I am a defendant in this action and a resident of the County of Los Angeles in the 4 State of California. I make this Declaration in support of (1) my Motion to Dismiss the 5 First Cause of Action Pursuant to FRCP 12(b)(6), but, with respect to that motion, only for 6 the purpose of setting forth judicially noticeable facts or attaching documents referred to 7 and relied upon in Plaintiff’s First Amended Complaint; (2) my Motion to Dismiss the 8 Second through Seventh Causes of Action Pursuant to FRCP 12(b)(1); (3) my Motion to 9 Strike the Second Through Sixth Causes of Action Pursuant to California Code of Civil 10 Procedure Section 425.16; and (4) my Motion for an Undertaking Pursuant to Code of Civil 11 Procedure Section 1030. I have personal knowledge of the following facts and if called 12 upon to testify, would and could do so competently as follows. However, because this 13 Declaration is offered for a limited purpose, it does not include all information I know about 14 the matters referred to herein. 15 A. The FBI says they’ve finished their work there, but… In a phone call with Grasswire, a spokesperson for the FBI field office in Los Angeles confirmed the agency finished their investigation at the apartment on Thursday. But law enforcement officials at other agencies said the building was still an active crime scene. “I don’t know what’s going on,” Deputy Olivia Bozek, a spokesperson for the San Bernardino County Sheriff’s Department told Grasswire by phone. “That is not a cleared crime scene. There’s still an active investigation going on.” The FBI’s in charge of the investigation so if they say it’s clear, presumably it’s clear for all agencies. Let’s hope: If the cops find out later that there were more than two people to this cell and they want to go back and look for the third suspect’s fingerprints or DNA inside Farook’s home, they can forget about that now. At last check at around 1:30 ET, not only were cameramen from various news outlets walking around inside, but seemingly random people off the street were too.

Strumpf UNC Chapel Hill and NBER UNC Chapel Hill November 2005 Preliminary Abstract Political stock markets have a long history in the United States. Organized prediction markets for Presidential elections have operated on Wall Street (1880-1944), the Iowa Electronic Market (1988-present), and TradeSports (2001-present). Such markets claim superior forecasting power to polls because they efficiently aggregate information. An important counterclaim is that such markets may be subject to manipulation and speculative attacks by partisan or large moneyed interests. We analyze this argument by studying alleged and actual manipulations-- speculative attacks not based on changes in fundamentals—in these three markets. We first investigate the speculative attacks on TradeSports market in 2004 when a single trader made a series of large investments in an apparent attempt to make one candidate appear stronger. Next we examine the historical Wall Street markets where political operatives from the contending parties actively and openly bet on city, state and national races, and the record is rife with accusations that parties tried to boost their candidates through investments and wash or phantom bets. Finally we report the results of a field experiment involving a series of planned, random investments-- accounting for two percent of total market volume-- in the Iowa Electronic Market in 2000. In every manipulation that we study there were measurable initial changes in prices. However, these were quickly undone and prices returned close to their previous levels. We find little evidence that political stock markets can be systematically manipulated beyond short time periods.

    Manipulating Political Stock Markets: A Field Experiment and a Century of Observational Data* Paul W. Rhode** Koleman S. Strumpf Univ. of Arizona and NBER Univ. of Kansas School of Business June 2008 Preliminary Abstract Political stock markets have a long history in the United States. Organized prediction markets for Presidential elections have operated on Wall Street (1880-1944), the Iowa Electronic Market (1988-present), and the internet (2000-present). Proponents claim such markets efficiently aggregate information and provide forecasts superior to polls. An important counterclaim is that such markets may be subject to manipulation by interested parties. We investigate the impact of actual and alleged speculative attacks— large trades, uninformed by fundamentals, intended to change prices— in political stock markets. First we report the results of a field experiment involving a series of planned, random investments-- accounting for two percent of total market volume-- in the Iowa Electronic Market in 2000. We next examine the historical Wall Street markets where political operatives from the contending parties actively and openly bet on city, state and national races; the record is rife with accusations that parties tried to boost their candidates through investments and wash bets. Finally, we investigate the speculative attacks on TradeSports market in 2004 when a single trader made a series of large investments in an apparent attempt to make one candidate appear stronger. In the cases studied, the speculative attack initially moved prices, but these changes were quickly undone and prices returned close to their previous levels. We find little evidence that political stock markets can be systematically manipulated beyond short time periods.
