The Medical Radiation Technologists Act, 2006 ______

Saskatchewan association of medical radiation technologists — Regulatory BylawS

Title 1 These bylaws may be referred to as The Medical Radiation Technologists Regulatory Bylaws, 2015. Definitions 2 In these bylaws: (a) “Act” means The Medical Radiation Technologists Act, 2006; (b) “Discipline” means Radiological Technology, Nuclear Medicine, Magnetic Resonance Imaging or Radiation Therapy; (c) “prescribed fee” means the applicable fee prescribed in The MRT Fee Bylaws; (d) “prescribed educational program” means an educational program described in section 3; (e) “required examination” means the examination described in section 4.

REGISTRATION AS A MEMBER Educational programs 3 An education program at a medical radiation technology school accredited by the Canadian Medical Association, or a program deemed equivalent by the Council of the association, is prescribed for the purposes of clause 20(1)(c) of the Act. Examinations 4(1) The examinations administered by the Canadian Association of Medical Radiation Technologists, or an examination deemed equivalent by the Council, is prescribed for the purposes of clause 20(1)(d) of the Act. (2) A person who applies for registration as a Medical Radiation Technologist must write the required examination at the first writing of the examination after he or she becomes eligible to write it, unless the Council or the Registrar gives special written permission to defer the writing of the examination. Categories of membership 5 membership in the Association consists of the following categories: (a) full Practice Membership; (b) Non-Practice Membership; (c) Student Membership; (d) Life Membership; (e) Associate Membership. General requirements for membership 6 All applicants for full practice, non-practice or student membership shall submit: (a) a completed membership application form provided by the Association, together with the prescribed fee; (b) in the case of an applicant whose first language is not English, evidence that the applicant meets the requirements for proficiency in English as recognized by Council; (c) evidence satisfactory to the Council of the applicant’s good character and, where applicable, good professional record; and (d) a criminal record check. Full practice membership 7(1) full practice membership is available to a person who meets the requirements of subsection 20(1) or (1.1) of the Act. (2) full practice membership entitles a person the following privileges: (a) subject to obtaining a full practice licence in accordance with these bylaws, to practice medical radiation technology in his or her discipline in Saskatchewan as a member; (b) to use the titles as prescribed in section 22 of the Act; (c) to vote and hold office in the Association; (d) to have a voice and a vote at the meetings of the Association; (e) to be appointed to committees of the Association; (f) to receive copies of the Association’s documents appropriate for distribution; and (g) to receive the publications of the Association. Non-practice membership 8(1) Non-practice membership is available to a person who: (a) was previously licensed as a full practice member but chooses not to practice as a Medical Radiation Technologist; and (b) is in good standing with the Association. (2) Non-practice membership entitles a person the following privileges: (a) to have a voice and vote at all meetings and mail ballots and to stand for and to be elected to any office and to be appointed to any committee; (b) to receive the publications of the Association; (c) to use the titles prescribed in section 22 of the Act. Student membership 9(1) Student membership is available to a person who: (a) is enrolled in a prescribed education program; (b) is eligible to write the required examination; or (c) has written the required examination but has not received the examination results. (2) Student membership entitles a person the following privileges: (a) subject to obtaining a restricted practice licence in accordance with these bylaws, to practice only under the direct supervision of a full practice member; (b) to vote at all meetings and mail ballots; and (c) to receive the publications of the Association. 404 THE SASKATCHEWAN GAZETTE, february 27, 2015

Life membership 10(1) Life membership is available to a person who: (a) has made an outstanding contribution to the profession of Medical Radiation Technology or to the Association; and (b) has been so designated by the Association. (2) Life membership entitles a person the following privileges: (a) to vote at all meetings and mail ballots and to stand for and be elected to any office or to be appointed to any committee; and (b) to receive the publications of the Association. Associate membership 11(1) Associate membership is available to a person who: (a) is not presently qualified as a full practice member; and (b) has paid the prescribed fee. (2) Associate membership entitles a person to receive the publications of the Association.

LICENSURE Licence required 12(1) unless otherwise stated on the licence or pursuant to these bylaws, all licences expire on December 31 in the year issued. (2) Every member is required to obtain a licence in each year in order to practice as a member by submitting the required application form, provided by the Association, together with the prescribed fee for the licence and any other fees or charges owing to the Association for any reason, on or before December 1 in each year. (3) A member who does not obtain or renew a licence ceases to be licensed, and is not entitled to practise or work as a member as of January 1 of the year for which the licence is required. (4) A member who does not renew a licence is noted as an inactive member in the register. Full practice licence 13(1) A full practice licence is available to a full practice member who: (a) has: (i) worked 1,200 practice hours in the member’s primary discipline and 300 practice hours in any secondary discipline in the previous five years; (ii) graduated from a prescribed educational program within the preceding three years; or (iii) completed a re-entry program recognized by Council within the preceding year; and (b) subject to subsection (2), in the case of an application for a renewal of a licence, has completed a total of 10 continuing education credits in the previous 12 months in accordance with section 17. (2) members who have not completed the continuing education credits required by clause (1)(b) may receive a full practice licence on the condition that they practice only under direct supervision until they complete the required credits. (3) Clause (1)(a) does not apply to an application for an initial licence from an applicant who becomes a member in accordance with subsection 20(1.1) of the Act. Restricted practice licence 14(1) An initial restricted practice licence or a renewal of a restricted practice licence is available to a person who meets the requirements for registration as a student member pursuant to clause 9(1)(b) or (c). (2) A restricted practice licence is valid for four months after the date of its issue and may be renewed for a maximum period totalling one year, if the member: (a) provides satisfactory references from his or her current employer; and (b) demonstrates that he or she is writing the required examination at the earliest opportunity available. (3) A holder of a restricted practice licence must practice only under the direct supervision of a full practice member in the same discipline. Licence revocation 15 The Registrar may immediately suspend the licence of a member where the Registrar determines that the member was not eligible for the licence when it was obtained, and the Registrar shall refer the issue to the Professional Conduct Committee as a complaint.

REVIEW OF DECISIONS OF REGISTRAR Application 16(1) for the purposes of subsection 21(4) of the Act, an application to review a decision of the Registrar respecting an application for registration or licensure must be made to the Council, within 30 days after a written copy of the decision is served, by sending or delivering a written request in the form of a letter to the Council, which must be received in the SAMRT office within that time, setting out the grounds on which the applicant alleges that the Registrar’s decision is in error, together with any documentation necessary to support the allegation. (2) The Council shall provide an applicant for review with an opportunity to make a verbal presentation to the Council, if desired by the applicant, as soon as possible after the application is received.

CONTINUING EDUCATION Continuing education 17(1) Each member is required to maintain a personal inventory of continuing education credits to be made available if requested by the Registrar. (2) A member obtains medical radiation technology continuing education credits in accordance with Schedule A for participation in professional conferences, individual activities, professional development courses and professional contributions.

INSURANCE Liability insurance 18 All members who practice are required to be insured against liability for professional negligence in an amount that is at least $1,000,000 per incident and $5,000,000 per year.

GENERAL Code of ethics 19 Every member shall comply with the Code of Professional Conduct contained in Schedule B. Conflict of interest 20 A member shall avoid any situation in which the member ‘s interests conflict, or have the potential to conflict, with the interests of any patient, resident, client or person with whom the member has a professional relationship. Special meetings 21(1) for the purposes of clause 7(2)(b) of the Act, the number of members who may demand in writing that a meeting be held is the number equal to 10% of the total number of all practising members. (2) The Council shall send or deliver a Notice of a Special Meeting to all members at least 15 days prior to the date of the meeting as specified in the resolution or demand requiring the meeting to be held, and no other business shall be considered. 406 THE SASKATCHEWAN GAZETTE, february 27, 2015

INVESTIGATION AND DISCIPLINE Professional Conduct Committee 22(1) The Council shall designate the chairperson of the Professional Conduct Committee. (2) The term of office for members of the Professional Conduct Committee is three years and may be renewed. Discipline Committee decisions 23 Decisions of the Discipline Committee are matters of public interest and as such shall be reported in the Association’s publications. Coming into force 24 Pursuant to subsection 14(4) of the Act, these bylaws come into force when they are approved by the Minister and published in the Gazette. Schedule B Code of Professional Conduct (section 19) l. Responsibility to the Public MRTs must act to serve and protect the public and maintain their trust and respect by: (a) complying with high standards of professional conduct, competence and appearance; (b) providing only those services for which they are qualified by education, training or experience to perform; (c) not making false, misleading or deceptive statements, orally or in writing; and (d) advancing and supporting health promotion and research.

2. Responsibility to Patients MRTs must act in the best interests of their patients by: (a) upholding the principle of informed consent including the right of the patient to refuse service; (b) respecting the dignity, right to privacy and autonomy of their patients; (c) treating all patients equitably, regardless of national or ethnic origin, colour, creed, sex, sexual orientation, age, family status, socioeconomic status, mental or physical ability or type of illness, with respect to their individual needs and overall welfare; (d) maintaining clear and appropriate professional boundaries in the MRT Patient relationship to avoid actions that could impair their professional judgment; (e) providing individualized, comprehensive and safe treatment during examinations or therapy sessions, taking into account the patient’s particular physical and emotional needs, values and cultural background; and (f) preserving and protecting the confidentiality contact with the patient, except to facilitate diagnosis or treatment of the patient, or when legally obliged or allowed to disclose such information.

3. Responsibility to the Profession MRTs must act to promote excellence in the profession by: (a) assisting each other and the SAMRT in upholding the spirit and the letter of the law, The Medical Radiation Technologists Act, 2006 and the bylaws and other standards of practice set or recognized by the SAMRT; (b) contributing to the development of the art and science of medical radiation technology through collaboration, continuing education and research; (c) conducting all professional activities, programs and relations honestly and responsibly, and by avoiding any actions that might discredit the profession; and (d) committing to the practise of lifelong learning, sharing new practices with colleagues and engaging in professional activities.

4. Responsibility to Colleagues and other Health Professionals MRTs must develop and maintain positive, collaborative relationships with colleagues and other health professionals by: (a) consulting with, referring to and cooperating with other professionals to the extent needed to serve the best interests of their patients; 408 THE SASKATCHEWAN GAZETTE, february 27, 2015

(b) ensuring the safety of other health professionals when in practice or in areas under the MRT’s responsibility; and (c) educating colleagues and other health professionals about practices and procedures relating to medical radiation technology.

5. Personal Responsibility MRTs are fully accountable for all their professional undertakings and shall: (a) maintain and enhance their personal well-being to be effective in their practice; (b) maintain and apply current and relevant scientific and professional knowledge and skill in every aspect of practice; (c) take appropriate action in responding to incidents which put the care of patients at risk or brings harm to the profession; (d) avoid conflicts of interest; and (e) provide professional service only when free from the influence of alcohol, drugs or other substances or any condition that might impede the delivery of safe service.
