdessi rolled over in an attempt to defend himself, causing Hallman to pick him up behind his back and use a back naked choke. Dennis Hallman gave John McDessi his first career loss due to a submission with a back-naked choke at 2:58 of the first round. After that, Hallman said his victory should have an asterisk, since he was overweight for the fight. The middleweight title fight between Jared Hamman and Kostas Philippu also ended in the first round. Filipu was able to repeatedly hit Hamman with powerful right-handed punches causing Hamman to fall on the mat at least four times. The final blow caused Hamman to fall face to the mat, after which John McCarthy ended the fight. Kostas Philippu won his second consecutive UFC victory, beating Jared Hamman at 3:11 of the first round by knockout. The final match of the preliminary card consisted of light heavyweights Krzysztof Soshinsky and Igor Pokrayac. Pokrajac immediately came after Soshinsky with punches that staggered and supported Soshinsky to the cage. Soshinsky fell to the ground under a quick series of blows and covered himself to defend himself. Thirty-five seconds into the first round, referee Yves Lavigne stopped the fight, giving Igor Pokrajac a knockout victory. The main card of the first fight of the evening, which was broadcast on the pay- per-view broadcast was a featherweight bout between Mark Hominick and Jang Song-jung. At the start, Hominick threw a wild left kick that missed Jung. Jun answered with a straight right that connected and sent Hominick to the ground. Joon followed the hominick down with a follow-up which led to the referee stopping the match. In a tie for the second fastest official knockout in UFC history, Jang Song-joon defeated Mark Hominic by knockout seven seconds into the first round. The victory also earned Jung the Knockout Night award. Welterweights Claude Patrick and Brian Ebersole then collided with each other. The first two rounds of the fight consisted of a big clinch fighting against a cage with occasional fights on the ground. The third round occurred mostly on the ground, with Patrick making a submission attempt at the beginning and end of the round, while between Ebersole was on top of the blow down on his opponent. After all three rounds of the fight were completed, the victory was given to Brian Ebersol by a split decision. Tito Ortiz and Antonio Rogerio Nogueira then took part in their light-heavyweight fight. Ortiz's early kick pushed Nogueira back. Nogueira managed to counter Ortiz's attack and turned the tide, thawing Ortiz back.

    Sogo MMA - Introduction and Overview What is MMA? Mixed martial arts (MMA) is a full contact combat sport that allows the use of both striking and grappling techniques, both standing and on the ground, from a variety of other combat sports. The roots of modern mixed martial arts can be traced back to the ancient Olympics in the sport of Pankration. Various mixed style contests took place throughout Europe, Japan and the Pacific Rim during the early 1900s. The combat sport of "vale tudo" (anything goes) that had developed in Brazil from the 1920s was brought to the United States by the Gracie family in 1993 with the founding of the Ultimate Fighting Championship (UFC). The more dangerous vale-tudo-style bouts of the early UFCs were made safer with the implementation of additional rules, leading to the popular regulated form of MMA seen today. Originally promoted as a competition with the intention of finding the most effective martial arts for real unarmed combat situations, competitors were pitted against one another with minimal rules. Later, fighters employed multiple martial arts into their style while promoters adopted additional rules aimed at increasing safety for competitors and to promote mainstream acceptance of the sport. Lead by the modern version of MMA the UFC (owned by Zuffa) is now the fastest growing spectator sport and the fastest growing combat sport in the world. With names like Chuck Liddell, Tito Ortiz, Anderson Silva and Georges St. Pierre becoming household names the sport of MMA continues to grow and receive acceptance by the general public.

INTRODUCTION The fighters who compete in the Ultimate Fighting Championship (“UFC”) are currently classified as independent contractors. However, this classification appears to contradict the level of control that the UFC exerts over its fighters. This independent contractor classification severely limits the fighters’ benefits, workplace protections, and ability to unionize. Furthermore, the friendship between UFC’s brash president Dana White and President Donald Trump—who is responsible for making appointments to the National Labor Relations Board (“NLRB”)—has added a new twist to this issue.1 An attorney representing a former UFC fighter claimed this friendship resulted in a biased NLRB determination in their case.2 This article provides a detailed examination of the relationship between the UFC and its fighters, the relevance of worker classifications, and the case law involving workers in related fields. Finally, it performs an analysis of the proper classification of UFC fighters using the Internal Revenue Service (“IRS”) Twenty-Factor Test. II. UFC BACKGROUND The UFC is the world’s leading mixed martial arts (“MMA”) promotion. MMA is a one-on-one combat sport that combines elements of different martial arts such as boxing, judo, wrestling, jiu-jitsu, and karate.
