Attached for your action is a revision to the Noise Compatibility Program (NCP) for the subject airport. On July 18,2003, the FAA approved the Record of Approval for this airport. On January 24, 2003, the FAA determined that the Noise Exposure maps for the Toledo Express Airport (TOL) were in colnpliance with the requirements of Section 103(a) Aviation Safety and Noise Abatement Act of 1979 and Title I4 Code of Federal Regulations, Part 150. The Rcvision to the NCP review began on January 14,2004. The public comment pcriod ended on March 13,2004. There were no comments received.

Consultation wilh, and participation by airport users, fedemf agencies, including the FAA, local? regionaI and state planning agencies, local interest groups and individuaIs, heIped in the development of a comprehensive program, taking into consideration all conccmed interests. Public information meetings were conducted, during the preparation of the revision to the NCP.

Sincc the approval of the Part 150, LIJ-13, Install sound insulation improvements at Swanton Township Elementary School (Page 7-31, Part 150 Study Updatc, Final October I998 and page 33, Supplemental Part 150 Study, to the final 1999 Part 150 Noise Compatibility Program, January 2003), has becn requested by the sponsor to be changed from sound insulation to acquisition. This program change request is the result of conversations betwcen the Toledo Express Airport (Sponsor) and the Swanton Township School Board in which the Swanton Township School Board requested acquisition by the sponsor instead of sound insulation. In 1997, the Program Consultant for thc Toledo-Lucas County Port Authority Residential Sound Attenuation Program completed a site inspection, which resulted in the co~npIetlonof a report titled, "Preliminary Sound Attenuation EvaIuation, Swanton Township SchooI." This rcport is an evaluation of the feasibility and probable cost of improving the noise reduction performance of'the buiIding.

The Swanton Township School Board approached the Toledo Express Airport to discuss the possibility of the school being acquired rather than sound attenuated. 'The Airport, then contacted the Federal Aviation Administration to amend measure LLI-13 in the currently appi-oved ROA. 'Thc Detroit Airports District Office advised the Airport that they must coordinate this with the school board, suppIy written documentation of this rcquest and provide for an oppoltunity for public comment. P~~bliccoordination was completed on March 18,2002. A presentation was made at the Swanton Local Board of Education meeting, by Paul Toth, Airport Director, to discuss the procedl~resfor changing the school from sound insulation to acquisition in the approved Part 150, and the timelines associated with the potential acquisition of the Swanton Township School located at 12035 Airporl Highway, Swanton Township, Lucas County, . The public was afforded ,717 opportunity to attcnd this meeting and ask questions of the airport. There were no questions at the meeting and the sponsor and school board decided to continue the process for ultimate acquisition of the school by requesting an amendment to the Record of ApprovaI.

This program change lvill not require the noise exposure maps, which were accepted on January 24,2003, to be updated. The school is currently locatcd in the 70-75 DNL. When the 1997 walk through and report of the faciIjty was completed by the program consultant, it was conci~~dedthat the primary noise paths are the single-glazed steel windows and the second floor exposure to the flight track for westerly departures. To implement sound insulation and approximate noise level reduction, it was concluded that the school would have to be brought up to current building codes before any noise level redilction improvements could be started. Acquisition of the school will remove approximately 150 students from the 70-75 DNL. The anticipated timekame is to have the project completed by the end of calendar year 2004 at a cost not to exceed $550,000.

The Noise Compatibility Program PCP) was approved on July 18, 2003 and listed LU- 13, Install sound insulation improvements at Swanton Township School. The Detroit Airports District Office concurs with the Airport's request to change I,U- 13 from "install sound insuIation improvements at Swanton Township School" to "acquire Swanton Township School."

The Great Lakes Region has reviewed and evaIuatcd the proposcd revision to the NCP and has concluded that it is consistent with the intent of tht: Act and meets the standards set forth in Flu Part 150. This coordination included the Offices of the Regional Counsel, Air Traffic, Airport PIming and Yrogamming Branch, Flight Standards, and Airways Facilities. No cottunents were received from the other lines of business.

On J11ly 15,2003, the FAA approved the Noise Compatibility Program (NCP) for the Toledo-Express Airport (TOL). The NCP included ten (1 0) measures, all of which the FAA approved. Land use measurc LU-13 is described below. After sound attenuation was approved by the FAA for Lhe Swanton Township Elementary School, the Swanton Township School Board approached the Airport and requested that the school be acquired instead of sound attenuated because of difficult technical issues associated with complying with the current building code that would significantly impact Ihc successful implementation of sound attenuation and which were not discovered during a preliminary review of the property. The revised recommendation is described beIow, and the sponsor's justification is included in the attached documentation. On March 18,2002. Paul Toth, Airport Director made a public presentation on the proposed amendment; during thc public comrnent period from January 14,2004 to March 13,2004, there wcre no public comments. The FAA evaluated the Noise Exposure Maps (NEM) that were determined in colnpliance on January 24,2003. These NEMs continuc to represent the prcsent and forecast noise envirorunent at TOL,

Descripiion: The Port Authority plans to acquire the Swanton Tow~lshipElcmentary School. This school is impacted by the 70-75 DNL contour shown on the Existing (2002) Conditions Noise Exposure hl:lap, which was accepted by FAA on January24,2003 to be in compliance with FAR Part 150. The School is located on the south side of Airport Highway, east of Wilkins Road. An inspection of the shucturc by qualified acoustical engineers determined that successful sound attenuation was possible, but couId not be attained unless a significant amount of additional work is done to bring the school building up to the current building code. This additional work would be the financial responsibility of the Swanton Township School Board. The Tolcdo-Lucas County Port Authority (the Airport Sponsor) is submitting an amendment to its Part I50 Noise Compatibility Progam Update, Final October 1998 ( I998 NCP) and Supplemental Part I50 Study to the Final 1998 Noise Compatibility Program, January 2003 (2003 Supplement to the NCP). The Federal Aviation Administration (FAA) approved these documents, submitted as one NCP, on July 18, 2003. The amendment being offered by the airport sponsor is for one measure of the Noise Compatibility Progarn, Measure LU-13, Install sound insulation improvements at Swanton Township Elementary School and is described on page 7-31 of the 1998 NCP and page 33 of the 2003 Supplcment to the NCP (see A~tuchrnentI).

One of the implementation actions included in this measure was the need for a detailed inspeclion of the structure by qualified acoustical engineers to determine current sound attenuation characteristics and the potential for successful sound insulation. The description of the measure also stated that difficult technical issues associated with conlplying with the current building code that would impact the successful inlplenlentation of sound insulation at the Swanton Township School. A detailed inspection, described below in the section entitled "ALTERNATIVES CONSlDERED / RECOMMENDED IMPLEMENTA'I'ION was undertaken. 4sa resuit of this inspection the Airport Sponsor requests this proganl measure be changed fro~nsound insulation as described above to Ihc acquisition of the Swanton Township School by the Toledo-Lucas County Port Authority. The Swanton Township School Board approached the Airport Sponsor to discuss the possibility of the school being acquired rather than sound attenuated (see Atfuc/irnenr 2). This was based in part on the findings of a detaiIed report (sec Alfac/zmenf4j, indicating technical problems associated with implementing sound attenuation in the school building. The Airport Sponsor then contacted the FAA to mend measure LU-13 in the currently :~pprovedNoise Compatibility Program. The Detroit Airports District Office ndviscd the Airport Sponsor that thcy must coordinate this with the Swnnton Tow~lship School Board, supply written doculnentation of this request, and provide an opportunity for public comment. Public coordination was completed on March 18, 2002. A rnemorandum to the community and meeting minutes of the presentation are referenced in Affucl~n?enf3. ANALYSIS OF EFFECT OF REVISION

This program change will not require the noise exposure maps (NEbi), which were accepted on January 24, 2003, to be updated. The school is currently located in the 70-75 DNL. Both the existing measure and the proposed measure would resolve the noise issue at the school property. FIowever, sound attenuation wou1d only reduce the noisc insidc the school facility. On the other hand, acquisition of' [he school by the Airport Sponsor vlould ensure that the school property would not be used for any non-compatible uses. Sound insuIating the school would cost at least 5632,500 and woi11d also require significant additional work to bring the school building up to the current building codes, which cost ~vouldbe the responsibility of the School Board. Furlher discussion of the costs of acquiring the school can be found in the ncst section.

ALTERNATIVES CONSIDERED/~IPLEIVENTATIONRECOMMENTAT[OP

The current inlplementation measure in the approved Noise Colt~patibilityProgram is to sound insulate lhc schooI. This was re assessed in 1997 (sce /Irtac:hmcnt 4, Report, Preliminary Sound Attenuation Evaluation, Swanton Township School, Airport Highway, Swanton, Ohio) during a walk through of lhe facility and an evaluation of the existing mechanical systems, building structure, and building code requirements. The report concluded that the primary noise paths are the single-gliized steel windows and the sccond floor exposure to the flight tracks for thc westerly departures. Given Ihc age and condition of the school buiIding, it was concluded that the school would have to undergo massive upgrades to be brou&t up to current building codes before any sound insulation in~provementscould be started. This included, but was not limited to, ventilation improvelnents, repairs to the exterior masonry, and steel angles at the window heads, which wouId need to be completed prior to the installation of the new window units/assemblies. The 1937 cost estimates for sound atlenuation r'mgcd between $300,000 and S500,OOO. The cost estimate was reevaluated in 2000 and again in 2003 and is currently estimated to be approximately $632,500.

Thc measure being proposed in this a~nendrnentwould be for the Tolcdo-Lucns Counly Port Authority to acquire !he school building and the associated properly from the Swanlon Township School Board. This would eliminate this school property from any non-compatible lcmri usc. The students were relocated to a newly buiIt facility. This new school is not Iocatcd in the csisting 2002 65 DNL or greater noise contours or Lhc 2007 G5 DNL or geatcr noise contours. Accluisilion costs would not exceed $5501000. Funds are available from the previous sound proofing effort and the funds need to be used by approximately June of 2004.
