    The Great Leap Backward: Criminal Law Reform with the Hon Jarrod Bleijie Andrew Trotter∗ and Harry Hobbs† Abstract On 3 April 2012, the Honourable Member for Kawana, Jarrod Bleijie MP, was sworn in as Attorney-General for Queensland and Minister for Justice. In the period that followed, Queensland’s youngest Attorney-General since Sir Samuel Griffith in 1874 has implemented substantial reforms to the criminal law as part of a campaign to ‘get tough on crime’. Those reforms have been heavily and almost uniformly criticised by the profession, the judiciary and the academy. This article places the reforms in their historical context to illustrate that together they constitute a great leap backward that unravels centuries of gradual reform calculated to improve the state of human rights in criminal justice. I Introduction Human rights in the criminal law were in a fairly dire state in the Middle Ages.1 Offenders were branded with the letters of their crime to announce it to the public, until that practice was replaced in part by the large scarlet letters worn by some criminals by 1364.2 The presumption of innocence, although developed in its earliest forms in Ancient Rome, does not appear to have crystallised into a recognisable form until 1470.3 During the 16th and 17th centuries, it was common to charge the families of a prisoner sentenced to death a fee for their execution, but ∗ BA LLB (Hons) QUT; Solicitor, Doogue O’Brien George. † BA LLB (Hons) ANU; Human Rights Legal and Policy Adviser, ACT Human Rights Commission.     Speech By Dr Christian Rowan MEMBER FOR MOGGILL Record of Proceedings, 26 November 2020 ADDRESS-IN-REPLY Dr ROWAN (Moggill—LNP) (3.42 pm): I begin by acknowledging the traditional custodians of the land on which we are meeting and pay my respects to elders past, present and emerging. Mr Deputy Speaker, I also congratulate you on your appointment to high office. It is indeed a great privilege and honour to continue to serve as the state member for Moggill in the 57th Queensland Parliament. I wish to formally place on record my thanks and sincere appreciation to the residents and constituents of the electorate of Moggill for their ongoing trust and support in re-electing me to be their representative in the 57th Parliament. I also wish to acknowledge and thank my wife, Jane, as well as Nicholas, Charley, Angus and Lucie for their support and words of encouragement. I specifically acknowledge my mother-in-law, Wendy Nelson. On 10 July this year, my father-in-law, Parker Nelson, suffered a midbrain stem stroke, with a secondary fractured skull and subarachnoid haemorrhage as a result of a subsequent fall. The following 18 weeks were incredibly difficult and challenging as Parker initially survived a prolonged course in the Royal Brisbane Hospital’s intensive care unit, followed by a subsequent lengthy admission to the stroke unit and rehabilitation ward. It was an incredible shock given that he was only 75 years old and had always been fit, strong and healthy and had always enjoyed an active lifestyle. Unfortunately, Parker died on 14 November 2020 and his funeral was held this week on Tuesday, 24 November 2020.

The truck convoy, led by the ATA’s own Safety Truck, drove through Canberra to Parliament House, where owner drivers gathered with placards calling for the end of the Road Safety Remuneration Tribunal (RSRT). ATA Chief Executive Christopher Melham said there could be no doubt of the trucking industry’s backing for the abolition of the RSRT, and welcomed the support of ministers, senators and other members of parliament at today’s event. “The Road Safety Remuneration System isn’t about safety – it’s about creating a two-tier payment system, where owner drivers and small operators are legally restricted from being able to negotiate their own rates,” Mr Melham said. “But this doesn’t apply to large fleets. This means that rather than having owner drivers paid more, they are losing jobs as they can no longer compete on price. “We know there are third and fourth generation family transport businesses who are going out of business as a result of the Tribunal. These are livelihoods and careers on the line. “As Minister Chester said at the rally this morning, you shouldn’t have to drive to Canberra to fight for your job. But hundreds of drivers did travel to Canberra to deliver a clear message – abolish the RSRT, and abolish it now.
