Advances in Social Sciences Research Journal – Vol.7, No.5 Publication Date: May 25, 2020 D OI:10.14738/assrj.75.8174. Berry, M. J. (2020) Should Publishers and Authors be more responsible? Advances in Social Sciences Research Journal, 7(5) 314-322. Should Publishers and Authors be more responsible? M. J. Berry Consultant Clinical Forensic Psychologist, Department of Applied Criminology, Birmingham City University, England ABSTRACT Should publishers adopt a more responsible role when publishing books that name individuals as Killers in major unsolved murder cases? This paper explores what could be described as “trial by authors” and the implications this has for victims; and their families; the alleged offenders and their families and the wider Society. It will use the case of the Hammersmith Nude Murders of six female prostitutes, where six booKs written by six authors identified five different Killers and the implications of their naming potential Killers. The sexual murders occurred in and around London’s Hammersmith during 1964 to 1965. Nobody was ever convicted. This writer argues that publishers should exercise some control over publishing what would be libellous if the identified individual was still alive. Keywords: publishers’ responsibilities; sex workers murders; false allegations; trial by authors; the killer known as ‘Jack the Stripper’. A BRIEF HISTORY OF THE HAMMERSMITH NUDE MURDERS Six female prostitutes (sex workers) working the West of London in England during 1964/1965 were murdered by what the police, the mass media and most experts recognise as a serial killer (see British newspapers at the time; for example Daily Mirror [1-2]; and later an article in the Sun Newspaper [3]).

  • Summary Procedure – Preliminary Plea
1.19 Criminal court procedure As we are already aware, criminal trials in Scotland are conducted under two types of procedure: ◆ Summary ◆ Solemn Less serious crimes are dealt with under summary procedure where a judge sits alone, i.e. the presiding judge is therefore ‘master of the facts’ and will determine the appropriate sentence to be handed down if the accused is found guilty. On the other hand, more serious crimes are conducted under solemn procedure where usually one judge sits with a jury of 15. In this type of trial, the jury is said to be ‘master of the facts’ and the judge’s role is merely to impose the penalty if the guilt of the accused is established beyond reasonable doubt. We shall look at the workings of both types of criminal procedure in turn. Summary procedure – preliminary plea As the name suggests, summary procedure is supposed to deal with minor crimes relatively quickly and efficiently and is used in the Justice of the Peace Court and the Sheriff Court. A judge presides and no jury is present. The accused person is prosecuted on complaint. A complaint is the document which outlines the specific nature of the criminal offence that the accused will have to answer at the trial. KEY POINT: Summary procedure is supposed to deal with minor crimes relatively quickly and efficiently and is used in the Justice of the Peace Courts and the Sheriff Court. The First Calling The first time that the prosecution and the defence lawyers appear in court will be at the First Calling.

Each episode conducts an in-depth investigation into both historic and contemporary crime cases as Professor Wilson interviews professionals who combat crime – high profile lawyers, pathologists, frontline police as well as some of the nation’s most notorious criminals. Themes covered in the series include serial killers, heists, gangs, miscarriage of justice, disposal of the body and crimes of passion, amongst others. In this first episode, Professor Wilson investigates the phenomenon of the Scottish serial killer, he says: “Serial killers inhabit our imagination as alien ‘others’. As monsters different to the likes of you and me. But as the old saying goes, the devil hides in plain sight. In my experience, that phrase is never more apt than when describing serial killers.” Crime Files considers the cases of serial killers including Peter Manuel, Peter Tobin and debates the true identity of Bible John.

  • 1 Domestic Abuse Bill New Clause 32 and 33
Domestic Abuse Bill New Clause 32 and 33: A Legislative Duty and National Requirement to Proactively Identify, Assess and Manage Serial and Serious Domestic Violence Perpetrators and Stalkers Briefing prepared by Laura Richards, Founder of Paladin National Stalking Advocacy Service, Former Head of Homicide Prevention Unit New Scotland Yard1 Terrorism begins at home. It’s time to join the dots. Currently, domestic abuse costs society at least £66 billion a year.2 This estimate does not include stalking or the psychological impact of stalking and therefore the cost is likely much higher. Three women are murdered by male partners or ex-partners every two weeks. It’s currently five women a week since lockdown began. This does not include stalking related murders of women where there is no relationship. The murders do not happen in a vacuum. These are murders in slow motion – the ‘drip-drip- drip’ happens over time on an escalating continuum. The “incident-led” approach to patterned crimes like domestic abuse and stalking is very costly must be stopped as women are paying with their lives and perpetrators are offending with impunity. One murder costs £2m on average to investigate3. One call-out to the police costs roughly £1500. Responding to perpetrators time and time again is incredibly costly and many commit domestic abuse as well as other crime4. Many predatory stalkers, sex offenders and serial killers abuse their partners. Police research5 found that 1 in 12 of domestic rapists were raping outside the home. Once a violent and controlling man leaves a partner, it does not mean the violence ends.
