MONITORING THE COMPLIANCE OF THE POLICE SERVICE OF NORTHERN IRELAND WITH THE HUMAN RIGHTS ACT 1998 HUMAN RIGHTS ANNUAL REPORT 2008 Foreword I am pleased to present this 4th Human Rights Annual Report published by the Northern Ireland Policing Board (the Board). The Board has a statutory duty to monitor the performance of the Police Service of Northern Ireland (PSNI) in complying with the Human Rights Act 1998. The Board was of course the first oversight body in the UK to have a statutory responsibility to ensure a police service complies with the Human Rights Act. This best practice has since been extended to Police Authorities in England and Wales. For policing to be effective and secure the confidence of the community it is essential that human rights standards are integrated into and applied to all aspects of policing. This ensures that both the rights of the police and the public are properly protected. This detailed report records progress during the last year, makes a number of recommendations for the year ahead and includes an assessment of progress of the implementation of recommendations outstanding from previous reports. Members of the Board’s Human Rights & Professional Standards Committee have specific responsibility for scrutinising this work and assisted by the expertise of its Human Rights Advisors will oversee the implementation of recommendations made in this Report. Over the last 5 years Keir Starmer QC and Jane Gordon have provided invaluable assistance and guidance in developing the Board’s framework for monitoring this critical area. Keir stood down from his role as Advisor to the Board in May 2008 and on behalf of the Board I would like to thank him for his work. -

It provides individuals with remedies if a public authority breaches their human rights. However, it does not set up a mechanism for monitoring compliance with human rights. The position for the Police Service of Northern Ireland (PSNI), however, is different. The Police (Northern Ireland) Act 2000 specifically mandates the Policing Board in Northern Ireland to monitor the performance of the PSNI in complying with the Human Rights Act 1998. We were appointed in February 2003 to advise the Policing Board how to meet this statutory duty. Since then we have published four reports: two Human Rights Annual Reports (2005 and 2006) and two Special Reports, the first on the policing of the Ardoyne parades 12th July 2004, the second on the policing of the Ardoyne parades 12th July 2005 and the Whiterock parade 10th September 2005. -

RESEARCH PAPER 03/43 The Northern Ireland 9MAY 2003 Assembly (Elections and Periods of Suspension) Bill Bill 104 of 2002-03 The Northern Ireland Assembly (Elections and Periods of Suspension) Bill had its First Reading on 8 May 2003, and its remaining stages are scheduled for 12 May 2003. Elections to the Northern Ireland Assembly were due to take place on 29 May 2003, having been put back from 1 May 2003 by the Northern Ireland Assembly Elections Act 2003 in March 2003. This was discussed in Research Paper 03/21, The Northern Ireland Assembly Elections Bill, 13 March 2003. On 1 May 2003 the British Government announced that it would postpone the elections until the autumn. The British and Irish Governments had been preparing to publish a Joint Declaration on moves towards full implementation of the Belfast Agreement, but they were not satisfied with the undertakings the IRA was prepared to give on meeting its obligations under the Agreement. The British Government argued that the outstanding issues over the IRA position could not be resolved during an election campaign, and so decided on a further postponement. The Irish Government did not support it on this point. This paper gives an account of the main features of the Bill, the British Government’s rationale for postponement, the main reactions to it, and some background. How the 'Northern Ireland Model'
HOW THE ‘NORTHERN IRELAND MODEL’ DID NOT DEFEAT THE IRA Henry Patterson Ulster University, Reino Unido My paper is a critique of what in my opinion is an historically deficient IRA and politically naïve attempt to promote a fallacious account of the peace process in Northern Ireland which can only serve as aid and comfort to terrorist and insurgent groups in the states to which the so-called „Northern Ireland model‟ is applied. Terrorism has not ended in Northern Ireland. The threat from dissident republicanism is higher than at any time since the Real IRA‟sOmagh bombing twelve years ago. The body tasked with monitoring terrorist activity in Northern Ireland noted in its report in May 2010 that: The threat from dissident activity in the 6 months under review has been higher than at any time since we first met in late 2003. The seriousness, range and temp have all changed for the worse… the groups remain highly active and dangerous.1 In a report published this week it noted that the threat remained „dangerously lethal‟ and that the attacks using home-made bombs had doubled between March and August of this year. 2Jonathan Evans, Director General of the Security Services (MI5) admits that when the agency was given overall responsibility for national security and intelligence work in Northern Ireland in October 2007 their working assumption was that the residual threat from terrorism in Northern Ireland was low and likely to decline but „Sadly that has not proven to be the case and we have seen a persistent rise in terrorist activity 1 Twenty-Third Report of the Independent Monitoring Commission, 26 May 2010, 4-5.
