As used in this chapter, unless the context otherwise requires 1. "Administrator" means the administrator of the division. 2. "Division" means the division of state parks of the state department of conservation and natural resources. 3. "Park" means any: (a) Area which has been designated as a state park; or (b) State park, monument or recreational area which is under the jurisdiction of the division. (Added to NAC by Div. of St. Parks, eff. 8-17-82) 407.010 Applicability. The provisions of NAC 407.050 to 407.150, inclusive, apply to all lands owned by or administered exclusively by the division. iDiv. of St. Parks, eff. 6-1-72]—(NAC A 8-17-82) FEES 407.050 Schedule of fees. The division will charge and collect the following fees: For an annual permit allowing the holder to use all parks: 407-1 For the user's noncommercial vehicle $35 For the user's second noncommercial vehicle 15 except that no fee is charged for an annual permit issued to a resident who is 60 years of age or older. For day use at: Lake Tahoe State Park 4 Any other state park 3 For overnight camping 4 For launching a boat 4 For reserving an area for group use in: Valley of Fire State Park 10 Kershaw-Ryan State Park 10 Cathedral Gorge State Park 10 Fort Churchill State Park 20 Any other park 30 For using any commercial vehicle (including a bus)_ in: Lake Tahoe State Park 40 cents per person or $4 per vehicle, whichever is greater. Any other state park ..30 cents per person or $3 per vehicle, whichever is greater. [Div. of St. Parks, eff. 5-3-72] —(NAC A 8-17-82; 8-9-831 407-2 8-9-83 407.060 No refund of fees where privileges rescinded for infractions. Fees charged for the use of a park will not be refunded if the user's privileges are rescinded as a result of his infraction of a park regulation. [Div. of St. Parks, eff. 6-1-72]—(NAC A 8-17-82) PROHIBITED ACTS 407.07 0 Illegal, dangerous or destructive behavior. The following acts are prohibited: 1. Entering, using or occupying state land, or water under the control, administration or jurisdiction of the division if a pro hibition against the act is posted on the land or near the water. 2. Occupying or using a park without paying the appropriate fee prescribed by NAC 407.050. 3. Defacing, removing, destroying or otherwise injuring in any manner any tree, shrub, fern, moss or other plant or any rock, fossil, petrified wood, petroglyph, pictograph, mineral or artifact found or growing on any state park land or other land administered by the division. 407-3 8-9-83 4. Disturbing, threatening, hunting, trapping or removing any wildlife, including any game animal, except for hunting upland game, waterfowl, or big game in any area designated for such hunting. 5. Destroying, injuring, defacing, removing or disturbing in any manner, any public building, sign, equipment, marker or other structure or property. 6. Selling or offering for sale any merchandise, or using land administered by the division, for any commercial purpose without written permission from the administrator. 7. Interfering with, hindering, obstructing or disobeying an officer of the division in the performance of his duty. 8. Distributing any handbills or circulars or posting, placing or erecting any bills, notices, papers or advertising devices or matter of any kind without written consent of the park supervisor. 9. Throwing any stone, knife, boomerang or other obj ect; annoying or assaulting other persons; interfering with, incumbering, obstructing or rendering dangerous any drive, path, walk, dock, boat launching ramp, beach or other public place; or engaging in any other conduct which endangers or is likely to endanger the health, life, limb or property of other persons; or committing any act tending to or amounting to a breach of the peace. 407-4 8-9-83 10. Possessing or consuming of any alcoholic beverage by a person who is less than 21 years of age. 11. In any area closed to hunting or during a period designated as being closed by the department of wildlife for big game in the area, shooting a bow and arrow or carrying or having in possession a firearm unless it is unloaded in both barrel and magazine and is contained inside a vehicle; or shooting an air rifle, air pistol or slingshot at any time. 12. Discharging firecrackers, rockets or any other fireworks. 13. Using wood for fuel except from supplies furnished by the division, a concessionaire or the user. 14. Reserving a site, area or facility except in a manner approved by the park supervisor. [Div. of St. Parks, eff. 6-1-72] — (NAC A 8-17-82; 8-9-83). 407.08 0 Camping. The following acts are prohibited: 1. Occupying a site for other than recreational purposes. 2. Camping for a longer period of time than established by the state park administrator. Camping will be on a first come, first served basis. The period of time persons may camp within a camp ground is 14 days, unless otherwise posted. 407-5 8-a-83 3. Erecting structures. 4. Camping overnight in places restricted to use by day, or in areas not established and posted as designated campsite or outpost camping areas. 5. Failing, before departure, to remove camping equipment, or to clean rubbish and litter from the place occupied by the visitor or visitors. 6. Pitching tents or parking trailers or other camping equipment, except in places provided for those purposes. Two camping units will not be considered as a single camp. 7. Leaving a campsite unoccupied overnight without permission from the park supervisor. Unattended camping equipment, which is not moved within 24 hours of being unattended is subject to impoundment. [Div. of St. Parks, eff. 6-1-72] 407.090 Fires. 1. The following acts are prohibited: (a) Building a fire without proper provisions to prevent it from spreading or leaving a fire without completely extinguishing it. (b) Building or lighting a fire outside of stoves, grills, fireplaces or fire rings provided by the division for that pur pose. 407-6 2. A fuel burning heater, grill, stove, hibachi or space heater provided by the park visitor may be used only in an area where a facility described in paragraph (b) of subsection 1 is available. 3. All lighted matches, cigars, cigarettes or burning material must be extinguished or deposited in a place where a fire hazard will not be caused, but not in any body of water, such as a stream, lake or spring or in any water system, such as a fountain or sink. 4. The burning of any material, such as a tire or an inner tube, which produces an excessive amount of air pollution is prohibited. [Div. of St. Parks, eff. 6-1-72] — (NAC A 8-17-82)_ 407.100 Swimming and scuba diving prohibited. Swimming or scuba diving is prohibited in the water around a launching ramp or dock. [Div. of St. Parks, eff. 6-1-72] — (NAC A 8-17-82; 8-9-83). 407-7 8-9-83 407.110 Sanitation. The following acts are prohibited: 1. Disposing garbage including paper, cans, bottles, waste material, fish offal and rubbish except by removal from the site or area, or disposal at places provided for those purposes. 2. Disposing or dumping refuse or waste from any trailer or other vehicle, except in places or receptacles provided for those purposes. 3. Cleaning fish, food, clothing and kitchenware at any place not specifically established for that use. 4. Any action leading to contamination of water. 5. Depositing, except in receptacles provided for that pur pose, any body waste in or on any portion of any comfort station or any public structure or the depositing of any bottles, cans, cloths, rags, metal, wood, stone, or any other damaging sub stances in any of the fixtures in those stations or structures. 6. Using refuse containers or other refuse facilities for dumping household or commercial garbage or trash brought as such from private property.
