MINUTES OF ORDINARY MEETING OF THE CANTONMENT BOARD HELD ON 25 JANUARY, 2020 AT 1130 HOURS IN THE OFFICE OF THE CANTONMENT BOARD, ------

Before the onset of the meeting, the Station Commander Brigadier S N Singh was welcomed by the CEO and all Members of the Board.

1. Brigadier S N Singh, Station Commander on having become the President, Cantonment Board, Dehradun (Ex-Officio) took oath of allegiance to the constitution of U/s 17 of the Cantonments Act, 2006.

2. Brigadier V K Patra, Commandant M H Dehradun on having become the SEMO of Cantonment Board, Dehradun (Ex-Officio) took oath of allegiance to the constitution of India U/s 17 of the Cantonments Act, 2006.

516-1 DEVOLUTION OF POWERS OF VICE-PRESIDENTS OF CANTONMENT BOARDS & CONSTITUTION OF THREE COMMITTEES-DRAFT BUSINESS REGULATION BYE LAWS

Reference Principal Directorate, Defence Estates, Min of Defence, Central Command letter No. 32670/VNS/BR/15 dated 30 December, 2019 thereby enclosing DG DE, Govt of India, Min of Defence, Delhi Cantt letter No. 76/67/Expert Committee/C/DE/2018/Vol-IV dated 24.12.2019 on the above subject.

The PD DE, Central Command has directed to forward the amended Business proposals in accordance with MoD instructions contained in Govt of India, Min of Def ID No. 14(12)/2018-D(Q&C) dated 23rd December, 2019, one of the recommendations relates to devolution of more responsibilities to Vice-President of Cantonment Boards. The Government has suggested for implementation of recommendations in Annexure-A and to constitute Committees of the Board and their roles and responsibilities be included as indicated in Annexure-B.

The main recommendations as contained in Annexure-A, are as under:

(1) The Vice-President of Cantonment Board should be directly elected (2) The Civil Area Committee may be empowered to exercise powers, duties and functions of the Board in addition to what has already been delegated, under Section 83, 137(2), 151, 168, 169 and 170 of the Cantonments Act, 2006. (3) Clause (b) of sub-section (1) of Section of the Cantonments Act, 2006 regarding power of Central Government to vary the constitution of the Board for the administration of Cantonments, should be done away with. (4) Cantonment Boards should switch over from the present system of calculating ARV as enunciated in Section 73 of the Cantonments Act, 2006 to the more scientific and objective Unit Area Rate method for assessment of properties. (5) The Cantonment Valuation Committee should consist of five members, including three independent experts, one each in the field of valuation, taxation or law and municipal management, the Executive Engineer(member of the Board) and the CEO (as the member- Secretary). 2

(6) Objections to the Assessment List prepared by the Cantonment Valuation Committee should be heard by a 5-member Appellate Committee consisting of the President, Cantonment Board as Chairman, the Vice-President of the Board, the CEO and two independent experts who are not members of the Cantonment Valuation Committee. (7) The DGDE and Min of Defence should work out legally tenable modalities for transferring Cantonment Board employees within a State or within a Command. (8) On the issue of disenfranchisement of certain class of voters in Cantonments in pursuance of Hon‟ble Supreme Court Order in Panchmarhi Cantonment case, either of the following two alternatives may be followed, after obtaining the advice of Attorney General of India:

(i) Sub-Section (1) of Section 28 of the Act should be suitably amended to bring it in line with the corresponding provisions of various State Municipal Laws; or (ii) In the alternative, an encroacher of defence land should be specifically disentitled from being enrolled as an elector/voter under sub-section (2) Section 28.

(9) (a) Every Board should be mandated to constitute three more statutory Committees, namely, the Finance Committee, the Education Committee and the Health & Environment Committee under the Cantonments Act. (b) Three new Sections may be inserted in the Cantonments Act to provide for Finance Committee (Section 47 A), Education Committee (Section 47 B) and Health & Environment Committee (Section 47 C).

(10) Reservation of seats for OBCs should be made in Cantonment Board elections where the States, in which those CBs are situated, have made such provisions with regard to Municipal elections; the manner of such reservations may also be followed mutatis mutandis.

(11) The word occurring after “the Central Government” in the second proviso to sub-section (2) of Section 66 may be deleted, and the same may inserted below sub-section (1)(b) of Section 66 of the Cantonments Act, 2006 .

The main recommendations for compositions of various Committees (amended) as contained in Annexure-B, are as under:

I. Finance Committee (Category –I Cantt)-consisting of 07 members to be elected by the Board of whom 04 shall be elected members and 03 nominated members, one of which shall be Executive Engineer(Garrison Engineer).

II. Health & Environment Committee (Category –I Cantt)- consisting of 07 members to be elected by the Board of whom 04 shall be elected members and 03 nominated members, amongst whom one shall be one Health Officer and one Executive Engineer(Garrison Engineer).

III. Education Committee (Category-I Cantt)- consisting of 05 members to be elected by the Board of whom 03 shall be elected members and 02 nominated members.

IV. Civil Area Committee (Category-I Cantt)- Composed of 08 Elected Members, the Executive Engineer (GE), the Health Officer. The Civil Area Committee may be empowered to exercise the powers, duties and functions of the Board, in addition to 3

what has already been delegated, under Sections 83, 137(2), 151, 168, 169 and 170 of the Cantonments Act, 2006.

As regards the proposed amendments in Cantonments Act, 2006 the action on the matter is to be taken Min of Defence/DG DE, Delhi Cantt. The Office has prepared Draft Business Regulations (amended) and various Committees under the Board, their compositions and duties and responsibilities, which is placed on the table for the consideration of the Board and for forwarding the amended Business Regulations to the Central Government, through DGDE for approval and thereafter its notification in the Gazette.

516-1 RESOLUTION: The matter was considered in detail and after deliberation resolved as under: The Draft Business Regulations of Cantonment Board, Dehradun is approved and necessary proposal be initiated to higher authorities for Gazette Notification. As regards constitution of various committees of Board, the same may be constituted by the Board under Section 48 of the Cantonments Act, 2006 after Gazette Notification of Draft Business Regulations of Cantonment Board, Dehradun.

517-2 TENDERS/BIDS FOR LEASING THE HOSPITALITY & CATERING SERVICES OF BOARD‟S “GANGOTRI” GUEST HOUSE

The Board in its ordinary meeting held on 29.12.2019 had resolved vide CBR No. 506-7 dated 29.12.2019 that tenders/bids be invited for leasing the hospitality & catering services of “Gangotri” Guest House. The sealed tenders/bids were invited vide tender Notice No. VI/17/GH/37 dated 07 December, 2019, with base amount of lease/rent @ Rs. 15,000/- p.m. which were published in daily newspaper “Dainik Jagran”, “Amar Ujala” and Hindustan () in their issues of 08th December, 2019. On due date, i.e. 23 Dec., 2019 up to 4.00 p.m. (closing hours), the tenders received were opened on the same day at 5.00 p.m. in the presence of the CEO, OS, JE (Civil) and Storekeeper. In all five tenders were received and their comparative statement is appended below:

NOTE:

1. The tender opening committee observed that the bidder (M/s Basant Tent House) has tendered the highest rates of Rs. 27,000/- p.m. but he has not fulfilled the tender documents- e.g. EMD, Experience, License from FSSAI.

2. The second highest bidder (M/s Raj Hospitality & Catering Service) has tendered the rates of Rs. 25,000/- p.m. and his tender accompanies with EMD, satisfactory experience from Govt as well as private Institutions, License from Food Authority of India (FSSAI).

The whole matter is placed with file on the table for the consideration of the Board.

517-2 RESOLUTION: The matter was considered by the Board and resolved to approve the lease rent of Rs. 25,000/- per month for Board‟s “Gangotri” Guest House to M/s Raj Hospitality & Catering Service, A- Block, Ekta Vihar, Ajabpur Khurd, Dehradun for a period of one year w.e.f. 1 Feb., 2020. Board further resolved that CEO is authorized to execute necessary Contract Agreement with the lessee and to issue offer letter.

518-3 REQUISITION OF PURV SAINIK KALYAN NIGAM LIMITED (UPNL)

To consider the Uttarakhand Purv Sainik Kalyan Nigam Ltd. (UPNL) letter No. 1126/Hkou@miuy dated 21.11.2019 under which requesting to provide two rooms on rental basis for 1 year. The office report states that the Board is having two rooms at Garhi Cantt (formerly cattle pond), which may be lease to Uttarakhand Purv Sainik Kalyan Nigam Ltd. (UPNL) on a monthly rental of Rs. 4000/- pm.

The letter of the Uttarakhand Purv Sainik Kalyan Nigam Ltd. (UPNL) together with office report on the same is placed on the table for the consideration of the Board.

518-3 RESOLUTION: Board considered the matter and resolved to approve the monthly rent of Rs. 5,000/- p.m. to lease two rooms of Board at Garhi Cantt and necessary Contract Agreement be executed , by the CEO, with Uttarakhand Purva Sanik Kalyan Nigam Ltd (UPNL).

519-4 LEASING THE RIGHTS OF RUNNING OF BOARD‟S CANTEEN ON RENTAL- INSIDE SHAHEED DURGA MALL PARK, DEHRADUN CANTT

Reference CBR No. 440-6 dated 24 September, 2019.

The Board had approved the highest bid of Shri Mukesh Singh Negi of Chamoli Uttarakhand on a rental of Rs. 13,100/- p.m for the shop No. 1 at Shaheed Durga Mall Park Dehradun Cantt. The above bidder was offered to run the canteen @ Rs. 13,100/- p.m for a period of one year vide letter No. XVI/12/Canteen dated 1.11.2019 but till date Shri Mukesh Singh Negi has not complied with the same.

Office report in this connection states that the EMD money of Rs. 10,000/- of above highest bidder be forfeited to the Board being a defaulter and fresh tenders may be recalled.

The case file along with office report is placed on the table for the Consideration of the Board.

519-4 RESOLUTION: Matter was considered by the Board and resolved that The EMD of Shri Mukesh Singh Negi of Chamoli (Uttarakhand) being defaulter, amounting to Rs. 10,000/- (Rs. Ten Thousand only) be forfeited to the Board and tenders be recalled for leasing the Board‟s Canteen within Shaheed Durga Mall Park of Cantonment Board, Dehradun.

520-5 REQUISITION OF VICE-PRESIDENT –REPLACING THE WATER SUPPLY PIPE LINE IN DAKRA AREA OF DEHRADUN CANTT

To consider the requisition of the Vice-President dated 20.12.2019, which states that in her Ward in Dakra some of the residents have complained of supply of contaminated water in their home. The water supply staff visited the sites for assessing the reason for contaminated water. It has been reported by them that the water supply pipe line is passing through the drain and dipped in the sullage water, which has developed cracks and holes at many places. The water supply G I pipe line of 3” dia is to be completely removed for approx. 200 ft in length for restoring potable water supply to the residents whose service connections are connected through this line. During the repair and replacement of water supply pipe line, all connections shall be dismantled.

The Junior Engineer (E&M) has estimated an expenditure of Rs. 85,000/- (Rupees Eighty Five Thousands only) for the purchase of 200 ft. GI Pipe of 3” dia and other accessories of pipe fittings.

The matter is placed before the Board for consideration.

520-5 RESOLUTION: Considered by the Board together with estimate and resolved to approve the estimate of Rs. 85,000/- (Rs. Eighty Five Thousand only) for replacement of water supply pipe line in Dakra area of Dehradun Cantt. Board further resolved to authorise the CEO to place work order and to make payment in due course.

521-6 REQUISITION OF SMT. MEENU, WARD MEMBER –ALIGNING AND JOINING OF THE WATER SUPPLY PIPE BY REPLACING OLD LINE & JOINING WITH WATER DISTRIBUTION LINE IN GARHI AREA OF DEHRADUN CANTT

To consider the requisition of Smt. Meenu, Ward Member dated 23.12.2019, which states that in her Ward in Garhi some of the colonies, areas, namely, Santoshi Mata Gali, Punjab & Sind Bank Colony, Vijay Gali are facing acute shortage of water supply and residents of these areas have complaining since long. The water supply staff visited the sites for assessing the reason for acute shortage of water supply. It has been reported by them that the water supply pipe lines are required to be aligned and to be connected through new pipe line across the road and supply to be regulated through Gate Valves and excavation for laying the pipe line. The Junior Engineer (E&M) has prepared an estimate amounting to Rs. 1,42,000/- (Rupees One Lakh Forty Two Thousands only) for the purchase of Gate Valves and other pipe fittings

The matter is placed before the Board for consideration.

521-6 RESOLUTION: Considered by the Board together with estimate and resolved to approve the estimate of Rs. 1,42,000/- (Rs. One Lakh Forty Two Thousand only) for aligning and joining of water supply pipe line in Garhi area of Dehradun Cantt. Board further resolved to authorise the CEO to place work order and to make payment in due course.

522-7 GRANT OF PROVISIONAL FAMILY PENSION-IN RESPECT OF LATE SHRI HARISH, MALI

To consider the Office report which states that Shri Harish S/o Shri Jai Ram, working as Mali , expired on 24.02.2019 in harness. The deceased employee was covered under NPS (National Pension Scheme) and was registered under PRAN. The NPS authorities at Allahabad have been written for necessary action in the matter.

The Central Civil Service (Pension) Rules, 1972 has provision …”.the Govt Servants who are covered by the New Pension Scheme (NPS) who are discharged on invalidation/disablement/dies during service since 1-1.2004 are entitled to following benefits on provisional basis till further orders:

Death in service not attributable to Government duty:

(i) Family Pension ….as per Rule 54 of CCS (Pension) Rules, 1972. (ii) Death Gratuity ……as per Rule 50 of CCS (Pension) Rules, 1972.” 7

In this context the Govt of India, DoP & PW O.M. No. 38/41/06-P&PW(A) dated 5.5.2009 has ordered”……….considering the hardships being faced by the employees appointed on or after 1.1.2004 who are discharged on invalidation/disablement and by the families of such employees who died during service since 1.1.2004, the President is pleased to extend the following benefits to Govt. Servants covered by the New Pension Scheme on provisional basis till further orders.

The Account Section has prepared pension papers accordingly for grant of Family Pension and DCRG to Smt. Savitri , wife of the deceased employee and got it audited from LAO (Army), Dehradun as under: (I) Family Pension……… (i) Rs. 12,450/- p.m. for a period of 10 yrs. w.e.f. 01.03.2019 (ii) Rs. 9,000/- after 10 yrs. (II) DCRG……………………. Rs. 3,34,656/- (lump sum)

The above pensionary benefits are to be provisionally sanctioned by the President, Cantonment Board, Dehradun and thereafter to be sub mitted to PD, DE, Min of Defence, Central Command for final sanction.

The whole matter together with pension file is placed on the table for the consideration of the Board.

522-7 RESOLUTION: Considered by the Board perusing the Office report on the agenda side and O.M. of Department of Pension and PW dated 05.05.2009, under which the provision of CCS (Pension) Rules, 1972 has been extended for grant of provisional pension in respect of employees covered under NPS (National Pension Scheme), The provisional pension is to be sanctioned by the President Cantonment Board and thereafter to be submitted to PD DE, Central Command for final pension. Board resolved to grant Family Pension & DCRG to the wife of the deceased employee (Late Shri Harish, Mali) as prepared by the Office under Rule 54 & Rule 50 of CCS (Pension) Rules, 1972; as follows::

(I )Family Pension ...... (i) Rs 12,450/- p.m. for 10 yrs w.e.f. 01.03.2019

(II) DCRG ...... (ii) Rs. 3,34,656/- (lump-sum)

The pension & DCRG be got audited before grant of provisional pension.

523-8 PROCEEDINGS OF BUILDING & HEALTH COMMITTEE HELD ON 21 JANUARY, 2020

To consider the proceedings of Building & Health Committee meeting held on 21 January, 2020 (Copy enclosed as Annexure-„A‟).

523-8 RESOLUTION:(1) Residential Building Plan:- Board perused the recommendations of the B&HC dated

21.01.2020 and resolved that to approve the residential building plans from Sl No. 1 to 32 as shown on the agenda side. Board further resolved that CEO is authorized to issue sanction letter after payment of development charges as shown in the table at column 6.

(2) Commercial Building Plan:- Board perused the recommendation of the B&HC dated 21.01.2020 and resolved to approve the commercial building plans appearing from Sl No. 1 to 8 on the agenda side. Board further resolved to authorize the CEO to issue sanction letter after payment of developmental charge as shown in the table at column 6.

(3) Additional Building Plan for Discussion :-(i) The Board considered the map of Smt. Sushila Devi under which she has requested to the Board to sanction her building plan. The PCB and the Board members asked to call Shri Mohan Singh Dewari, the husband of Smt. Sushila Devi, to represent his grievances/problems regarding the site of construction of his building. He apprised the Board that his plot/land is in a low lying area and the drain constructed above his land is on higher side so that water would be logged on his low land/plot. Moreover it would be difficult to make road for accessing his plot/land from main road. Board proposed that necessary material etc. would be provided by the Board for levelling his plot/land for facilitating to make approach road and to get rid of water logging problem, but he will have to get the work done by his own mason/labours to suit his plans. Board finally resolved that JE (Civil) of the Board shall visit the site in question and will submit his report for the consideration of the Board in the next meeting. (ii) Board also considered the case of Shri Amit Kumar in which B&HC has recommended to require Khasra Khatauni and a site inspection is to be undertaken by the B&HC for further consideration of his building plan. Board therefore resolved that after complying the needful, the matter be put up before the next meeting of the Board. (4) Permission of Cutting of Trees:- The matter was considered by the Board and the Board resolved as under:-

(i) The applicant, Shri Jaideep Gurung is required to obtain permission from Forest Department of the State Govt. for cutting of trees and to plant ten saplings in place of 1 tree to be cut and same be placed before the next Board for the sanction U/s 262 of the Cantonments Act, 2006.

(ii) The applicant, Shri Arun Kumar Sharma is required to obtain permission from Forest Department of the State Govt. for cutting of trees and to plant ten saplings in place of 1 tree to be cut and same be placed before the next Board for the sanction U/s 262 of the Cantonments Act, 2006.

(iii) The applicant, Shri Anurag Garg is required to obtain permission from Forest Department of the State Govt. for cutting of trees and to plant ten saplings in place of 1 tree to be cut and same be placed before the next Board for the sanction U/s 262 of the Cantonments Act, 2006.

(iv) The applicant, Shri Jitendra Taneja is required to obtain permission from Forest Department of the State Govt. for cutting of trees and to plant ten saplings in place of 1 tree to be cut and same be placed before the next Board for the sanction U/s 262 of the Cantonments Act, 2006.

(v) The applicant, Shri Jitendra Taneja is required to obtain permission from Forest Department of the State Govt. for cutting of trees and to plant ten saplings in place of 1 tree to be cut and same be placed before the next Board for the sanction U/s 262 of the Cantonments Act, 2006. (5) Extension of Time:- Considered by the Board and resolved to grant extension of time to the applicant Smt. Neeru Gurung for completion of construction of her house for a further period of 1 year, which is last and final extension granted for. (6) Unauthorized Construction: Issue of Notice U/s 248 & Prosecution U/s 320 of the Cantonments Act, 2006:- The matter was considered by the Board and Board resolved to issue notice U/s 248 and simultaneously prosecution also be launched U/s 320 of the Cantonments Act, 2006 against Shri Hanish Khetrapal & Shri Gaurav Khetrapal, Wing No. 2/1/5, Shop No. 5, Premnagar Dehradun for his unauthorized construction and not complying to Board earlier show cause notices in the matter.

(7)Unauthorized Construction: Issue of Notice U/s 248 & Prosecution U/s 247 of the Cantonments Act, 2006:- The matter was considered by the Board and Board resolved to issue notice U/s 248 and simultaneously prosecution also be launched U/s 247of the Cantonments Act, 2006 against Shri Amit Khanna, House No. 104, Premnagar Dehradun for doing unauthorized construction and not complying to Board earlier show cause notices in the matter.

524-9 NOTIFYING THE CIVIL AREA IN RESPECT OF DEHRADUN CANTT

Reference CBR No. 393-45 dated 25.06.2019.

The Board vide above CBR had resolved to notify the Civil Area in Dehradun Cantonment for notification the same by the Government. The necessary draft proposal was initiated under Cantonment Board Dehradun letter No. X/17/Civil Area/5 dated 01.08.2019, which was returned by the PDDE, Central Command; Lucknow Cantt under their letter No. 56444/DDN/CA/2 dated 13.09.2019 and directed to adhere to guidelines described in above mentioned letter and to forward the proposal for notification of civil area along with all the information and documents as required therein.

The office has prepared the draft proposal for notifying the civil area in respect of Dehradun Cantonment by the Central Govt. under section 46 of the Cantonments Act, 2006 , complying to the guidelines and requisite information and documents for forwarding the proposal to the Govt. of India, Min of Defence for notification in the Official Gazette.

As regards formation of Civil Area Committee, the Board is competent authority to appoint Civil Area Committee under the provisions of section 47 (1)&(2) of the Cantonments Act, 2006 after the notification of civil area of Dehradun Cantonment in Official Gazette.

In this connection the office has prepared the draft notification of Civil Area along with GLR of Garhi Dakra area and Premnagar area together with layout plan of Civil Area of Dehradun Cantonment, which are placed on the table for the consideration of the Board.

524-9 RESOLUTION: - The Board perused draft notification of Civil Area for notifying the civil area in Dehradun Cantonment along with connected documents and resolved that necessary proposal be initiated to higher authorities for publication for notifying the civil areas in Dehradun Cantonment in the official Gadget.

525-10 ACTION TAKEN BY THE CEO UNDER SECTION 26 OF THE CANTONMENTS ACT, 2006

Reference requisition of Smt. Madhu Khattri, Ward Member dated 20.01.2020.

To consider the requisition of Smt. Madhu Khatri, Elected Member in which she has stated that the Regional Chief Engineer of PWD, Lok Nirman Anubhag 2, Dehradun that the above department of Uttarakhand Govt. has proposed to repair and improve the road Garhi Cantt to Tapkeshwar Mandir under State Govt. projects in Vidhan Sabha constituency out of State Govt. Funds. The ward Member has requested to grant NOC of the Cantonment Board Dehradun to enable the PWD to undertake the proposed developmental work.

Keeping in view the problems of the general public and immediate execution of the work being necessary the CEO has taken action under section 26 (2) of the Cantonments Act, 2006 and granted NOC to the aforesaid department for undertaking the public developmental work of repair and improvement of road as reported above as the best interest of the general public.

Board is requested to confirm and note the action taken by the CEO under section 26 of the Cantonments Act, 2006.

526-11 GRANT OF NOC FOR REPAIR & MAINT. WORKS (PCC ROADS) & CONSTRUCTION OF PULIA IN PREMNAGAR AREA OF DEHRADUN CANTT

To consider the requisition of Shri Harbanse Kapoor, MLA of Dehradun Cantt Constituency to grant NOC for the following developmental works in Premnagar area of Dehradun Cantt out of MLA funds.

1) PCC Roads from Sanjay Ahuja house to Ashok Anand house in Special Wing. 2) PCC Road in Chawla lane wing No. 6. 3) PCC Road in Jagroshan lane Wing No. 3. 4) PCC Road in Dr. Gyan Lane Wing No. 3. 5) Construction of Pulia in Wing No. 7 near Bholey Provision Store.

The requisition of Shri Harbanse Kapoor, MLA is placed on the table for the consideration of the Board.

526-11 RESOLUTION:- The requisition of Shri Harbanse Kapoor, MLA was considered by the Board and resolved to grant NOC for repair and maintenance work as shown on the agenda side from Sl No. 1 to 5 to be carried out of MLA funds.

527-12 GRANT OF MOU FOR REPAIR AND MAINTENANCE OF INTERNAL ROADS OF PREMNAGAR AREA OF DEHRADUN CANTT

To consider the letter No. Nil dated Nil from the Executive Engineer, Construction Division, PWD Dehradun thereby intimating that during FY 2019-20 under State Govt. projects works the Uttarakhand Govt. vide GO No. 3413/III(2)/19-21 ,e0,y0,0@2017 Vh0lh0 and Go. No. 1704/III (2)/18-18 (MLA)/2017 dated 04.05.2018 thereby allocating Rs. 145.21 Lakhs and formulation of MoU to undertake the repair and maintenance works of internal roads of Premnagar Area as per list attached of roads all in 11 and there lengths.

In this context the aforesaid letter and drafted MoU is placed on the table for the consideration of the Board to grant NOC of the Board and signing of the MoU by the CEO on behalf of the Board.

527-12 RESOLUTION:- The letter of the Executive Engineer, Construction Division, PWD Dehradun and draft MoU as shown on agenda side was considered by the Board in detail and after deliberation Board resolved that NOC for repair and maintenance work for internal roads of Premnagar area of Dehradun Cantt is granted.

Board further resolved that CEO is authorized to issue NOC and to sign the MoU on behalf of the Board after suitable rectification in the clauses of MoU.

528-13 MARKETS, SLAUGHTER HOUSES, TRADE & OCCUPATIONS, SECTION 265 AND 266 OF THE CANTONMENTS ACT, 2006

To consider the provisions of Section 265 and 266 of the Cantonments Act, 2006 for regulating the markets, slaughter houses and all trades and profession in the Cantonment area of Dehradun Cantt .

Whereas Section 265 deals with Public Markets and Slaughter Houses and Board is empowered to maintain on the land under its control public markets and public slaughter houses together with stalls, shops, sheds, pens and other buildings or conveniences for the persons carrying on trade or business . Further Board may at any time, by public notice, close any public market or public slaughter house

The Section 266 deals with use of Public Market, empowers the CEO that “No person shall without the general or special permission in writing of the Chief Executive Officer, sell or expose for sale any animal or article in any public market. Further any person contravening the provisions of this section may be summarily removed from the market under the orders of the Chief Executive Officer.

In the light of recent judgement of the Hon‟ble Supreme Court of India, the presence of slaughter within Public Market and sale and exposure of animal has been totally prohibited and the Board and CEO Has to take action accordingly as prescribed under Section 265 and 266 of the Cantonments Act, 2006.

Matter is placed before the Board for consideration.

528-13 RESOLUTION:- The matter was considered by the Board in detail

and after much deliberation Board authorizes the CEO to issue notices to

slaughter houses and shopkeepers for sale or expose any animal or article in

public market and straying pigs. Board further resolved that such

persons/shopkeeper be identified and notices be issued to restrain from such

activities within a period of 20 days, else action be initiated for summarily

removing defaulter (s) from the market by the CEO or any official of the

Board authorized by him/her in this behalf.

529-14 REQUISITION OF SHRI KAMAL RAJ, WARD MEMBER, WARD 3, PREMNAGAR

To consider the requisition of Shri Kamal Raj, Elected Member of Ward 3, Premnagar, Dehradun Cantt dated 20.01.2020 thereby stating that the conservancy services for lifting the garbage in Premnagar area is not satisfactory. He has requested that the lifting of the garbage be done in the morning as well in the evening.

The requisition letter of Shri Kamal Raj, Elected Member is placed on the table for the consideration of the Board.

529-14 RESOLUTION:- The requisition of Shri Kamal Raj was considered by the Board and Board resolved that for the satisfactory conservancy services under “Door to Door garbage collection and sweeping of roads etc.” in civil areas of Dehradun Cantt. by making provision for the same in the evening shift also by engaging 6 Safaiwalas for Premnagar area and 6 Safaiwalas for Garhi Cantt area of Dehradun Cantonment . CEO is further directed by the Board to invite e-tenders for “Door to Door garbage collection and sweeping of road etc.” by adding/including the above provision of evening shift and engagement of additional manpower for the said conservancy services.

530-15 EXTENSION OF CONTRACTUAL PERIOD OF SHRI MANOJ BISHT, ENGAGED AS SANITARY INSPECTOR ON CONTRACT FOR CIVIL AREA AND SHRI YASHWANT SINGH ENGAGED AS SCHOOL CLERK IN GIRLS INTER COLLEGE

Reference CBR No. 323-5 dated 26 February, 2019.

To consider the applications submitted by Shri Manoj Kumar Bisht and Shri Yahwant Singh dated 21.01.2020 to extend their contractual engagement, who were engaged as Sanitary Inspector and School Clerk, respectively for a period of 11 months w.e.f. 01.03.2019 vide CBR under reference. 532-17 SHIFTING OF TRENCHING GROUND, PREMNAGAR

Reference SDM (F/R) Dehradun letter No. 387/L.B.C.-2019 dated 26 Dec 2019.

To consider the office report dated Jan 2020 of Sanitary Supdt, Cantonment Board, Dehradun Cantt which states that during a meeting held by District Magistrate, Dehradun on 01 Jan 2020 along with the residents dwelling in the vicinity of trenching ground, Premnagar, he had ordered to conduct a meeting with the residents of the area on 03 Jan 2020 in the presence of CEO Dehradun and settle the case. In compliance to above, a meeting was held between CEO Dehradun and the residents of the area dwelling near trenching ground on 03 Jan 2020. After hearing the grievances of the public a consensus was made that -

(i) The dumped garbage shall be completely disposed off within 06 months. The daily collection of garbage shall also be disposed off simultaneously with the old garbage. Simultaneously a proposal to the DM Dehradun may be forwarded for allotment of a suitable land for disposal of garbage or Cantonment Board Dehradun may also initiate the process of acquiring a suitable land for the same.

(ii) A boundary wall around the present trenching ground will have to be constructed.

The matter is placed before the Board. The Board may decide.

532-17 RESOLUTION:- The matter was considered by the Board at length and

factually the Board is heavily State aided for funds and having no lands of its own and as such Board is not in a state to purchase alternate land for Trenching Ground. Therefore Board resolved that necessary proposal be sent by the Board to the District Magistrate, Dehradun for providing alternate site for shifting and developing of Trenching Ground for Premnagar area of Dehradun Cantonment and till the matter is finalized/land allotted by the State Govt., the present

Trenching Ground shall be in operation which is being provided with solid waste

treatment plant. Board further resolved, as regards construction of boundary wall around the trenching ground, that necessary estimate be got prepared and placed before the Board in its next meeting.

533-18 DECLARATION OF AMBASSADOR CAR AND MARUTI VAN (AMBULANCE) VEHICLES AS BER (BEYOND ECONOMICAL REPAIR)

Reference CBR No. 434-30 dated 15 Oct 2012.

To consider the office report dated 20 Jan 2020 of Sanitary Supdt, Cantonment Board which states that the Board in the year 2012 had declared the two vehicles (i) Maruti Van No. UP07D 1424 (Ambulance) and (ii) Ambassador Car No. UP07H 6622 as BER.

In this connection the first auction proceedings of the above vehicles held on 25 June 2012 were rejected by the Board. In second auction held on 31 Aug 2012, the Board approved the highest bid of Maruti Van (Ambulance) for Rs. 12,700/- + 5% VAT offered by Shri Shailendra Gurung, 510 Dakra, Dehrdun Cantt. As regards Ambassador Car the Board resolved to retender the bid as the highest bid received by Shri Krishan Kr Kashyap, 604 Dakra, Dehradun Cantt were on lower side. In third auction held on 23 Nov 2012 as the highest bid of Rs. 26,500/- received was less than the highest bid received in second call i.e., Rs. 31,200/- + VAT 4.5%). Therefore the approval of PCB, Dehradun was obtained to approve the highest bid received from Shri Krishan Kr Kashyap in second call.

The highest bidder Shri Shailendra Gurung for Maruti Van (Ambulance) did not turn up to collect the vehicle and the same is lying condemn in the office workshop. The highest bidder Shri Krishna Kr Kashyap was informed vide this office letter No. XIV/12/Condemnation/32 dated 26 Nov 2012 to deposit the highest bid of Rs. 31,200/- + 4.5% VAT offered by him but he also did not appear to collect the Ambassador Car. Instead Shri Krishan Kr Kashyap vide letter dated 26 Feb 2015 requested this office to release his earnest money of Rs. 5000/- deposited by him in the auction of Ambassador Car.

In this connection the office report along with documents are placed on the table. The Board may decide.

533-18 RESOLUTION:- Board considered the matter in detail and after

deliberation it resolved that EMD amounting to Rs.5000/- deposited by Shri Krishan Kumar Kashyap be forfeited to the Board being defaulter. Board further resolved that the Ambassador Car No. UP07H 6622 and Maruti Van (Ambulance) No. UP07D 1424 were put to auction couple of times in the past but the highest bidders did not turn up to take the delivery of the Car by depositing bid amount. Therefore Board resolved that both the vehicles be auctioned immediately and Board authorises the CEO to approve the highest bidders

534-19 DECLARATION OF CONSERVANCY VEHICLE NO. UK07CA 2104 AS „BER‟

To consider the question of declaring the conservancy vehicle No. UK07 CA 2104 as BER as the same has outlived its life and lying off road. The details of the vehicle is as under-

i) Vehicle No. - UK07 CA 2104 ii) Make - Swaraj Majda Dumper Truck iii) Date of purchase - 9 Jan 2001 iv) Off Road since - Aug 2011

In this connection the vehicle in question was got checked by M/s Guna Workshop, Dehradun (Govt. authorized class „A‟ Workshop) and the said workshop has given an estimate of Rs. 4,02,380/- for its repair and change of parts, while the new vehicle is costing approx 8-10 lakhs. Hence the vehicle in question is beyond economical repairs (BER) and has also outlived its life of 10 years.

Board to consider to declare the vehicle No. UK07CA 2104 beyond economical repair (BER) and may be put up for auction in due course. In this connection the office report along with documents are placed on the table. The Board may decide.

534-19 RESOLUTION:- the matter was considered by the Board and Board observed that the vehicle in question is almost 20 years old and out of service/off road since Aug., 2011 and to declare the vehicle as beyond economical repair

(BER) the vehicle was got checked by Govt. authorize class-A workshop i.e M/s Guna Workshop, Dehradun who has given a estimates of Rs. 4,02,380/- to make it road worthy hence the huge expenditure involved is neither economical nor as per norms to keep the vehicle in service which has out lived its life. Therefore Board resolved that the vehicle be auctioned immediately and authorises the CEO to

accept the highest bid.

535-20 PAYMENT OF PROFESSIONAL FEE FOR COMPILING 2016-17 ABAS DATA

To consider the office report of the Programmer of Cantonment Board Dehradun which states that as per directions of the Govt. of India, Min of Defence to feed accounting data in ABAS (Accrual Based Accounting System) software w.e.f 2016-17.

In this regard M/s Aggarwal& Aggarwal, Chartered Accountant compiled the data for 2016-17 and undertaking convince for travelling as approved in CMC dated 26.11.2018 held at Delhi, in ABAS software in respect of Cantonment Board Dehradun in this regard the CA has submitted a bill amounting to Rs. 57,655/- on account of Professional fee and TA, DA for reimbursement.

The bill of the CA along with office report is placed on the table for the consideration of the Board.

535-20 RESOLUTION:- The matter was considered by the Board and resolved the professional fee for compiling accounting data for FY 2017

in ABAS software undertaken by M/s Aggarwal & Aggarwal, Chartered Accountant amounting to Rs. 57,655/- (Fifty Seven Thousand Six Hundred Fifty Five) be paid to the firm. Board further resolved that CEO is authorised to make payment accordingly.

536-21 PERMISSION FOR USE OF DUSHERRA GROUND IN PREMNAGAR, DEHRADUN FOR ORGANIZING “SARASWATI PUJAN”

To consider the letter No. SP/2020/02 dated 23.01.2020 from Building Dreams Foundation thereby requesting that there foundation is working for the education of children of down trodden community for last 3 years. There foundation is proposing to organize “Saraswati Pujan” on 30.01.2020 it has been requested by them to permit them to organize the function without any charge in Dusherra Ground at Premnagar Dehradun.

The letter of the Building Dreams Foundation is placed on the table for the consideration of the Board.

536-21 RESOLUTION:- The matter was considered by the Board and resolved to grant permission for use of Dushera Ground in Premnagar without any charge on 30.01.2020 subject to the condition that after the function the venue (Dushera Ground at Premnagar) be cleaned by the organizer i.e Building Dreams Foundation.CEO to issue necessary permission letter accordingly.

537-22 PURCHASE OF SUBMERSIBLE PUMPING SETS FOR THE TUBE WELLS

Reference CBR No. 281-2 dated 06.10.2018.

The Board vide CBR under reference had approved the rates of M/s Janak Engineering Company, Dehradun for the supply of Submersible Pumping Sets for Cantonment Board Tube well for a period of one 18 year. The said firm vide letter dated 20 Jan, 2020 has agreed to supply the Submersible Pumping Sets on the same rates as approved by the Board vide CBR under reference.

In this connection the letter of M/s Janak Engineering Company, Dehradun is placed on the table. The Board may decide.

537-22 RESOLUTION:- The matter was considered by the Board

and resolved that the requisite pumping sets for tube wells be

purchased from GeM. Board further authorizes the CEO to place

supply order and to make payment in due course accordingly.

538-23 FINANCE COMMITTEE MEETING-NON-COMPLIANCE BY THE MEMBERS

The meeting of the Finance Committee was convened vide letter No. I/13/Finance Committee/33 dated 14 January, 2020 scheduled to be held on 17th January, 2020 in the Office of the Cantonment Board, Dehradun. But none of the members of the Committee attended the above meeting, in which urgent matters were to be considered e.g. - Revision of certain Taxes and Charges which are the source of income from local sources for the Board. This Cantonment Board is heavily state aided for meeting the expenditures on Budget Heads of Expenditure and the higher authorities are pressing hard time and again for increasing the revenue from local sources.

In this connection the agenda of the Finance Committee is placed on the table for the consideration and decision of the Board.

538-23 RESOLUTION:- Considered by the Board and resolved to direct the members of the Finance Committee to assemble for the conduct of meeting at the earliest and proceedings of the Finance Committee be put up before the Board.

539-24 SCREENING COMMITTEE MEETING- NON-COMPLIANCE BY THE MEMBERS

On the directions of the Govt of India, Min of Defence, DG DE, Delhi Cantonment letter No. 1937/GEN/DE/19 dated 22.10.1972, a Screening Committee was constituted by the Board vide CBR No. 501-2 dated 29 Nov., 2019 to review the cases of employees who will be attaining the age of 50/55 yrs or will be completing 30 years of service qualifying for pension, as the case may be.

The first meeting of the Screening Committee was held on 31.12.2019, in which only elected members and the Office Supdt. were present in which the Committee asked for more documents and therefore next meeting was convened on 08th January, 2020 but none of the Committee turned up for the meeting. The meeting of the Committee was convened for the third time on 17 January, 2020 but again none of the members was present on the meeting.

In this regard, the Board has to submit to the Government, the report in the matter by 31st January, 2020, without fail. Hence Board is requested to consider re-constituting the Screening Committee for completion of task as directed under Govt of India, Min of Defence, DG DE, Delhi Cantonment letter referred to above within time limit, comprising the CEO and following officials: 19

539-24 RESOLUTION:- Considered by the Board and Board observed that the Board has already constituted the Screening Committee vide CBR No. 501-2 dated 29.11.2019 for compliance to Govt. of India, Min of Defence, DG DE letter mentioned on the agenda side to review the cases of employees who will be attaining the age of 50/55 years or will be completing 30 years of qualifying service for pension. Board also observed that the committee has not reviewed the cases of employees as desired till now. Board, therefore directed to Screening Committee to convene the meeting within three days for the needful Board further resolved that CEO is authorised to submit the report to Govt. /higher authorities as directed before 31st January, 2020.

540-25 RESOLUTION:- The matter of mutation of properties U/s 81 of the Cantonment Act, 2006 was considered by the Board together with legal advice of the CLA, who has cleared the mutation files as shown on the agenda side. Board resolved to approve the mutation of properties for the purpose of realizing Boards revenue (taxes & charges) only in respect of mutation applications appearing from Sl No. 1 to 66 on the agenda side. Board further resolved to authorise the CEO to issue necessary approval of the Board.

541-26 DRAFT SANCTION ORDER IN RC0072018A008 AGAINST SHRI RAEES AHMED, DRIVER AND SHRI VIJAY KUMAR, PEON, CANTONMENT BOARD DEHRADUN

To consider the letter No. 5398/ RC0072018A008 dated 30.12.2019, from CBI, SPE, Indira Nagar, Dehradun, thereby forwarding the facts of the subject case including the allegations and the result of investigation for prosecution of Shri Kamal Raj, Member of the Cantonment Board, Dehradun , Shri Raees Ahmed, Driver, Cantonment Board, Dehradun, Shri Vijay Kumar, Peon, Cantonment Board, Dehradun U/s 120-B IPC r/w Section 7(b) & 7A of the amended P.C. Act, 1988 and prosecution under substantive offences U/s 7(b), 8(1) r/w explanation of 2 & 7 of the amended P.C. Act, 1988 . It has been stated in the above letter that CBI has sought sanction for prosecution in respect of Shri Kamal Raj, Member of Cantonment Board, Dehradun, separately, from the Ministry of Defence.

The CBI has sought the permission for prosecuting Shri Raees Ahmed, Driver and Shri Vijay Kumar, Peon both employees of Cantonment Board, Dehradun vide letter No. 5398/ RC0072018A008 dated 31.12.2019.

In above context, the gist of legal opinion obtained from the CLA (Cantt Legal Advisor) is as follows:

The CBI has charged two employees of the Board namely Shri Raees Ahmed, Driver and Shri Vijay Kumar, Peon under section 7, 7 A, 8 and 12 of the Prevention of Corruption Act, 1988 and a detailed study of the charged sheet the Cantt Legal Adviser has that the aforesaid sections of the Prevention of Corruption Act, 1988 is devoid of merit and does not warrant any sanction. Finally “in absence of any evidence the case is not likely to stand in the Hon’ble Court and therefore, accord to sanction for prosecution will be detrimental to the interest of Cantt Board Dehradun. The records annexed by the CBI along with C.B.I report also does not make out the case of granting of sanction for prosecution. Therefore, I am of the view that sanction of the prosecution as demanded by the CBI cannot be provided based on material available on the record.”

In this connection RC0072018A008 along with legal opinion are placed on the table for the consideration of the Board. Board may decide.

541-26 RESOLUTION:- The matter was considered by the Board by perusing the CBI requisition of CBI, Dehradun for Draft sanction order for prosecution of Shri Rais Ahmed, Driver and Shri Vijay Kumar both employees of the Cantonment Board, Dehradun; in RC 0072018A008 and legal advice obtained from Cantt Legal Advisor (CLA) and after much deliberation the Board resolved that second Legal Advice/opinion may also be taken from some senior lawyer of local Civil Courts. Board resolved to authorise the CEO to invite expression of interest from senior and prominent lawyers of local courts to engage him/her in the panel of Cantt Legal Advisor and CEO to obtain second legal advice/opinion in the foregoing case and to put up the same before the ensuing meeting of the Board for consideration.

WITH THE PERMISSION OF THE CHAIR

The following agenda points raised by Col Virender Singh, Adm Comdt, Nominated Member of the Cantonment Board Dehradun.

1. Dog Menace in Dehradun Cantt area : - Board resolved to take steps for sterilisation of dogs through Nagar Nigam, Dehradun

2. Filling of S I vacancy under Head F(9) Military Consy:- CEO apprised the Board that since the post of SI is lying vacant for over one year, sanction of higher authorities for filling the post is mandatory. Request of this Office is pending with the higher authorities and also for amendments in educational qualifications/training at par with State Govt. Board directed to sent reminder for urgent sanction for filling the post of SI under Head F(9) in the best interest of conservancy services to the Army units and installations. As regards reservation of post of SI, as per rules and norms, for Ex-serviceman, the single cadre post is not reserved for any category, however, every one eligible candidate can apply when the post is notified and Ex- serviceman is given age relaxation up the service rendered in Army plus 3 years

3. Unauthorised activities in Baniya Bazar :- CEO apprised the Board that Cantonment Board has not granted any license or permission for unauthorised trade or profession. Apart from above activities, the DEO Meerut is competent to take action.

4. Mil Consy staff (F-9) to report for attendance to Stn HQrs, Dehradun:- CEO apprised the Board that Mil. Consy Employees under F-9 are employees of Board & their attendance for pay is to be taken by the Office of the Cantt Board, at the source, as per Service Rules and norms The employees of Mil Consy (F-9) report for duties to Stn HQr, at the central place decided by the Stn HQrs itself. Board directed that although the attendance, may be taken by the Cantt Board, Dehradun in the Office but the staff of Military Conservancy F(9) should report to Stn HQrs at usual duty time of reporting.

5. Building Plan of Smt. Sushila Devi W/o Mahender Singh, Ex-Hav, Birpur Road, Garhi Cant:-

CEO apprised the Board that the Bldg. Plan of Smt. Sushila Devi was although approved vide CBR No. 66-39(1) dated 08.06.2017 with the condition that sanction may be given by the CEO 24

after verification of land documents. On verification, the ADM(adm.), Dehradun had informed vide letter No. 295/vye.Adhi./2017 dated 11 Aug., 2017 that the name of Smt. Sushila Devi does not appear in Khasra/Khatonin of land records. The applicant was informed accordingly and her bldg. plan was returned in original as per CBR No. 154-15 dated 20.01.2018. In this connection the CLA in his legal opinion has also opined that till her name (Smt. Sushila Devi) is not mutated in Khatoni (land records), her Bldg. Plan may not be approved as per Building Bye-Laws of Cantt Board, Dehradun. Board, therefore resolve that Smt. Sushila Devi be asked to get her name mutated in land records of the State Govt. Revenue Deptt. to get her Bldg. plan sanctioned by the Cantt Board, Dehradun. It came to the knowledge of the Board that Shri Mahender Singh, husband of Smt. Sushila Devi has submitted an affidavit along with certificate of Patwari that land in question belongs to Smt. Sushila Devi. Board directed that the building plan of Smt. Sushila Devi be put up before the next Board with the report of the JE(Civil) for approval.

6. Case of Shri Gopal Singh Deori :- Shri Gopal Singh Deori, who has some land issue, was called in the meeting by the orders of the PCB in the meeting to address his grievances/complaint. He told the Board that his land is in low lying area than the other lands and houses before his plot/land and moreover, a drain has been constructed in front of his land/plot which is on higher ground, which causes water logging in his land/plot and also neither access to his land/plot from main road and provision a gate on his property is not possible. The Board after deliberation, resolved that all the material required for levelling his land/plot in line with land/houses in front of his land from approach road, will be provided by the Board and execution of work will have to be done in his look after/supervision for his satisfaction. Shri Gopal Singh Deori agreed to Board‟s orders and thanked the entire Board.
