January 2020 saw the first known U.S. case of COVID-19; the first known death from the disease occurred the following month.1 By November 10, over 10 million Americans had contracted the disease and more than 237,000 had died—a death total far exceeding battle deaths from World War I, the Korean War, and the Vietnam War combined;2 just over 18,000 of these COVID-19 fatalities were Texans.3 Across the nation, businesses closed, unemployment surged past 14%, and the gross domestic product plunged by an annual rate of nearly 33% in a single quarter.4 As if all this were not bad enough, the disease and the often-disorganized government response to it served to further roil an already polarized populace.

    ORDER BY THE COUNTY JUDGE OF HARRIS COUNTY (Temporarily controlling the occupancy of a premises) Whereas, in response to the COVID-19 pandemic, federal, state and local officials issued proclamations and declarations of disaster, and thereby invoked their respective emergency management plans to protect the public; and Whereas, on January 31, 2020, the Secretary of Health and Human Services declared a public health emergency “in response to COVID-19, a highly contagious virus that spreads through person-to-person contact and continues to ravage communities across the globe”; and Whereas, on March 11, 2020, Harris County Judge Lina Hidalgo issued a Declaration of Local Disaster for Public Health Emergency to allow Harris County to take measures to reduce the possibility of exposure to COVID-19 and promote the health and safety of Harris County residents in accordance with Section 418.108(a) of the Texas Government Code. Viruses mutate, so there may be a different coronavirus strain next year. Like the flu vaccine, this year’s coronavirus vaccine may not protect against next year’s strain. Will we allow Judge Hidalgo’s Order to set precedent for future governmental remedies to viruses or diseases? Will it be a little easier to force people to wear certain items? Today a mask, tomorrow a hazmat suit – Page 1 of 8 where does it stop? Every day Judge Hidalgo’s Order is allowed to stay in place, the liberties of the residents of Harris County are trampled on.
