Signed: Date: 3 Abstract In the history of crime and punishment the prisons of medieval London have generally been overlooked. This may have been because none of the prison records have survived for this period, yet there is enough information in civic and royal documents, and through archaeological evidence, to allow a reassessment of London’s prisons in the later middle ages. This thesis begins with an analysis of the purpose of imprisonment, which was not merely custodial and was undoubtedly punitive in the medieval period. Having established that incarceration was employed for a variety of purposes the physicality of prison buildings and the conditions in which prisoners were kept are considered. This research suggests that the periodic complaints that London’s medieval prisons, particularly Newgate, were ‘foul’ with ‘noxious air’ were the result of external, rather than internal, factors. Using both civic and royal sources the management of prisons and the abuses inflicted by some keepers have been analysed. This has revealed that there were very few differences in the way civic and royal prisons were administered; however, there were distinct advantages to being either the keeper or a prisoner of the Fleet prison. Because incarceration was not the only penalty available in the enforcement of law and order, this thesis also considers the offences that constituted a misdemeanour and the various punishments employed by the authorities. -

Pope Leo of Bourges, clerical immunity and the early medieval secular Charles West1 At first glance, to investigate the secular in the early Middle Ages may seem to be wilfully flirting with anachronism. It is now widely agreed that the early medieval political order was constructed neither against nor in opposition to the Church, but rather that the Church, or ecclesia, largely constituted that order.2 This would seem to leave little early medieval scope for the secular, understood in conventional terms as the absence of religion (and moreover often associated with modernity).3 This position is broadly reflected in the recent historiography, which focuses either on Augustine’s short-lived notion of the secular in Late Antiquity, or on the role of Gregorian Reform in beginning a slow secularisation of political authority.4 These separate approaches are spared from intersecting by the early medieval half- millennium which is presented, as so often, as either too late or too early for key developments. However, in recent years, the argument has been forcefully made across a range of fields that, far from being a neutral or universal category, the secular is in reality ‘a historically-produced idea’, and one that moreover encodes a disguised theology.5 As a consequence, ‘to tell a story 1 This paper is based on research carried out on a project funded by the AHRC 2014-16. THE MEDIEVJ\L CLERGY 1\ND VIOLENCE: AN HISTORJOGRAPHICAL INTRODUCTION Peter Clarke It is a conunonplace that the l'vliddle Ages we:e violent. Life then was demon srrably 'nasty, brutish and short'. In medieval society war was a frequent event, and violence, or the threat of it, was often used to resolve disputes. The period was allegedly violent from its inception. Violence accompanied the transition from ancient to medie val sociery, as barbanans invaded the declining Western Roman Empire. Violence also arguably played a key roJe in rhe social and political fonnation of the medieval West. In the cenual Middle Ages weak central power and untrammeled violence arguably forced the vulnerable to seek protection from and accept subjection to an ernerging military aristocracy. The social dominance of this warrior elite was bolstered, according to Mare Bloch, by the violence of external aggressors, the Arab, Magyar and Viking raiders who began attacking Europe in the ninth century. In the triparrite model of medieval society this noble dass or ordo were indeed the 'bellatores', those who made war.1 Accordingly secular authority in medieval society depended on violence. Kings dcmonstrated their power by limiting and comroling violence among their subjects, a responsibility irnplicit in the idea of the king's peace. One of their main functions was war-leader, a roJe de picted on medieval coins and seals showillg killgs as mounted fighting-men. Successful medieval rulers were expected to extend their realms by conquest and reward their military followers with the spoils of war: booty and land. Hence lay violence was normal in medieval society and virtually illsritutional ised at its upper Ievels. -

Tulinius The Medieval Subject and the Saga Hero Abstract: In this article an attempt is made to understand the way medieval Icelandic sagas stage their characters as an expression of a conflict of norms within the society which produced them, i.e. Iceland in the thirteenth century. Two contemporary sagas show how this conflict of norms is part of the reality facing chieftains in a society where they must use violence to preserve their power and protect themselves and their kinsmen, but where the fate of their souls is also at stake in a Christian world-view forcefully promoted by a militant Church. Two sagas of Icelanders are then studied in which this conflict of norms is thematized as one between Christianity and paganism. The conflict of norms in question is instrumental in generating an image of the self which is generated by the forces in presence in medieval culture. It concerns the extent to which the sagas are about a tradition-bound society with roots in a pagan Viking culture and to what extent they are an expression of authors and audiences who belong to the Christian West of the High Middle Ages. There is not enough space here to describe the different forms this debate has taken through time (Andersson 1962; Mundal 1977; Clover 1984). One could say, however, that the opposing terms structuring it are on the one hand “ancient, autochthonous, and pagan,” and on the other “re- cent, foreign, and Christian.” The underlying idea is that thirteenth-century society and culture in Iceland and Norway were still under the influence of their pagan heritage, though they were being gradually transformed by the Church and an aris- tocratic culture originating in more southern parts of Europe. -
