November 18, 2020 Dear Texas House Republicans, Once again Democrat efforts to turn Texas blue were soundly rejected by voters across the Lone Star State. While we continue to wait for election results to settle here in Texas and across the nation, it is obvious that Texas voters have delivered a mandate for conservative reform to their elected officials. While our control over national affairs is limited, Republican control of Texas is absolute. The GOP holds majorities in both chambers of the Texas Legislature. It also holds the governor’s office, the lieutenant governor’s office, and every other statewide office. Indeed, Republicans have majorities sufficient to enact any reform they wish – apart from state constitutional amendments – without securing a single Democrat vote. Texans voted for that result and Texans expect that from their elected officials. To be clear, Texas voters did not vote for bipartisan capitulation or compromise with Democrats, they voted for conservative Republican policies to be enacted. Texas has not elected a Democrat statewide since 1994. Texas voters’ decision to again shut Democrats out of statewide office and return Republican majorities to our Legislative and Congressional Delegations signals voters want the Republican Party of Texas Platform rigorously pursued and they expect results – not excuses. In order to advance the Republican Party of Texas Platform and its 87th Session Legislative Priorities, any Republican campaigning for Speaker of the Texas House should and must commit the following to Republican voters: ● Each Republican Party of Texas legislative priority will receive a vote on the floor of the Texas House. ● All House committees shall be chaired by Republicans and shall be composed of a majority of Republicans. -

The first section examines the location of the members of the Texas Senate and of the Texas House on the liberal-conservative dimension along which legislative politics takes place in Austin. In both chambers, every Republican is more conservative than every Democrat and every Democrat is more liberal than every Republican. There does, however, exist substantial ideological diversity within the respective Democratic and Republican delegations in each chamber. The second section explores the extent to which each senator and each representative was on the winning side of the non-lopsided final passage votes (FPVs) on which they voted. -

On the final Saturday before Election Day, U.S. Rep. Lizzie Fletcher corralled campaign volunteers ahead of one of their final text- and phone-banking sessions. The freshman Democrat’s campaign has relied heavily on those efforts amid the coronavirus pandemic, and campaign officials said Saturday that they’d sent more than a half-million texts and placed the same number of calls to potential voters. Across town, Republican challenger Wesley Hunt briefly spoke to about 30 volunteers before they headed out to homes in the surrounding neighborhood in search of voters. “We want everybody to turn out,” the former Army pilot said. “I want as many people to exercise their constitutional right to go vote, primarily because people died for it.” A day after Texas closed out an early-voting period that saw record turnout, campaigns and nonpartisan groups spent Saturday making among their final cases to potential or undecided voters in southeast Texas, hoping that last-minute get-out-the-vote efforts would bring out supporters on Election Day despite ongoing concerns about the risk of COVID-19. -

IN THE SUPREME COURT OF TEXAS 444444444444 NO. 14-0667 444444444444 IN RE JARED WOODFILL ET AL., RELATORS 4444444444444444444444444444444444444444444444444444 ON PETITION FOR WRIT OF MANDAMUS 4444444444444444444444444444444444444444444444444444 PER CURIAM Residents of the City of Houston filed a referendum petition requesting the City Council to reconsider and repeal its equal rights ordinance and, if it did not repeal the ordinance, to put it to popular vote. The City Council refused, claiming the petition was invalid. Though the ordinance is steeped in controversy, the legal principles at play are relatively simple. First, “the power of . referendum . is the exercise by the people of a power reserved to them,” and this power should be protected. Taxpayers’ Ass’n of Harris Cnty. v. City of Houston, 105 S.W.2d 655, 657 (Tex. 1937). Second, city officials must perform their ministerial duties. See Anderson v. City of Seven Points, 806 S.W.2d 791, 793 (Tex. 1991). Finally, when officials refuse to do so, and when there is no adequate remedy by appeal, mandamus may issue. See In re Union Carbide Corp., 273 S.W.3d 152, 156 (Tex. 2008) (orig. proceeding) (per curiam) (“[A] relator must show that it has no adequate remedy by appeal.”). We conclude that the Houston City Council has not performed a ministerial duty and there is no adequate remedy by appeal. Accordingly, we conditionally grant mandamus relief. This dispute concerns the duties of the City Secretary and the City Council of Houston when a referendum petition is filed. January 29, 2021| Regular Session, Issue 3 | 87th Regular Session Every Friday, this newsletter will keep you up to speed on some of the legislation important to Texas Farm Bureau members that Austin staff are following. Please do not hesitate to contact the appropriate staff with any questions. Legislative Update Water SB 152 and companion HB 668: Relating to the regulation of groundwater conservation districts. Perry, Charles (R) and Harris, Cody (R) Summary: SB 152 and HB 668 empower landowners to protect their constitutional rights from illegal groundwater regulations. Current law does not require enough transparency or provide landowners with reasonable options to change or challenge bad regulations. If property owners are faced with an illegal regulation, they only have one option— to challenge the district’s action in court and take on the risk having to pay the district’s attorney fees. The language in SB 152 and HB 668 is currently being negotiated. The following description of the bills is based upon the current state of negotiations: 1. Requiring notice of a permit or permit amendment that will prevent a neighboring landowner from being able to drill a well on their property or drill at a particular location on their property. The local district will determine how that notice will be provided. This notice will give landowners who will be DIRECTLY affected by the district’s actions an opportunity to decide if they should participate in the permitting process to protect their right to drill a well. In some districts, spacing rules allow a neighbor to drill a well 50 feet from a property line. -

This was particularly perplexing to many outside (and within) evangelical circles, because as leaders of America’s “Moral Majority” for almost four decades, prior to Trump’s campaign, evangelicals had insisted that only candidates who set a high standard for personal integrity and civic decency, were qualified to serve as president. -

the sentinel TEXAS ETHICS & RELIGIOUS LIBERTY COMMITTEE Texas Legislative Update March 15–27, 2021 Texas Issues As of March 27th, there were 66 days left in the Texas Legislative session. The time to get bills out of House Committees, through the Calendars Committee and to the House floor for a vote is running short. After a House floor vote, the bills must go still through the Senate process. In order for House bills to be successful, they need to be voted out of their respective Committees ideally the first week of April. Senate bills also need to make their way out of committees to be voted on and sent over to the House. We need all hands on deck to let our voices be heard. Children & Gender – Bills to Support HB 68 by Rep. Steve TOTH –“The Innocence Protection Act,” has sat in the Texas House Public Health Committee for over a month. It would classify medical procedures to change a child’s sex, such as puberty blockers or genital surgeries, as child abuse. Read more here – thetexan.news HB1399 by Rep. Matt Krause – Relating to professional liability insurance coverage for and prohibitions on the provision to certain children of procedures and treatments for gender transitioning, gender reassignment, or gender dysphoria. HB 4014 by Rep. Cole Hefner and SB1646 by Senator Charles Perry – Relating to the protection of children, including the definition of child abuse and the prosecution of the criminal offense of abandoning or endangering a child. SB1311 by Senator Bob Hall and HB 2693 by Rep. Steve Toth – Relating to the provision of and professional liability insurance coverage for gender transitioning or gender reassignment medical procedures and treatments for certain children– Parents and health care providers who request, prescribe, or perform these medical treatments are maiming children for life. -

THEIR RULE MAKING AUTHORITY AUSTIN—With strong suggestion that the Texas Ethics Commission plans to overstep their authority to implement rules that would impact freedom of speech in Texas, today six !Republican Texas Senate nominees submitted a letter to the Texas Ethics Commission. In a letter authored by Republican nominee Bob Hall, and signed by Rep. Van Taylor, Sen. Charles Perry, Paul Bettencourt, Konni Burton, and Don Huffines, the nominees inform the TEC that legislating in their role as commissioners would be a clear violation of the constitutional authority of the Texas Legislature. The potential controversy surrounds the debate over Senate Bill 346, which was recalled by the Texas Senate but passed through the Texas House. !The bill was later vetoed by Governor Perry for its “chilling effect” on free speech in Texas. “I’m proud to be joined by other Senate Republican nominees in sending a clear message to the Texas Ethics Commission,” commented Senator-elect Hall. “It’s the duty of the Texas Legislature to decide these matters, and the TEC should take care to not overstep its constitutional authority.
