In accordance with 24 V.S.A. §4441, the Berlin Planning Commission has prepared and approved this written report on March 27, 2021, after holding a public hearing on a proposed revision to the town’s Land Use and Development Regulations.

Brief Explanation of the Proposed Amendments The Town of Berlin is proposing to revise SECTION 2202.H(1)(g) of the Land Use and Development Regulations (the Flood Hazard Overlay District). The proposed change is necessary to meet the requirements of FEMA and make Berlin eligible for Class 8 in the Community Rating System.

Statement of Purpose The purpose of the proposed revision is to meet the requirements of FEMA and make Berlin eligible for Class 8 in the Community Rating System.

Municipal Plan Goals and Policies The proposed revision is intended to further a principal objective of the Berlin Town Plan to encourage flood resilient communities.

Municipal Plan Future Land Use The proposed revision will encourage more property owners in the Flood Hazard Area to purchase flood insurance by making it more affordable which is consistent with the policies of the Berlin Town Plan.

Planned Community Facilities The proposed revision does not directly implement any specific proposals for planned community facilities.

SECTION 2202.H(1)(g) Constructed with electrical, heating, ventilation, plumbing, air conditioning equipment and other service facilities that are designed and/or located at least one foot above the Base Flood Elevation, so as to prevent water from entering or accumulating within the components during a flood;
