JUSTICE PETER OLABISI IGE, JCA I am immensely grateful to the ADMINISTRATOR, National Judicial Institute for the opportunity and privilege to present a paper titled THE STRUCTURE OF THE JUDICIAL SYSTEM IN ELECTION DISPUTE AND IN THE ELECTORAL PROCESS within the theme of this year’s workshop which is “Repositioning the Judiciary for Better Justice Delivery” I deem it fit to find meanings to the words “Structure”, “Judicial System”, “Election Dispute” and “Electoral Process”. “Structure” means “to arrange” as defined on page 1650 of the Black’s Law Dictionary, 10th Edition. “Judicial System” otherwise known as Judicature has been defined in said Black’s Law Dictionary page … as; “1. The action of judging or of administering justice through duly constituted Courts. 2. Judiciary. 3. A judge’s office, function, or authority. 4. The system by which Courts, trials, and other aspects of administration of justice are organized in a country. Also termed (in sense 4) judicial system.” “Election Dispute” to my mind relates to all conflicts, disagreements or controversies amongst political parties and candidates in general elections or other elections organized and conducted by an impartial or a constitutional or statutory body which in Nigeria is Independent National Electoral Commission INEC (in Nigeria), in respect of results declared or the return made by the body saddled with responsibilities 1 of conducting a free and fair election after the Electoral process has been concluded. -

However, the nature and character of the dominant political parties in Nigeria threaten the country’s nascent democratic project. They lack clear ideological orientation, do not articulate alternative worldviews, rarely mobilise the citizenry, and basically adopt anti-democratic methods to confront and resolve democratic issues. Intra- and inter-party electoral competition is fraught with intense violence, acrimony and warfare. Put differently, these parties display all the tendencies and conduct of authoritarianism. The result is that what exists in Nigeria is ‘democratism’, the form and not the substance of an evolving democracy. The paper interrogates their metamorphosis and masquerading character as ploy to delay the people-oriented revolution. The just- concluded PDP party primaries and secondary elections are evidence that demands a verdict. Dhikru Adewale Yagboyaju, PhD Dhikru Adewale Yagboyaju is a senior lecturer in the Department of Political Science at the University of Ibadan, Nigeria email: [email protected] ABSTRACT The relationship between elections and the vitality of a democratic society is clear. Elections have proven to be the best means of strengthening the mandate of a performing administration or removing a non-performing one. This paper argues, however, that the outcomes of several elections in Nigeria’s Fourth Republic have proved contrary to the common trend in most advanced democratic systems, in which electoral outcomes are based on performance. While in some cases, especially in political party primaries, candidates with little or no democratic credentials have emerged during general elections, in other instances administrations with relatively high records of infrastructural development have been voted out. This study traces the most probable causes of this paradox to Nigeria’s money politics and a possible misinterpretation of the concept of development. It is essentially a literature-based study, descriptive but also analytical. The paper concludes that the country will have to contend with the politics of underdevelopment for as long as immediate and pecuniary benefits constitute the expectation of the generality of followers. Security Threat Assessment for South West Executive Summary Political Context The merger between the Action Congress of Nigeria (ACN), Congress for Progressive Change (CPC), All Nigerian Peoples Party (ANPP) and other smaller parties, has provided an opportunity for opposition parties to align and challenge the dominance of the Peoples Democratic Party (PDP). This however will also provide the backdrop for a keenly contested election in 2015. The zoning arrangement for the presidency is also a key issue that will define the face of the 2015 elections and possible security consequences. Across the six geopolitical zones, other factors will define the elections. These include the persisting state of insecurity from the insurgency and activities of militants and vigilante groups, the high stakes of election as a result of the availability of derivation revenues, the ethnic heterogeneity that makes elite consensus more difficult to attain, as well as the difficult environmental terrain that makes policing of elections a herculean task. Preparations for the Elections The political temperature across the country is heating up in preparation for the 2015 elections. While some state governors are up for re-election, most others are serving out their second terms. The implication is that most of the states are open for grab by either of the major parties and will therefore make the electoral contest fiercer in 2015 both within the political parties and in the general election. -

In 2007 Umaru Musa Yar'Adua of the ruling People's Democratic Party (PDP) was elected to a four-year term as president, along with Vice President Goodluck Jonathan, also of the PDP. The election was marred by what international and domestic observers characterized as massive fraud and serious irregularities, including vote rigging and political violence. Vice President Jonathan became acting president on February 9 after the National Assembly conferred presidential authority on him during President Yar'Adua's prolonged illness. On May 5, Jonathan assumed the presidency following Yar'Adua's death. There were numerous instances in which elements of the security forces acted independently of civilian control. Many Political Parties, especially in transitional and semi-authoritarian States, lack internal democracy. They also frequently fall under the control of powerful economic and political elites. It is from this view that the paper discuses political parties and Chief Executives in Nigeria’s Fourth Republic with a focus of PDP (1999 to 2007). The paper argues that, in Nigeria, Chief Executives, particularly at the National level have been having influence over the activities of political parties at the detriment of “descent democracy”. To get out of the malaise, the paper recommends that, the Chief Executives should learn to put aside their personal ego in the interest of the state and that they should aim at good governance.
