When the recent clerical sex abuse of minors by members of the clergy of unprecedented proportions erupted in 2002, the Church found itself challenged to cope with the aftermath. 1. The context of the modern understanding of the penalty Within the broader context of the Catholic Church in the United States, the American bishops were learning of the unfortunate and heinous sexual abuse of minors by members of the clergy. Their early responses to the crisis have been fairly well documented in the Bishops’ Committee Report, “Brief History: Handling Child Sexual Abuse Claims”1. [Translated from Original Spanish] Thy Kingdom Come! PRESENTATION OF THE COMMUNIQUÉS OF THE GENERAL CHAPTER 1. From January 8th through February 25th, 2014, the Extraordinary General Chapter of the Legion of Christ took place in Rome. His Eminence, Cardinal Velasio De Paolis, CS, and his two counselors, Fr. Gianfranco Ghirlanda, SJ, and Fr. Agostino Montan, CSI, presided. Sixty- one chapter fathers participated, 19 ex officio and 42 elected by the nine territories of the congregation and the centers of Rome. 2. This Extraordinary General Chapter marks the end of the journey of in-depth revision that the congregation has travelled since the apostolic visitation, which took place during 2009- 2010, and the naming of a Pontifical Delegate in the summer of 2010. Our principal tasks in the Chapter, as Pope Benedict XVI1 indicated and as Pope Francis confirmed2, were to revise the Constitutions and to elect a new central government for the congregation. 3. In the first days, in light of the reports that the Pontifical Delegate and the pro-General Director submitted, we focused on analyzing the life of the Congregation since the ordinary General Chapter that took place in 2005. One of the outcomes of the intense exchange of ideas that took place in those days was the communiqué that the Chapter approved on January 20th, 2014, about the journey of renewal of the Congregation. This same day, the elections of the new central government took place. Rome, 30 May 1998 4 FOREWORD n May 1998 the Pontifical Council for the Laity convened the World I Congress of the Ecclesial Movements (the proceedings of which are being published here), with the aim of promoting a better knowledge of these organizations that in various ways are enriching the life of the Church today. On the one hand, the Congress was intended to deepen theological reflection on the specific nature of these aggregations of the faithful. On the other, it was intended to foster an exchange of experi- ences between the representatives of the various movements and between them and some Bishops and other participants engaged in dif- ferent forms of life and of Christian witness. This was a way of respond- ing to the invitation of John Paul II, who had asked the movements to make a gesture of “joint witness” in the year dedicated to the Holy Spirit. The Congress turned out, in practice, to be an event that surpassed the expectations even of those who had helped to prepare it. The days during which it was held were days full of surprises, culminating in the great surprise of the meeting of the Pope with the movements on the Vigil of Pentecost. -

THE 1962 VATICAN INSTRUCTION “CRIMEN SOLLICITATIONIS,” PROMULGATED ON MARCH 16, 1962 Observations by Thomas Doyle, O.P., J.C.D. November 1, 2006 1. The recently revealed (2003) Vatican document outlining the procedures for dealing with cases of solicitation of sex by priest-confessors has caused a swell of alarm and surprise on the part of survivors, attorneys and others. 2. This document was issued by the Congregation of the Holy Office in March, 1962. It was presented by the Prefect, Alfredo Cardinal Ottaviani, to Pope John XXIII for the Pope’s approval. This is the normal manner of receiving Papal approval for documents of this nature. It was then sent to all the bishops in the world. The bishops were admonished to maintain strict confidentiality about the document and ordered not to allow it to be reproduced or commented upon. 3. Crimen Sollicitationis remained in effect until 2001 when the Vatican published a new set of procedures for prosecuting especially grave canonical crimes, including certain sexual crimes committed by the clergy. Two official documents were issued. The first was an apostolic letter of Pope John Paul II, known by its Latin title Sacramentorum sanctitatis tutela, by which the actual norms were promulgated. This letter, dated April 30, 2001, was followed on May 18, 2001 by an official document that set forth the norms. This latter document was signed by Cardinal Josef Ratzinger, prefect of the Congregation for the Doctrine of the Faith. Both documents refer to certain serious canonical crimes and among those is sexual abuse by clerics. These documents represent revised procedures to be used by Bishops and major religious superiors in response to allegations of clergy sexual abuse. -

Pope Leo of Bourges, clerical immunity and the early medieval secular Charles West1 At first glance, to investigate the secular in the early Middle Ages may seem to be wilfully flirting with anachronism. It is now widely agreed that the early medieval political order was constructed neither against nor in opposition to the Church, but rather that the Church, or ecclesia, largely constituted that order.2 This would seem to leave little early medieval scope for the secular, understood in conventional terms as the absence of religion (and moreover often associated with modernity).3 This position is broadly reflected in the recent historiography, which focuses either on Augustine’s short-lived notion of the secular in Late Antiquity, or on the role of Gregorian Reform in beginning a slow secularisation of political authority.4 These separate approaches are spared from intersecting by the early medieval half- millennium which is presented, as so often, as either too late or too early for key developments. However, in recent years, the argument has been forcefully made across a range of fields that, far from being a neutral or universal category, the secular is in reality ‘a historically-produced idea’, and one that moreover encodes a disguised theology.5 As a consequence, ‘to tell a story 1 This paper is based on research carried out on a project funded by the AHRC 2014-16.
