87th LEGISLATIVE SESSION AND COVID RESTRICTIONS On January 12, 2021, lawmakers from across the state will convene the 87th Texas Legislative Session, meeting for the Regular Session over the following 140 days through May 31. This will be the first time that all 181 legislators will come together since the beginning of the Covid-19 pandemic, and the virus is top-of-mind for everyone involved. While the Governor recently announced the re-opening of the Capitol building on January 4, we have minimal knowledge of the health and safety protocols the members, staff and Capitol visitors will have to follow when they enter the building next week. It will surely be a much different environment than previous sessions. We know the following requirements will be in place as of today, per a memo released by the State Preservation Board last week: • The Capitol building will only be open from 9 a.m. to 6 p.m., Monday through Friday; it will be closed Saturday and Sunday for cleaning. • The public may only enter through the North Capitol entrance. • Covid testing will be encouraged and provided on the North Plaza at no expense. • A mask will be required to be worn inside the building at all times. • All deliveries to the Capitol, including food and beverage, must be left at the loading dock; no delivery personnel will be allowed beyond the loading dock or through the public entrance. • No public tours or groups or sponsored event space will be available. • The House and Senate will manage public access to their offices once convened and rules are adopted, and the public will need to check with the offices directly for specific guidelines. -

The National Popular Vote Plan and Direct Election of the President: An FAQ What is the National Popular Vote plan? The National Popular Vote plan (NPV) is a statute that, as of April 2009, had been introduced by state legislators in 48 states and publicly committed to be introduced in the remaining two states. NPV seeks to guarantee election of the presidential candidate who receives the most popular votes in all 50 states and the District of Columbia. It creates an agreement among states to award all of their electoral votes collectively to the presidential candidate winning the national popular vote once the number of participating states together have a majority (currently 270 of 538) of electoral votes. In considering the NPV bill, the choice for legislators is straightforward: passing NPV will guarantee election of the national popular vote winner once joined by enough participating states to make it decisive for determining future elections. Until that point, a state’s current rules will apply. The NPV plan is founded on two state powers clearly established in the U.S. Constitution: a state’s plenary power to decide how to apportion its electoral votes and a state’s power to enter into binding interstate compacts. As of April 2009, New Jersey, Hawaii, Maryland, and Illinois – which together possess a fifth of the total electoral votes necessary to trigger the agreement – have enacted the NPV compact. It has been adopted by a total of 26 state legislative chambers in 16 states, earning public support from nearly 1,300 legislators and national luminaries like the editorial boards of the New York Times and Los Angeles Times and former U.S. -

Alabama Legislature WHERE IS THE ALABAMA STATE HOUSE LOCATED? The Alabama State House is located at 11 South Union Street in Montgomery. The House of Representatives chamber is on the 5th floor and the public viewing gallery for the House is located on the 6th floor. The Alabama Senate chamber is on the 7th floor and the public viewing gallery for the Senate is located on the 8th floor. WHAT ABOUT LEGISLATIVE SESSIONS? The 2021 Regular Session of the Alabama Legislature will convene on February 2. The Legislature convenes in regular annual sessions on the first Tuesday in February, except (1) in the first year of the four-year term, when the session will begin on the first Tuesday in March, and (2) in the last year of a four-year term, when the session will begin on the second Tuesday in January. The length of the regular session is limited to 30 meeting days within a period of 105 calendar days. There are usually two meeting or “legislative” days per week, with other days devoted to committee meetings. Special sessions of the Legislature may be called by the Governor, with the Proclamation listing the subjects which the Governor wishes considered. These sessions are limited to 12 legislative days within a 30 calendar day span. In a regular session, bills may be enacted on any subject. Tidwell, Chief, United States Forest Service Chief Tidwell, On July 15, 2014, the Utah Water Development Commission (Commission) met to discuss the Proposed Directive on Groundwater Resource Management issued by the U.S. Forest Service. The Commission meeting was an open and recorded meeting. Chris Iverson, Deputy Regional Forester, and Kathryn Conant, Director, Lands and Minerals, both with U.S. Forest Service Region 4, addressed the Commission on the proposed directive. In response to the explanation by the Region 4 officials, the WDC received comments from: Michael Styler, Executive Director, Utah Department of Natural Resources Steven Clyde, Clyde Snow and Sessions Kent Jones, Utah State Water Engineer Randy Parker, CEO, Utah Farm Bureau Federation John Loomis, General Manager, Snowbasin Ski Resort Ed Bowler, Chair, Washington County Water Conservancy District After the listed presentations and commission discussion, a motion was made requesting that the Commission cochairs send a letter to the U.S. Forest Service outlining the Commission's concerns and requesting the Forest Service to withdraw the proposed Directive on Groundwater Resource Management. The vote on the motion was unanimous in the affirmative with legislators from both parties and both legislative chambers in full support. Members of the Commission who are not elected legislators also supported the motion and requested that their names be added in support. -
