This is an interlocutory application, brought by the respondents in the main application, for leave to file a fourth set of affidavits in the main application. The main application is an application to review the decision of the respondents to transfer the applicant, a prisoner, from a facility in Upington to a facility in Kimberley. 2 2. In order to avoid any confusion, the parties herein will be referred to as in the main application. 3. The applicant, in the main application, obtained an interim interdict by way of a rule nisi, issued on the 27 February 2015 and confirmed on the 28 August 2015, preventing the said transfer pending the outcome of the said review and ordering that the costs of the interim interdict be costs in the review application. The review application was duly filed. The respondents opposed the review and an answering affidavit was filed on their behalf. 4. In broad terms the basis of the applicant’s review of the said decision was based on the contention that moving him from Upington would take him away from his family. The applicant, Mbombela Local Municipality in co-operation with WANDIMA Environmental Services, is requesting the establishment of a residential township, Tekwane extention 2 on former disturbed agricultural land. Approximately 92.3473ha will be developed for residential purposes, 1 x business centre, 1x bus and taxi terminus, 14 public open spaces, crèches and churches. The proposed residential township is situated south of the road to Kanyamazane, and north of the Crocodile River running parallel to the N4 national road.

But the guarantee in section 34 1 of the Constitution 2 does not include the choice of procedure or forum in which access to courts is to be exercised. The return of service recorded that service was effected on 20 March 2014 at about 11h00 by affixing to the principal door at the domiciLium citandi et executandi. The arrears amounted to R 69 510 and the monthly 2 instalment on the loan was RS 967.47. Default judgment was taken on 22 May 2014 and applicants learnt of it for the first time on 23 May 2014 on a follow up call to the respondent's attorneys. The applicants averred that a copy of the judgement in the form of a draft order was obtained from the respondent's attorneys on 5 June 2014. This application was launched within the stipulated time on 19 June 2014.
